Amending Resolution No. (3) of 2017

Forming the Committee for Developing

Construction Works Permit Procedures in the Emirate of Dubai[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Decree No. (28) of 2015 Concerning Governance of the Boards and Committees Affiliated to the Government of Dubai;

Resolution No. (3) of 2017 Forming the Committee for Developing  Construction Works Permit Procedures in the Emirate of Dubai (the “Original Resolution”);

The Order of 1961 Establishing the Dubai Municipality; and

Executive Council Resolution No. (32) of 2018 Approving the Organisational Structure of the Dubai Municipality,

Do hereby issue this Resolution.

Superseded Articles

Article (1)

Articles (2), (4), (8), (9) and (10) of the Original Resolution are hereby superseded by the following:

Formation of the Committee

Article (2)

a.     Pursuant to this Resolution, a temporary committee named the “Committee for Developing Construction Works Permit Procedures in the Emirate of Dubai” (the “Committee”) is formed under the chairmanship of the Assistant Director General for the Engineering and Planning Sector of the DM, and with the membership of representatives from the following entities:

1.      the Dubai Municipality;

2.     the Roads and Transport Authority;

3.     the Dubai Electricity and Water Authority;

4.     the Dubai Civil Aviation Authority;

5.     the Directorate General of Civil Defence in Dubai;

6.     the Dubai Development Authority; and

7.     the Department of Planning and Development (Trakhees).

b.     The representatives of the entities referred to in paragraph (a) of this Article will be nominated by the officials in charge of these entities. The representatives must be experienced and specialised in fields that are relevant to the work of the Committee.

Functions of the Committee

Article (4)

a.     For the purpose of achieving its objectives, the Committee will have the duties and powers to:

1.      identify and consider the systems, requirements, conditions, and procedures that are currently adopted in providing Construction Works permit services; and develop all their processes, including the application and performance processes;

2.     standardise the procedures, requirements, and conditions for providing Construction Works permit services in the Emirate; reduce the service delivery time; and expedite the relevant processes, to ensure providing quality services to customers;

3.     integrate and streamline the procedures for providing Construction Works permit services by creating a single window for all entities concerned with providing these services, automating all relevant procedures, and making these services accessible through smart applications;

4.     keep up to date on the international best practices for issuing Construction Works permits, and adopt these practices to develop and facilitate permit issuance procedures in the Emirate;

5.     contribute to supporting innovation and creativity through the development of the systems, conditions, and requirements related to construction materials;

6.     set the Committee’s action plan, develop the performance indicators and quantitative goals to be achieved; measure progress in the implementation of plans and programmes; develop improvement plans in the light of the achieved outcomes; and submit the relevant periodic reports to the Executive Council;

7.     form sub-committees and work teams to assist it in performing its duties; and determine the duties, powers, and tenures of these sub-committees and work teams;

8.     seek assistance from experts and specialists, as it deems appropriate, whether or not they are employees of the entities represented in the Committee, provided that they do not have the right to vote in its deliberations; and

9.     exercise any other duties or powers required for the achievement of the objectives of the Committee, as assigned to it by the Chairman of the Executive Council.

b.     The Committee may delegate any of the powers vested in it under paragraph (a) of this Article to any member of the Committee or of the sub-committees or work teams formed by the Committee, provided that this delegation is specific and in writing.

Submitting Final Reports

Article (8)

a.     The Committee will submit to the Executive Council, no later than the end of December 2020, a final report on the recommendations required for developing Construction Works permit procedures; the outcomes of the work and achievements of the Committee; the difficulties and obstacles that the Committee has faced in performing its duties and achieving its objectives; and the proposals it deems appropriate to address and overcome these difficulties and obstacles.

b.     The Chairman of the Executive Council may, where required, extend the deadline referred to in paragraph (a) of this Article for the period he determines.

Financial Appropriations

Article (9)

The DM must provide the financial appropriations required to enable the Committee to achieve its objectives and perform the duties assigned to it under this Resolution.

Issuing Implementing Resolutions

Article (10)

The Chairman of the Executive Council will issue the resolutions required for the implementation of the provisions of this Resolution.

Commencement and Publication

Article (2)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
