Approving the
Family Law Regulatory Procedures Manual of the Dubai Courts[1]

We, Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler of
Dubai, Chairman of the Judicial Council,
After perusal
of:
Federal Law No. (10) of 1992 Issuing the
Law of Evidence Governing Civil and Commercial Transactions and its
amendments;
Federal Law No. (11) of 1992 Issuing the
Civil Procedure Code, its Regulatory Bylaw, and their amendments;
Federal Law No. (28) of 2005 Concerning
Family Affairs and its amendments;
Law No. (9) of 2007 Establishing the
Awqaf and Minors Affairs Foundation and its amendments;
Law No. (6) of 2005 Regulating the Dubai
Courts and its amendments;
Law No. (13) of 2016 Concerning the
Judicial Authorities in the Emirate of Dubai;
Law No. (14) of 2017 Regulating
Endowments and Gifts in the Emirate of Dubai;
Ministerial Resolution No. (761) of 2016
Amending the Affidavits and Attestation Bylaw;
Ministerial Resolution No. (1150) of
2010 Concerning the Bylaw Regulating the Visitation of Children under Custody;
Ministerial Resolution No. (563) of 2013
Amending the Family Guidance Bylaw;
Ministerial Resolution No. (579) of 2017
Regulating the Administration of Estates;
Administrative Resolution No. (4) of
2008 Concerning the Terms of Reference of Family Guidance Committees at the
Dubai Courts;
Administrative Resolution No. (8) of
2008 Concerning the Bylaw of Children under Custody in the Emirate of Dubai;
Administrative Resolution No. (3) of
2010 Concerning the Affidavits and Attestation Bylaw; and
Resolution No. (33) of 2020 Concerning
Remote Litigation Procedures and Continuity of Court Services,
Do hereby issue this Resolution.
Pursuant to this Resolution, the attached
Family Law
Regulatory Procedures Manual (the "Manual"), inclusive of the rules, procedures, tables,
and forms set forth therein, is approved.
All courts and concerned organisational
units of the Dubai Courts must, each within its own jurisdiction, must
apply the
attached Manual to all open cases and uncompleted proceedings
initiated prior to the effective date of this Resolution.
a. This Resolution
supersedes the above-mentioned Administrative Resolution No. (4) of 2008,
Administrative Resolution No. (8) of 2008, and Administrative Resolution No.
(3) of 2010.
b. Any provision in
any other administrative resolution or circular will be repealed to the extent
that it contradicts the provisions of this Resolution.
This Resolution will be published in the
Official Gazette and will come into force on the day on which it is published.
