Resolution No. (1) of 2022
Delegating Certain Powers to the President of
the Dubai Courts[1]

We, Maktoum bin Mohammed bin Rashid Al Maktoum,
Deputy Ruler of Dubai, Chairman of the Judicial Council,
After perusal of:
Federal Law No. (11) of 1992 Issuing the Civil Procedure Code (the
“Law”) and its amendments;
Cabinet Resolution No. (57) of 2018 Issuing the Regulatory Bylaw of Federal Law No. (11)
of 1992 Issuing the Civil Procedure Code (the “Bylaw”) and its
amendments;
Law No. (13) of 2016 Concerning the Judicial Authorities in the
Emirate of Dubai and its amendments;
Decree No. (35) of 2021 Designating the Head of the Local Judiciary
in the Emirate of Dubai for the Purposes of Implementing Federal Legislation;
and
Resolution No. (14) of 2021 Approving the Functions of the General
Secretariat and the Secretary General of the Judicial Council of the Emirate of
Dubai,
Do hereby issue this Resolution.
For the purposes of issuing the regulatory resolutions and taking the actions and
measures stipulated in the Law and the Bylaw, the President of the Dubai Courts
is hereby delegated the following powers:
1.
issuing the rules for selecting and appointing local and international
expert witnesses to work with the divisions established within the Dubai Courts in accordance with the
provisions of Article (30)bis of the Law; and determining the method of payment of their remunerations or salaries;
2.
administering the legal oath prescribed in paragraph (2) of Article
(30)bis1 of the Law to the expert witnesses referred to in sub-paragraph (1) of this Article before
commencing their duties;
3.
approving the description of the functions of the Case Management Office and
regulating its administrative affairs;
4.
prescribing the rules and procedures for publishing judgements
issued by the Dubai Courts;
5.
determining the working hours and the administrative procedures for receiving and registering cases with the special courts;
6.
regulating the registration of execution applications and the
creation and archiving of their files; and
7.
determining the rules and procedures for outsourcing the administration of attachment procedures and the sale of attached
property, to natural
persons or to public or private legal persons; and prescribing their work processes and fees.
The General Secretariat of the Judicial Council will, on a regular
basis and in coordination with the Dubai Courts, review the powers delegated
under this Resolution and submit the findings of this review, and its
recommendations in respect of the same, to the Judicial Council.
This Resolution comes into force on the day on which it is issued,
and will be published in the Official Gazette.
