Law No. (6) of 2005

Regulating the Dubai Courts[1]

We, Maktoum bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

The Constitution of the United Arab Emirates;

Law No. (2) of 1992 Concerning Judicial Inspection and its amendments;

Law No. (6) of 1992 Establishing the Judicial Council;

Law No. (8) of 1992 Establishing the Public Prosecution and its amendments; and

Law No. (1) of 1996 Establishing the Dubai Judicial Institute and its amendments,

Do hereby issue this Law.

Article (1)

This Law will be cited as “Law No. (6) of 2005 Regulating the Dubai Courts”.

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

Ruler:

His Highness the Ruler of Dubai.

Courts:

The Dubai Courts.

President:

The president of the Courts.

Director:

The director of the Courts.

Article (3)

The Courts will have a President, Director, and deputy director.

Article (4)

The President will be appointed pursuant to a decree of the Ruler. Without prejudice to the independence of the judiciary, the President will supervise the affairs of the Courts and issue the regulations and bylaws required to regulate the work of the Courts.

Article (5)

The Director will be appointed from among judges pursuant to a decree of the Ruler. The Director will assist the President in supervising the Courts; coordinating and organising work in the various departments of the Courts; and issuing the relevant resolutions required in this respect. In the event of absence of the President or in case of any other impediment on his part, the Director will act as the President. The Director will also exercise any powers delegated to him by the President.

Article (6)

The deputy director will be appointed from among judges pursuant to a decree of the Ruler. In the event of absence of the Director or in case of any other impediment on his part, the deputy director will act as the Director. The deputy director will also exercise any powers delegated to him by the Director.

Article (7)

a.    The Courts will be comprised of the following departments:

1.    the Financial and Administrative Affairs Department;

2.    the Technical Department;

3.    the Information Technology Department;

4.    the Notary Public Department; and

5.    the Lawyers Affairs Department.

The President may, at his own discretion, establish any other departments.

b.    The departments of the Courts will report to the Director, and will perform their work under his supervision.

c.     The President will issue the regulations and bylaws determining the functions of the departments and sections of the Courts and regulating their work.

Article (8)

This Law will be published in the Official Gazette and will come into force on the day on which it is issued.
