Amending Law No. (2) of 2017

Concerning the

Mohammed bin Rashid Al Maktoum Knowledge Foundation[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (6) of 2008 Establishing the Dubai Culture and Arts Authority;

Law No. (2) of 2017 Concerning the Mohammed bin Rashid Al Maktoum Knowledge Foundation (the “Original Law”);

Decree No. (1) of 2017 Appointing the Chairman of the Mohammed bin Rashid Al Maktoum Knowledge Foundation;

Decree No. (29) of 2020 Forming the Supreme Committee for Development of the Government Sector in the Emirate of Dubai; and

The presentation of the Chairman of the Supreme Committee for Development of the Government Sector in the Emirate of Dubai,

Do hereby issue this Law.

Superseded Articles

Article (1)

Articles (2), (3), (4), (9), (12), and (15) of the Original Law are hereby superseded by the following:

Definitions

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

Ruler:

His Highness the Ruler of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

DCAA:

The Dubai Culture and Arts Authority.

MBRKF:

The Mohammed bin Rashid Al Maktoum Knowledge Foundation.

Chairman:

The chairman of the DCAA.

Director General:

The director general of the DCAA.

CEO:

The chief executive officer of the MBRKF.

Applicability of the Law to MBRKF

Article (3)

The provisions of this Law will apply to the Mohammed bin Rashid Al Maktoum Knowledge Foundation regulated pursuant to the above-mentioned Law No. (2) of 2017 as a public corporation having legal personality and the legal capacity required to undertake all acts and dispositions that ensure the achievement of its objectives. The MBRKF is hereby affiliated to the DCAA.

Head Office of the MBRKF

Article (4)

The head office of the MBRKF will be located in the Emirate.

Appointment and Functions of the CEO

Article (9)

a.    A CEO will be appointed to the MBRKF pursuant to a resolution of the Chairman of the Executive Council.

b.    The CEO will manage the MBRKF and ensure that its executive body achieves the objectives of the MBRKF. In particular, the CEO will have the duties and powers to:

1.    propose the policies, strategic plans, and work programmes of the MBRKF; submit the same to the Director General for approval, in preparation for final approval by the Executive Council; and follow up the implementation of these policies, plans, and programmes upon approval;

2.    propose the draft annual budget and financial statements of the MBRKF, and submit the same to the Director General for approval, in preparation for final approval by the competent entities in the Emirate;

3.    propose the organisational structure of MBRKF and submit the same to the Director General for approval, in preparation for final approval by the competent entities in the Emirate;

4.    represent the MBRKF before third parties and execute contracts, agreements, and memoranda of understanding, in fields that are relevant to the work of the MBRKF, with local, regional, and international entities, in accordance with the relevant table of approval powers adopted by the Chairman;

5.    draft the resolutions regulating the administrative, financial, and technical work of the MBRKF, and submit the same to the Director General for approval;

6.    supervise the work of the executive body of the MBRKF and appoint competent and specialised employees as per the approved budget;

7.    prepare periodic reports on the achievements and activities of the MBRKF, and present the same to the Director General to take the appropriate action in this regard; and

8.    exercise any other duties or powers required for the achievement of the objectives of the MBRKF, as assigned or delegated to him by the Director General.

Financial Resources of the MBRKF

Article (12)

The financial resources of the MBRKF will consist of:

1.    the financial appropriations allocated to the MBRKF in the general budget of the DCAA;

2.    the grants, gifts, and donations provided to the MBRKF and accepted by the Chairman; and

3.    any other resources approved by the Chairman.

Issuing Implementing Resolutions

Article (15)

The Chairman will issue the resolutions required for the implementation of the provisions of this Law.

Repeals

Article (2)

a.    Articles (7), (8), (10), and (11) of the Original Law are hereby repealed.

b.    The above-mentioned Decree No. (1) of 2017 is hereby repealed. Any provision in any other legislation will also be repealed to the extent that it contradicts the provisions of this Law.

Commencement and Publication

Article (3)

This Law comes into force on the day on which it is issued, and will be published in the Official Gazette.
