We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Federal Law No. (6) of 1979 Concerning Veterinary Quarantine and its amendments;

Federal Law No. (24) of 1999 Concerning the Protection and Development of the Environment, its Implementing Bylaw, and their amendments;

Federal Law No. (10) of 2002 Concerning the Practice of the Veterinary Medicine Profession and its amendments;

Federal Law No. (16) of 2007 Concerning Animal Welfare, its amendments, and its Implementing Bylaw;

Federal Law No. (15) of 2009 Concerning Combatting Tobacco, its amendments, and its Implementing Bylaw;

Federal Law No. (8) of 2013 Concerning the Prevention and Control of Contagious and Epidemic Animal Diseases, and its Implementing Bylaw;

Executive Council Resolution No. (49) of 2024 Regulating the Practice of Medical Activities and Professions in the Emirate of Dubai;

Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai and its amendments; and

The legislation establishing and regulating free zones in the Emirate of Dubai,

Do hereby issue this Law.

Chapter One

Preliminary Provisions

 

Title of the Law

Article (1)

This Law will be cited as "Law No. (5) of 2025 Concerning Public Health in the Emirate of Dubai".

Definitions

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Government:

The Government of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

DM:

The Dubai Municipality.

DHA:

The Dubai Health Authority.

DAHI:

The Dubai Academic Health Institution.

DCAS:

The Dubai Corporation for Ambulance Services.

Responsible Entity:

The Dubai Municipality or the Dubai Environment and Climate Change Authority, as the case may be, in accordance with their respective statutory functions.

Concerned Entity:

A local Government Entity legally vested with the authority to regulate any of the Public Health Domains within the Emirate, and is mandated to implement the provisions of this Law and the resolutions issued in pursuance hereof. This includes the DHA, the Responsible Entity, the DAHI, and the DCAS.

Competent Authority:

Any federal or local government entity which, under the legislation establishing it or regulating its work, has functions relating to any aspect of the Public Health Domains.

Health Service Provider:

A Government Healthcare Facility or non-government Healthcare Facility licensed by the DHA to provide Health Services in the Emirate.

Educational Institution:

This includes universities, colleges, institutes, schools, early childhood centres, and similar institutions authorised by the competent educational authority to conduct educational activities in accordance with the legislation in force.

Public Health:

Regulated measures across multidisciplinary fields aimed at providing conditions for protecting and sustaining human and community health, and Environmental Health. This is achieved through disease prevention, Healthcare provision, improvement of human and community health, oversight of the Food Chain, Consumer Products, and the Environment, and the promotion of structured and sustainable collective efforts to ensure the continuous improvement of community health and wellbeing.

Public Health Domains:

The domains specified under this Law.

Communicable Disease:

An infectious disease that results from direct or indirect transmission of a pathogenic agent, or its toxic products or secretions, to another person, causing illness.

Permit:

A document issued by the Concerned Entity authorising a Person licensed in the Emirate by the competent licensing authority to engage in any of the activities related to Public Health Domains.

Establishment:

An entity licensed under the law by the competent licensing authority to conduct economic activities in the Emirate and authorised by the Concerned Entities, each within its own jurisdiction, to conduct any of the activities related to Public Health Domains.

Placement along the Product Chain:

This includes the Primary Production, manufacture, treatment, packaging, repackaging, wrapping, processing, transportation, import, possession, storage, distribution, preparation, use, supply, display, sale, export, re-export, advertising, or promotion of Food or Consumer Products by any means, including electronic means.

Primary Production:

The stages preceding the manufacture and preparation of Food or Consumer Products.

Food:

This includes:

1.    any raw, primary, manufactured, or semi-manufactured substance, or part thereof, intended for human consumption by eating or drinking, including packaged and unpackaged drinking water and pickles;

2.    any substance used in the manufacture, preparation, or processing of Food, excluding cosmetics, Tobacco, and substances used as medications; and

3.    any other substance designated as Food by a resolution of the Director General of the Responsible Entity.

Food Additive:

Any substance not normally consumed as Food in itself and not typically used as a characteristic ingredient of Food, whether or not it has nutritive value, the intentional addition of which to Food for a technological purpose in the manufacture, processing, preparation, treatment, packaging, transport, or storage of such Food results, or may, directly or indirectly, result in the substance or its by-products becoming a component of such Food or affecting its characteristics.

Food Safety:

Measures intended to ensure that Food does not cause harm to the Consumer, upon Placement along the Product Chain or consumption in accordance with its intended use.

Healthy Food:

Food that contains the nutrients required by the human body based on the individual’s health status, physical condition, and age.

Applied Nutrition:

Methods for improving the nutritional quality of Food through primary prevention and monitoring, establishing reference values and guidelines for Healthy Food, nutrition education, and the Placement along the Product Chain of Healthy Food at the level of Establishments, individuals, and groups. These methods are based on awareness-raising, regulatory controls, and oversight interventions as determined by the Concerned Entity.

Food Chain:

All stages through which Food passes, starting from Primary Production through to final Consumer.

Product Label:

Any information, statement, mark, image, or descriptive symbol, whether written, printed, drawn, marked, decorated, stamped, embossed, or affixed to the packaging of Food or Consumer Products intended for human or Animal consumption, as well as any document or information attached to, included with, accompanying, or associated with such Food or Consumer Product, which provides information relating to its characteristics, composition, nature, method of preparation, instructions for use, storage, or associated Risks.

Food Permit:

A document issued by the Responsible Entity pursuant to this Law and the resolutions issued in pursuance hereof, authorising a Person to undertake any Food-related activity within the Emirate, including Food Safety and hygiene training or consultancy; the production of Food in domestic premises for Placement along the Product Chain; or conducting cleaning activities related to drinking water, including the cleaning of water tanks.

Food-related Establishment:

An Establishment issued with a Food Permit.

Consumer Product:

Any product intended for human use or consumption for any purpose, including, without limitation, cosmetics, personal care Products, perfumes, health supplements, cleaning Products, antimicrobials, toys, textiles, Food-contact materials, healthcare Products, air fresheners, and any other product designated by the Municipality as a Consumer Product.

Unsafe Consumer Product:

Any Consumer Product which, under normal or reasonably foreseeable conditions of use, presents a Risk, or poses the highest degree of Risk when used contrary to its intended purpose. This also includes any Consumer Product that affects human health, safety, or the Environment, as determined in accordance with the standards adopted by the DM or the legislation in force in the Emirate.

Consumer Product Safety:

Ensuring that a Consumer Product, when used as intended, does not cause harm to the Consumer upon its Placement along the Product Chain or consumption.

Consumer:

A person who obtains Food or a Consumer Product, whether with or without consideration, to meet his needs or the needs of others.

Vigilance Programmes:

Procedures for identifying adverse reactions or toxicity associated with Consumer Products intended for Placement along the Product Chain in the local Markets. This includes assessing potential Risks arising from their use, methods for identifying and tracking such Risks, monitoring the alerts and circulars issued by international authorities and organisations in respect of the same, as well as receiving and analysing related incident reports.

Withdrawal:

A measure taken by the Responsible Entity against a Food-related Establishment or Consumer Product-related Establishment to prevent the Placement along the Product Chain of any Food or Consumer Product in the Emirate that is proven to be unfit for human consumption or unsafe.

Recall:

A measure taken by the Responsible Entity, or by a Food-related Establishment, or Consumer Product-related Establishment, to retrieve any Food or Consumer Product in the Emirate after it has been supplied to the Consumer, where it is proven to be unfit for human consumption or unsafe.

Consumer Product Permit:

A document issued by the DM under this Law and the resolutions issued in pursuance hereof, authorising a Person to conduct any of the activities related to Consumer Product Placement along the Product Chain in the Emirate, which are determined by this Law and the relevant directives of the Director General of the DM; or to conduct training and consultancy activities related to Consumer Product Safety and health.

Consumer Product-related Establishment:

An Establishment issued with a Consumer Product Permit.

Animal Health:

A functional and naturally productive state of an Animal, indicating the absence of any symptoms of disease or health or nutritional disorders that may affect its typical condition, behaviour, or productive capacity characteristic of its species or breed, and which, when maintained, ensures that the Animal does not cause harm to humans upon Placement along the Product Chain, consumption, or handling.

Feed:

Any substance or product intended for oral feeding to Animals, whether raw, manufactured, or fully or partially processed. This includes feed additives and other Products used in Animal nutrition for the purpose of improving the quality of Foodstuffs of Animal origin.

Animal Disease:

Any disease, whether infectious or non-infectious, that adversely affects an Animal's health, causes its death, or renders it unfit for human consumption.

Zoonosis:

An Infectious Disease that is naturally transmissible from Animals to humans.

Veterinary Quarantine:

The process of isolating an Animal in a designated area or facility for the purpose of conducting health examinations to ascertain whether it is affected by disease, to identify the cause of illness if present, to determine appropriate treatment, and to prevent the transmission of infection.

Stray Animal:

An unowned Animal, which is found in a situation relying on itself, and not under the control or care of any Keeper.

Unrestrained Animal:

An Animal that roams around without restraint or supervision by its Keeper, even if it is able to return to the place where it is normally kept.

Keeper:

A person who owns, keeps, houses, cares for, or guards an Animal, whether permanently or temporarily.

Animal Permit:

A document issued by the Responsible Entity, under this Law and the resolutions issued in pursuance hereof, authorising a Person to conduct any of the Animal-related activities in the Emirate specified by this Law or by the resolution to be issued by the Director General of the Responsible Entity.

Animal-related Establishment:

An Establishment issued with an Animal Permit.

Export Certificate:

A document issued by the Responsible Entity to a Food-related Establishment, Consumer Product-related Establishment, or Animal-related Establishment, certifying that a Consignment of Food, Consumer Products, or Feed is fit for consumption or use according to its intended purpose, and that it meets the health and safety standards specified in the statement included in each certificate.

Owner:

A Person, or his legal representative, who owns or has actual control over the Built Environment or any part thereof.

Built Environment:

The environment constructed for all purposes, excluding industrial purposes, related to human habitation and life, whether for work, worship, healthcare, transportation, recreation, or other similar purposes. The Built Environment includes, without limitation, Buildings, Roads, bridges, tunnels, electricity and water systems (including water tanks), Waste transport and Disposal systems, sewerage networks and installations, common service facilities such as mosques, shops, markets, parks, public transport stations, and recreational places.

Built Environment Health:

Ensuring that physical, chemical, biological, or any other factors within the Built Environment do not cause any harm affecting human health.

Workers’ Accommodation:

A Building, including the service facilities annexed thereto, designated as residence for Workers.

Workers’ Accommodation Health Permit:

A document issued by the Responsible Entity, under this Law and the resolutions issued in pursuance hereof, authorising a Person to conduct any activity related to Workers’ Accommodation Health.

Environmental Health:

The relationship between the Environment, including all its natural and built elements and its physical, chemical, biological, social, and psychosocial factors, and human health. It encompasses the assessment and control of these factors with the aim of preventing disease, and creating an Environment that supports the health, safety, and well-being of the community.

Environmental Health Permit:

A document issued by the Responsible Entity, under this Law and the resolutions issued in pursuance hereof, authorising a Person to conduct any activity related to Environmental Health.

Environmental Health-related Establishment:

An Establishment issued with an Environmental Health Permit.

Public Health Pests:

Organisms that may harm humans or Animals; act as vectors, hosts, or transmitters of pathogens; or cause inconvenience to humans or damage their property.

Pesticide:

A substance or mixture of chemical, organic, or biological substances that is used to control Public Health Pests by eradicating them or reducing their activity and infestation.

Ready-to-use Pesticides:

A substance, or a mixture of substances, intended for immediate use in the control of Public Health Pests found exclusively in residential premises, and which does not require dilution or mixing by the end user.

Public Health Pest Control Permit:

A document issued by the Responsible Entity, under this Law and the resolutions issued in pursuance hereof, authorising a Person to engage in any of the Public Health Pest control activities or Placement along the Product Chain of Pesticides.

 Public Health Pest Control Establishment:

An Establishment issued with a Public Health Pest Control Permit.

Ports of Entry Health:

A Public Health Domain aimed at preventing the spread of Communicable Diseases that reach the UAE through the Emirate’s land, air, or sea Ports of Entry.

Building:

Any structure, regardless of its designated use or the activity for which it is intended, whether completed, under construction, or floating, together with any movable property designated for that structure.

Contractor:

A Person who is licensed to practise the contracting profession in accordance with the legislation in force in the Emirate.

Cemeteries:

Sites designated by the DM for the burial of deceased persons, whether Muslim or non-Muslim, in accordance with their respective religious rites.

International Health Regulations:

A set of rules and standards established by the World Health Organisation in accordance with its statutes, which are adopted by the UAE and are consistent with national legislation, for the purpose of controlling the spread of diseases, protecting against Public Health Risks, and responding to Public Health Emergencies of international concern.

Person with Disability:

A natural person suffering from a permanent or temporary physical, sensory, mental, communicative, learning, or psychological deficiency or impairment which, as a result of interaction with other physical and behavioural barriers, may hinder his full and effective participation in the society on an equal footing with others.

Worker:

A natural person authorised to work for an Establishment licensed in the UAE, under the supervision and direction of an Employer.

Risk:

An unplanned incident, activity, or change that is likely to cause injuries, illnesses, deaths, damage to property, or negatively impact any of the Public Health Domains.

Risk Assessment:

An analytical study that determines the likelihood of a Risk occurrence and the extent of its potential impact on human health and Public Health Domains, and outlines measures to address and manage that Risk.

Emergency:

A major occurrence or a series of major occurrences which causes substantial harm to individuals or property; which compromises public order, the continuity of government work, human health, the Environment, or the economy; and which requires special mobilisation and coordination among multiple entities.

Crisis:

An occurrence which is more complicated than an Emergency; which compromises the stability of a large segment of society; and which undermines the ability of the Government to perform its duties.

Disaster:

A serious disruption to the functioning of society, at any scale, resulting from Hazardous Events that interact with conditions of exposure, vulnerability, and capacity, and leading to one or more human, material, economic, or environmental losses or impacts.

Preparedness:

Taking action to prepare the resources and capabilities, and develop plans to respond to potential Risks, Emergencies, Crises, and Disasters that may occur in the future. This includes preparation, coordination, and training on, national Response plans.

Response:

All actions taken as a result of the occurrence of a Risk, Emergency, Crisis, or Disaster, with the aim of mitigating its negative impact, and ensuring that assistance and support are provided to the community.

Person:

A natural person or a public or private legal person.

Objectives of the Law

Article (3)

This Law aims to:

1.    reduce the Risks affecting human and community health in the Emirate;

2.    enhance and protect Public Health in the Emirate in accordance with precautionary principles, scientific and practical evidence, and in alignment with local and international health regulations;

3.    strengthen coordination and cooperation at all levels in the field of Preparedness and Response to health Risks and Public Health challenges in the Emirate;

4.    raise the level of public awareness, culture, and knowledge within the Emirate regarding the factors and Risks that affect human health and their causes; foster a sense of individual and collective responsibility; and promote public awareness of preventive measures;

5.    provide a healthy and sustainable Environment in the Emirate that is suitable for residence and promotes stability, rendering it appealing for investment and business activities;

6.    reinforce the responsibility of Persons in all matters related to ensuring Public Health in the Emirate; and

7.    improve the UAE’s ranking on global competitiveness indices in all Public Health Domains.

Scope of Application

Article (4)

The provisions of this Law apply in all zones across the Emirate, including in Special Development Zones and free zones, such as the Dubai International Financial Centre.

Public Health Domains

Article (5)

The Public Health Domains in the Emirate are as follows:

1.    Communicable Diseases;

2.    Non-communicable Diseases;

3.    Family Health;

4.    Individual Health;

5.    Physical Activity;

6.    Student Health;

7.    Mental Health;

8.    Ports of Entry Health;

9.    Food Safety;

10.  Consumer Product Safety;

11.  Animal Health;

12.  Built Environment Health;

13.  Environmental Health;

14.  Workers’ Accommodation Health;

15.  Tobacco Control;

16.  Public Health Pests Control;

17.  Burial of the Deceased and Supervision of Cemeteries; and

18.  any other domain as determined and regulated by a resolution of the Chairman of the Executive Council.

Chapter Two

Communicable Diseases

 

Functions of the Concerned Entities in the Domain of Communicable Diseases

Article (6)

a.    In the domain of Communicable Diseases, the DHA will have the duties and powers to:

1.    develop policies, procedures, protocols, standards, and scientific guidelines and manuals related to the management and prevention of Communicable Diseases within the Emirate, and submit the same to the Competent Authority for approval;

2.    define the roles and responsibilities of the Concerned Entities, and determine the operational procedures for the management and prevention of Communicable Diseases within the Emirate;

3.    prescribe the requirements, roles, and innovative frameworks relating to the detecting, investigating, monitoring, and prevention of Communicable Diseases, including investigation within Healthcare Establishments, laboratories, Isolation centres for infected persons or Quarantine for contacts, public transport, Educational Institutions, Workers’ Accommodation, and other population gathering places, in coordination with the Concerned Entities and the Competent Authorities;

4.    issue Permits for activities related to the prevention or treatment of Communicable Diseases;

5.    collect, analyse, and regularly update data relating to Communicable Diseases; provide epidemiological analyses; and submit the necessary recommendations thereon to the Competent Authorities in the Emirate for such directives as they deem appropriate;

6.    identify and designate priority Communicable Diseases, and develop programmes for their prevention in alignment with the orientations of the UAE and the Emirate;

7.    cooperate with local, federal, and international entities concerning standards for infection prevention; the detection and control of Communicable Diseases and emerging epidemics; the control of antibiotic-resistant bacteria; and the monitoring of developments related thereto at the local, regional, and international levels;

8.    develop the necessary immunisation programmes; supervise their implementation; evaluate their effectiveness; and ensure their coverage of the target groups, in coordination with the DAHI;

9.    develop the necessary standards to ensure the proper management and quality of vaccines, and maintain them during their transport, storage, and administration; and ensure the availability and continuity of their supply chains, in coordination with the DAHI;

10.  coordinate with the Concerned Entities to ensure Preparedness, develop plans, and enhance readiness and capacities as a proactive measure to detect the entry of Communicable Diseases through Ports of Entry, or the occurrence of an emerging disease in the Emirate, and provide channels of communication and cooperation among these entities;

11.  determine the mechanisms for communicating with the Concerned Entities and the public in cases of outbreaks of Communicable Diseases;

12.  develop plans and conduct scientific research to sustain and advance projects and programmes related to Communicable Diseases, in cooperation with Educational Institutions and research institutions;

13.  monitor the general Public Health situation in the Emirate; continuously assess health Risks; and ensure the implementation of health regulations in coordination with the Concerned Entities;

14.  develop a Risk Assessment matrix in coordination with the Concerned Entities, and adopt alert level indicators to activate the emergency plan at the level of the Emirate;

15.  recommend changes to Emergency level, alert level, or Preparedness level based on the outcomes of submitted reports and Risk Assessment indicators;

16.  collaborate with National Public Health Committees to develop and update the Risk Assessment matrix and Emergency plans activation indicators, and adopt them at the local level, in line with the Risk Assessment requirements at the UAE and Emirate levels;

17.  coordinate with the Concerned Entities to determine the process flow for joint operations related to Communicable Diseases, and to standardise the procedures followed in the Emirate;

18.  design and implement training courses and workshops on self-assessment to enhance the levels of Preparedness, implement Emergency and prevention plans, supervise the development of specialised cadres, provide health capabilities, and educate and raise awareness of the public on Communicable Diseases, in coordination with the Concerned Entities;

19.  activate the technical action plans for the prevention of Communicable Diseases, and take appropriate measures to contain their spread, including raising public awareness and engaging with the media, in coordination with the Concerned Entities;

20.  supervise health teams, monitor their performance and compliance, and submit reports on their achievements, compliance, and Preparedness to the Competent Authorities for appropriate guidance;

21.  establish and prescribe the procedures for managing Communicable Diseases; take appropriate measures to control their spread; and ensure the treatment of infected cases, in coordination with the Concerned Entities;

22.  supervise the management of the health impacts resulting from Emergencies and health Crises, and take appropriate measures to support Recovery from Communicable Diseases, in coordination with the Concerned Entities;

23.  cooperate with international, regional, federal, and local entities to provide information related to Communicable Diseases for the purposes of detection, Response, and control;

24.  impose Quarantine on areas and Persons in cases of health Emergencies or Crises, in coordination with the Concerned Entities. For this purpose, the DHA may take any of the following measures and procedures:

a.    close any Establishment, Building, or area, and temporarily suspend the use of any means of transport, as required; or

b.    issue directives that Persons infected or suspected of being infected with Communicable Diseases be isolated in designated Isolation or appropriate Quarantine facilities for the necessary period, or subject them to medical observation.

25.  establish the procedures, protocols, and standards required for Isolation and Quarantine in Healthcare Facilities and other facilities, to combat the outbreak of Communicable Diseases in the Emirate;

26.  develop the necessary health protocols to protect healthcare Workers from infection and to ensure that they are free from any Communicable Diseases;

27.  establish appropriate frameworks, in coordination with the Concerned Entities and Competent Authorities, for the inspection and Disinfection of any site or means of transport in the Emirate, and for taking all necessary measures to control the outbreak of diseases in the event that a Communicable Disease is suspected therein;

28.  establish a unified Communicable Disease notification system in the Emirate;

29.  coordinate with the Concerned Entities regarding reference laboratories for Communicable Diseases. This includes:

a.    identifying reference laboratories and determining the scope of work of each of them;

b.    establishing the policies, standards, and requirements that these laboratories must comply with;

c.     determining the requirements for capacity building, competency assessment, and ensuring the business continuity of these laboratories; and

30.  exercise any other duties or powers required for combatting Communicable Diseases as assigned to the DHA in accordance with the legislation in force in the Emirate.

b.    In the domain of Communicable Diseases, the Responsible Entity will have the duties and powers to:

1.    develop the policies and procedures to control Communicable Diseases caused by Food, Animals, the Environment, or Public Health Pests;

2.    conduct investigations into Communicable Diseases transmitted through Food, Animals, or Public Health Pests; and

3.    take the necessary measures to address the effects resulting from Communicable Diseases, in coordination with the DHA and in accordance with the relevant procedures adopted by the DM.

c.     In the domain of Communicable Diseases, the DAHI will, in addition to its obligations stipulated in Article (7) of this Law, undertake the following:

1.    participating in provision of vaccinations and immunisations to newborns and the members of the community for the prevention of Communicable Diseases; and

2.    providing consultants with expertise and specialisation in Communicable Diseases.

3.    In the domain of Communicable Diseases, the DCAS will undertake the following:

4.    developing policies and procedures for the control Communicable Diseases during patient transport operations; and

5.    following the necessary procedures during patient transport operations for the control of Communicable Diseases.

Health Service Provider Obligations

in the Domain of Communicable Diseases

Article (7)

Subject to liability, Health Service Providers and their Workers must, in accordance with the legislation in force and the protocols approved in this respect, comply with the following obligations:

1.    immediately notifying the DHA of any Communicable Diseases, for the purpose of enabling the DHA to perform its assigned functions in the domain of Communicable Diseases;

2.    managing suspected or confirmed cases of Communicable Diseases;

3.    coordinating with the Concerned Entities to ensure Response to and containment of Communicable Diseases; and the protection of individuals at risk of contracting Communicable Diseases;

4.    notifying the DHA of the results of medical tests related to Communicable Diseases, as well as of any other information required under the procedures and standards approved by the DHA in this respect;

5.    notifying the DHA of deaths resulting from Communicable Diseases, in accordance with the procedures and standards approved by the DHA in this respect;

6.    refraining from disclosing any information relating to patients infected with Communicable Diseases, except as permitted under the legislation in force in the Emirate;

7.    implementing the circulars, directives, and protocols issued by the Concerned Entities, and taking all necessary Preventive Measures to combat Communicable Diseases;

8.    applying the approved standards relating to Communicable Diseases, as well as the relevant immunisation programmes;

9.    conducting medical tests in the event of suspected or confirmed infection with a Communicable Disease;

10.  collecting laboratory specimens from suspected cases of Communicable Diseases, and transporting them to approved reference laboratories whether operated by Health Service Providers or by third parties. These laboratories must not dispose of or otherwise process such specimens until a definitive diagnosis has been established;

11.  taking all approved measures in the event that any of their Workers is infected with a Communicable Disease; and

12.  complying with any other obligations prescribed by the DHA in the domain of Communicable Diseases, pursuant to the policies, circulars, and protocols approved by the DHA in this respect.

Obligations of Persons Infected or Suspected of

Being Infected with Communicable Diseases

Article (8)

Subject to liability, a Person who is infected, or suspected of being infected, with any Communicable Disease, must:

1.    not come into contact with members of the community in any manner that may result in the spread of the Communicable Disease;

2.    not travel or move from one place to another, except to a hospital or Healthcare Facility, without the approval of the DHA;

3.    not conceal that he is infected with a Communicable Disease from close contacts or Healthcare Facilities;

4.    not cause the transmission of infection to others in any manner whatsoever, whether intentionally or unintentionally;

5.    implement any measure required of him to prevent the outbreak of the Communicable Disease;

6.    implement the preventive and therapeutic measures issued by the Concerned Entities and Health Service Providers; and

7.    comply with any other obligations as determined by the DHA in the domain of Communicable Diseases, pursuant to the DHA policies, circulars, and protocols approved in this regard.

Chapter Three

Non-communicable Diseases

 

Functions of Concerned Entities in the Domain of Non-communicable Diseases

Article (9)

a.    In the domain of Non-communicable Diseases, the DHA will, in coordination with the Concerned Entities, have the duties and powers to:

1.    collect and analyse data related to Non-communicable Diseases to assess their spread, trends, and associated Risk factors, and submit the necessary reports to the Competent Authority;

2.    develop the policies and procedures required for preventing and limiting the spread of Non-communicable Diseases;

3.    determine priorities for addressing Non-communicable Diseases, based on national programmes, as well as local, regional, and international statistics and data; monitor developments; and allocate financial and human resources to control their spread;

4.    develop a plan for the prevention of Non-communicable Diseases at the level of the Emirate, specifying the responsibilities of Concerned Entities, Health Service Providers, and Health Insurance Companies in this domain;

5.    develop the policies, standards, requirements, and programmes for the early detection and management of Non-communicable Diseases, in accordance with established priorities and subject to the relevant approved health protocols;

6.    develop the policies, standards, requirements, and programmes for reducing Risk factors associated with Non-communicable Diseases;

7.    develop the policies for providing rehabilitation and long-term care services to Persons with Non-communicable Diseases, and establish the necessary protocols in this regard;

8.    regulate and supervise Health Services related to Non-communicable Diseases provided by the public and private sectors;

9.    contribute to the development of national plans to combat Non-communicable Diseases;

10.  contribute to the review, approval, and implementation of requirements for local, regional, and international initiatives and research related to combatting Non-communicable Diseases;

11.  promote and reinforce the principle of shared responsibility among all segments of society to combat Non-communicable Diseases, and activate partnerships in this domain with Educational Institutions and research institutions;

12.  develop and implement programmes to raise community awareness of approved preventive screenings, the importance of timely testing, and adherence to prescribed treatments, instructions, and procedures to reduce the risk of disease progression and to control symptoms;

13.  collect and analyse information for the early detection, control, and management of Non-communicable Diseases, and enable patients to access Health Service Providers;

14.  support research efforts to better understand, prevent, and manage Non-communicable Diseases, and use the results of such research to inform evidence-based policies and strategies;

15.  monitor the effectiveness of programmes for the prevention and control of Non-communicable Diseases, evaluate their impact, and make the necessary adjustments and improvements;

16.  support efforts to prevent and control Non-communicable Diseases at all local, regional, and international levels, and participate in local and international health initiatives; and

17.  exercise any other duties or powers as required for combatting Non-communicable Diseases, or as may be assigned under the legislation in force in the Emirate.

b.    The DCAS will, in the domain of Non-communicable Diseases and within its legally vested functions, have the duties and powers to:

1.    collaborate with the DHA in developing the policies, procedures, and mechanisms for the prevention and control of Non-communicable Diseases;

2.    collaborate with the DHA in preparing the policies, standards, and requirements for the early detection and management of Non-communicable Diseases, in accordance with established priorities and approved ambulance health protocols;

3.    regulate and supervise the provision of ambulance Healthcare Services related to Non-communicable Diseases in the public and private sectors;

4.    collaborate with the DHA in reviewing, approving, and implementing the requirements of local, regional, and international initiatives and research related to Ambulance Services for combatting Non-communicable Diseases;

5.    collaborate with the DHA to promote and reinforce the principle of shared responsibility among all segments of society for combatting Non-communicable Diseases from an ambulance perspective; and activate partnerships with Educational Institutions and research institutions in this domain; and

6.    collaborate with the DHA in developing programmes to raise community awareness about approved ambulance screenings, the importance of timely testing, and adherence to prescribed treatments, instructions, and procedures to reduce the risk of progression and to control the symptoms of Non-communicable Diseases.

c.     In addition to its obligations under Article (10) of this Law, the DAHI will, in the domain of Non-communicable Diseases, have the duties and powers to:

1.    collaborate with the DHA in developing the policies, procedures, and mechanisms for the prevention and control of Non-communicable Diseases;

2.    collaborate with the DHA in preparing the policies, standards, and requirements for the early detection and management of Non-communicable Diseases, in accordance with established priorities and subject to health protocols; and

3.    provide necessary consultations to the Concerned Entities.

Obligations of Health Service Providers in the Domain of Non-communicable Diseases

Article (10)

Subject to liability, Health Service Providers and their Workers must, in accordance with the legislation in force and the approved protocols in this respect, comply with the following obligations:

1.    conducting preventive screenings for the early detection of Non-communicable Diseases for all segments of the community, across all age groups;

2.    contributing to the implementation of preventive programmes, in line with the relevant approved standards;

3.    submitting regular reports on the detected Non-communicable Diseases, including all relevant information to the DHA, in accordance with the approved mechanisms and procedures;

4.    providing individuals seeking periodic screenings with appropriate advice and information regarding the necessary tests, assessment, and care; ensuring their informed consent is obtained and documented; notifying them of the results of tests and assessments; and following up on their conditions, in line with the relevant approved standards and procedures;

5.    promoting health awareness among patients to support them in making positive, healthy lifestyle changes;

6.    providing appropriate support to Persons with Disabilities to enable them to understand all requirements, processes, and outcomes of preventive screenings, in cooperation and coordination with the Concerned Entities;

7.    providing the DHA, the DCAS, and the Concerned Entities with the required data and information on Non-communicable Diseases whenever requested; and

8.    complying with any other obligations that are prescribed by the Concerned Entities in the domain of Non-communicable Diseases.

Chapter Four

Family Health

 

Functions of the Concerned Entities in the Domain of Family Health

Article (11)

a.    In the domain of Family Health, the DHA will, in coordination with the Competent Authorities, have the duties and powers to:

1.    develop programmes and plans that support maternal health during pregnancy, childbirth, and the postpartum period;

2.    develop family planning programmes to educate mothers about optimal intervals between pregnancies; provide them with health education and the means to ensure optimal spacing between births; and raise awareness on how to plan pregnancies safely;

3.    supervise child immunisation programmes to protect children from preventable Diseases, including the provision of vaccines, scheduling vaccination campaigns, and monitoring vaccine coverage rates;

4.    develop and implement health and nutrition awareness programmes for families;

5.    promote preventive health practices within the family, including encouraging regular medical check-ups, screenings, and immunisations for all family members;

6.    develop programmes for pre-marital screening to prevent genetic diseases, and provide programmes for psychological and social support to families, especially during pregnancy, childbirth, and child-rearing;

7.    collect data on Family Health indicators; conduct the necessary research and studies on these indicators; and propose measures to enhance Family Health;

8.    develop plans to sustain and develop health services and programmes for the protection of Family Health, and coordinate in this regard with the Concerned Entities;

9.    promote awareness among families and community members about the importance of regular preventive screenings for the early detection of Non-communicable Diseases, in line with international best practices in Public Health. These include periodic screenings for newborns, early childhood screenings, school health checks, screenings during pregnancy, childbirth, and the postnatal period, and periodic preventive screenings for adults; and

10.  exercise any other duties or powers as required for the protection of Family Health, or as assigned to it in accordance with the legislation in force in the Emirate.

b.    In the domain of Family Health, the DAHI will have the duties and powers to:

1.    conduct premarital medical screenings;

2.    provide reproductive and sexual health services, including men’s health, and maternal care during pregnancy, childbirth, and the post-partum period;

3.    provide the necessary services to care for children and ensure their protection through medical, social, and other appropriate means;

4.    conduct periodic medical examinations for children to monitor their growth and health, and advise mothers on balanced Healthy Food throughout their children’s development;

5.    encourage Educational Institutions to prioritise Student Health by providing appropriate immunisations for each age group;

6.    conduct periodic medical examinations for families in accordance with the approved health programmes; and

7.    exercise any other duties or powers as required for the protection of Family Health, or as assigned to the DAHI in the legislation in force and in accordance with the relevant protocols adopted by the DAHI.

c.     Provision by the DAHI of the Healthcare Services set out in sub-paragraphs (b)(2), (b)(3), (b)(4), (b)(5), and (b)(6) of this Article does not preclude Health Service Providers from providing those services.

Obligations Related to Family Health

Article (12)

Entities mandated to facilitate Family Health programmes and services must:

1.    promote, and encourage target groups to adopt, Healthy Lifestyles; and deliver Family Health programmes and services;

2.    ensure the competence of their Workers in delivering Family Health programmes and services;

3.    provide a supportive environment and comprehensive care services for mothers and children;

4.    raise awareness about the objectives, requirements, importance, and necessity of delivering Family Health programmes and services;

5.    conduct preventive screenings for the early detection of Non-communicable Diseases and periodic visits in accordance with the approved protocols in this regard;

6.    provide the DHA with periodic data and reports on the delivery of Family Health programmes and services;

7.    comply with the applicable Public Health regulations, policies, and standards relating to Family Health; and

8.    comply with any other obligations as prescribed by the DHA as necessary to protect Family Health, in accordance with the relevant policies, circulars, and protocols approved by the DHA.

Chapter Five

Individual Health

 

Functions of the Concerned Entities in the Domain of Individual Health

Article (13)

a.    In the domain of Individual Health, the DHA will, in coordination with the Competent Authorities and Concerned Entities, have the duties and powers to:

1.    develop policies, standards, and requirements; and define roles and responsibilities to promote Healthy Lifestyles, immunisation, medical screenings, and health awareness for members of the community;

2.    establish controls, standards, and procedures for conducting medical examinations for individuals; and supervise and regulate such examinations, including pre-employment and residency visa medical fitness tests, driving licence medical tests, professional driver permit medical assessments, the issuance of occupational health cards, and any other purposes as determined by the DHA in accordance with the legislation in force in the Emirate;

3.    establish controls for promoting and protecting the physical and mental health of Young Adults and adults, and for combatting negative behaviours that pose significant health risks;

4.    establish controls for promoting and protecting the health of older people and ensuring the provision of integrated healthcare for them;

5.    establish controls for promoting and protecting the health of Persons with Disabilities and ensure they have access to appropriate healthcare;

6.    support and encourage physical activity, sport, and the adoption of Healthy Lifestyles;

7.    support awareness campaigns on the dangers of psychoactive substances, including narcotic drugs, alcohol, and Tobacco or Tobacco Products;

8.    provide health education to individuals regarding health Risks, healthy behaviours, disease prevention, and the importance of undergoing regular medical screenings;

9.    develop and update controls and standards as required to ensure the provision of healthcare for individuals;

10.  support and encourage medical research and studies aimed at enhancing understanding of health issues affecting members of the community;

11.  establish frameworks for the protection of patient rights, the safeguarding of privacy, and the resolution of issues related to medical malpractice;

12.  promote health and wellbeing through organising initiatives that encourage individuals to adopt healthier lifestyles and make informed decisions regarding their health;

13.  provide support and services to Persons with Disabilities to ensure their healthcare needs are met; and

14.  exercise any other duties or powers required for the protection of Individual Health, as may be determined by a resolution of the Director General of the DHA, or as may be vested in the DHA under the legislation in force in the Emirate.

b.    In the domain of Individual Health, the DAHI will, in addition to its obligations under Article 14 of this Law, undertake the following:

1.    participating in the provision and administration of vaccinations;

2.    participating in conducting medical examinations for individuals;

3.    conducting pre-employment and residency visa medical fitness tests, issue occupational health cards, and perform any other medical screenings required under the legislation in force in the Emirate; and

4.    exercising any other duties or powers required for the protection of Individual Health, that are vested in the DAHI under the applicable legislation and the relevant protocols adopted by the DAHI.

Obligations of Health Service Providers in the Domain of Individual Health

Article (14)

In the domain of Individual Health, Health Service Providers must, in accordance with the applicable legislation and approved protocols, comply with the following obligations, subject to liability:

1.    providing Health Services to individuals, including vaccinations;

2.    supporting and implementing programmes aimed at promoting a culture of healthy behaviours and lifestyles among individuals, in accordance with the applicable policies, regulations, and guidelines;

3.    submitting periodic reports to the DHA regarding performance indicators and outcomes related to Individual Health, in accordance with the prevailing policies, regulations, and guidelines; and

4.    complying with any other obligations prescribed by the DHA in the domain of Individual Health under the policies, circulars, and protocols approved by the DHA in this respect.

Chapter Six

Physical Activity

 

DHA Functions in the Domain of Physical Activity

Article (15)

In the domain of Physical Activity, the DHA will, in coordination with the Competent Authorities, have the duties and powers to:

1.    develop and disseminate evidence-based Physical Activity guidelines for different age groups;

2.    organise awareness campaigns on the importance of regular Physical Activity;

3.    support and develop initiatives and programmes that encourage Physical Activity, particularly in Educational Institutions and workplaces;

4.    integrate Physical Activity into Health Services and Healthcare Facilities as part of treatment plans;

5.    collect data on Physical Activity levels and related health outcomes to inform and support decision-making and therapeutic interventions;

6.    evaluate the impact and effectiveness of Physical Activity promotion programmes and policies, as needed, to achieve better health outcomes; and

7.    exercise any other duties or powers relating to Physical Activity, as assigned to it in accordance with the legislation in force in the Emirate.

Chapter Seven

Student Health

 

Functions of the Concerned Entities in the Domain of Student Health

Article (16)

a.    In the domain of Student Health, the Responsible Entity will, in coordination with the Competent Authority in the field of education, have the duties and powers to:

1.    establish standards, conditions, and controls for Placement along the Product Chain of Food or Consumer Products within Educational Institutions;

2.    establish the nutritional conditions and requirements applicable to the Food served in Educational Institutions;

3.    establish the standards required for the establishment of canteens within Educational Institutions;

4.    establish the requirements applicable to Food Suppliers to Educational Institutions, in a manner that ensures that the Food provided is compliant with Food Safety requirements and standards, and is appropriate to the students’ age groups;

5.    establish the controls, standards, designs, and fittings that must be provided for Placement along the Product Chain of Food in areas within Educational Institutions for the purpose of selling or serving Food to students;

6.    raise awareness about Applied Nutrition for students among Educational Institution administration staff, students, and parents, with the aim of improving Student Health and nutritional status, in accordance with the applicable international best practices;

7.    audit and inspect Educational Institutions to verify their compliance with the standards, conditions, and requirements prescribed by this Law, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate; and

8.    exercise any other duties or powers within the mandate of the Responsible Entity, that are intended to safeguard Student Health or that are vested in it under the legislation in force in the Emirate.

b.    In the domain of Student Health, the DHA will, in coordination with the Competent Authority in the field of education, have the duties and powers to:

1.    develop Student Health policies, standards, and guidelines; and define roles, for promoting and protecting Student Health within Educational Institutions;

2.    oversee the scheduling and conduct of periodic medical examinations for students, as required for each educational stage;

3.    launch and support health promotion campaigns within Educational Institutions to raise awareness on Healthy Lifestyles, disease prevention, and mental health, and to support the early detection of developmental delays and other health conditions;

4.    coordinate immunisation programmes within Educational Institutions to ensure that students receive the required vaccinations;

5.    support medical examinations conducted within Educational Institutions to detect health problems and to enable early access to appropriate healthcare, including examinations related to vision and hearing problems;

6.    develop and implement health education programmes to promote Student Health, including promoting physical activity, Healthy Food, personal hygiene, and raising awareness about the Risks of Smoking, alcohol consumption, and psychoactive substances;

7.    collect and analyse data related to health issues within Educational Institutions, conduct the necessary research and studies in this regard, and take appropriate actions and measures based on their results;

8.    oversee the establishment of proper clinics within Educational Institutions;

9.    adopt activities and programmes that contribute to promoting mental health within Educational Institutions;

10.  develop plans for training and qualifying healthcare and educational staff in the domain of Student Health;

11.  raise awareness among faculty, healthcare staff, and parents in Educational Institutions of the importance of Public Health and the requirements and means of preventing diseases that may affect students;

12.  develop sustainable development plans for healthcare programmes and projects in cooperation with the Concerned Entities and other stakeholders;

13.  supervise the provision of necessary medical care to students in Educational Institutions, and provide a mechanism for the referral of cases requiring follow-up to Health Service Providers;

14.  detect cases of infection in Educational Institutions; implement measures for infection control and for limiting the spread of Communicable Diseases; and organise procedures and mechanisms for reporting them;

15.  establish safety and psychological and health support standards for students of Educational Institutions who are Persons with Disabilities or from other special groups, in coordination with the Competent Authority; and follow up on their medical and psychological reports; and

16.  exercise any other duties or powers required for protecting Student Health, as may be assigned to it under the legislation in force in the Emirate and the relevant policies adopted by it.

c.     The DAHI will, in coordination with the Competent Authority in the field of education, undertake the provision of Healthcare Services and therapeutic services to students. This does not preclude Healthcare Service Providers from providing these services.

d.    In the domain of Student Health, the DCAS will, in coordination with the Competent Authority in the field of education, be responsible for supervising the establishment of First Aid rooms within Educational Institutions, determining the devices, equipment, and first aid supplies that must be provided therein, and determining the procedures for training Workers in Educational Institutions to undertake Response to Emergencies.

Obligations of Educational Institutions in the Domain of Student Health

Article (17)

In the domain of Student Health, Educational Institutions must, subject to liability and in accordance with the legislation in force in the Emirate and the relevant approved protocols:

1.    comply with the policies and procedures required for ensuring compliance with the requirements, standards, and programmes developed by the DHA and the Responsible Entity for the protection of Student Health in coordination with the Competent Authority in the field of education;

2.    provide Healthcare Services to students while they are present in the Educational Institution or participating in activities organised by it outside its premises, and establish the appropriate procedures to ensure the referral of cases requiring follow-up and medical intervention to Health Service Providers;

3.    take the necessary measures to provide students with Healthy Food options;

4.    monitor health phenomena among students and notify their parents, the DHA, and the Competent Authority in the field of education thereof;

5.    raise awareness of the dangers of unacceptable behavioural practices in Educational Institutions;

6.    contribute to raising awareness about the Risks of Smoking, alcohol consumption, psychoactive substances, and addiction;

7.    ensure the implementation of vaccination campaigns for students of Educational Institutions in accordance with the directives of the National Immunisation Programme;

8.    provide a safe educational environment free from health Risks, accidents, and injuries of all kinds;

9.    conduct periodic surveys to assess Student Health;

10.  maintain students’ health records;

11.  provide the DHA or the Responsible Entity with any statistics it requests relating to staff and students enrolled in different educational stages;

12.  provide the DHA with any information and data it requests in accordance with the applicable policies, systems, and guidelines, including information on medical tests conducted, their results, and information on referral and medical intervention procedures taken as appropriate for each student’s case;

13.  support the implementation of the periodic school examinations required by the DHA, and support National Public Health Committees and the implementation of statistics in accordance with the requirements of national, regional, and international programmes;

14.  provide the required periodic examinations and notify the DHA of their results, in accordance with the approved procedures in this regard;

15.  implement Preventive Measures for infection control and containment, in accordance with the relevant procedures adopted by the DHA;

16.  notify the DHA and Competent Authorities of suspected or confirmed cases of Communicable Diseases, according to the severity of the disease, the approved list of Communicable Diseases, and the procedures and standards established for this purpose;

17.  refrain from disclosing any information relating to Communicable Diseases or Non-communicable Diseases to any entity, except in accordance with the relevant procedures and controls prescribed by the DHA; and

18.  comply with any other obligations determined by the Concerned Entities pursuant to the policies, circulars, and protocols approved by them in this regard.

Chapter Eight

Mental Health

 

Functions of the Concerned Entities in the Domain of Mental Health

Article (18)

a.    In the domain of Mental Health, the DHA will, in coordination with the Concerned Entities, have the duties and powers to:

1.    formulate and update policies and strategies relating to Mental Health, in coordination with the Concerned Entities;

2.    raise awareness of Mental Health issues through Mental Health awareness campaigns;

3.    establish the necessary protocols for addressing psychological issues resulting from Emergencies and Crises;

4.    develop prevention programmes aimed at promoting Mental Health and reducing the incidence of Mental Disorders;

5.    encourage research in the domain of Mental Health, and evaluate the effectiveness of the related programmes and services provided to individuals;

6.    encourage the establishment of specialised centres and clinics for Mental Disorders in the Emirate;

7.    train health professionals in the Emirate to enhance their ability to provide care for patients with Mental Disorders and to improve their skills in managing such cases;

8.    monitor and evaluate programmes and policies relating to Mental Health to ensure their effectiveness and continuous improvement;

9.    develop, enhance, and expand comprehensive and integrated Mental Health services to meet the needs of all segments and age groups of the community;

10.  cooperate with various sectors in the Emirate to implement the approved strategies for promoting Mental Health in the Emirate;

11.  enhance and improve Mental Health information and data systems for the purpose of developing Mental Health services; and

12.  exercise any other duties or powers relating to Mental Health as vested in the DHA under the legislation in force in the Emirate, and in accordance with the relevant protocols adopted by the DHA.

b.    The DAHI will provide Healthcare Services and treatment services for patients suffering from Mental Disorders, in addition to any other duties or powers relating to Mental Health that are vested in the DAHI under the legislation in force and in accordance with the relevant protocols adopted by the DAHI. The performance of these functions by the DAHI does not preclude Healthcare Service Providers from providing those services.

Chapter Nine

Ports of Entry Health

 

Powers and Functions of the Concerned Entities

in the Domain of Ports of Entry Health

Article (19)

a.    In the domain of Ports of Entry Health, the DHA will have the duties and powers to:

1.    monitor diseases that may enter or spread through the borders into the Emirate by tracking Communicable Diseases and global health threats, and coordinate with international health organisations to implement the necessary measures to prevent the entry of such diseases into the Emirate;

2.    establish Quarantine protocols, develop inspection procedures, and enforce Quarantine measures at the Emirate’s Ports of Entry;

3.    ensure that border Healthcare Facilities are adequately equipped to deal with health Emergencies;

4.    address cross-border health challenges through developing plans for Emergency Response and international cooperation with global health organisations;

5.    coordinate with Concerned Entities, Competent Authorities, and providers of land, air, and sea transport services to adopt and implement standard procedures and necessary measures at the Emirate’s Ports of Entry to prevent, manage, and control diseases that may enter through these Ports of Entry, including Zoonoses and diseases transmitted through Food, water, or any other vectors that may pose a Risk to Public Health;

6.    implement and follow up on the implementation of the procedures required under the International Health Regulations, including strengthening the necessary core capacities in this regard; and

7.    exercise any other duties or powers related to the domain of Ports of Entry Health that are vested in the DHA under the legislation in force in the Emirate and in accordance with the relevant protocols adopted by it in this regard.

b.    In the domain of Ports of Entry Health, the DAHI will have the duties and powers to:

1.    provide Healthcare Services to travellers at Ports of Entry;

2.    provide medical care to travellers who are subject to Quarantine, Isolation, medical examination, or any other procedures for Public Health purposes;

3.    provide immunisation; implement the appropriate preventive measures based on the type of disease; and issue the traveller who receives the vaccination or undergoes other preventive measures with an official certificate from the medical authority, in accordance with internationally approved forms.

c.     The provision of Healthcare Services and treatments by the DAHI under paragraph (b) of this Article does not preclude Healthcare Service Providers from providing such services.

d.    In the domain of Ports of Entry Health, the Responsible Entity will have the duties and powers to:

1.    monitor imported Consumer Products to ensure that they meet safety requirements and conform with the approved specifications, including the monitoring of their places of storage and transportation;

2.    monitor imported and re-exported Foods, as well as Foods exported with export certificates to ensure that they meet Food Safety requirements;

3.    inspect maritime transport vessels, in coordination with the Competent Authorities, to ensure that they are free from Public Health Pests; and issue health certificates in accordance with the requirements of the World Health Organisation;

4.    exercise health control over imported Animals; and

5.    implement Quarantine procedures for imported Food, Animals, and Feed, where required.

Travellers’ Obligations

Article (20)

A traveller passing through the Emirate’s Ports of Entry must, in accordance with the legislation in force in the Emirate and the relevant approved protocols:

1.    comply with the policies, circulars, and protocols issued by the Concerned Entities in this regard;

2.    provide the Concerned Entities, medical teams, and Health Service teams at the Emirate’s Ports of Entry with the information and data they require;

3.    notify the DHA and the Competent Authorities at the Emirate’s Ports of Entry in the event of contracting or having suspicions of contracting any Communicable Disease;

4.    comply with personal hygiene and preventive measures, such as wearing masks and maintaining physical distancing, in accordance with the approved protocols;

5.    disclose to the Competent Authorities or Concerned Entities if bringing in any type of Animal, raw Animal Products, or by-products; and

6.    fulfil any other obligations related to Ports of Entry Health as prescribed by the Concerned Entities or the Competent Authorities, including obligations concerning non-commercial Food Consignments carried by travellers.

Chapter Ten

Food Safety

 

Conducting Food-related Activities

Article (21)

a.    No Person may conduct any activity related to the Placement along the Product Chain of Food in the Emirate, including the establishment of Food factories, or the establishment of facilities for the desalination, purification, or packaging of water for drinking purposes, except after obtaining the requisite Food Permit.

b.    No Person may engage in training activities or provide consultancy services in the field of Food, without first obtaining the requisite Food Permit.

c.     No Food-related Establishment may conduct any activity related to the Placement along the Product Chain of Food outside the premises specified in its Food Permit, without first obtaining the prior approval of the Responsible Entity.

d.    No Food-related Establishment may destroy Food without first obtaining the approval of the Responsible Entity nor without the supervision of the Responsible Entity.

e.    No Food-related Establishment may display or sell Healthy Food or any Food bearing health or nutritional claims without first obtaining the approval of the Responsible Entity.

f.     No Food-related Establishment may place non-halal Food along the Product Chain without first obtaining the approval of the Responsible Entity.

Functions of the Concerned Entities in the Domain of Food Safety

Article (22)

a.    In the domain of Food Safety, the Responsible Entity will have the duties and powers to:

I.   In Respect of the Premises of the Food-related Establishments and their Facilities:

1.    establish the controls, standards, and requirements for the construction and fit-outs of the premises of the Food-related Establishment, its surrounding environment, and its various facilities, including temporary Buildings, kiosks, and mobile Food vehicles;

2.    establish the requirements for the maintenance and operation of the premises of the Food-related Establishment and its various facilities, including temporary Buildings, kiosks, and mobile Food vehicles;

3.    establish the requirements for the equipment and tools used in the Placement along the Product Chain of Food in the Food-related Establishment;

4.    establish the requirements for the maintenance and operation of the premises of the Food-related Establishment and its various facilities, including temporary Buildings, kiosks, and mobile Food vehicles; and

5.    exercise any other relevant duties or powers as determined by the Responsible Entity or that are vested in it under the legislation in force in the Emirate.

II. In Respect of the Requirements for the Control of Food-Related Risks

1.    establish the conditions, controls, and guidelines for the Placement along the Product Chain of Food in the Emirate, in order to ensure Food Safety, in accordance with the Food Permit issued for each food-related activity;

2.    develop an integrated system for overseeing the implementation of Applied Nutrition programmes at Food-related Establishments and Educational Institutions, in order to enhance proactive prevention and protect the community from Food-borne diseases. In particular, the Responsible Entity will have the duties and powers to:

a.    exercise oversight of health and nutritional claims on packaged and non-packaged Food Placed along the Product Chain in the Emirate;

b.    approve Healthy Foods and Foods bearing nutrition claims, whether pre-packaged or not, that are subject to Placement along the Product Chain in the Emirate;

c.     take the necessary measures to improve the nutritional value of Foods provided in Food-related Establishments and Educational Institutions; and

d.    raise awareness among members of the community regarding the principles of Applied Nutrition and Food Safety, with the aim of improving health and nutritional status.

3.    establish the standards, conditions, and controls for the Placement along the Product Chain of Healthy Food and Foods bearing health or nutrition claims in the Emirate;

4.    establish the standards, conditions, and controls for the Placement along the Product Chain of Food in Educational Institutions;

5.    establish the conditions and requirements for the Placement along the Product Chain of non-halal Food;

6.    establish, in coordination with the Concerned Entities, the conditions and requirements for the protection of Food from fraud and adulteration;

7.    prescribe the health and technical requirements for the safety and efficiency of drinking water systems in Food-related Establishments;

8.    prescribe the controls and requirements for novel Foods and Food Additives;

9.    develop the procedures for assessing the Risks of Food contaminants and the requirements for their control;

10.  establish the requirements applicable to Workers in Food-related Establishments, and the requirements for their training and qualification;

11.  establish the requirements for the hygiene of the premises of Food-related Establishments and their various facilities, including temporary Buildings, kiosks, and mobile Food vehicles;

12.  monitor Risks related to Food, and investigate and assess Food-borne diseases, in coordination with the Concerned Entities, committees, and task forces formed at the level of the Emirate and the UAE, to ensure Food Safety;

13.  develop the procedures for the Traceability, Withdrawal, and Recall of Food, including prescribing the technical rules for Food Traceability systems;

14.  determine the records related to the Placement along the Product Chain and Food Safety, and prescribe procedures for their management, and the period for which they must be retained;

15.  collaborate with the Concerned Entities in implementing Food Security strategies in the UAE; and

16.  exercise any other relevant duties or powers determined by the Responsible Entity or that are vested in it under the legislation in force in the Emirate.

III.            In Respect of Oversight and Inspection of Food-related Establishments

1.    audit and inspect Food-related Establishments and their Workers, including Establishments authorised to provide Food-related training and consultancy, to ensure their compliance with the requirements stipulated in their Food Permit;

2.    conduct control and inspection relating to the Placement along the Product Chain of Food in the Emirate, including the means of its transport and preservation, the places of its storage, preparation, and display; and verify that appropriate temperatures are maintained in these places during its Placement along the Product Chain;

3.    verify compliance by Food-related Establishments with the legislation in force in the Emirate and the approved requirements and specifications related to Food Safety and the health of Workers in those Establishments;

4.    conduct ongoing assessment of the health status of Food-related Establishments, in accordance with the controls and standards determined pursuant to a resolution issued by the Director General of the Responsible Entity in this regard;

5.    audit the Food Safety systems implemented by Food-related Establishments, and verify their proper and accurate application;

6.    control and supervise Food-related Advertisements;

7.    leverage and utilise the latest technological, innovative tools, programmes, and systems to ensure the continuous monitoring of Food-related Establishments;

8.    receive and investigate reports and complaints related to Food, and take the necessary actions and measures against persons who commit acts that constitute a violation of this Law, the resolutions issued in pursuance hereof, or other legislation in force in the Emirate;

9.    take the necessary actions and measures to prevent the Placement along the Product Chain of Food, including its seizure, Withdrawal, Recall, destruction, or re-export, in the event that any of the following is established:

a.    failure to comply with the requirements for the Placement along the Product Chain of Food;

b.    non-conformity of Food with the controls and standards prescribed by the Responsible Entity;

c.     Placement along the Product Chain of unregistered Food;

d.    committing fraud or deceit in the Placement along the Product Chain of Food;

e.    non-conformity of Food with the adopted technical regulations and Standard Specifications;

f.     Food found to be unfit based on laboratory testing;

g.    Food found to be unfit for human consumption; or

h.    Placement along the Product Chain of Food before verifying that laboratory testing has been conducted in accordance with Risk Assessment requirements.

10.  establish controls for virtual (remote) inspection; and

11.  exercise any other relevant duties or powers determined by the Responsible Entity or that are vested in it under the legislation in force in the Emirate.

IV. In Respect of the Control of Imported and Re-exported Food:

1.    establish the conditions and requirements to be met by Food imported into, or re-exported from, the local market, in a manner that ensures Food Safety in accordance with relevant federal and local legislation; and specify the certificates, documents, and health and procedural records required to be issued by the country of origin;

2.    control imported Food to ensure that it meets Food quality and Food Safety requirements, complies with technical regulations, and conforms with approved specifications, by undertaking the following:

a.    establishing, and continuously developing, the requirements and methods for the control of imported Food from the point of origin;

b.    prescribing the conditions and requirements for the acceptance of imported Food Consignments, based on its type and whether the Food is intended for the local market or for re-export; and verifying that the Food meets these conditions and requirements;

c.     establishing procedures for the inspection of imported Food Consignments based on Risk Assessment, and verifying their apparent fitness for consumption;

d.    identifying the types of imported Food from which samples are required to be taken, based on Risk Assessment;

e.    seizing imported Food shipments, or any part thereof, at Ports of Entry or at the warehouses of the Food-related Establishment, in accordance with the relevant procedures adopted by the Responsible Entity;

f.     denying entry of imported Food Consignments; and taking the necessary measures in respect thereof, including re-exporting them to the country of origin or to any other country, where the Food, or any part thereof, does not conform with the approved specifications, conditions, or requirements; is unfit for human consumption; or is adulterated or spoilt;

g.    releasing imported Food to the local markets, in accordance with the relevant procedures prescribed by the Responsible Entity in this regard; and

h.    conditionally releasing imported Food that is proven not to be harmful to the health of the Consumer, considering its intended use, or that will be treated in accordance with the procedures adopted by the Responsible Entity in this regard.

3.    determine the guarantees required for the entry of Food that does not conform with health conditions, or that is temporarily held;

4.    establish conditions and procedures for verifying that Food conforms with halal Food requirements;

5.    establish conditions and procedures for verifying that Food Suppliers from outside the UAE conform with the requirements for Food imported into the Emirate; and

6.    exercise any other relevant duties or powers determined by the Responsible Entity or that are vested in it under the legislation in force in the Emirate.

V. In Respect of Laboratory Testing of Food:

1.    establish the mechanisms required for sampling Food during its Placement along the Product Chain, based on Risk Assessment, and conducting laboratory testing thereof to verify its conformity with the technical regulations and specifications adopted by the Responsible Entity, and its fitness for human consumption;

2.    develop a manual for proper sampling methods for various types of Food, ensuring that samples accurately represent the Consignment or production batch from which they are taken;

3.    periodically or randomly collect samples of Food for laboratory testing, to verify their conformity with the technical regulations and specifications adopted by the Responsible Entity, with the aim of ensuring Food Safety and fitness for human consumption, through the development of sampling plans covering all stages of the Food Chain;

4.    prescribe the standards for laboratory tests related to Food Safety, in accordance with the technical regulations, scientific references, and specifications adopted by the Responsible Entity in this regard;

5.    verify that Food-related Establishments implement a self-inspection system for the Food they produce;

6.    determine the cases in which the results of Food samples that do not conform with the approved specifications may be reviewed, and consider the possibility of re-testing or determine whether the Food may be reconditioned to become fit for human consumption and released, in accordance with the controls and procedures specified by a relevant resolution of the Director General of the Responsible Entity; and

7.    exercise any other relevant duties or powers determined by the Responsible Entity or that are vested in it under the legislation in force in the Emirate.

VI. In Respect of the Social Responsibility of Responsible Entities:

1.    coordinate with Concerned Entities to establish technical regulations and Standard Specifications for Food, and to develop legislation related to Food Safety, nutrition, and food security;

2.    coordinate with Concerned Entities in all matters related to Food Safety, including specifying the health and technical requirements necessary to ensure Food Safety, the safety of packaged drinking water, and Applied Nutrition;

3.    collaborate with research and studies centres and institutions, and with local, regional, and international organisations in the domain of Food Safety; and conduct surveys related to Food;

4.    publish research, studies, and reports; and develop specialised awareness and educational programmes on the domain of Food Safety, with the aim of raising Consumer awareness; and

5.    exercise any other relevant duties or powers determined by the Responsible Entity or that are vested in it under the legislation in force in the Emirate.

VII. In Respect of Issuing Permits, Approvals, and Certificates:

The Responsible Entity will, in accordance with the conditions and procedures specified by a resolution of its Director General, issue the following Permits, approvals, and certificates:

1.    Food Permits authorising the conduct of all activities related to Food and Food Safety, including Food training and consultancy activities, the production of Food in domestic premises for Placement along the Product Chain, and cleaning activities related to drinking water, including the cleaning of water tanks;

2.    approvals issued to a Food-related Establishment wishing to conduct its activity outside the premises specified in its Food Permit;

3.    approvals for the Placement along the Product Chain of repackaged Food, whether at the stage of manufacture, production, or import;

4.    certificates authorising the sale of Food in local markets;

5.    certificates attesting to a Food factory’s compliance with Food Safety requirements;

6.    certificates attesting to a Food-exporting Establishment’s compliance with the requirements of Food-importing countries;

7.    certificates for the evaluation of the Product Label of packaged Food prior to its Placement along the Product Chain;

8.    approvals for amending, changing, or removing the Product Label, or repackaging of Food;

9.    certificates for Food exports;

10.  certificates for laboratory testing of Food;

11.  certificates for accreditation of Healthy Food or Food with health or nutritional claims;

12.  approvals for the Placement along the Product Chain of non-halal Food by a Food-related Establishment; and

13.  any other approvals, Permits, or certificates as determined and regulated by a resolution of the Director General of the Responsible Entity.

b.    In the domain of Food Safety, the DHA will, in coordination with the Concerned Entities, have the duties and powers to:

1.    develop standards that promote the consumption of Healthy Food in the Emirate; standards for declaration of caloric content of food in restaurants; and nutritional standards for the display of Products at Food outlets;

2.    develop regulations governing Advertisements related to Food health claims;

3.    develop regulations for providing alternative healthy Food options;

4.    develop optimal nutrition standards for women during pregnancy, childbirth, and the postpartum period;

5.    develop policies, programmes, guidelines, and recommendations on Food and nutrition for infants, children, and adults;

6.    develop policies that support Healthy Food environments;

7.    develop guidelines to end the inappropriate promotion of Food intended for infants and children;

8.    develop policies, programmes, and guidelines to control obesity; as well as awareness programmes on Healthy Food standards;

9.    develop and enhance evidence-based dietary guidelines that provide recommendations for a balanced and healthy diet;

10.  Implement educational campaigns for all segments of society to raise awareness of the importance of diet and the Risks associated with unhealthy diets;

11.  collaborate with the Concerned Entities to reduce the consumption of unhealthy Food by setting standards to limit the intake of sodium, sugars, partially hydrogenated fats, saturated fats, and trans fats;

12.  provide advice for the detection, investigation, and treatment of all Food-borne diseases transmitted to humans;

13.  raise awareness among members of the community, in cooperation with the Concerned Entities, of the importance of reporting any behaviours or negative practices related to Food Safety that may pose a Risk to Public Health;

14.  collect data on dietary habits, nutritional status, and related health outcomes, in order to take the necessary actions and measures in respect thereof;

15.  assess the impact of initiatives, programmes, and policies related to Healthy Food; and adjust them as needed to achieve better health outcomes;

16.  coordinate with the Responsible Entity in all matters relating to Food Safety;

17.  improve the health status of the population to combat diseases resulting from malnutrition, by adding micronutrients such as iodine, iron, vitamins, and similar substances to Food, or by requiring the modification of Food ingredients; and by prohibiting the marketing of Food that poses a Risk or potential Risk to health; and

18.  exercise any other duties or powers related to Food Safety that are vested in it under the legislation in force in the Emirate and the relevant protocols adopted by DHA.

Obligations of Food-related Establishments

Article (23)

Subject to liability, a Food-related Establishment must:

1.    comply with the provisions of this Law, the resolutions issued in pursuance hereof, the instructions issued by DHA and the Responsible Entity in the domain of Food Safety, and the conditions of the Food Permits issued to it;

2.    comply with the applicable legislation and approved requirements related to the health and safety of its Workers;

3.    obtain the approvals and certificates stipulated in this Law and the resolutions issued in pursuance hereof, and comply with their conditions;

4.    comply with the maintenance and hygiene requirements for its Buildings, facilities, equipment, and utensils used in Placement of Food on the Product Chain;

5.    comply with the requirements applicable to its Workers, including training and qualification requirements;

6.    apply safe health practices during work, as approved by the DHA or the Responsible Entity in this regard;

7.    comply with the standards, conditions, and requirements for Placement along the Product Chain in the Emirate of any Food under its responsibility while in the Food Chain, including Healthy Food and Food with health or nutritional claims;

8.    comply with the standards, conditions, and controls for Placement along the Product Chain of any Food within Educational Institutions;

9.    comply with the conditions and requirements for Placement along the Product Chain of any non-halal Food;

10.  refrain from Placement along the Product Chain of any Food containing prohibited Additives in its composition or manufacture;

11.  refrain from Placement along the Product Chain of any Food that is spoiled, adulterated, or harmful to Consumer health;

12.  refrain from Placement along the Product Chain of any Food sourced from any Person who does not hold a Food Permit or is not licensed by the Competent Authorities;

13.  comply with the requirements for halal Food;

14.  comply with the conditions and requirements for Placement along the Product Chain of any Food imported for the local market or intended for re-export;

15.  implement the Food Safety systems approved by the DHA or the Responsible Entity, and apply good hygiene practices that ensure the limitation of Risks during Placement along the Product Chain of any Food in its possession or under its responsibility;

16.  keep, retain, and manage records in accordance with the procedures and periods determined by the Responsible Entity; and enable the authorised employees of the Responsible Entity to access such records upon request;

17.  establish a Traceability system to identify the sources of any Food under Placement along the Product Chain, and the entities to which such Food has been distributed or sold, and the quantities thereof, wherever possible;

18.  notify the Responsible Entity of any Food in its possession that poses a Risk to Consumer health;

19.  notify DHA or the Responsible Entity of any person who has contracted a disease due to Food produced or distributed by the Food-related Establishment;

20.  undertake Withdrawal or Recall of any Food in the Emirate that is proven to be unfit for human consumption, or as required by a resolution of the Responsible Entity or the Competent Authorities;

21.  implement the Food Safety systems and programmes approved by the DHA or the Responsible Entity;

22.  have its packaged Food registered with the Responsible Entity prior to its Placement along the Product Chain;

23.  affix a health warning on any Food containing ingredients that may cause allergic reactions for the Consumer;

24.  maintain the cleanliness of drinking water; and notify the Responsible Entity in the event of any contamination;

25.  provide data relevant to Food Safety, as requested by the DHA or the Responsible Entity in accordance with applicable legislation;

26.  establish a system for receiving, recording, and following up on Consumer comments and complaints; take the necessary corrective measures regarding them; and maintain the relevant records;

27.  comply with the controls and requirements related to enhancing Preparedness for dealing with Emergencies; and

28.  comply with any other obligations related to Food Safety that are determined by a resolution issued by the Director General of the Responsible Entity or the officials of the Concerned Entities, each according to their jurisdiction.

Chapter Eleven

Consumer Product Safety

 

Conducting Activities Related to Consumer Products

Article (24)

a.    No Person may conduct any activity related to the Placement along the Product Chain of a Consumer Product in the Emirate before obtaining the Consumer Product Permit.

b.    No Person may conduct training or consultancy activities in the domain of Consumer Products in the Emirate before obtaining the relevant Consumer Product Permit.

c.     No Consumer Product-related Establishment may conduct any of the following:

1.    Placement along the Product Chain of a Consumer Product that is contaminated, spoiled, adulterated, or misrepresented;

2.    Placement along the Product Chain of a Consumer Product under conditions that pose a Risk to Consumer health;

3.    Placement along the Product Chain of a Consumer Product bearing health claims without obtaining the DM’s approval;

4.    Placement along the Product Chain of a Consumer Product within the Emirate that is not registered with the DM, does not conform with the applicable Standard Specifications or controls adopted by the DM, or has not been proven fit for human consumption after inspection; or

5.    Placement along the Product Chain of a Consumer Product whose ingredients may cause adverse effects to the Consumer without indicating this by means of clear health warnings on the Product Label.

Functions of Concerned Entities in the Domain of Consumer Product Safety

Article (25)

Without prejudice to federal legislation, the approved Standard Specifications in the UAE, and the functions of the federal entities concerned with Consumer Products, the DM, in the domain of Consumer Product Safety, will have the duties and powers to:

1.    identify the Consumer Products whose safety the DM is responsible for ensuring;

2.    issue Permits to conduct activities related to Consumer Product Placement along the Product Chain, including training or consultancy activities in the domain of Consumer Product Safety;

3.    oversee compliance by Consumer Product-related Establishment, based on the respective Consumer Product Permits issued to them, with the controls and standards relating to:

a.    their premises and facilities, in terms of design, equipment, hygiene, and maintenance;

b.    Placement along the Product Chain of Consumer Products in the Emirate, whether manufactured inside or outside the UAE;

c.     Consumer Products imported for the local market or intended for re-export, to ensure their safety and compliance with the applicable legislation in force;

d.    the assessment and registration of Consumer Products, and the issuance of the relevant certificates and reports;

e.    the Workers present at its premises and various facilities, as well as their training and qualification; and

f.     the storage facilities of Consumer Products, and means of their transportation.

g.    deploy and use the latest technological, innovative, and technical means, systems, and programmes that ensure continuous monitoring of Consumer Product-related Establishments and their Placement along the Product Chain of Consumer Products;

4.    issue approvals for any change to, removal of, or modification of the Product Label of a Consumer Product, or any change to its packaging;

5.    issue export and free sale certificates for Consumer Products;

6.    issue laboratory test reports for Consumer Products, and determine the standards for laboratory tests related to Consumer Product Safety, in accordance with the approved standards in this regard;

7.    issue approvals for the promotion and advertising of Consumer Products;

8.    manage the sampling process as follows:

a.    establishing sampling procedures based on Risk Assessment and laboratory testing, to ensure compliance with technical regulations and approved specifications;

b.    conducting regular or unannounced sampling, to ensure compliance with technical regulations and approved specifications; and

c.     determining the standards for laboratory tests, in accordance with technical regulations, scientific references, and the specifications approved in this regard.

9.    determine the cases in which the results of samples that do not conform with the approved specifications may be reviewed, and assess the possibility of re-testing them, in accordance with the controls and procedures approved in this regard;

10.  conduct Risk Assessments and implement Vigilance Programmes to monitor, study, and evaluate Risks and side effects resulting from the use of Consumer Products, with the aim of mitigating and preventing them;

11.  receive reports and complaints regarding Consumer Product-related Establishments and Consumer Products placed on the market in the Emirate, investigating them, and taking the necessary measures and actions against those who commit the acts that constitute violations of this Law and the resolutions issued in pursuance hereof;

12.  take the necessary measures and actions to prevent the Placement along the Product Chain of any Consumer Product, including its re-export, Withdrawal, Recall, or destruction, if it is found not to be registered, not tested, not conforming with the Standard Specifications, not compliant with the controls and standards adopted by the DM, not laboratory-approved, or not proven to be fit for use;

13.  determine the records that must be kept by Consumer Product-related Establishments and the required retention period;

14.  conduct scientific studies and research in the domain of Consumer Product Safety, and carrying out field surveys and opinion polls regarding awareness of the Risks associated with such products, in collaboration with public and private entities, including Educational Institutions, scientific laboratories, and expert houses;

15.  coordinate with the Concerned Entities regarding the development or amendment of Standard Specifications related to Consumer Products; and

16.  exercise any other duties or powers related to Consumer Product Safety that are vested in the DM under the legislation in force in the Emirate.

Obligations of Consumer Product-related Establishments

Article (26)

Subject to liability, a Consumer Product-related Establishment must:

1.    comply with the provisions of this Law, the resolutions issued in pursuance hereof, the legislation in force in the Emirate, the instructions and regulations issued by the DM in the domains of Consumer Product Safety and health, and the conditions of the Consumer Product Permit issued to it;

2.    obtain the approvals and certificates stipulated in this Law and comply with their conditions;

3.    meet the maintenance and hygiene requirements of its Buildings and facilities;

4.    meet the requirements applicable to its Workers, including requirements for their training and qualification;

5.    comply with the procedures, requirements, technical rules, and health and preventive measures related to the Placement along the Product Chain of Consumer Products in the Emirate;

6.    ensure that Consumer Products meet the approved requirements and Standard Specifications at all stages of its Placement along the Product Chain;

7.    have its Consumer Products registered before commencing its Placement along the Product Chain in the Emirate;

8.    not engage in the Placement along the Product Chain of any Consumer Product that is spoiled, adulterated, or harmful to Consumer health;

9.    conduct Risk Assessment and implement Vigilance Programmes related to any Consumer Product in its possession or under its responsibility, in accordance with the controls and mechanisms adopted by the DM in this regard;

10.  keep and retain records in accordance with the mechanisms and periods adopted by the DM in this regard;

11.  establish a Traceability system, which includes, where possible, identifying the sources of the Consumer Product under Placement along the Product Chain, the entities to which it has been distributed or sold, and the quantities involved;

12.  notify the DM of any Consumer Product that may pose a Risk to Consumer health;

13.  undertake the Withdrawal and Recall of the Consumer Product if it is found to be unfit for human use, or if so required pursuant to a relevant decision issued by the DM or the Competent Authority;

14.  place health warnings on any Consumer Product that contains any components which may cause side effects to the Consumer;

15.  fully cooperate with the DM, provide it with the required data and information in accordance with the specified mechanisms and periods; not obstruct its employees or authorised representatives; and comply with the measures and actions issued by the DM in relation to the Consumer Product; and

16.  comply with any other obligations related to Consumer Product Safety as may be specified by a resolution issued by the Director General of the DM in this regard.

Chapter Twelve

Animal Health

 

Conducting in Animal-related Activities

Article (27)

a.    No Person may commit any of the following acts:

1.    engaging in any Animal-related activities in the Emirate without first obtaining an Animal Permit from the Responsible Entity;

2.    endangering the health of any Animal in a manner that may result in its illness;

3.    possessing, acquiring, or keeping any pet Animal in the Emirate without first obtaining a pet ownership licence from the Responsible Entity;

4.    possessing, acquiring, or keeping any Animal, including productive or pet Animals, in the Emirate prior to its tagging and registration with the Responsible Entity;

5.    engaging in random feeding of Animals by individuals or Establishments engaged in Animal-related Activities;

6.    slaughtering or engaging in the Placement along the Product Chain of any Animal that is infected or suspected of being infected with any Communicable Disease or epidemic disease, or engaging in the Placement along the Product Chain of that Animal's Waste, Products, or equipment used in its care or transport, except after obtaining the prior approval of the Responsible Entity;

7.    slaughtering any Animal, whether for commercial or non-commercial purposes, outside abattoirs or Establishments approved by the Responsible Entity;

8.    forging or counterfeiting the meat stamps of DM abattoirs, or using such stamps on imported carcasses or on the meat of Animals slaughtered outside abattoirs or Establishments approved by the Responsible Entity;

9.    using prohibited or restricted medicines and Pesticides in contravention of the legislation in force in the Emirate;

10.  randomly using antibiotics, hormones, or growth promoters without a prescription issued by a Veterinarian licensed to practise veterinary medicine in the Emirate;

11.  breeding productive Animals in villas, houses, or residential areas; or

12.  possessing or raising Dangerous Animals or prohibited Animals in the Emirate as specified under the legislation in force.

b.    The Director General of the Responsible Entity will, pursuant to a resolution he issues in this respect, specify the Animals subject to the provisions of this Article.

Functions of the Responsible Entity in the Domain of Animal Health

Article (28)

In the domain of Animal Health, the Responsible Entity will have the duties and powers to:

1.    ensure Animal Health and the safety of Animal Products, and provide preventive and curative veterinary services at their respective locations;

2.    determine the Animal-related activities for which obtaining an Animal Permit is required, including activities such as breeding and caring for Animals in enclosures and farms for reproduction and production purposes; the Placement along the Product Chain of Animal supplies; the treatment of Animals; and the operation of the relevant Establishments such as milking facilities and abattoirs; and issue Permits for the conduct of such activities;

3.     issue Permits for the establishment and operation of abattoirs, and verify their compliance with the relevant approved health standards and requirements;

4.    regulate the ownership of Animals by determining the types and numbers of Animals that must be registered and for which a Permit for ownership, possession, or raising is required;

5.    monitor the compliance of Animal-related Establishments, based on their licensed activities, with the controls and standards relating to the following:

a.    designs and equipment required to be available at the premises of Animal-related Establishments and their various facilities, based on the activity to be conducted;

b.    technical manuals for the operation of Animal-related Establishments, including the requirements and controls applicable to their Workers;

c.     cleanliness and maintenance of the premises and facilities of Animal-related Establishments, including the substances authorised for use in cleaning and disinfecting the entrails of Animals intended for human consumption or designated as Animal Feed;

d.    technical and guidance manuals required for the ownership, breeding, keeping, and care of Animals;

e.    storage and disposal of dead Animals, and the methods of their destruction; and

f.     compliance with Animal welfare standards.

6.    determine Animal Diseases and Zoonoses; determine modes of transmission and methods of prevention; prescribe the procedures to be followed upon infection of any Animal with such diseases; announcement of such cases by means deemed appropriate; and adopt the necessary measures and procedures for their control;

7.    notify the DHA and the Concerned Entities of Zoonoses;

8.    monitor compliance with the requirements and specifications applicable to vehicles and means of transporting Animals, Feed, Animal Food, and veterinary substances;

9.    issue health certificates for live Animals, Feed, and Animal Food;

10.  monitor compliance with the requirements applicable to the transport of carcass meat and its by-products from abattoirs and other approved Animal slaughtering facilities, as well as the storage thereof and the disposal of their Waste designated to be destroyed;

11.  issue approvals for all Advertisements relating to Animals, including electronic Advertisements; and oversee and supervise compliance with the advertising conditions;

12.  issue approvals for the dispatch and import of pathological samples relating to Animals; examine such samples; and conduct scientific experiments thereon;

13.  monitor compliance by abattoirs and other approved Animal slaughtering facilities with the conditions and requirements adopted by the Responsible Entity in this respect;

14.  monitor compliance with the conditions and requirements applicable to the import of Animals to the local market and their re-export, in a manner that ensures Animal Health and is consistent with the relevant legislation in force;

15.  prescribe the cases and conditions for the seizure and confiscation of Stray Animals and Unrestrained Animals, and all matters relating to the care for and disposal thereof;

16.  examine Animals offered for sale in livestock markets, specialised markets, or Animal display and sale outlets; and verify their soundness and freedom from diseases;

17.  implement Veterinary Quarantine procedures in respect of Animals, Feed, and Animal supplies that are imported or brought into the Emirate from other Emirates, where it is established that they do not conform with the approved standards and specifications, or where they are suspected of being infected with any Animal Disease, Zoonosis, or of posing a Risk to Public Health;

18.  issue laboratory test certificates for Animals, in accordance with the standards applicable to laboratory testing related to Animal Health, and the approved specifications and scientific references in this respect;

19.  determine the records that must be maintained by Animal-related Establishments, and the period for which they must be retained;

20.  approve the procedures and requirements for Risk Assessment and Vigilance Programmes to monitor Risks and adverse effects arising from Animal-related activities; and examine and assess these Risks and adverse effects in order to mitigate and prevent them;

21.  conduct oversight and inspection of facilities for Placement along the Product Chain of Animals and Animal supplies, and collect the necessary samples to verify compliance with the conditions, specifications, controls, and standards approved in this respect;

22.  continuously assess Animal-related Establishments; and verify that they employ the latest methods, programmes, and innovative technological systems that ensure ongoing oversight of these establishments and the Placement along the Product Chain of Animals, wherever possible;

23.  receive and investigate reports and complaints against Animal-related Establishments and any person engaged in the Placement along the Product Chain of Animals; and take the necessary measures and actions against those who commit acts constituting violations under the provisions of this Law and the resolutions issued in pursuance hereof;

24.  collaborate and coordinate with the DHA regarding reports received on Zoonoses and take the necessary measures and actions to combat them;

25.  activate Veterinary Quarantine procedures; and take the necessary measures with respect to sick Animals, and Feeds and Animal supplies that do not conform with the approved specifications and standards or that pose a Risk to Public Health, including their seizure and destruction;

26.  cooperate with research and study centres, and regional and international institutions and organisations in the domain of Animal Health;

27.  conduct scientific studies and research in the domain of Animal Health, publish them by such means as deemed appropriate, and take the necessary measures and actions to act upon their results;

28.  collaborate and coordinate with the Concerned Entities to develop specifications and standards for Animals, and to establish plans and programmes for the control of Animal Diseases and Zoonoses;

29.  prescribe the conditions for accompanying pets in Public Places, and designate the Public Places where it is prohibited to accompany such Animals;

30.  establish policies, standards, and requirements, and determine roles and responsibilities to enhance the control of epidemic Animal Diseases and Zoonoses;

31.  establish, in coordination with the Concerned Entities, controls to promote and protect Animal Health and to ensure the safety of Animals and of Animal Products;

32.  develop policies and systems for the management of Stray Animal populations in the Emirate; ensure their protection; prevent their abuse; determine methods for handling them; and regulate their feeding in accordance with best practices;

33.  develop a plan for the prevention of Animal Diseases at the level of the Emirate, and determine the responsibilities of the Concerned Entities and Veterinary Healthcare Service Providers;

34.  develop policies, standards, and requirements to reduce Risk factors leading to the spread of Animal Diseases and Animal epidemics;

35.  design and develop programmes for the early detection and management of Animal Diseases, including intervention activities and programmes to mitigate their Risk factors, and develop plans to ensure the sustainability of such programmes in the Emirate; and

36.  exercise any other duties or powers required for the protection of Animal Health, as specified by a relevant resolution of the Director General of the Responsible Entity, or as vested in the Responsible Entity under the legislation in force in the Emirate.

Obligations of Animal Keepers

Article (29)

Subject to liability, an Animal Keeper must:

1.    comply with the provisions of this Law, the resolutions issued in pursuance hereof, the legislation in force in the Emirate, and the conditions of the Animal Permit issued to him;

2.    tag and register the Animals, including productive Animals and pets, in accordance with the procedures approved by the Responsible Entity in this respect;

3.    not engage in the Placement along the Product Chain of Animals except in locations designated by the Responsible Entity;

4.    comply with the conditions and controls for the possession, housing, and care for Animals, including the conditions for accompanying pets in Public Places;

5.    maintain the cleanliness and upkeep of farms, barns, small holdings, and all other structures and their associated facilities used for keeping Animals for any purpose;

6.    not leave Animals unrestrained or astray;

7.    provide Animals with complete and appropriate Animal Feed, suitable for its age and species, in sufficient quantities to maintain them in good health and meet their nutritional needs;

8.    separate local Animal breeds from imported Animals for breeding purposes;

9.    provide Animals with the necessary preventive and curative veterinary services;

10.  monitor, and periodically examine and test, Animals to ensure that they are free from Animal Diseases or Zoonoses;

11.  comply with the technical guidelines required for the ownership, housing, breeding, and care of Animals, as approved by the Responsible Entity, including for both productive and companion Animals and pets;

12.  not dispose of the carcass of a dead Animal in open areas or in Public Places, but rather dispose of the same in accordance with the relevant procedures adopted by the Responsible Entity;

13.  comply with the procedures prescribed to prevent Animals from contracting any Animal Disease or Zoonosis, including immunising Animals against such diseases and obtaining the relevant immunisation card; and

14.  fulfil any other obligations related to Animal Health as determined pursuant to the relevant resolution of the Director General of the Responsible Entity.

Obligations of Keepers of Infected Animals

Article (30)

A Keeper of an Animal that is infected, or suspected of being infected, with any contagious Animal Disease must:

1.    immediately notify the Responsible Entity upon the infection of the Animal, or suspicion of its infection, with any contagious Animal Disease;

2.    isolate Animals suspected of being infected with any contagious Animal Disease, and implement Veterinary Quarantine measures for those confirmed to be infected;

3.    not slaughter or undertake Placement along the Product Chain of any Animal that is infected, or suspected of being infected, with any contagious Animal Disease, or of its Waste, Products, or the tools used in its care;

4.    not dispose of Animal carcasses in open areas or Public Places, but rather dispose of the same in accordance with the relevant procedures adopted by the Responsible Entity;

5.    not cause the transmission of a contagious Animal Disease to any other Animal, whether intentionally or unintentionally;

6.    implement any measure as required by the Responsible Entity or the Competent Authorities to prevent the outbreak of a contagious Animal Disease;

7.    take the preventive and therapeutic measures prescribed by the specialised Veterinarian or the Responsible Entity; and

8.    fulfil any other obligations determined pursuant to the relevant resolutions issued by the Responsible Entity or the Competent Authorities.

Obligations of Animal-related Establishments

Article (31)

Subject to liability, an Animal-Related Establishment must:

1.    comply with the provisions of this Law, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate, the instructions and regulations issued by the Responsible Entity in the domain of Animal Health and safety and the safety of Animal Products, and the terms of the Permit issued to it;

2.    comply with the technical requirements, controls, and manuals governing the operation of the Animal-related Establishment, including the requirements and controls applicable to its Workers;

3.    obtain the approvals and certificates stipulated in this Law and the resolutions issued in pursuance hereof, and comply with their conditions;

4.    keep its facilities in good condition and carry out regular maintenance and cleaning;

5.    comply with the procedures, requirements, technical rules, and health and preventive measures relating to the health and safety of Animals and of Animal Products;

6.    adhere to Animal welfare standards;

7.    undertake Placement along the Product Chain of, and use, only the tools, equipment, and medicines that are registered and authorised for such purposes in the Emirate;

8.    not undertake Placement along the Product Chain of Products or tools that have a negative impact on the Animal Health and safety;

9.    maintain and retain records in accordance with the procedures and periods adopted by the Responsible Entity in this regard;

10.  notify the Responsible Entity of any Products, medicines, or preparations used that may have caused harm to an Animal;

11.  immediately notify the Responsible Entity of any cases of Animals contracting notifiable contagious diseases, in accordance with the legislation in force;

12.  undertake the Withdrawal and Recall of Products and tools used in the care of Animals, if proven to be unsafe for use, or upon the issuance of a resolution by the Responsible Entity or the Competent Authority to that effect;

13.  not send any pathological specimens outside the UAE, import them, or conduct any tests or scientific experiments on them without first obtaining the approval of the Responsible Entity;

14.  comply with the requirements and specifications applicable to vehicles and means of transport used for Animals, Feed, Animal Food, and veterinary supplies;

15.  comply with the requirements that must be met by abattoirs and designated facilities for Animal slaughter;

16.  comply with the requirements applicable to the transport of carcass meat and its by-products from abattoirs and designated facilities for Animal slaughter, as well as the requirements for their storage, and for the disposal and destruction of carcass Waste;

17.  not dispose of Animal carcasses in open areas or Public Places, but rather dispose of the same in accordance with the relevant procedures adopted by the Responsible Entity;

18.  not dispose of, discard, or leave veterinary medical Waste, whether liquid, solid, or gaseous, in violation of the instructions and guidelines adopted by the Responsible Entity in this regard;

19.  maintain and retain records in accordance with the procedures and periods specified by the Responsible Entity;

20.  comply with the procedures and requirements for Risk Assessment and Vigilance Programmes approved by the Responsible Entity relating to the practice of Animal-related activities; and examine and assess such Risks to mitigate and prevent them;

21.  obtain the approval of the Responsible Entity for all Advertisements related to the Placement along the Product Chain of Animals, including electronic Advertisements;

22.  fully cooperate with the Responsible Entity; provide it with the required data and information in accordance with the prescribed procedures and periods; refrain from obstructing its employees or authorised representatives; and comply with any procedures and measures it issues relating to Animals; and

23.  fulfil any other obligations relating to Animal Health and safety or to the safety of Animal Products as may be prescribed by a relevant resolution issued by the Director General of the Responsible Entity or the official in charge of the Competent Authority.

Chapter Thirteen

Built Environment Health

 

Functions of the Responsible Entity in the Domain of Built Environment Health

Article (32)

a.    The Responsible Entity is the Competent Authority in the Emirate in charge of all matters related to Built Environment Health. For this purpose, the Responsible Entity will have the duties and powers to:

1.    establish the environmental and health requirements and standards that must be met in the Built Environment, including those relating to building materials, the quality of water and indoor air, water systems and tanks, swimming pools, fountains, closed waterways, as well as sewerage systems and their treatment methods, and permissible levels of noise and lighting;

2.    inspect, test, calibrate, and assess the systems, equipment, and materials used in the Built Environment to verify their efficiency and suitability and to ensure Built Environment Health, and take the necessary measures to require Owners to remedy any violations;

3.    establish the controls and standards required for the periodic maintenance of the Built Environment;

4.    exercise oversight and conduct inspections of the Built Environment and the Workers in this environment to verify compliance with the approved health and environmental requirements, in coordination with the Concerned Entities;

5.    manage the collection of samples, including the following:

a.    establishing procedures for sample collection, based on Risk Assessment and laboratory testing, to verify their conformity with the relevant approved technical regulations and specifications;

b.    conducting periodic or unannounced sample collections to verify their conformity with the approved technical regulations and specifications;

c.     prescribing the standards for laboratory testing in accordance with the technical regulations, scientific references, and specifications approved in this respect; and

d.    determining the cases in which it is permissible to reassess the test results of samples that do not conform with the approved specifications and standards, and considering the possibility of re-testing such samples in accordance with the controls and procedures approved in this respect.

6.    receive and investigate reports and complaints related to the Built Environment; and take the necessary measures and actions against those who commit acts that constitute a violation of the provisions of this Law and the resolutions issued in pursuance hereof;

7.    take the necessary actions and measures to ensure the Built Environment Health;

8.    continuously assess the Built Environment, and coordinate with the Concerned Entities to address and control Communicable Diseases and Risks; and

9.    exercise any other duties or powers relating to Built Environment Health, as determined by the relevant resolution of the Director General of the Responsible Entity, or as assigned to it under the legislation in force in the Emirate.

b.    in the domain of Built Environment Health, the DCAS will be responsible for establishing the standards and procedures to be followed for providing First Aid services in the Built Environment, and determine the responsibilities of Owners, occupants, and visitors of the sites and facilities comprising such environment, to ensure their safety.

Obligations of Owners in the Domain of Built Environment Health

Article (33)

Subject to liability, and within the domain of Built Environment Health, an Owner must:

1.    comply with the environmental and health requirements and standards adopted by the Responsible Entity in the domain of Built Environment, including those relating to construction materials, indoor air quality, water systems and tanks, swimming pools, fountains, closed waterways, sewerage systems and their treatment methods, and the permissible levels of noise and lighting;

2.    conduct analysis of samples of water, and samples and measurements of indoor air quality, in accordance with the requirements and standards for the Built Environment as approved by the Responsible Entity;

3.    use and operate the Built Environment, or any part thereof, in a manner that ensures the Built Environment Health;

4.    perform cleaning and Disinfection on a continuous basis within the Built Environment and its surroundings;

5.    respond immediately to any health Risks or issues within the Built Environment;

6.    not use any materials whose emissions may cause, whether directly or indirectly, pollution of the Built Environment in a manner harmful to human health or living organisms;

7.    ensure that indoor air quality levels within the Built Environment do not exceed unacceptable limits, and strive to maintain these levels in accordance with the relevant standards approved by the Responsible Entity;

8.    ensure ventilation of indoor air within the Built Environment in accordance with the indoor air quality standards approved by the Responsible Entity;

9.    provide the necessary tools, equipment, systems, and modern technologies to ensure the Built Environment Health, including devices for measuring water quality and indoor air quality;

10.  provide appropriate means to vent gaseous emissions, air-polluting vapours, and heat generated by various activities and facilities within the Built Environment;

11.  carry out periodic maintenance of the Built Environment in a manner that ensures it continues to meet the relevant environmental and health requirements and standards approved by the Responsible Entity;

12.  not engage in any activity within the Built Environment that may cause harm to Public Health or the surrounding environment;

13.  comply with the relevant health, technical, and regulatory conditions and requirements as prescribed by the Responsible Entity;

14.  ensure that his Workers within the Built Environment complete the training and technical qualification programmes approved by the Responsible Entity;

15.  comply with the conditions and requirements prescribed by the Concerned Entities, including the DCAS, in accordance with the relevant legislation and guidelines applicable to them; and

16.  fulfil any other obligations related to Built Environment Health as may be determined by the Concerned Entities pursuant to resolutions issued by their respective officials in charge.

Chapter Fourteen

Environmental Health

 

Functions of the Concerned Entities in the Domain of Environmental Health

Article (34)

a.    In accordance with the relevant legislation applicable to it, the Responsible Entity is mandated to maintain Environmental Health in the Emirate. This includes monitoring and assessment of the quality of air, water, and soil to detect hazardous pollutants; assessing the environmental impact of development and industrial projects; and undertaking Response to Emergencies and Disasters in coordination with the Concerned Entities and other stakeholders.

b.    In the domain of Environmental Health, the DHA will, in coordination with the concerned entities, have the duties and powers to:

1.    establish the standards required for identifying environment-related diseases;

2.    analyse and assess health Risks associated with various environmental factors; determine preventive and corrective measures; and develop health guidelines for the groups in the community most vulnerable to environment-related diseases;

3.    conduct public awareness campaigns regarding environment-related diseases and methods of managing various environmental situations in a manner that preserves Public Health;

4.    conduct research and studies on the prevention of diseases caused by environmental pollution and climate change, and support and encourage other entities to undertake research and innovation in this field;

5.    support the Concerned Entities in Response operations to Emergencies resulting from environmental pollutants that affect Public Health; and

6.    exercise any other duties or powers relating to Environmental Health as assigned to the DHA under the legislation in force in the Emirate.

c.     The DAHI will segregate medical and non-medical Waste in its Healthcare Facilities and dispose of the same, in accordance with the legislation in force in the Emirate and the relevant approved protocols.

Regulating Activities Related to Environmental Health

Article (35)

a.    No Person may conduct an activity related to Environmental Health in the Emirate without first obtaining the Environmental Health Permit. The Environmental Health Permit will be issued in accordance with the conditions and procedures prescribed by the relevant resolutions of the Director General of the Responsible Entity.

b.     In the domain of regulating activities related to Environmental Health, the Responsible Entity will have the following duties and powers to:

1.    specify the Environmental Health-related activities whose practice requires the issuance of Environmental Health Permits;

2.    issue Environmental Health Permits for Environmental Health-related activities;

3.    establish the conditions and requirements that must be met in the premises of Environmental Health-related Establishments and their various facilities, based on the type of activities authorised for practice;

4.    establish the technical requirements for the operation of Environmental Health-related Establishments, including the technical requirements applicable to their Workers;

5.    establish the Public Hygiene requirements for the premises and facilities of Environmental Health-related Establishments;

6.    determine the records that must be maintained by Environmental Health-related Establishments, and the period for which they must be retained;

7.    monitor and inspect Environmental Health-related Establishments and their Workers to ensure compliance with the conditions of the Environmental Health Permits issued to them, as well as the obligations prescribed under the provisions of this Law, the resolutions issued in pursuance hereof, and the other legislation in force in the Emirate;

8.    take the necessary measures and actions to protect the health of members of the community and beneficiaries of the services provided by Environmental Health-related Establishments; take the necessary measures to bring non-compliant Establishments into compliance; and impose the penalties prescribed under this Law and the resolutions issued in pursuance hereof against violating Establishments;

9.    evaluate Environmental Health-related Establishments in accordance with the controls and standards specified by the relevant resolution issued by the Director General of the Responsible Entity;

10.  utilise the latest technological means, programmes, systems, innovative solutions, and smart platforms that ensure continuous monitoring of Environmental Health-related Establishments, whenever possible;

11.  receive, investigate, and take the appropriate action in respect of complaints filed against Environmental Health-related Establishments, and against those who commit acts constituting violations of the provisions of this Law and the resolutions issued in pursuance hereof; and

12.  exercise any other duties or powers related to Environmental Health as assigned to it under the applicable legislation in force.

Obligations of Environmental Health-related Establishments

Article (36)

Subject to liability, an Environmental Health-related Establishment must:

1.    comply with the provisions of this Law, the resolutions issued in pursuance hereof, the other legislation in force in the Emirate, and the conditions of the Environmental Health Permit issued to it;

2.    comply with the technical requirements for the operation of Environmental Health-related Establishments, including the requirements applicable to its Workers;

3.    instruct visitors of the Environmental Health-related Establishment to comply with the health guidelines issued by the Responsible Entity and the Concerned Entities;

4.    carry out general cleaning, Disinfection, and sterilisation activities, including the segregation and disposal of all types of Waste, in accordance with the controls and standards adopted by the Responsible Entity in this regard;

5.    maintain, retain, and manage records in accordance with the procedures and periods prescribed by the Responsible Entity in this regard; and enable the employees of the Responsible Entity, and those authorised by, it to access such records upon request;

6.    ensure that its Workers complete the relevant training and technical qualification programmes approved by the Responsible Entity;

7.    provide the Responsible Entity and the Concerned Entities with the data and information required; and fully cooperate with, and not obstruct the work of, their employees and those authorised by them;

8.    comply with the health standards for the various environmental factors that are linked to Environment-related Diseases, or that negatively affect Public Health, as specified by a resolution issued by the Director General of the Responsible Entity in this regard; and

9.    fulfil any other obligations that are related to Environmental Health, as determined by the relevant resolution of the officials in charge of the Concerned Entities, each within his respective jurisdiction.

Chapter Fifteen

Workers’ Accommodation Health

 

Functions of the Responsible Entity in the Domain of Workers’ Accommodation Health

Article (37)

a.    The Responsible Entity in the domain of Workers’ Accommodation Health will have the duties and powers to:

1.    establish the environmental and health conditions and requirements that must be met in Workers’ Accommodations, including those relating to building materials, indoor air quality, water systems, sewerage, noise levels, and lighting;

2.    inspect, test, calibrate, and evaluate the systems, equipment, and materials used in Workers' Accommodation, to verify their efficiency and validity, to ensure Workers’ Accommodation Health; and to take the necessary measures to compel the Owner to remedy any violations;

3.    establish the controls and standards for the periodic maintenance of Workers' Accommodation;

4.    monitor and inspect Workers' Accommodations and their associated facilities, including areas for Placement along the Product Chain of Food and the Workers therein; and collect samples from water systems and indoor air, in order to verify their compliance to the standards and requirements adopted in this regard;

5.    issue approvals for the occupancy of Workers' Accommodations, following inspection of such Workers' Accommodations and their associated facilities, and verification of conformity to the standards and requirements adopted in this regard;

6.    specify the activities related to Workers' Accommodation Health whose practice requires the issuance of Workers' Accommodation Health Permits, and establish the conditions and requirements for their issuance;

7.    issue Workers' Accommodation Health Permits;

8.    establish the technical requirements for Workers' Accommodations, including the technical requirements applicable to the Workers therein;

9.    establish the requirements relating to general cleanliness in the premises and facilities of Workers' Accommodations;

10.  determine the records that must be kept in Workers' Accommodation, and the period for which they must be retained;

11.  assess Workers' Accommodations in accordance with the controls and standards specified by a resolution issued by the Director General of the Responsible Entity in this regard;

12.  continuously assess Workers' Accommodation Health, and coordinate with the Competent Authorities to combat and control Communicable Diseases;

13.  utilise the latest technological means, programmes, systems, innovative solutions, and smart platforms that ensure continuous monitoring of Workers' Accommodation, whenever possible;

14.  receive and investigate reports and complaints filed against Workers' Accommodation-related Establishments; and take the necessary measures and actions against those who commit acts constituting a violation of the provisions of this Law and the resolutions issued in pursuance hereof;

15.  take all necessary measures and actions to ensure the Workers' Accommodation Health, including the measures and actions required to bring non-conformant Workers' Accommodations into compliance, in a manner that prevents harm to the health of their occupants; and

16.  exercise any other duties or powers that are related to Workers' Accommodation Health, as assigned to it under the applicable legislation in force.

b.    The DCAS will, in the domain of Workers' Accommodation Health, have the duties and powers to:

1.    establish the requirements for Ambulance Stations and for Response to Workers' Accommodations Emergencies;

2.    monitor and inspect Workers' Accommodations and their associated facilities, to verify their conformity with the requirements adopted in this regard; and

3.    exercise any other duties or powers relating to Workers' Accommodation Health as assigned to the DCAS in accordance with the legislation in force in the Emirate.

Obligations of Owners in the Domain of Workers' Accommodations Health

Article (38)

In the domain of Workers' Accommodations Health, and subject to liability, an Owner must:

1.    comply with the environmental and health conditions and requirements approved by the Responsible Entity in the domain of Workers' Accommodation Health and Workers' gathering places, including those relating to construction materials, indoor air quality, water systems and tanks, sewerage systems and their treatment methods, and the permissible levels of noise and lighting;

2.    have water samples tested, in accordance with the requirements approved by the Responsible Entity in this regard;

3.    use and operate Workers’ Accommodation, or any part thereof, in a manner that ensures that Workers’ Accommodation Health is maintained;

4.    ensure that cleaning and Disinfection works are carried out on a continuous basis inside Workers’ Accommodation and in its surroundings, and including dumping and disposal of Waste in designated areas;

5.    not use any materials whose emissions within Workers’ Accommodation may, whether directly or indirectly, cause harm to the health of Workers;

6.    ensure that indoor air quality levels in Workers’ Accommodation do not reach unacceptable limits; and take all necessary measures to maintain air quality within the levels prescribed by the Responsible Entity;

7.    ensure ventilation of indoor air within Workers’ Accommodation in accordance with the indoor air quality standards approved by the Responsible Entity;

8.    provide the appropriate means for venting gaseous emissions, air pollutants, and heat produced by various activities and facilities within the Workers’ Accommodation;

9.    carry out periodic maintenance of Workers’ Accommodation in a manner that ensures it continues to meet the environmental and health conditions and requirements approved by the Responsible Entity;

10.  not engage in any activity within Workers’ Accommodation that may compromise Public Health or the surrounding environment;

11.  comply with the health, technical, and regulatory conditions and requirements for Workers’ Accommodation in the Emirate, as adopted by the Responsible Entity in this regard;

12.  provide the necessary tools and equipment to ensure the health of Workers’ Accommodation and Workers’ gathering areas, including indoor air quality monitoring devices;

13.  ensure that his Workers within Workers’ Accommodation complete the training and technical qualification programmes approved by the Responsible Entity; and

14.  fulfil any other obligations related to the health of Workers’ Accommodation as determined by a resolution issued by the Director General of the Responsible Entity in this regard.

Obligations of Companies Occupying Workers’ Accommodation

Article (39)

Subject to liability, a Company occupying Workers’ Accommodation must:

1.    comply with the provisions of this Law, the resolutions issued in pursuance hereof, the other legislation in force in the Emirate, and the conditions of the Permit issued to it;

2.    meet the technical requirements for Workers’ Accommodation, including the requirements related to its Workers;

3.    instruct visitors of the Workers’ Accommodation to comply with the health guidelines issued by the Responsible Entity and the Concerned Entities;

4.    carry out general cleaning, Disinfection, and sterilisation activities, including the disposal of all types of Waste, in accordance with the controls and standards adopted by the Responsible Entity in this regard;

5.    maintain, retain, and manage records in accordance with the procedures and periods prescribed by the Responsible Entity in this regard; and enable the employees of the Responsible Entity, and those authorised by, it to access such records upon request;

6.    ensure that its Workers complete the relevant training and technical qualification programmes approved by the Responsible Entity;

7.    provide the Responsible Entity and the Concerned Entities with the data and information required; and fully cooperate with, and not obstruct the work of, their employees and those authorised by them; and

8.    fulfil any other obligations related to the health of Workers’ Accommodation as determined by a resolution issued by the Director General of the Responsible Entity in this regard.

Chapter Sixteen

Tobacco Control

 

Functions of the DM in the Domain of Tobacco Control

Article (40)

In the domain of Tobacco Control, the DM will have the duties and powers to:

1.    develop the controls and conditions governing the Placement along the Product Chain of Tobacco, Tobacco Products, and related goods, including electronic Tobacco Products, in accordance with the legislation in force in the Emirate;

2.    issue Tobacco Permits, and supervise and monitor Permit holders;

3.    establish the necessary controls and requirements to prohibit Smoking in Public Places, in accordance with the legislation in force in the Emirate, and monitor compliance therewith by all persons;

4.    establish the controls and requirements for permitting Smoking in designated areas, and issue Permits to, and monitor, Establishments managing such areas;

5.    develop specialised awareness and educational programmes on the domain of Tobacco Control and its derivatives, in coordination with the Concerned Entities; and

6.    exercise any other duties or powers related to the control of Tobacco and its derivatives, as determined by the Director General of the DM, or as assigned to it under the applicable legislation in force in the Emirate.

Chapter Seventeen

Public Health Pest Control

 

Conducting Public Health Pest Control-related Activities

Article (41)

No Person may practise any activity related to Public Health Pest Control in the Emirate, including Placement along the Product Chain of Pesticides, without first obtaining a Public Health Pest Control Permit. This permit will be issued in accordance with the requirements and procedures prescribed by a resolution of the Director General of the Responsible Entity in this respect.

Functions of the Responsible Entity in the Domain of Public Health Pest Control

Article (42)

The Responsible Entity is the competent entity in the Emirate in charge of regulating all matters related to Public Health Pest Control. For this purpose, the Responsible Entity will have the duties and powers to:

1.    control Public Health Pests and provide integrated Public Health Pest Control services using environmental, chemical, biological, mechanical, physical, or any other methods as may be adopted by the Responsible Entity for this purpose;

2.    specify the Public Health Pest Control activities whose practice requires the issuance of a Public Health Pest Control Permit;

3.    issue Permits for the conduct of Public Health Pest Control activities, including Permits for fumigation of materials and products, and termite control, as applicable to each activity;

4.    issue Permits to Workers employed by Public Health Pest Control Establishments;

5.    establish the controls and standards required to be available at the premises of Public Health Pest Control Establishments and their various facilities, based on the permitted activities;

6.    manufacture, import, and register Pesticides;

7.    establish the health, technical, and regulatory conditions and requirements that must be complied with by Public Health Pest Control Establishments, including those related to the storage, transportation, and disposal of Pesticide Containers;

8.    inspect maritime vessels, in coordination with the Competent Authorities, to ensure they are free from Public Health Pests, determine infestation rates if present, and issue health certificates in accordance with World Health Organisation requirements;

9.    conduct laboratory and field testing of Pesticides to evaluate their effectiveness against the target Pest and to determine their impact on Public Health and the Environment, in accordance with the approved procedures in this regard;

10.  accredit Public Health Pest Control Establishments and continuously assess their implemented programmes and operations, in accordance with the approved procedures in this regard;

11.  determine the records that must be maintained by Public Health Pest Control Establishments, and the period for which they must be retained;

12.  monitor and inspect Public Health Pest Control Establishments operating in the Emirate, as well as their Workers, to verify their compliance with the conditions of their issued Permits; the technical requirements, controls, and standards governing their operations, including their Public Health Pest Control activities and Placement along the Product Chain of Pesticides; and their obligations under this Law and the resolutions issued in pursuance hereof;

13.  issue Permits for the Placement along the Product Chain, and sale in retail outlets, of Ready-to-use Pesticides, in accordance with the approved requirements and specifications in this regard;

14.  monitor the Placement along the Product Chain of Ready-to-use Pesticides in retail outlets, to verify their compliance with the conditions and specifications set out in their issued sales Permit;

15.  take all necessary preventive measures for control Public Health Pest Control and prevent their infestation in the Emirate, whether on its own motion or upon the request of the Concerned Entities. These measures include the seizure of goods or materials infested with Public Health Pests, and the closure of storage facilities until such goods or materials are treated, destroyed, or re-exported;

16.  take such precautionary measures and actions it deems appropriate in the event of a violation of the provisions of this Law or the resolutions issued in pursuance hereof, including the seizure, destruction, or disposal by any means it deems appropriate of any equipment, tools, materials, or Containers used, whether directly or indirectly, in committing the violation, in addition to imposing the penalties prescribed by this Law and the resolutions issued in pursuance hereof on the violators;

17.  receive and investigate reports and complaints related to the Public Health Pest Control; and take the necessary measures and actions against those who commit acts that constitute violations of the provisions of this Law and the resolutions issued in pursuance hereof;

18.  cooperate and coordinate with the DHA regarding reports of diseases transmitted to humans by Public Health Pests, and take the necessary measures to eliminate such Pests in infested areas;

19.  cooperate and coordinate with the Concerned Entities in establishing specifications and standards for all aspects of Pesticides, as well as in the development of plans and programmes for the control of Public Health Pests;

20.  conduct scientific studies and research on Public Health Pest Control, publish their findings by such means as it deems appropriate, and take the necessary measures and actions to address those findings;

21.  classify Public Health Pest specimens in accordance with the procedures adopted in this regard;

22.  accredit Workers in the field of Public Health Pest Control, in accordance with the standards adopted by it in this regard.

23.  exercise any other duties or powers related to Public Health Pest Control, as determined by the Director General of the Responsible Entity, or as assigned to it under the applicable legislation in force in the Emirate.

Obligations of Public Health Pest Control Establishments

Article (43)

Subject to liability, a Public Health Pest Control Establishment must:

1.    comply with the provisions of this Law, the resolutions issued in pursuance hereof, the legislation in force in the Emirate, and the conditions of the Public Health Pest Control Permit issued to it;

2.    use Pesticides registered with the Concerned Entity in the UAE, in accordance with the applicable legislation and the instructions of the manufacturer;

3.    maintain a list of the Pesticides used or intended to be used, along with their registration certificates issued by the Competent Authorities;

4.    comply with the health, technical, and regulatory conditions and requirements applicable to Public Health Pest Control Establishments, including those related to its Workers, and the storage, transport, and disposal of Pesticide Containers;

5.    ensure the cleanliness and maintenance of the premises and facilities of the Public Health Pest Control Establishment;

6.    maintain, retain, and manage records in accordance with the procedures and periods prescribed by the Responsible Entity in this regard; and enable the employees of the Responsible Entity, and those authorised by, it to access such records upon request;

7.    ensure the safe disposal of Pesticides that are expired, banned, or not authorised for Placement along the Product Chain in the Emirate, as well as of empty Pesticide Containers, in accordance with the relevant procedures approved by the Responsible Entity;

8.    ensure the adherence to Public Health protection procedures at its affiliated premises and at any sites where it conducts its Public Health Pest Control activities;

9.    refrain from Placement along the Product Chain of any Pesticides in Containers, colouring, or forms that may suggest to the Consumer that they are Food or Consumer Products;

10.  undertake the Placement along the Product Chain of Public Health Pesticides safely and in accordance with the controls approved by the Responsible Entity in this regard, including those related to their transportation from one location to another, in a manner that prevents spillage or dispersion;

11.  qualify and evaluate its Workers in accordance with the standards adopted by the Responsible Entity in this regard;

12.  comply with the technical standards and requirements applicable to the execution of field Public Health Pest Control operations, in accordance with the requirements approved by the Responsible Entity in this regard;

13.  use materials and equipment approved for Public Health Pest Control by the Responsible Entity;

14.  implement the preventive and precautionary measures prescribed by the Responsible Entity;

15.  provide the Responsible Entity and the Concerned Entities with the data and information required; and fully cooperate with, and not obstruct the work of, their employees and those authorised by them;

16.  carry out termite control and stored grain Pest control operations, using appropriate Pesticides in accordance with the instructions issued by the Responsible Entity; and

17.  fulfil with any other obligations related to Public Health Pest Control as may be specified by a resolution issued by the Director General of the Responsible Entity in this regard.

Obligations of Owners and Contractors in the Domain of Public Health Pest Control

Article (44)

a.    A Contractor will, throughout the construction works, be responsible for Public Health Pest Control; for preventing Pest infestation at construction sites; and for ensuring that such sites remain free from Pests at all times.

b.    An Owner will be responsible for Public Health Pest Control in the Built Environment and its surrounding area; for taking all necessary measures to ensure that the Built Environment, its facilities, and appurtenances remain free from such Public Health Pests; for notifying the Responsible Entity upon detection of any Pests and of the measures taken in response; and for engaging either the Responsible Entity or a Public Health Pest Control Establishment to control the infestation.

Chapter Eighteen

Burial of the Deceased and Supervision of Cemeteries

 

Prohibited Acts

Article (45)

No Person may undertake any of the following acts:

1.    burial or cremation of any deceased person at other than the Cemeteries designated or approved by the DM;

2.    burial or cremation of any deceased person at any of the Cemeteries in the Emirate without first obtaining the relevant Permit from the DM; or

3.    burial of a non-Muslim deceased person at Cemeteries designated for Muslims.

Functions of the Concerned Entities

in the Domain of Burial of the Deceased and Supervision of Cemeteries

Article (46)

a.    The DM is the competent entity in the Emirate in charge of all matters related to Burial of the Deceased and Supervision of Cemeteries. For this purpose, the DM will have the duties and powers to:

1.    designate land in the Emirate for establishment of Cemeteries;

2.    establish, manage, protect, supervise, and regulate Cemeteries in the Emirate;

3.    designate areas within Cemeteries for the burial of martyrs;

4.    designate separate facilities for washing the bodies of deceased females, distinct from those designated for deceased males;

5.    designate areas for the burial of human organs;

6.    designate areas for the burial of deceased neonates, young children, and non-viable foetuses;

7.    designate areas for the burial of the deceased who have died from Communicable Diseases or Infectious Diseases; and take the necessary Preventive Measures for their washing and burial;

8.    determine the types of Cemeteries designated for the burial of human remains and the procedures for managing them;

9.    issue Permits for the burial or cremation of the deceased in accordance with the relevant requirements and procedures adopted by DM;

10.  determine the cases in which exemptions from certain requirements prescribed for the issuance of burial or cremation Permits may be granted;

11.  undertake the transport, preparation, washing, and shrouding of the deceased, and their burial in Cemeteries;

12.  ensure that Muslim deceased are buried in accordance with the teachings of Islamic Sharia; that People of the Book are buried in accordance with their respective religious rites; and that others are buried as determined by the DM in coordination with the Concerned Entities;

13.  take the necessary measures to preserve the sanctity of Cemeteries;

14.  maintain and reconstruct graves affected by weather-related damage;

15.  establish rules of conduct during visits to Cemeteries;

16.  determine the types of headstones permitted to be placed on graves;

17.  establish procedures and time frames for relocating Cemeteries, in coordination with the DHA;

18.  establish the rules of conduct during burial of deceased females;

19.  establish procedures for archaeological Cemeteries;

20.  establish procedures for Cemeteries that have reached full capacity;

21.  coordinate with the Concerned Entities to establish procedures for burial in cases of Emergencies, Crises, and Disasters; and

22.  exercise any other duties or powers that are related to the Burial of the Deceased and Supervision of Cemeteries, as determined by the relevant resolution of the Director General of the DM; or that are vested in the DM under the legislation in force in the Emirate.

b.    The DHA will, in coordination with the Concerned Entities, establish the preventive conditions and controls regarding the washing, transportation, embalming, and burial of the persons who have died of Communicable Diseases or Infectious Diseases.

Chapter Nineteen

Final Provisions

 

Management of Health Risks, Emergencies, Crises, and Disasters

Article (47)

To ensure the effective management of health Risks, Emergencies, Crises, and Disasters in the Emirate, the DHA will, in coordination with the Concerned Entities, have the duties and powers to:

1.    develop, and oversee compliance with, strategic plans and general policies for managing health Risks, Emergencies, Crises, and Disasters, as well as Business Continuity, as part of the health Emergency, Crisis, and Disaster Preparedness system which covers Prevention, Preparedness, Response, and Recovery;

2.    develop various plans and scenarios for dealing with health Risks, Emergencies, Crises, and Disasters which may compromise Public Health, and the environment; protect lives and property; and determine the role of the Concerned Entities in implementing the same and ensure their commitment to implementing plans for training on these scenarios;

3.    prescribe the procedures for participating in Response operations in the event of health Emergencies, Crises, and Disasters;

4.    organise training programmes and specialised courses related to all types of health Emergencies, Crises, and Disasters;

5.    manage the strategic medical stock in the Emirate in a manner that ensures capacity to address health Risks, Emergencies, Crises, and Disasters; and

6.    exercise any other duties or powers required to ensure effective management of health Risks, Emergencies, Crises, and Disasters, as determined pursuant to the relevant resolution of the Director General of the DHA, or as vested in the DHA under the legislation in force in the Emirate.

Shared Responsibilities

Article (48)

For the purpose of achieving the objectives of this Law, the Concerned Entities will coordinate and cooperate with one another in respect of the following shared responsibilities:

1.    taking the necessary measures to manage and protect Public Health information and data;

2.    taking the necessary measures to align the strategies and policies adopted at the Emirate level in any of the Public Health Domains with the corresponding strategies and policies adopted at the UAE level;

3.    making services related to Public Health Domains accessible to all members of the community without discrimination;

4.    providing media briefings on all matters related to Public Health Domains, particularly during health Emergencies, Crises, and Disasters;

5.    implementing awareness programmes aimed at promoting health and addressing Risk factors;

6.    mobilising efforts for Emiratisation of the workforce engaged in Public Health Domains;

7.    supporting Public Health-related systems and applications;

8.    supporting research, studies, and surveys that are relevant to Public Health; and

9.    assuming any other shared responsibilities as determined pursuant to the relevant resolutions of the Chairman of the Executive Council.

Violations and Administrative Penalties

Article (49)

a.    Without prejudice to any stricter penalty stipulated in any other legislation, a Person who commits any of the violations stipulated in this Law or the resolutions issued in pursuance hereof will be punished by a fine of not less than five hundred dirhams (AED 500.00) and not more than one million dirhams (AED 1,000,000.00).

b.    The acts that constitute violations of this Law, or the resolutions issued in pursuance hereof, and the relevant fines prescribed for these violations will be determined pursuant to the relevant resolutions issued by the Chairman of the Executive Council.

c.     Upon repetition of the same violation within one (1) year from the date of the previous violation, the amount of the fine imposed on the violator will be doubled. A fine must not exceed two million dirhams (AED 2,000,000.00).

d.    In addition to the penalty of a fine, a Concerned Entity, within its mandate and in coordination with the Competent Authority, may take one or more of the following measures against a violator:

1.    suspension of the violator from conducting his activity for a period not exceeding six (6) months, taking into consideration the impact of this suspension on stakeholders whose interests are connected to the violator’s activity;

2.    closure of the facilities where activities related to Public Health Domains are conducted for a period not exceeding three (3) months;

3.    destruction, seizure, Withdrawal, or re-export of Food and Products that are proven to be in violation of the provisions of this Law or the resolutions issued in pursuance hereof, in accordance with the approved conditions, requirements, controls, standards, specifications, and guidelines; and disposal thereof in such a manner as deemed appropriate, as the case may be;

4.    impounding vehicles proven to be in violation of the provisions of this Law or the resolutions issued in pursuance hereof; and taking the appropriate action in respect thereof in accordance with the legislation in force in the Emirate; and/or

5.    revoking the Permits, approvals, and certificates issued to the violator.

Remedies

Article (50)

A violator who, through his actions or negligence, causes harm to Public Health is liable for remedying the harm or paying compensation for it within the time frame prescribed by the Concerned Entity. If the violator fails to do so, the Concerned Entity may, by using its own resources or engaging third parties, remedy the harm and restore the situation to its original state at the violator’s expense, in addition to twenty percent (20%) of the relevant costs and expenses as administrative fees. The Concerned Entity will estimate these costs, and its estimation will be final.

Law Enforcement

Article (51)

Employees of the Concerned Entities, designated pursuant to a resolution of the official in charge of the Concerned Entity, each within his area of competence, and the persons authorised by the Concerned Entities, will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Law and the resolutions issued in pursuance hereof. For this purpose, they may issue the necessary violation reports; and, where necessary, seek the assistance of police personnel.

Grievances

Article (52)

Any affected party may submit a written grievance to the official in charge of the Concerned Entity against the decisions, procedures, or measures taken against him in accordance with the provisions of this Law and the resolutions issued in pursuance hereof, within fifteen (15) days from the date of being notified of the contested decision, procedure, or measure. The grievance will be determined by a committee formed by the official in charge of the Concerned Entity for this purpose, within thirty (30) days from the date of its submission, and the decision issued by the committee on the grievance will be final.

Coordination and Cooperation

Article (53)

All Government Entities and non-government entities in the Emirate must fully cooperate with the Concerned Entities to enable them to perform their respective functions under this Law, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate; and must, upon request, provide the Concerned Entities with all forms of support. This includes exchange of data and statistics related to any of the Public Health Domains governed by the provisions of this Law and the resolutions issued in pursuance hereof.

Outsourcing

Article (54)

The Concerned Entity may, in accordance with the legislation in force, outsource any of its duties and powers under this Law and the resolutions issued in pursuance thereof to any public or private entity pursuant to an agreement concluded for this purpose. This agreement will provide for the rights and obligations of both parties.

Fees

Article (55)

In return for issuing Permits, certificates, and approvals, and for providing other services that fall within its mandate, and are subject to this Law and the resolutions issued in pursuance hereof, the Concerned Entity will collect the fees and charges as prescribed by a relevant resolution of the Chairman of the Executive Council.

Payment of Fees and Fines

Article (56)

Fees, fines, costs, charges, and expenses collected pursuant to this Law and the resolutions issued in pursuance hereof will be paid to the Public Treasury of the Government of Dubai.

Suspension and Relaxation of Requirements

Article (57)

The Director General of the Responsible Entity or the Director General of the DHA, each within his respective functions, may, where required for the public interest and subject to the controls adopted by him in this regard, suspend or relax some of the requirements, conditions, or standards stipulated in this Law and the resolutions issued in pursuance hereof, to the extent that this suspension or relaxation does not compromise Public Health.

Issuing Implementing Resolutions

Article (58)

With the exception of the resolutions which the Chairman of the Executive Council is exclusively authorised to issue under this Law, the officials in charge of the Concerned Entities, each within his respective mandate, will issue the resolutions required for implementing the provisions of this Law. These resolutions will be published in the Official Gazette.

Repeals

Article (59)

Any provision in any other legislation is hereby repealed to the extent that it contradicts the provisions of this Law.

Publication and Commencement

Article (60)

This Law will be published in the Official Gazette and will come into force ninety (90) days after the date of its publication.
