We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Federal Law by Decree No. (35) of 2023 Concerning the Union-owned Properties;

Federal Law by Decree No. (35) of 2024 Concerning the Reorganisation of the Civil Defence Authority;

Cabinet Resolution No. (24) of 2012 Regulating Civil Defence Services in the United Arab Emirates and its amendments;

Law No. (5) of 1995 Establishing the Department of Finance;

Law No. (21) of 2008 Concerning Pensions and Social Security of Local Paramilitary Personnel of the Government of Dubai and its amendments;

Law No. (6) of 2012 Concerning Management of the Human Resources of Local Paramilitary Personnel in the Emirate of Dubai and its amendments;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai, its Implementing Bylaw, and their amendments;

Law No. (8) of 2018 Concerning Management of the Government of Dubai Human Resources and its amendments;

Law No. (12) of 2020 Concerning Contracts and Warehouse Management in the Government of Dubai;

Law No. (26) of 2023 Concerning the Executive Council of the Emirate of Dubai;

Decree No. (29) of 2013 Appointing the Deputy Chief of Police and General Security in the Emirate of Dubai;

Decree No. (4) of 2021 Establishing the Supreme Committee of Emergency, Crisis, and Disaster Management in the Emirate of Dubai;

Decree No. (39) of 2023 Concerning the Methodology for Approving Organisational Structures of Paramilitary Departments in the Emirate of Dubai;

Decree No. (60) of 2023 Regulating the Transfer of Employees in the Government of Dubai; and

Resolution No. (19) of 2013 Approving the Line of Command Structure of the Paramilitary Departments of the Government of Dubai,

Do hereby issue this Law.

Title of the Law

Article (1)

This Law will be cited as "Law No. (4) of 2025 Establishing the Dubai Civil Defence General Command".

Definitions

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Ruler:

His Highness the Ruler of Dubai.

Government:

The Government of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

DOF:

The Department of Finance in the Emirate.

Chief:

The Chief of Police and General Security in the Emirate.

Deputy Chief:

The Deputy Chief appointed pursuant to the above-mentioned Decree No. (29) of 2013.

SCCDM:

The Supreme Committee of Emergency, Crisis, and Disaster Management in the Emirate of Dubai.

CDGC:

The Civil Defence General Command in the Emirate established under this Law.

Commander-in-Chief:

The Commander-in-Chief of Civil Defence in the Emirate.

Civil Defence:

The safeguarding and protection of lives, property, Public Facilities, public and private projects, and national sources of wealth during times of peace, armed conflict, and major Incidents; the provision of relief to those affected; and coordination with the Concerned Entities to ensure the safety of transport and communications networks, and the continuous and uninterrupted operation of Public Facilities and Critical Infrastructure.

Civil Defence Measures:

The set of preventive actions, measures, and procedures, undertaken by the CDGC to prevent fires and to safeguard lives, property, Public Facilities, public and private projects, and national sources of wealth.

Concerned Entity

Any Government Entity or non-government entity in the Emirate that plays a role in providing support to the CDGC and CDGC Stations in Incident Response and management.

CDGC Stations:

The fire and rescue stations of the CDGC established in various areas of the Emirate in accordance with their respective functions.

Incident:

This includes any Risks, Emergencies, Crises, and Disasters.

Risk:

An Incident or series of Incidents which may occur naturally or be man-made, whether caused by mistake; as a result of negligence or failure to follow proper procedures; or due to the existence of vulnerabilities which lead to the occurrence of an Emergency, Crisis, or Disaster, causing material or moral harm to members of the community, including injuries, fatalities, property loss, or environmental, economic, social, and health damage, requiring increased operational readiness by the CDGC.

Emergency:

A major Incident or series of Incidents which cause substantial harm to life or Property; compromise Public Order, the continuity of Government operations, human health, the environment, or the economy; and require special mobilisation in coordination with the Concerned Entities.

Crisis:

An Incident or series of Incidents which are more complicated than an Emergency; which compromise the stability of a large segment of society; and which undermine the ability of the Government to perform its duties.

Disaster:

An Incident or series of Incidents which have occurred and caused significant damage, and from which recovery requires the cooperation of the Government, Government Entities, and individuals.

Volunteer:

A natural person who, voluntarily or upon the CDGC’s invitation, participates in Civil Defence activities during times of peace, armed conflict, or the occurrence of Incidents; and who is trained at a CDGC Station and by the Concerned Entities to assist in rescue operations, relief of victims, and Disaster management.

Preventive Safety Requirements:

The requirements that must be fulfilled for the protection against fire Hazard, prevention of fires, and firefighting, as well as for Disaster Response and mitigation to safeguard lives and property.

Public Facility:

Any project established or managed by the UAE or the Emirate, which operates regularly and continuously, and relies on public authorities in fulfilling the public needs, with the aim of contributing to maintaining public order and serving the public interest.

Establishments:

This includes Buildings; residential complexes; hotels and hotel apartments; banks, financial institutions, and money exchange outlets; gold and jewellery shops; sports and cultural clubs; shopping and entertainment centres; hospitals and clinics; warehouses and storage facilities designated for the safekeeping of valuables or hazardous materials as specified by the CDGC; fuel stations; and any other establishments designated pursuant to a resolution of the Commander-in-Chief.

Critical Infrastructure:

Establishments of political, economic, or social significance, whether owned by the UAE, the Emirate, or individuals, as designated pursuant to a resolution of the Commander-in-Chief.

Shelter Sites:

A public or private Building equipped with essential services, temporarily designated for use during Emergencies, Crises, or Disasters to provide individuals with necessary care and protection.

Evacuation:

The relocation of individuals, for reasons of public safety, to safe locations during Disasters, Crises, or other threats.

Preparedness:

Taking measures to prepare the resources, capabilities, and plans required to respond to anticipated Emergencies, Crises, and Disasters. This includes the preparation and coordination of Response plans and associated training.

Response:

The measures taken during Emergencies, Crises, or Disasters to mitigate their adverse effects and to ensure the provision of the necessary support to the community.

Establishment of the CDGC

Article (3)

Pursuant to this Law, a Government Department named the “Dubai Civil Defence General Command” is established. The CDGC will have legal personality and the legal capacity required to undertake the acts and dispositions that ensure the achievement of its objectives. The CDGC is affiliated to the Chief.

CDGC Headquarters

Article (4)

The headquarters of the CDGC will be located in the Emirate. CDGC Stations may be established within the Emirate pursuant to a resolution of the Commander-in-Chief.

Objectives of CDGC

Article (5)

The CDGC will have the following objectives:

1.    to maintain the safety of the community, protect lives and property, and safeguard national sources of wealth by providing proactive, smart, and innovative services that enhance the quality of life within the community;

2.    to promote the concepts of sustainable safety, protection, and readiness services; effective Response; and operational efficiency in managing Incidents, in order to make the city safer and more secure, in line with international best practices;

3.    to raise community awareness and foster a culture of prevention, instilling the concept of protection against Risks, Disasters, and Crises through smart methods, and to encourage volunteering in Civil Defence activities;

4.    to improve the efficiency of prevention resources and preventive safety measures; and strengthen the Emirate’s position as a global leader in the protection of lives and property;

5.    to efficiently and effectively manage and invest in institutional talents and resources; to support the UAE national professional cadre; and to enhance the professionalism of firefighters and rescue teams, all with a view to enhancing the protection and safety of the community against various Risks;

6.    to enhance institutional competitiveness, innovation, and future readiness by applying advanced technologies for preventive safety, thereby attaining global leadership in fire prevention and in the protection of lives and property; and

7.    to cooperate with the Concerned Entities to ensure business continuity, the sustained provision of Public Facility services, and the restoration of normality in areas affected by Incidents.

Functions of the CDGC

Article (6)

a.    The CDGC is the competent official entity in the Emirate in charge of all measures and actions required to safeguard lives, property, and national sources of wealth; to ensure community safety and civil protection; to prevent and mitigate Risks and Disasters; and to undertake Disaster recovery, during times of peace or armed conflict, across all areas of the Emirate, including in special development zones and free zones, such as the Dubai International Financial Centre.

b.    For the purpose of achieving its objectives, the CDGC will, in coordination and cooperation with the Concerned Entities, perform the duties and functions assigned to the Directorate General of Civil Defence in Dubai under the legislation in force in the Emirate. In particular, the CDGC will have the duties and powers to:

1.    develop, supervise, and follow up the implementation of, the Civil Defence general policy and strategic plans;

2.    approve various Civil Defence plans and scenarios aimed at achieving public safety, providing civil protection, and safeguarding lives, property, and national sources of wealth;

3.    prepare Emergency plans and protocols for protection against Disaster, and adopt the best available methods in this regard;

4.    develop, implement, and oversee the implementation of, operational firefighting plans and Civil Defence Measures; develop advanced Civil Defence training plans; and provide the necessary resources to ensure their success;

5.    coordinate and cooperate with the SCCDM and other entities concerned with Civil Defence on the identification of Risks, Emergencies, Crises, and Disasters; and determination of their classification levels, as well as the Preventive Measures and Incident Preparedness, in accordance with the mechanisms and procedures applicable in this regard;

6.    establish, equip, and maintain the CDGC Stations and their affiliated operations rooms, to ensure they undertake the measures and actions stipulated in this Law, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate; implement Civil Defence Measures; adopt all necessary preventive and precautionary measures; and provide CDGC Stations and their affiliated operations rooms with the latest smart technologies, firefighting resources and equipment, ensuring their sustained functionality;

7.    ensure the readiness and preparedness of CDGC Stations to respond to all types of Incidents;

8.    coordinate with the SCCDM on the assessment of the Emirate's situation during Incidents; determine the appropriate course of action to manage the same; take all appropriate measures and precautions; and issue the necessary resolutions in this respect;

9.    conduct studies on Civil Defence operations and develop plans to improve Civil Defence tasks and procedures across the Emirate;

10.  take all necessary measures to prevent and control fires and mitigate other Risks; carry out firefighting, rescue, and rapid intervention operations to suppress Incidents before escalation; minimise human and material losses; and evacuate citizens, residents, and the public from affected areas;

11.  approve safety requirements and Preventive Safety Requirements for Establishments, Public Facilities, Critical Infrastructure, Buildings, and other facilities;

12.  supervise key Civil Defence processes and procedures implemented at CDGC Stations and their affiliated operations rooms;

13.  prescribe general conditions and specifications for the establishment of public and private Evacuation sites and Shelter Sites in line with international best practices; manage and supervise these sites; and verify their readiness for use at all times;

14.  regulate early detection fire alarm systems in the Emirate and ensure that Establishments, Public Facilities, Critical Infrastructure, and Buildings are connected to the approved electronic systems of the CDGC and CDGC Stations;

15.  designate areas where some or all Civil Defence Measures are to be implemented, and determine the priorities for their implementation during Incidents;

16.  verify the effectiveness of the Civil Defence Measures and systems used in Establishments, Public Facilities, Critical Infrastructure, and Buildings in responding to Incidents and fires;

17.  ensure compliance by the Concerned Entities and their cooperation in meeting security requirements and Preventive Safety Requirements;

18.  conduct preventive inspections of Establishments, Public Facilities, Critical Infrastructure, and Buildings to verify:

a.     the provision and implementation of security measures and Preventive Safety Requirements;

b.     the fulfilment and completion of Civil Defence requirements and conditions; and

c.     the validity and operational status of fire prevention, protection, and firefighting systems;

19.  train and prepare of individuals responsible for firefighting and fire control operations;

20.  supervise Civil Defence awareness plans and programmes for community members, and train Volunteers and volunteer teams from the public and private sectors in Civil Defence;

21.  propose legislation relating to Civil Defence matters, and the bylaws, resolutions, and regulations governing the work of the CDGC and CDGC Stations;

22.  approve the establishment of fuel stations and authorise the conduct of activities related to the distribution of petroleum products, natural gas, and liquefied gas, including associated depots, storage areas, and means of transport and distribution, verifying compliance with the Preventive Safety Requirements and protection protocols approved by the CDGC;

23.  review the infrastructure plans for Establishments, Public Facilities, Critical Infrastructure, and Buildings referred to it by the Concerned Entities, competent commercial licensing authorities, and building permit issuing authorities to verify compliance with Preventive Safety Requirements; ensure the provision of fire prevention and passive fire protection systems in accordance with the relevant specifications and requirements adopted by the CDGC; and monitor compliance following the issuance of final permits to ensure ongoing adherence;

24.  verify that Establishments, Public Facilities, Critical Infrastructure, Buildings, and other facilities are compliant with Preventive Safety Requirements and conditions, and are equipped with passive fire-protection systems, and fire detection, alarm, and suppression systems;

25.  establish and implement Preventive Safety Requirements for events and activities held across the Emirate; secure such events; and provide inspection and firefighting teams;

26.  develop and implement Evacuation drill plans for Establishments, Public Facilities, Critical Infrastructure, Buildings, and other facilities in accordance with the relevant Preventive Safety Requirements approved by the CDGC;

27.  own, take lease of, and manage the real property, movables, materials, equipment, devices, systems, and other assets as required to enable the CDGC to exercise its functions and perform its work; and ensure their optimal utilisation;

28.  establish, solely or in partnership with other persons, companies, and corporations to implement the projects and programmes that enable it to exercise its legally mandated functions, in accordance with the legislation in force in the Emirate;

29.  join international, regional, and local organisations; and organise and participate in international, regional, and local events and conferences in fields related to the functions of the CDGC and Civil Defence;

30.  seek, as it deems appropriate, the assistance of experts and specialists in areas related to Civil Defence, whether from the concerned government entities within or outside of the Emirate or from the private sector; and

31.  exercise any other duties or powers related to Civil Defence, as assigned to it by the Ruler or the Chief.

CDGC Emblem

Article (7)

The CDGC will have its own distinctive emblem, proposed by the Commander-in-Chief and approved by the Chief and the Ruler. The Commander-in-Chief may also approve a subsidiary emblem for specific CDGC Stations, provided that the subsidiary emblem maintains a visual connection to the main emblem of the CDGC, and is used for media, social, cultural, or similar purposes.

Uniform

Article (8)

a.       The CDGC will have a uniform for its Staff Members, the design and regulations of which will be approved by the Commander-in-Chief, who will determine the occasions on which the uniform must be worn.

b.       The CDGC will bear the cost of providing the uniform, paramilitary kit, and related standard-issue items to its Staff Members.

Executive Body of the CDGC

Article (9)

a.    The executive body of the CDGC will comprise the Commander-in-Chief, Deputy Commander-in-Chief, assistants to the Commander-in-Chief, and the directors of the general directorates of the CDGC, together with a number of Staff Members and civilian administrative, finance, and technical Employees.

b.    Staff Members will be subject to the provisions of the above-mentioned Law No. (6) of 2012, while the civilian Employees will be subject to the provisions of the above-mentioned Law No. (8) of 2018.

Commander-in-Chief

Article (10)

a.       The Commander-in-Chief will be appointed pursuant to a decree of the Ruler.

b.       The Commander-in-Chief will be directly responsible to the Chief for performing the duties assigned to him under this Law, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate; and for performing any other duties assigned to him by the Ruler or the Chief.

Functions of the Commander-in-Chief

Article (11)

a.       The Commander-in-Chief will supervise the work and activities of the CDGC; manage its affairs; and represent it in its relations with third parties. For these purposes, the Commander-in-Chief will have the duties and powers to:

1.    propose, in coordination with the Concerned Entities in the Emirate, the general policy and the strategic and development plans of the CDGC, including the general Civil Defence policy; present the same to the Chief for approval; and follow up their implementation;

2.    propose the policies, strategies, and initiatives in support of Civil Defence; review them in consultation with the Concerned Entities in the Emirate; and submit the same to the Chief for approval;

3.    approve the initiatives, programmes, projects, studies, and recommendations that relate to the work and activities of the CDGC, and that contribute to achievement of its objectives;

4.    approve and review the work plans and programmes of the CDGC, and assess their applicability on an annual basis;

5.    prepare the draft annual budget and Financial Statements of the CDGC, and present the same to the Concerned Entities in the Emirate for approval;

6.    submit periodic reports to the Chief on the implementation of the approved general policies, strategies, and initiatives; and on the performance indicators and programmes related to implementation of the Civil Defence strategic plans of the Emirate; as well as annual performance reports on the work and activities of the CDGC;

7.    supervise the daily operations of the CDGC, as well as its civilian Employees and Staff Members; and appoint the technical and administrative personnel required to carry out the functions of the CDGC in accordance with the legislation in force in the Emirate;

8.    propose the Organisational Structure of the CDGC and submit the same to the Chief for approval, in accordance with the relevant adopted Methodology for approving Organisational Structures of Paramilitary Entities in the Emirate;

9.    approve the bylaws and resolutions regulating the administrative, financial, and technical work of the CDGC;

10.  propose fees and charges for the services provided by the CDGC, and submit the same to the competent entities in the Emirate for approval;

11.  conclude contracts, agreements, and memoranda of understanding with others, as required for the achievement of the CDGC’s objectives and for enabling it to perform its duties and functions;

12.  form permanent and temporary specialised committees and work teams; and determine their duties and powers; and

13.  exercise any other duties or powers required for the achievement of the objectives of the CDGC and for enabling it to perform its duties and functions under this Law, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate, as assigned or delegated to him by the Chief.

b.       The Chief may delegate any of his powers under paragraph (a) of this Article, or under any other provision of this Law, to the Deputy Chief or the Commander-in-Chief, provided that such delegation is specific and in writing.

c.       The Commander-in-Chief may delegate any of his duties and powers under paragraph (a) of this Article, or under any other provision of this Law, to the Deputy Commander-in-Chief, to any of the assistants to the Commander-in-Chief, to any of the directors of general CDGC directorates, to any of the heads of CDGC Stations, or to any member of the executive leadership of the CDGC, provided that such delegation is specific and in writing.

CDGC Stations

Article (12)

A CDGC Station is hereby mandated to exercise the duties and powers to:

1.    carry out the measures and actions stipulated in this Law;

2.    implement, in cooperation and coordination with the Concerned Entities, Civil Defence Measures and adopt all preventive and precautionary measures necessary to avert Risks or mitigate their impact;

3.    develop the plans and projects required for the implementation of the approved Civil Defence policy, and follow up on these plans and projects;

4.    prepare, in coordination with the Concerned Entities, Civil Defence services and other services required to address potential Risks and Disasters;

5.    analyse potential Risks that fall within the CDGC Station’s jurisdiction through the on-site inspections conducted by specialised work teams;

6.    ensure Civil Defence Measures are in place at all events organised by Government Entities or private entities that fall within the CDGC Station’s jurisdiction;

7.    conduct Evacuation drills for Establishments, Public Facilities, Critical Infrastructure, Buildings, and other facilities, in accordance with the relevant approved Preventive Safety Requirements; and

8.    exercise any other duties or powers related to Civil Defence, as assigned or delegated to it by the Commander-in-Chief.

Civil Defence Measures

Article (13)

Civil Defence Measures include the following:

1.    prescribing the regulations governing fire protection, fire alarm, and firefighting systems;

2.    preparing and installing the necessary tools, systems, machinery, devices, and equipment required for Civil Defence operations;

3.    establishing and equipping CDGC Stations and their affiliated operations rooms;

4.    stockpiling materials, tools, medicines, and disinfectants required for Civil Defence operations;

5.    implementing Evacuation plans for areas and neighbourhoods within the Emirate, where circumstances so warrant;

6.    coordinating and cooperating with the Concerned Entities to restore normality to areas affected by Disasters, and to reinstate disrupted services in public and private facilities;

7.    establishing, preparing, and allocating public and private Evacuation sites and Shelter Sites, in coordination with the Concerned Entities, and verifying their readiness for use at all times;

8.    developing awareness programmes to educate the population on precautionary measures and their responsibilities in maintaining their safety in the event of Incidents; and

9.    undertaking any other measures determined pursuant to the relevant resolution of the SCCDM.

Disaster Response Procedures

Article (14)

In the event of a Disaster, or where circumstances indicate a high likelihood of its occurrence, the following procedures will apply:

1.    The SCCDM will declare the commencement of a state of Emergency, and will declare its termination upon cessation of the circumstances giving rise thereto.

2.    Civil Defence Measures will be implemented, following the required procedures, in coordination with the Concerned Entities.

3.    The Chairman of the SCCDM will issue the necessary resolutions to the temporarily requisition the real property and movables belonging to others, as required by the Emergency, and to the extent necessary to carry out Civil Defence Measures and operations. This requisition must be temporary and subject to payment of fair compensation. The provisions of the legislation regulating compulsory acquisition of property for public benefit in force in the Emirate will apply.

4.    The CDGC and CDGC Stations will be granted the right of use over real property and Establishments, as necessary to carry out Civil Defence Measures and operations, in return for the payment of fair compensation. Owners, occupiers, usufructuaries, or possessors of such property or Establishments may not undertake any action that would impede the exercise of this right of use.

5.    The CDGC will undertake immediate intervention to minimise human and material losses, in coordination with the Concerned Entities.

6.    Civil Defence requirements procured by way of direct procurement, notwithstanding the provisions of the above-mentioned Law No. (12) of 2020.

7.    Materials and equipment necessary to sustain life and provide relief to affected individuals will be stockpiled and stored under supervision.

8.    Public and private Evacuation sites and Shelter Sites will be used to accommodate the population, in accordance with the relevant approved plans and in cooperation and coordination with the Concerned Entities.

9.    Immediate intervention will be undertaken to assist the Concerned Entities in preparing public and private hospitals, field hospitals, medical centres, and other suitable facilities to receive and administer first aid to the injured.

10.  Civilian Employees, Staff Members, or other individuals will be assigned, as deemed appropriate, to participate in Civil Defence operations. Any person so assigned will be deemed seconded from his original employer, which will continue to pay his salary, allowances, and employment benefits for the duration of the assignment.

11.  Any other measures determined pursuant to the relevant resolution issued by the Chief or the Chairman of the SCCDM will be taken.

Preventive Safety Requirements

Article (15)

a.       An Establishment, Public Facility, Critical Infrastructure, Building, and any other facility designated by a resolution of the Commander-in-Chief must appoint or assign an experienced and specialised individual, as deemed appropriate, to be in charge of implementing all Preventive Safety Requirements within those Establishments, Public Facilities, and Buildings. The appointed individual will act as liaison between this Establishment, Public Facility, or Building and the CDGC or CDGC Stations, and will be responsible for developing and implementing internal plans to address potential Risks within the Establishment or Building, and for keeping its occupants informed, in cooperation and coordination with the CDGC and CDGC Stations.

b.       The Establishments, Public Facilities, Critical Infrastructure, Buildings, and other facilities referred to in paragraph (a) of this Article must comply with the standards and conditions prescribed by the CDGC for the appointment of individuals in charge of implementing the Preventive Safety Requirements.

Duties of Licensing Authorities and Insurance Companies

Article (16)

a.    All competent licensing authorities in the Emirate must ensure that no licence, permit, or approval is issued or renewed to any Person unless the applicant provides a valid official certificate issued by the CDGC confirming compliance with the Preventive Safety Requirements.

b.    Insurance companies operating in the Emirate may not provide insurance coverage for any Building, Establishment, or facility against fire Risks unless the insured party provides a valid official certificate issued by the CDGC confirming compliance with the Preventive Safety Requirements.

Obligations of Owners

Article (17)

Owners of Establishments, Public Facilities, Critical Infrastructure, Buildings, and other facilities must:

1.    carry out regular maintenance of fire prevention systems;

2.    ensure the provision of security and safety measures and compliance with the Preventive Safety Requirements prescribed by the CDGC;

3.    refrain from any act or omission that may constitute a breach the security and safety requirements or the Preventive Safety Requirements;

4.    notify the CDGC within the time frame it determines, and obtain its approval, regarding any modification to the Establishment, Facility, or Building that may affect the Preventive Safety Requirements; and

5.    fulfil any other obligations determined pursuant to the relevant resolution of the Commander-in-Chief.

Establishment of Civil Defence Stations

Article (18)

Civil Defence stations will be established within airports, free zones, ports, industrial cities, and special development zones, and will be equipped with preventive safety systems and passive fire protection systems and equipment in accordance with the specifications set by the CDGC. The distribution plans for the stations and the instructions for their establishment will be approved pursuant to a resolution of the Chairman of the Executive Council.

Trading in Systems, Equipment, Devices, and Machinery

Article (19)

a.    No natural or legal person may trade in, or otherwise deal with, systems, equipment, devices, tools, and machinery necessary for Civil Defence operations without first obtaining the approval of the CDGC, which will be issued after verifying the availability and conformity of the systems, equipment, and tools with international standards.

b.    The installation or maintenance of the systems, equipment, and devices referred to in paragraph (a) of this Article will not be carried out without first obtaining the approval of the CDGC, and such installation and maintenance will be supervised by specialists and technicians licensed by the CDGC.

c.     Without prejudice to any applicable civil or criminal liability, all systems, detectors, machinery, equipment, devices, and tools related to preventive safety that are installed in Buildings, Establishments, and facilities will be deemed exclusively designated for Civil Defence purposes. It is prohibited to relocate, disconnect, remove, damage, fail to maintain, or modify any of these systems, alarms, machinery, equipment, devices, or tools. Any Person in violation of this Article will be required to restore the situation to its original state and will bear all incurred expenses and costs, as well as any compensation arising therefrom.

d.    The Commander-in-Chief will issue a resolution specifying the systems, equipment, devices, machinery, and tools necessary for Civil Defence operations.

Outsourcing CDGC Functions

Article (20)

With the exception of the powers, functions, and responsibilities vested in it in respect of Civil Defence and developing and drafting the policies and legislation that fall within its mandate under this Law, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate, the DCGC may outsource, in accordance with the legislation in force in the Emirate, any of its other powers, functions, and responsibilities under this Law to any public or private entity pursuant to an agreement concluded with that entity for this purpose. This agreement will state the rights and obligations of the DCGC and the contracted entity, as well as the conditions, requirements, and specifications that the entity must observe when performing the functions outsourced to it by the DCGC.

Inspection of Establishments and Facilities

Article (21)

a.    Staff Members of the CDGC and other Employees engaged in preventive safety and firefighting will be authorised to conduct inspections of Establishments, Public Facilities, Critical Infrastructure, Buildings, and other facilities to verify the adequacy and effectiveness of fire protection, fire detection and prevention, and firefighting systems; the availability of Evacuation sites and Shelter Sites; and compliance with all Preventive Safety Requirements.

b.    Staff Members of the CDGC are hereby authorised, during firefighting operations and for the purpose of protecting lives and property, to access Establishments, Public Facilities, Critical Infrastructure, Buildings, and other facilities without a prior permission.

General Call-up

Article (22)

a.    The Commander-in-Chief may issue a general call-up to all personnel of the CDGC and CDGC Stations, including Staff Members, civilian personnel, and Volunteers, to raise the operational readiness of the CDGC and enable these persons to assume their positions to respond to Incidents.

b.    In the event of the death of any personnel of the CDGC or CDGC Station while performing Civil Defence operations, these personnel will be deemed as a Martyr killed in the line of duty, and the entitlements prescribed for Martyrs under the applicable legislation will be disbursed.

Law Enforcement

Article (23)

The CDGC Employees nominated pursuant to a resolution of the Commander-in-Chief will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Law and the resolutions issued in pursuance hereof. For this purpose, they may issue the necessary violation reports; and, where necessary, seek the assistance of police personnel.

Cooperation with the CDGC

Article (24)

All individuals, Government Entities, non-government entities, and public-benefit entities must fully cooperate with the CDGC and CDGC Stations; meet its requirements; and provide it with all the data, information, documents, statistics, reports, and studies it requests, to enable it to achieve its objectives, implement Civil Defence Measures, and exercise its functions under this Law, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate.

International Cooperation and Coordination

Article (25)

a.    The CDGC may coordinate with international, regional, federal, and local entities in areas related Civil Defence.

b.     The CDGC may, in accordance with legislation in force, conclude agreements and memoranda of understanding with external entities or join any regional or international organisations that specialise in areas related to Civil Defence and to the work of the CDGC.

Submitting Periodic Reports

Article (26)

The CDGC will submit to the Chief and the SCCDM periodic reports, including reports on potential Incidents and those that have occurred in the Emirate. Such reports must contain the outcomes of the work, activities, and achievements of the CDGC, the obstacles and challenges it encounters, and the relevant solutions and proposals recommended by the CDGC, in order for the Chief and the SCCDM to take the appropriate action in respect thereof.

Fees

Article (27) 

In return for issuing certificates and providing services under this Law and the resolutions issued in pursuance hereof, the CDGC will collect the fees prescribed by the relevant resolution of the Chairman of the Executive Council. The revenue collected by the CDGC under this Law will be paid to the Public Treasury of the Government.

Violations and Administrative Measures

Article (28)

a.    Without prejudice to any stricter penalty stipulated in any other legislation, a Person who violates this Law or the resolutions issued in pursuance hereof will be punished by a fine of no less than one thousand dirhams (AED 1,000.00) and no more than one million dirhams (AED 1,000,000.00). The Chairman of the Executive Council will determine, pursuant to a relevant resolution issued by him, the acts that constitute violations and the fines, penalties, and administrative measures to be imposed on violators.

b.    Upon repetition of the same violation within one (1) year from the date of the previous violation, the amount of the fine referred to in paragraph (a) of this Article will be doubled. The fine must not exceed two million dirhams (AED 2,000,000.00).

Financial Resources of the CDGC

Article (29)

The financial resources of the CDGC will consist of:

1.    the financial appropriations allocated to the CDGC in the General Budget of the Government;

2.    the movable and immovable property allocated to the CDGC by the Government;

3.    the fees and charges for the services provided by the CDGC or CDGC Stations; and

4.    any other resources approved by the Chief.

Accounts and Financial Year of the CDGC

Article (30)

a.    In managing its accounts and records, the CDGC will apply the rules and principles of government accounting.

b.    The Financial Year of the CDGC will commence on 1 January and will end on 31 December of the same Year, except that the first Financial Year will commence on the date on which this Law comes into force and will end on 31 December of the following Year.

Transfer and Succession

Article (31)

a.    As of the date on which this Law comes into force, the following will be transferred to the CDGC:

1.    the ownership of the real property, movables, assets, systems, devices, equipment, and funds of the Directorate General of Civil Defence in Dubai and its stations that are relevant to Civil Defence and the functions mandated to the CDGC under this Law, in accordance with the provisions of the above-mentioned Federal Law by Decree No. (35) of 2023 and other legislation in force in the Emirate;

2.    civilian Employees and Staff Members working at the Directorate General of Civil Defence in Dubai as at the effective date of this Law, including the financial appropriations allocated to these Employees and Staff Members by the Department of Finance, in accordance with the provisions of the above-mentioned Law No. (1) of 2016, Decree No. (60) of 2023, and other legislation in force in the Emirate. This transfer must be made in coordination with the Department of Finance and the concerned federal entities, without prejudice to their existing rights; and

3.    the financial appropriations allocated by the Department of Finance to the Directorate General of Civil Defence in Dubai.

b.    The emblem of the CDGC and the uniform of its Staff Members in use on the date on which this Law comes into force will continue to be used until the new official emblem and uniform are approved in accordance with Articles (7) and (8) of this Law.

c.     The legislation relating to Civil Defence matters and regulating Civil Defence work, that is in force on the effective date of this Law, will continue in force to the extent that it does not contradict the provisions of this Law, until new superseding legislation is issued.

Issuing Implementing Resolutions

Article (32)

With the exception of the resolutions that the Chief, Chairman of the Executive Council, or Chairman of the SCCDM is exclusively authorised to issue under this Law, the Commander-in-Chief will issue the resolutions required for the implementation of the provisions of this Law, including those relating to:

1.    Civil Defence requirements;

2.    conditions and requirements for fire prevention systems;

3.    fire alarm systems; and

4.    any other matters relating to Civil Defence operations.

Repeals

Article (33)

Any provision in any other legislation will be repealed to the extent that it contradicts the provisions of this Law.

Publication and Commencement

Article (34)

This Law will be published in the Official Gazette and will come into force on the day on which it is published.
