Concerning the

Dubai Industry and Export Development Corporation[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Federal Law No. (1) of 1979 Regulating Industrial Affairs and its Implementing Bylaw;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (25) of 2008 Concerning the Department of Economic Development;

Law No. (34) of 2009 Concerning the Dubai Export Development Corporation;

Law No. (13) of 2011 Regulating the Conduct of Economic Activities in the Emirate of Dubai and its amendments;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai;

Decree No. (22) of 2009 Concerning Special Development Zones in the Emirate of Dubai;

Executive Council Resolution No. (10) of 2016 Approving the Organisational Structure of the Department of Economic Development; and

The legislation establishing and regulating free zones in the Emirate of Dubai,

Do hereby issue this Law.

Title of the Law

Article (1)

This Law will be cited as "Law No. (3) of 2021 Concerning the Dubai Industry and Export Development Corporation".

Definitions

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

DED:

The Department of Economic Development.

Director General:

The director general of the DED.

DIEDC:

The Dubai Industry and Export Development Corporation.

CEO:

The chief executive officer of the DIEDC.

Programme:

The Industry and Export Development and Promotion Programme.

Economic Activity:

Any commercial, industrial, artisan, occupational, agricultural, service, or other for-profit activity licensed in the Emirate in accordance with the legislation in force.

Establishment:

Any company or sole proprietorship licensed to conduct an Economic Activity. This includes companies and corporations licensed to operate within Special Development Zones and free zones.

Scope of Application

Article (3)

a.    The provisions of this Law apply to the Dubai Export Development Corporation regulated by the above-mentioned Law No. (34) of 2009, as a public corporation having legal personality and affiliated to the DED.

b.    The name “Dubai Export Development Corporation” wherever mentioned in any other legislation in force in the Emirate is hereby replaced by the name “Dubai Industry and Export Development Corporation”.

Head Office of the DIEDC

Article (4)

The head office of the DIEDC will be located in the Emirate. The DIEDC may, pursuant to a resolution of the Director General, establish branches and offices within and outside of the Emirate.

Objectives of the DIEDC

Article (5)

The DIEDC will have the following objectives:

1.    to promote the Emirate as a global hub for export and re-export, and for knowledge-, innovation-, and sustainability-based industries;

2.    to develop the exports of the Emirate; and to build the capacity, and enhance the competitive edge, of the industrial sector of the Emirate in local, regional, and international markets;

3.    to encourage investment in the industrial and export sectors and enhance their contribution to the Emirate’s gross domestic product (GDP);

4.    to contribute to creating new opportunities in international markets with a view to facilitating the export of industrial products and services of the Emirate to such markets and promoting these products and services;

5.    to encourage knowledge- and innovation-based industries, and promote transformation towards clean and sustainable industries; and

6.    to achieve industrial integration with the concerned federal and local entities in order to achieve self-sufficiency at the national level, particularly in major industrial sectors.

Functions of the DIEDC

Article (6)

For the purpose of achieving its objectives, the DIEDC will, in coordination and cooperation with the concerned federal and local entities, have the duties and powers to:

1.    propose the policies and strategic plans required for developing the industrial and export sectors of the Emirate; submit the same to the Director General for approval, in preparation for final approval by the Executive Council; and follow up the implementation of these policies and plans upon approval;

2.    support implementation of the policies, programmes, and initiatives for the development of industries and promotion of exports in line with the comprehensive strategic plans for the economic development of the Emirate;

3.    determine the standards and requirements that must be met by Establishments and their products to be registered with the Programme;

4.    follow up and evaluate performance of the industrial and export sectors in the Emirate; identify the obstacles that hinder their development; and propose the actions required to remove or address these obstacles;

5.    promote local industries with a view to exporting their products; diversify local industry products that meet international standards; and support high value added industrial sectors.

6.    develop the infrastructure that supports the industrial and export sectors in the Emirate;

7.    study and review the legislation regulating the industrial and export sectors; propose drafts of legislation that would support their regulation and development; and submit the same to the competent entities in the Emirate to take the appropriate actions and decisions in respect thereof;

8.    provide the assistance, information, and technical advice required for assisting Establishments to develop their ability to market their products in foreign markets;

9.    identify target export foreign markets and determine the products and services that may be exported from the Emirate to these markets;

10.  propose concluding, or acceding to, international treaties and conventions, for the development of industries and exports, with other countries and international organisations;

11.  propose and implement initiatives and programmes that aim to raise awareness of the importance of the industrial and export sectors in supporting the Emirate's gross domestic product (GDP);

12.  coordinate with Establishments on the development of their trademarks to enable them to promote their products in foreign markets;

13.  encourage Establishments to diversify their investment portfolios in various fields of industry with a view to achieving industrial integration;

14.  participate in achieving industrial integration and self-sufficiency in the major sectors of the economy;

15.  consider the complaints filed by Establishments in respect of any matters related to the functions of the DIEDC, and provide appropriate settlement for these disputes;

16.  consolidate relations between the manufacturers and service providers in the Emirate and foreign importers;

17.  cooperate and coordinate with concerned federal and local entities, and with foreign entities; and conclude memoranda of understanding with these entities with the aim of developing the competitive edge of the industrial and export sectors of the Emirate;

18.  conduct periodical studies on the industrial and export sectors in the Emirate, and make these studies available for use by Establishments when making their investment decisions;

19.  hold trade exhibitions and events; and organise trade conferences and missions, marketing visits, and training programmes and workshops related to industries and exports at the national and international levels;

20.  coordinate with the concerned federal and local entities to create the industry register of the entities licensed in the Emirate; and

21.  exercise any other duties or powers required for the achievement of the objectives of the DIEDC.

Executive Body of the DIEDC

Article (7)

The executive body of DIEDC will be comprised of the CEO and a number of administrative, finance, and technical employees, to whom the legislation applicable to the DED employees will apply.

Appointment and Functions of the CEO

Article (8)

a.    The CEO will be appointed pursuant to a resolution of the Chairman of the Executive Council upon the recommendation of the Director General.

b.    The CEO will be directly responsible to the Director General for exercising the duties and powers assigned to him under this Law, the resolutions issued in pursuance hereof, and the legislation in force in the Emirate.

c.     The CEO will supervise the work and activities of the DIEDC in a manner that ensures the achievement of its objectives. In particular, the CEO will have the duties and powers to:

1.    prepare the general policy and the strategic and development plans of the DIEDC; submit the same to the Director General for approval; and follow up their implementation;

2.    propose the policies and strategic plans required for developing the industrial and export sectors in the Emirate; and submit the same to the Director General for approval;

3.    propose the projects, initiatives, activities, and programmes that contribute to the achievement of the objectives of the DIEDC and enable the DIEDC to exercise its functions; and submit the same to the Director General for approval;

4.    draft the bylaws, regulations, and resolutions regulating work at the DIEDC; and submit the same to the Director General for approval;

5.    prepare the organisational structure of the DIEDC, and submit the same to the Director General for approval, in preparation for final approval by the Executive Council;

6.    supervise the work of the executive body of the DIEDC;

7.    submit periodic reports on the performance of the DIEDC to the Director General to advise on the relevant appropriate action;

8.    promote institutional relationships with the concerned corporations, sectors, and organisational units of the DED; and with other relevant partners and entities, with a view to achieving the objectives of the DED and the DIEDC;

9.    represent the DIEDC before third parties, and conclude contracts and memoranda of understanding to which the DIEDC is party; and

10.  exercise any other duties or powers assigned or delegated to him by the Director General.

Advisory Committee

Article (9)

The Director General may form a committee to provide advice to the DIEDC on matters that enable it to perform its functions under this Law, particularly the matters related to promoting industries and exports in the Emirate. This committee must comprise experts and specialists from within and outside of the DIEDC as members. The resolution forming the committee will determine its functions and terms of reference, and the procedures for convening its meetings and passing its resolutions and recommendations.

Promotion Programme

Article (10)

a.    The DIEDC will develop a Programme known as the "Industry and Export Promotion Programme", which aims to contribute to increasing the exports of the industrial sector of the Emirate, to promote the products and services of the Establishments that have potential in international markets, and to support these Establishments in promoting their products and commodities.

b.    The standards and requirements that must be met by Establishments and their products to be registered with the Programme and avail of the benefits and incentives available to its participants, as approved by the Executive Council in this respect, will be determined pursuant to a resolution of the Director General.

Cooperation with the DIEDC

Article (11)

Subject to the provisions of applicable legislation, Government Entities in the Emirate must fully cooperate with the DIEDC and provide it with the required support, including providing it, upon request, with the data and statistics related to industries and exports to enable it to achieve its objectives and perform its functions under this Law and the resolutions issued in pursuance hereof.

Financial Resources of the DIEDC

Article (12)

The financial resources of the DIEDC will consist of:

1.    the support allocated to the DIEDC in the budget of the DED; and

2.    any other resources approved by the Chairman of the Executive Council.

Issuing Implementing Resolutions

Article (13)

The Director General will issue the resolutions required for the implementation of the provisions of this Law.

Supersession and Repeals

Article (14)

a.    This Law supersedes the above-mentioned Law No. (34) of 2009.

b.    The bylaws, resolutions, and instructions issued in implementation of the above-mentioned Law No. (34) of 2009 will continue in force, to the extent that they do not contradict this Law, until new superseding bylaws, resolutions, and instructions are issued.

c.     Any provision in any other legislation will be repealed to the extent that it contradicts the provisions of this Law.

Publication and Commencement

Article (15)

This Law will be published in the Official Gazette and will come into force on the day on which it is published.
