Establishing the

Executive Council of the Emirate of Dubai[1]

We, Maktoum bin Rashid Al Maktoum, Ruler of Dubai,

Do hereby issue this Law.

Article (1)

This Law will be cited as "Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai ".

Article (2)

The following words and expressions will have the meaning indicated opposite each of them unless the context implies otherwise:

Ruler:

His Highness the Ruler of Dubai.

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

Department:

Any of the Government of Dubai departments, including the Dubai Electricity and Water Authority and the Ports, Customs, and Free Zone Corporation.

Article (3)

The Executive Council of the Emirate of Dubai is hereby formed to assist the Ruler in performing his duties and exercising his powers. The Executive Council will consist of a Chairman, deputy Chairman, and members from amongst the chairpersons or directors general of Departments, as the case may be.

Persons other than the chairpersons and directors general of Departments may also be appointed as members in the Executive Council.

Article (4)

The Ruler will, pursuant to a decree, appoint the Chairman of the Executive Council, accept his resignation, or remove him from office.

Article (5)

Upon the recommendation of the Chairman of the Executive Council, the Ruler will, pursuant to decrees, appoint the Deputy Chairman of the Executive Council and the chairpersons or directors general of Departments, as the case may be; accept their resignations; or remove them from office.

Article (6)

Departments are:

1.    His Highness the Ruler's Court;

2.    the Department of Health and Medical Services;

3.    the Ports, Customs and Free Zone Corporation;

4.    the Dubai Police General Headquarters;

5.    the Dubai Electricity and Water Authority;

6.    the Awqaf and Islamic Affairs Department;

7.    the Department of Economic Development;

8.    the Land Department;

9.    the Department of Civil Aviation and Free Zone;

10.  the Department of Finance;

11.  the Department of Justice;

12.  the Department of Tourism and Commerce Marketing;

13.  the Department of Information; and

14.  the Dubai Municipality.

Article (7)

1.    The Chairman of the Executive Council will convene and preside over its meetings, run its discussions, follow up the work of Departments, and issue the resolutions and instructions required in this respect.

2.    The Chairman of the Executive Council will present the outcome of the work of the Executive Council to the Ruler; and will sign, in the name and on behalf of the Executive Council, on all the resolutions it issues.

3.    The Deputy Chairman of the Executive Council will exercise all the powers of the Chairman in the event of his absence for any reason.

Article (8)

Under the supervision of the Ruler, the Executive Council will undertake all the functions vested in it pursuant to this Law.

The Executive Council aims to maintain security and order, provide public utilities, and achieve economic and social development in the Emirate.

In particular, the Executive Council will have the following functions:

1.    to develop, and supervise the implementation of, the general policy of the Executive Council in all fields, under the general supervision of the Ruler;

2.    to take all measures necessary for the implementation of federal laws , including the drafting of laws, bylaws, resolutions, and local orders.

3.    to approve draft laws and decrees and submit them to the Ruler for final approval and issuance; and issue the resolutions necessary for their implementation;

4.    to prepare the draft annual budget and the financial statements of the Emirate; and to follow up the implementation of the annual budget upon approval thereof;

5.    to approve development plans and monitor their implementation upon approval thereof;

6.    to approve draft regulations; and issue these regulations upon approval by the Ruler;

7.    to oversee the implementation of laws, regulations, and resolutions;

8.    to ratify the agreements concluded with oil companies;

9.    to establish; regulate; and monitor the work of all Government departments, agencies, and authorities as required to serve the interest of the Emirate;

10.  to supervise the coordination of work among Departments, and ensure the proper performance of their work; and

11.  to perform any other duties assigned to the Executive Council by law.

Article (9)

The Chairman and Deputy Chairman of the Executive Council and the chairpersons or directors general of Departments are responsible to the Ruler for performing their duties and exercising their powers.

Article (10)

At the end of each financial year, the Executive Council will submit to the Ruler a detailed report on the work performed in all fields in the outgoing year, together with the Executive Council's action plan for the upcoming year to achieve the Emirate's objectives of prosperity and growth in all fields.

Article (11)

A chairperson or director general of a Department will, within the respective functions of his Department, have the powers and duties to:

1.    propose the general policy of the Department, and supervise its implementation upon approval thereof by the Executive Council.

2.    supervise the work progress of the Department in accordance with the applicable laws, regulations, and Executive Council resolutions;

3.    implement the budget within the limits of approved appropriations allocated to the Department and in accordance with the applicable laws, regulations, and resolutions;

4.    propose draft laws and regulations pertaining to the Department and submit the same to the Executive Council; and

5.    perform any other powers vested in him pursuant to the applicable laws, decrees, and regulations.

Article (12)

The Executive Council will have a General Secretariat headed by a Secretary General appointed pursuant to a decree of the Ruler. The Secretary General will serve as the rapporteur of the Executive Council and will draft its minutes of meetings. The powers and duties of the Secretary General will be determined pursuant to the relevant regulation issued by the Executive Council.

Article (13)

Any provision in any other law or regulation will be repealed to the extent that it contradicts the provisions of this Law.

Article (14)

This Law comes into force on the day on which it is issued, and will be published in the Official Gazette.
