Transferring the

Dubai Paramilitary Human Resources Committee to the

Dubai Government Human Resources Department[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

The Dubai Police Law of 1966 and its Implementing Bylaw No. (1) of 1984;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (31) of 2009 Establishing the Dubai Government Human Resources Department (the “DGHR”) and its amendments;

Law No. (6) of 2012 Concerning Management of the Human Resources of Local Paramilitary Personnel in the Emirate of Dubai and its amendments;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai;

Law No. (8) of 2018 Concerning Management of the Government of Dubai Human Resources;

Decree No. (29) of 2020 Forming the Supreme Committee for Development of the Government Sector in the Emirate of Dubai;

Resolution No. (19) of 2013 Approving the Line of Command Structure of the Paramilitary Departments of the Government of Dubai;

Resolution No. (1) of 2016 Concerning the Dubai Paramilitary Human Resources Committee (the “DPHRC").

Executive Council Resolution No. (19) of 2012 Concerning the Methodology for Approving Organisational Structures of Government Entities in the Emirate of Dubai and its amendments;

Executive Council Resolution No. (40) of 2015 Concerning the Functions of the General Secretariat of the Executive Council of the Emirate of Dubai;

Resolution No. (2) of 2017 Appointing the Chairman of the Dubai Paramilitary Human Resources Committee;

Resolution No. (3) of 2017 Appointing the Secretary General of the Dubai Paramilitary Human Resources Committee;

Resolution No. (5) of 2017 Approving the Rewards and Incentives Bylaw of the Dubai Paramilitary Human Resources Committee;

Resolution No. (1) of 2020 Reconstituting the Dubai Paramilitary Human Resources Committee;

Resolution No. (2) of 2020 Approving the Internal Bylaw of the Dubai Paramilitary Human Resources Committee; and

The presentation of the Chairman of the Supreme Committee for Development of the Government Sector in the Emirate of Dubai,

Do hereby issue this Law.

Transfer of the DPHRC

Article (1)

As of the date on which this Law comes into force, the DPHRC and its General Secretariat are hereby transferred to the DGHR, and incorporated as an organisational unit within the approved DGHR Organisational Structure. The DGHR will, in coordination with the General Secretariat of the Executive Council, determine the organisational level, the duties, and the functions of the said organisational unit.

Transfer and Succession

Article (2)

a.     The following are hereby transferred from the DPHRC to the DGHR:

1.     the duties and functions assigned to the DPHRC and its General Secretariat under the above-mentioned Law No. (6) of 2012, Resolution No. (2) of 2020, and the legislation in force in the Emirate of Dubai;

2.     the ownership of the real property, movables, assets, devices, equipment, and other property of the DPHRC and its General Secretariat;

3.     the civilian Employees who are in the service of the General Secretariat of the DPHRC by the effective date of this Law. These Employees will be governed by the above-mentioned Law No. (8) of 2018, and will retain their Total Salaries and the increments and allowances they receive by the effective date of this Law; and

4.     the financial appropriations allocated to the DPHRC and its General Secretariat by the Department of Finance in its annual budget.

b.    Paramilitary Staff Members, who are in the service of the General Secretariat of the DPHRC by the effective date of this Law, are hereby transferred to the Dubai Police. The DGHR will, in coordination with the Dubai Police and within no later than two (2) weeks from the effective date hereof, determine the Staff Members who will be seconded to the DGHR; and these Staff Members will be governed by the above-mentioned Law No. (6) of 2012 and the resolutions issued in pursuance thereof.

c.     All rights and obligations of the DPHRC and its General Secretariat are hereby transferred to the DGHR.

Issuing Implementing Resolutions

Article (3)

The Chairman of the Executive Council will issue the resolutions required for the implementation of the provisions of this Law.

Repeals

Article (4)

a.     Pursuant to this Law, the following resolutions are repealed:

1.     Resolution No. (1) of 2016 Concerning the Dubai Paramilitary Human Resources Committee;

2.     Resolution No. (2) of 2017 Appointing the Chairman of the Dubai Paramilitary Human Resources Committee;

3.     Resolution No. (3) of 2017 Appointing the Secretary General of the Dubai Paramilitary Human Resources Committee;

4.      Resolution No. (5) of 2017 Approving the Rewards and Incentives Bylaw of the Dubai Paramilitary Human Resources Committee;

5.     Resolution No. (1) of 2020 Reconstituting the Dubai Paramilitary Human Resources Committee; and

6.     Resolution No. (2) of 2020 Approving the Internal Bylaw of the Dubai Paramilitary Human Resources Committee.

b.    Any provision in any other legislation will be repealed to the extent that it contradicts the provisions of this Law.

Publication and Commencement

Article (5)

This Law will be published in the Official Gazette and will come into force on the day on which it is published.
