Establishing
the
Dubai Maritime

We, Mohammed
bin Rashid Al Maktoum, Ruler of Dubai,
After perusal of:
Federal Law No. (9) of 1982 Concerning
Maritime Trade;
Law No. (1) of 1992
Establishing the Department of Economic Development and its amendments;
Law No. (1) of 2001
Establishing the Ports, Customs, and Free Zone Corporation;
Law No. (19) of 2005 Concerning
Financing Projects of the Ports, Customs, and Free Zone Corporation;
Law No. (5) of 2006 Appointing
the Chairman of the Ports, Customs, and Free Zone Corporation; and
Law No. (18) of 2006 Concerning
Management and Realisation of the Public Funds of the Government of Dubai,
Do hereby issue this Law.
This Law will be cited as “Law No. (11) of 2007
Concerning the Dubai Maritime City”.
The following words and expressions, wherever
mentioned in this Law, will have the meaning indicated opposite each of them unless
the context implies otherwise:

Pursuant
to this Law, a city named the “Dubai Maritime City”, whose boundaries are
demarcated on the plan attached to this Law, is established.
2-
An
authority named the "Dubai Maritime City Authority" is hereby
established to manage the DMC. The DMCA will have legal personality, financial
and administrative autonomy, and the capacity required to own movable and
immovable property and undertake all legal dispositions that ensure the
achievement of its objectives. The DMCA will be affiliated to the Ports, Customs,
and Free Zone Corporation.
The DMCA aims to strengthen the position of the Emirate and turn it into
a hub for maritime sectors, including without limitation:
1. navigation services;
2. navigation
management;
3. registration of ships
and yachts;
4. owning and chartering
ships and yachts;
5. navigation and
academic research;
6. designing and
building ships and yachts;
7. regulating maritime
transport;
8. maritime exhibitions,
conferences, training courses, and workshops;
9. maritime tourism; and
10. maritime
arbitration.
For the purpose of achieving its objectives, the
DMCA will have the powers to:
1.
issue
the regulations and bylaws required for the implementation of the provisions of
this Law, including those regulating registration of ships and yachts; and
regulating maritime traffic and navigation within the boundaries of the DMC;
2.
issue
licences to individuals,
companies, establishments, and maritime consultancy firms that wish to conduct
various maritime activities or any other activity related thereto;
3.
provide
companies, establishments, and individuals with administrative staff,
technicians, artisans, and other workers in accordance with the conditions
agreed upon between the DMCA and the requesting entity;
4.
collect
fees for the services that the DMCA provides;
5.
own,
sell, lease out, mortgage land and facilities; or dispose thereof in any
manner;
6.
build
and manage infrastructure and buildings on the land of the DMCA;
7.
hold
shares or enter into partnership with others to establish companies within and
outside of the DMC;
8.
cooperate
with local and international maritime corporations and agencies; and
9.
invest
and utilise the DMCA funds in commercial, financial, or service fields.
Article (6)
The DMCA will be responsible for licensing various maritime activities
and other activities related thereto, including:
1. ownership of ships
and yachts;
2. operating ships and
conducting ship operations;
3. managing ships;
4. operating as maritime
agents;
5. ship chartering and
brokerage; and freight;
6. loading and unloading
cargo;
7. maritime
classification bodies;
8. maritime surveyors and inspectors;
9. marine insurance;
10. maritime financing;
11. maritime navigation
regulatory authorities;
12. maritime tourism,
maritime leisure industry, and cruises;
13. seismic survey
vessels, drilling vessels, and refuelling vessels;
14. marine fishing and
marine aquaculture;
15. ship and yacht
building and repair;
16. storage;
17. marine equipment;
18. maritime information
systems;
19. marine exploration,
surveying, and photography;
20. marine education,
training, and research;
21. marine conferences
and workshops; and
22. any other activities
that are relevant to the DMC work and are approved by the Chairman.
The management of the DMCA will be comprised of the Chairman, the CEO,
and an executive body.

The
Chairman of the Ports, Customs, and Free Zone Corporation will be the Chairman
of the DMCA.
2.
The
Chief Executive Officer of the DMCA will be appointed, and his functions will
be determined, pursuant to a resolution of the Chairman.
Any person who violates the
provisions of this Law and the regulations issued in pursuance hereof, or any
terms of a licence issued by the DMCA, will be subject to the civil penalties
prescribed by the relevant regulation issued by the Chairman.
Article (10)
The Chairman will
issue the bylaws, regulations, and resolutions required for the operation and
management of the DMC.
Article (11)
The
DMCA may outsource to one or more legal person(s),
(the “Operator(s)”), the management and conducting of any or all the
operations performed within the land of the DMCA, including the development and
investment of the DMCA property. The DMCA may, in accordance with the
objectives and conditions it deems appropriate, conclude contracts for
assigning; transferring the ownership; mortgaging; or disposing, in any manner,
of the assets of the DMCA. The Chairman is hereby authorised to sign all the documents
and contracts required in relation to the Operator(s) or any other party. The
DMCA will not be liable for any debts or obligations claimed from the Operator
(s) or any other party.
Article (12)
Neither the DMCA, within its area of jurisdiction,
nor the companies and individuals working within the land of the DMCA may, with
respect to their operations in this land, be subject to the local laws and
regulations concerning the Dubai Municipality, the Department of Economic
Development, the Rent Committee, the Department of Tourism and Commerce
Marketing, or the Roads and Transport Authority; nor may be subject to the
authority and powers that are within the jurisdiction of any of these entities.
Article (13)
No entity may conduct its activities within the DMC without first
obtaining the required licence from the DMCA.
Article (14)
The financial resources of the DMCA will consist
of:
1.
the
support allocated to the DMCA in the general budget of the Emirate;
2.
fees
and charges for the services provided by the DMCA;
3.
grants
and gifts received by the DMCA and accepted by the Chairman; and
4.
any
other resources approved by the Chairman.
Article (15)
Any provision in
any other legislation will be repealed to the extent that it contradicts the
provisions of this Law.
Article (16)
This Law will be published in the Official Gazette and will come into
force on the day on which it is issued.
