Regulating the Use of the
Emblems of the Emirate of Dubai and the Government of Dubai[1]

We, Mohammed bin
Rashid Al Maktoum, Ruler of Dubai,
After
perusal of:
Federal
Law by Decree No. (31) of 2021 Issuing the Crime and Punishment Law and its
amendments;
Federal
Law by Decree No. (34) of 2021 Concerning Combating Rumours and Cybercrimes and
its amendments;
Federal
Law by Decree No. (46) of 2021 Concerning Electronic Transactions and Thiqa
Services;
Law
No. (8) of 2019 Concerning His Highness the Ruler of Dubai’s Court;
Law
No. (5) of 2021 Concerning the Dubai International Financial Centre;
Law
No. (17) of 2023 Concerning the Emblem of the Emirate of Dubai;
Law
No. (26) of 2023 Concerning the Executive Council of the Emirate of Dubai;
Decree
No. (22) of 2009 Concerning Special Development Zones in the Emirate of Dubai;
Decree
No. (22) of 2021 Concerning the Chairman of His Highness the Ruler of Dubai’s
Court; and
The
legislation establishing and regulating free zones in the Emirate of Dubai,
Do hereby issue this Law.
This
Law will be cited as “Law No. (1) of 2025 Regulating the Use of the Emblems of
the Emirate of Dubai and the Government of Dubai”.
The
following words and expressions, wherever mentioned in this Law, will have the
meaning indicated opposite each of them unless the context implies otherwise:
Emirate: |
The
Emirate of Dubai. |
Ruler: |
His
Highness the Ruler of Dubai. |
Government: |
The
Government of Dubai. |
Executive
Council: |
The
Executive Council of the Emirate of Dubai. |
HHRC: |
His
Highness the Ruler's Court. |
Government
Entity: |
Any
of the Government departments, public agencies or corporations, Government
authorities and councils, or other public entities affiliated to the
Government, excluding Government Entities managed on a commercial basis. |
Competent
Authority: |
The
Department of Economy and Tourism in the Emirate of Dubai or any of the
authorities supervising Special Development Zones and free zones, such as the
Dubai International Financial Centre. |
Emblem: |
This
includes the Emblem of the Emirate and the Emblem of the Government. |
Emblem
of the Emirate: |
The
emblem depicted in Illustrations (1) and (2) attached to this Law. |
Emblem
of the Government: |
The
emblem depicted in Illustrations (3) and (4) attached to this Law. |
Person: |
A
natural or legal person. |
a. The Emirate will have a distinct emblem which reflects its identity,
heritage, values, principles, and orientations. The design of the Emblem of the
Emirate is depicted in Illustrations (1) and (2) attached hereto.
b. The Government will have an emblem that is distinct yet incorporates design
elements from the Emblem of the Emirate. The design of the Emblem of the Government is depicted in
Illustrations (3) and (4) attached hereto.
a. The Emblem of the Emirate is the property of the Emirate, and the Emblem of the Government is the property of the Government. Both Emblems are protected under this Law and other legislation in force in the Emirate.
b. The protection afforded under paragraph (a) of this Article extends to the Emblem attached to the above-mentioned Law No. (17) of 2023. No Person may use this Emblem, by virtue of it being the property of the Emirate.
a. The Emblem of the Emirate will be used in the locations, events,
documents, and seals of the entities designated by the Chairman of the HHRC.
b. No Person, other than the entities specified in paragraph (a) of
this Article, may use the Emblem of the Emirate without first obtaining a
special authorisation from the Chairman of the HHRC or his authorised
representative. Where authorisation is granted, the Emblem must be used in
accordance with the rules stipulated in that authorisation.
a. The Emblem of the Government will be used in the buildings, sites, events,
activities, and functions; official documents, seals, and records; electronic instruments,
websites, and digital applications; and promotional or marketing materials of
the Government and Government Entities.
b. A non-government entity and a Government Entity managed on a
commercial basis may use the Emblem of the Government, subject to obtaining a
special authorisation from the Chairman of the Executive Council or his
authorised representative. In this case, the Emblem of the Government must be
used in accordance with the rules stipulated in the authorisation.
The
Emblem will be used in the manner, and in compliance with the conditions and specifications,
specified in the relevant manual prepared by the General Secretariat of the
Executive Council and approved by a resolution issued by the Chairman of the
Executive Council in this respect.
The
following acts are hereby prohibited:
1. the use of the Emblem, by non-government entities or any other
entities authorised to use it, in any manner or by any means, before obtaining
the authorisation referred to in Article (5) and Article (6) of this Law;
2. the use of the Emblem for commercial purposes or for the purpose of
advertising or promoting products, goods, materials, or tools;
3. any act of infringement upon the Emblem, or the
use thereof in any manner that results in its deformation, or undermines its worth
or standing; and
4. the use of the Emblem in any activity or event that conflicts with
the values and principles of the Emirate, or with public order or morality.
A
Person who becomes aware that another Person has committed any of the prohibited
acts stipulated in Article (8) of this Law must report it to the Competent
Authority or the competent judicial authorities to take the necessary legal
action against the violators.
Without
prejudice to any stricter penalty stipulated in any other legislation, a Person
who commits any of the acts stipulated in paragraphs (3) and (4) of Article (8)
of this Law will be punished by imprisonment for not less than three (3) months
and not more than five (5) years, and a fine of not less than one hundred
thousand dirhams (AED 100,000.00) and not more than five hundred thousand
dirhams (AED 500,000.00), or either of these penalties. In case of conviction,
the court will order the confiscation of the tools and equipment used in
committing this criminal offence.
a. A Person who commits any of the acts stipulated
in sub-paragraphs (1) and (2) of Article (8) of this Law will be punished by a
fine of ten thousand dirhams (AED 10,000.00).
b. Upon repetition of the same violation within one (1) year from the date of the previous violation, the
amount of fine mentioned in paragraph (a) of this Article will be doubled. The fine
must not exceed twenty thousand dirhams (AED 20,000).
c. In addition to the penalty of a fine referred to in paragraph (a) of this
Article, the Competent Authority may, in any order, take one or more of the
following measures against a violator:
1. issuing a warning;
2. closing the violating establishment or suspending its commercial activity
for a period not exceeding six (6) months; and/ or
3. revoking the commercial licence.
d. Any affected party may submit a written grievance to the official in
charge of the Competent Authority against any penalty or administrative measure
taken or imposed against him. The grievance will be determined, within sixty
(60) days from the date of its submission, by a committee formed by the
official in charge of the Competent Authority for this purpose. The decision
issued by the committee in respect of the grievance will be final.
Any
Person using the Emblem, including the Emblem attached to the above-mentioned
Law No. (17) of 2023, by the effective date of this Law, other than the
Government Entities or other entities authorised to use the Emblem, must remove
it and cease using it within thirty (30) days from the effective date hereof
unless that Person has obtained the special authorisation referred to in
Article (5) and Article (6) of this Law.
The
provisions of Article (10) and Article (11) of this Law apply to any Person who
commits any of the prohibited acts referred to in Article (8) of this Law in
connection with the use of the Emblem attached to the above-mentioned Law No.
(17) of 2023.
The
Chairman of the Executive Council will issue the resolutions required for the implementation
of the provisions of this Law.
a. This Law supersedes the above-mentioned Law No. (17) of 2023.
b. Any provision in any other legislation is hereby repealed to the extent that it
contradicts the provisions of this Law.
This
Law will be published in the Official Gazette and will come into force on the
day on which it is published.
