Car Parks in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Law No. (5) of 1995 Establishing the Department of Finance;

Law No. (17) of 2005 Establishing the Roads and Transport Authority and its amendments;

Law No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai and its amendments;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai, its Implementing Bylaw, and their amendments;

Law No. (26) of 2023 Concerning the Executive Council of the Emirate of Dubai;

Executive Council Resolution No. (5) of 2016 Regulating Car Parks in the Emirate of Dubai (the “Original Resolution”); and

Executive Council Resolution No. (27) of 2020 Amending the Schedules of Fees Attached to Executive Council Resolution No. (5) of 2016 Regulating Car Parks in the Emirate of Dubai,

Do hereby issue this Resolution.

Superseded Articles

Article (1)

Articles (1) and (5) of the Original Resolution are hereby superseded by the following:

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

RTA:

The Roads and Transport Authority.

Director General:

The director general and chairman of the Board of Executive Directors of the RTA.

TRA:

The Traffic and Roads Agency of the RTA.

Government Entity:

Any of the ministries, Government departments, public agencies or corporations, Government councils, public authorities, or other entities affiliated to the Federal Government or the Government of Dubai.

Vehicle:

Any motorised machine, pedal cycle, motorcycle, carriage, or other machine designed to run on Roads, whether mechanically propelled or otherwise.

Public Car Park:

An area within the Emirate supervised by the RTA and designated under planning and construction legislation for Vehicles to park in, whether for a fee or free of charge. This includes on-street car parks, off-street car parks, and multi-storey car parks.

Premium Car Park:

A Public Car Park with special characteristics in terms of its location, level of service, or the Parking Fees collected for its use by Vehicles; and located within high-density residential areas, business districts, or areas near public transport stations. Premium Car Park will be designated in accordance with the controls and criteria approved by the Director General, in coordination with the General Secretariat of the Executive Council and the Department of Finance.

Private Car Park:

An area that may, under planning and construction legislation, be used as a private car park by any Person or entity authorised by the RTA in accordance with this Resolution, whether with or without consideration.

Parking Fee:

A fee charged under this Resolution for parking a Vehicle in a Public Car Park for a specific period.

Reservation Fee:

A fee charged under this Resolution for the reservation of a Public Car Park space for a specific period.

Permit:

Any of the permits issued by the TRA under this Resolution.

Peak Hours:

The period during which traffic volume in the Emirate reaches its maximum permitted limit. This period will be determined in accordance with the controls and criteria approved by the Director General, in coordination with the General Secretariat of the Executive Council and the Department of Finance.

Event:

Any event organised in the Emirate, whether on a permanent or temporary basis, for entertainment, marketing, sports, arts, cultural, educational, tourist, health, religious, or any other purposes. An Event may take the form of a conference, festival, exhibition, concert, theatrical performance, literary reading, contest, or any other form; and may result in an increase in traffic beyond normal levels in the surrounding area. Events and their designated locations will be determined pursuant to a decision issued by the Director General, in coordination with the General Secretariat of the Executive Council and the Department of Finance.

Person:

A natural or legal person.

Parking Fee

Article (5)

In return for parking a Vehicle in a Public Car Park, a Parking Fee will be charged. The amount of this fee will be determined based on the category and type of the Public Car Park, the number of parking hours, Peak Hours, and Event hours, as set out in Schedules (1) and (2) attached hereto.

Supersession of Schedules

Article (2)

Schedules (1) and (2) attached to the Original Resolution are hereby superseded by the two (2) schedules attached hereto.

Commencement and Publication

Article (3)

This Resolution comes into force on 1 April 2025, and will be published in the Official Gazette.
