Forming the Supreme
Committee for
Overseeing the Development of
Hatta Area[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of
Dubai, Chairman of the Executive Council,
After perusal
of:
Law No. (5) of 1995 Establishing the
Department of Finance;
Law No. (3) of 2003 Establishing the
Executive Council of the Emirate of Dubai;
Law No. (17) of 2005 Establishing the
Roads and Transport Authority and its amendments;
Decree No. (28) of 2015 Concerning
Governance of the Boards and Committees Affiliated to the Government of Dubai;
Resolution No. (39) of 2021 Concerning
the Commissioner General for the Infrastructure, Urban Planning, and Well-being
Pillar;
Executive Council Resolution No. (66) of
2017 Forming the Strategic Affairs Council of the Executive Council of the
Emirate of Dubai; and
Executive Council Resolution No. (18) of
2021 Forming the Supreme Urban Planning Committee in the Emirate of Dubai,
Do hereby
issue this Resolution.
The following words and expressions,
wherever mentioned in this Resolution, will have the meaning indicated opposite
each of them unless the context implies otherwise:
Emirate: |

The Executive Council of the Emirate of
Dubai. |
SAC: |
The Strategic Affairs Council of the
Executive Council. |
Hatta Area: |
The area demarcated, under the
legislation in force, within the geographical boundaries of the Emirate. |
Supreme Committee: |
The Supreme Committee for Overseeing the
Development of Hatta Area, formed under this Resolution. |
Chairman: |
The chairman of the Supreme Committee. |
The Supreme Committee will have the
following objectives:
1.
to develop Hatta Area in alignment with the Dubai 2040 Urban Master
Plan; and improve the services and business activities conducted within the
geographic scope of Hatta Area, with a
view to highlighting the historical value of the natural and archaeological sites located
therein; and to ensure the provision of quality services of the highest level
in the area;
2.
to encourage, and overcome the obstacles facing, investment in
Hatta Area through the creation of investment opportunities or forging
partnerships with investors from the public and private sectors and with local
and international establishments, while preserving the environment and natural
resources of Hatta Area;
3.
to enhance the social, economic, and educational capabilities of
Hatta Area; increase its appeal as a first-class tourist destination; enrich
the cultural and social life therein; and enhance the local culture and link it
to the Tourism Pillar; and
4.
to create express and direct channels for the launch and completion
of development projects, through cooperation and coordination with the
concerned Government Entities.
Pursuant to this Resolution, a supreme
committee named the “Supreme Committee for Overseeing the Development of Hatta Area” is
formed under the chairmanship of the Commissioner General for the Infrastructure,
Urban Planning, and Well-Being Pillar, and with the membership of:
1.
the Managing Director and Chief Executive Officer of the Dubai
Electricity and Water Authority PJSC;
2.
the Director General of the Department of Economy and Tourism in
the Emirate of Dubai;
3.
the Director General of the Dubai Municipality;
4.
the Director General of the Dubai Culture and Arts Authority;
5.
the Chief Executive Officer of the Engineering Office;
6.
a representative from the General Secretariat of the Executive
Council; and
7.
a representative from the Roads and Transport Authority.
For the
purposes of this Resolution, the Supreme Committee will have the duties and
powers to:
1.
formulate the general policy for the development and upgrade of
Hatta Area; supervise the implementation, governance, and development of all projects, initiatives,
programmes, activities, and events that are launched for the development and
upgrade of Hatta Area and intended for its residents and visitors; and submit
the same to the Chairman of the Executive Council for approval;
2.
supervise, in coordination with the concerned entities, the preparation
and implementation of the comprehensive plan for the development of Hatta Area,
including supporting the educational, social, cultural, tourism, and other
sectors;
3.
ensure that the plan for the development and upgrade of Hatta Area
is progressing in accordance with the set plans and the strategic performance
indicators approved for it and is aligned with the Government priorities and orientations; and that it achieves its approved objectives in this
regard;
4.
supervise the rehabilitation of Hatta Area infrastructure, and
ensure that the concerned entities implement the rehabilitation and development
works in Hatta Area;
5.
propose and review the draft legislation related to the achievement of the objectives of the
Supreme Committee, and submit the same to the Competent Entities for approval
in accordance with the relevant procedures adopted by them;
6.
supervise the provision of investment opportunities in the projects
and initiatives dedicated to the residents of Hatta Area and to the private sector;
7.
ensure the integration of roles, coordination of efforts, exchange
of information, and cooperation among federal and local government entities, on
all matters that contribute
to the
achievement of the objectives of the Supreme Committee;
8.
approve, in coordination with the concerned entities, the plan for
promoting and marketing Hatta Area locally and internationally;
9.
make the necessary decisions on any issues or conflicts that may
arise among the entities involved in the development, upgrade, and
rehabilitation of Hatta Area, where no compromise solutions are reached by these entities; and refer, where required, unresolved
issues or conflicts to the SAC;
10.
follow up the
implementation
of the plan for the development and upgrade of Hatta Area; monitor its progress
and completion phases; and issue the necessary directives on the obstacles and
difficulties that may be encountered in any of the plan phases;
11.
coordinate with the concerned entities in the Emirate to ensure the
availability of the budget funds required for implementing the approved plan
for the development and upgrade of Hatta Area;
12.
form sub-committees and work teams to assist it in performing its
duties; and determine their functions
and terms of
reference, and all other matters related to these sub-committees and work
teams;
13.
seek assistance from experts and specialists, as it deems
appropriate, from
amongst Hatta Area residents or other experts and consultants; and invite
them to attend its meetings without having the right to vote in its
deliberations;
14.
conclude contracts, agreements, and memoranda of understanding with
Government Entities and with
the private
sector, as required to enable the Supreme Committee to perform its duties and
achieve its objectives;
15.
approve, in coordination with the concerned entities, the building
regulations, land uses, and land plans in Hatta Area; and submit the same to
the Competent Entities in the Emirate to complete the relevant necessary procedures;
16.
submit to the Chairman of the SAC and the Chairman of the Executive
Council periodic
reports that include the recommendations, outcomes of the work, and achievements, of
the Supreme Committee; and
17.
exercise any other duties or powers that are relevant to the
development and upgrade of Hatta Area and that contribute to the achievement of the Supreme
Committee objectives, as assigned to it by the Chairman of the Executive
Council or the Chairman of the SAC.
a.
The Supreme Committee will hold its ordinary meetings at the
invitation of the Chairman at least once a month, or where necessary, at the
time and place determined by the Chairman.
b.
The Chairman may, on his own accord or
upon the request
of the majority of the Supreme Committee Members, hold an extraordinary meeting
to discuss urgent matters that require immediate decisions. In this case, the agenda of the
extraordinary meeting must be exclusively dedicated to the matters for which
the meeting is held.
c.
At its first meeting, the Supreme Committee will elect a vice
chairman, who will act as the Chairman where the Chairman is absent or becomes
incapable of performing his duties.
d.
Supreme Committee meetings will be valid if attended by the
majority of its Members, provided that the Chairman or vice chairman is in
attendance.
e.
The Supreme Committee will pass its resolutions and recommendations
by majority vote of attending Members; and in the event of a tie, the chair of
the meeting will have a casting vote.
a.
A rapporteur will be appointed to the Supreme Committee by the
Chairman.
b.
The Supreme Committee rapporteur will have the duties to:
1.
prepare the Supreme Committee meeting agendas in accordance with
the rules approved by the Chairman in this respect, and notify the Supreme
Committee Members of the same within sufficient time prior to meetings;
2.
send ordinary and extraordinary meeting invitations to the Chairman
and Members;
3.
record minutes of meetings and follow up the implementation of
resolutions and recommendations;
4.
verify that quorums of meetings are present, and inform the
Chairman of the same;
5.
supervise the maintenance and organisation of the records and
documents of the Supreme Committee;
6.
provide all the administrative support required to enable the
Supreme Committee to perform its duties under this Resolution;
7.
implement the administrative directives issued to him by the
Chairman; and
8.
perform any other duties assigned to him by the Chairman.
The above-mentioned Decree No. (28) of
2015, or any other superseding legislation, applies to the management of the meetings of the
Supreme Committee, to the confidentiality of information, to the duties of the
Chairman and Members, and to all other matters related to governance of the
Supreme Committee.
The Roads and Transport Authority will
provide the Supreme Committee with administrative and technical support to
enable it to perform its duties under this Resolution.
All Government Entities, and other
entities in the Emirate, concerned with the development, upgrade, and
rehabilitation of Hatta Area must fully cooperate with the Supreme Committee
and its sub-committees and work teams, and provide the data, information,
statistics, and documents as requested and deemed necessary by the Supreme
Committee to enable it to achieve its objectives and perform its duties under this Resolution.
The tenure of the Supreme
Committee will be three (3) years, renewable pursuant to a resolution of the
Chairman of the Executive Council issued upon the recommendation of the
Chairman.
The Supreme Committee must coordinate
with Department of Finance for the provision of the budget funds required to
enable it to perform its duties under this Resolution. The Supreme Committee's budget will be managed, and the financial
transactions will be performed as per that budget, by the Department of
Finance.
The Chairman will issue the resolutions
required for the implementation of the provisions of this Resolution.
This Resolution comes into force on the
day on which it is issued, and will be published in the Official Gazette.
