Amending Executive Council Resolution No. (23)
of 2013
Regulating Supplementary Information Signs on
the
Roads of the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum,
Crown Prince of Dubai, Chairman of the Executive Council,
After perusal
of:
Law No. (17)
of 2005 Establishing the Roads and Transport Authority and its amendments; and
Executive
Council Resolution No. (23) of 2013 Regulating Supplementary Information Signs
on the Roads of the Emirate of Dubai (the “Original
Resolution”),
Do hereby issue this Resolution.
Articles (1), (4), (6), and (11) of the Original Resolution are
hereby superseded by the following:
The following words and expressions, wherever mentioned in this
Resolution, will have the meaning indicated opposite each of them unless the
context implies otherwise:
UAE: |
The United
Arab Emirates. |
Emirate: |
The Emirate
of Dubai. |
RTA: |
The Roads
and Transport Authority. |
Director General: |
The director
general and chairman of the Board of Executive Directors of the RTA. |
TRA: |
The Traffic
and Roads Agency of the RTA. |
Government Entity: |
This
includes any of the federal government entities or Government entities
affiliated to the Government of Dubai, excluding free zone authorities. |
Authorised Entity: |
A Government
Entity or private establishment authorised by the TRA to install a
Supplementary Information Sign on any Road of the Emirate on a permanent or
temporary basis. |
Authorisation: |
A document
issued by the TRA authorising the installation of Supplementary Information
Signs at the sites specified therein. |
Supplementary Information Sign: |
A sign with
coloured background manufactured to the specifications and measurements
determined by the TRA according to the standards and requirements it adopts
in this respect, and placed on a permanent or temporary basis on a Road of
the Emirate to guide the public to a cultural, tourist, commercial, or
service site; the site of an event or exhibition; or any other major landmark
in the Emirate. |
Permanent Sign: |
A
Supplementary Information Sign whose placement is authorised by the TRA for a
period of one (1) year or more. |
Temporary Sign: |
A
Supplementary Information Sign whose placement is authorised by the TRA for
less than one (1) year. |
Road: |
Any public
way on which traffic is allowed, including main roads, side roads, and
byroads; streets; public squares; bridges; tunnels; interchanges; road median
strips; public car parks; pavements; pedestrian crossings; waterways and navigable canals; and quays. This also
includes Motorways and Arterial Roads, and Service and Collector Roads. |
Motorways and Arterial Roads: |
Main roads
open for traffic in the Emirate. |
Service and Collector Roads: |
Roads open
for traffic in front of entrances and exits of residential, commercial, and
industrial facilities and compounds. |
Contractor: |
A natural or
legal person prequalified by the TRA to perform all works related to the designing, manufacturing, installation, removal, and
maintenance of Supplementary Information Signs. |
a.
Supplementary Information Signs will be designed, installed,
maintained, and removed in accordance with the technical requirements,
standards, and specifications stipulated in the Traffic Control Devices Manual
prepared by the TRA.
b.
An Authorised Entity must engage a Contractor to design,
manufacture, install, maintain, or remove Supplementary Information Signs.
The Contractor will be responsible for providing the shop drawings of the
Supplementary Information Signs; conducting detailed field studies of the sites
where these signs will be installed; submitting the Authorisation application;
and paying the prescribed fees and security deposits.
Authorisations will be granted subject to the following
requirements:
1.
An applicant for Authorisation must be a Government Entity, or a
private establishment licensed in the Emirate.
2.
The applicant for Authorisation must be an entity that meets the
requirements, standards, and rules determined by the Director General pursuant
to the relevant resolution he issues in this respect.
3.
The Supplementary Information Sign must contain the name and logo
of the Authorised Entity.
4.
The Supplementary Information Sign must not include any promotional
material.
5.
The text of the Supplementary Information Sign must be written in
Arabic. However, the English language may be used in addition to Arabic. In
any event, the text of the sign must be written correctly and must meet the
specifications and measurements prescribed by the TRA regarding font type and
size.
6.
The space allocated for the Arabic text must not be less than fifty
per cent (50%) of the total space allocated for writing on the Supplementary
Information Sign.
7.
The Supplementary Information Sign may not include any name,
reference, or meaning that contradicts the provisions of Islamic Sharia, public
order and morality, or UAE traditions.
8.
The Supplementary Information Sign must not block the view of any
religious, historical, cultural, or Government buildings, or public facilities.
9.
The Supplementary Information Sign must not block the view of any road
sign, Supplementary Information Sign, or advertising board.
10.
The Supplementary Information Sign must not obstruct the flow of
Road traffic or of pedestrians, or obstruct vision on a Road.
11.
The Supplementary Information Sign must not cause harm to persons
or damage to public or private property.
Authorised Entities will bear the cost of designing, manufacturing,
and installing Supplementary Information Signs, as well as the cost of their
removal upon expiry of the term of the Authorisation. Authorised Entities will
also bear:
1. the cost of replacing, modifying, or
relocating Supplementary Information Signs;
2. the cost of repairing damaged
Supplementary Information Signs, regardless of the entity causing the damage;
3. administrative and supervisory charges of twenty-five percent (25%) of the cost of the works
implemented by the RTA in respect of Supplementary Information Signs; and
4. the cost of preventive or periodic
maintenance of Supplementary Information Signs as prescribed by the TRA in this
respect.
The title “Chairman of the Board of Directors” is hereby replaced
by “Director General”, wherever mentioned in the Original Resolution.
This Resolution will be published in the Official Gazette and will
come into force thirty (30) days after the day on which it is published.
