Sports Establishments and
Sports
Events in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin
Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,
After
perusal of:
Federal
Law No. (2) of 2015 Concerning Commercial Companies and its amendments;
Law No. (3) of 2003 Establishing the Executive Council of
the Emirate of Dubai;
Law No. (9) of 2004 Concerning the Dubai International
Financial Centre and its amendments;
Law No. (11) of 2009 Concerning the Dubai Sports Council
and its amendments;
Law No. (13) of 2011 Regulating the Conduct of Economic
Activities in the Emirate of Dubai and its amendments;
Law No. (1) of 2016 Concerning the Financial Regulations of
the Government of Dubai;
Law No. (8) of 2016 Regulating the Grant of Law Enforcement
Capacity in the Government of Dubai;
Decree No. (22) of 2009 Concerning Special Development
Zones in the Emirate of Dubai;
Decree No. (25) of 2013 Concerning the Event eLicensing and
eTicketing System in the Emirate of Dubai;
Decree No. (9) of 2015 Regulating the Raising of Donations
in the Emirate of Dubai;
Decree No. (1) of 2020 Placing Government Sports
Establishments under the Supervision of the Dubai Sports Council; and
The legislation establishing and regulating free zones in
the Emirate of Dubai,
Do hereby issue this
Resolution.
The following words and expressions, wherever mentioned in
this Resolution, will have the meaning indicated opposite each of them unless
the context implies otherwise:

The Government of Dubai. |

Government Entity: |
Any of the Government departments, public agencies or corporations,
councils, authorities, or other entities affiliated to the Government. |

DSC: |
The Dubai Sports Council. |
|
Chairman: |
The chairman of the DSC. |
|
General Secretariat: |
The general secretariat of the DSC. |
|
Secretary General: |
The secretary general of the DSC. |
|
Sports Establishment: |
Any Company or corporation licensed in the Emirate to conduct a sports
activity for commercial or non-commercial purposes. This includes, without limitation,
Sports Clubs, Sports Companies, Sports Academies, Sports Centres, and
Physical Fitness Centres, which are concerned with the social, cultural, and
sports welfare of the youth. |

Sports Club: |
A Sports Establishment designated by the DSC, which is dedicated to
practising one or more sports. This includes Sports Companies, Sports
Academies, and similar entities established by the Sports Establishment. |
|
Sports Company: |
A Company incorporated by a Sports Club for practising a specific
sport. |
|
Sports Academy: |
A Sports Establishment specialised in training and qualifying athletes
and sports professionals in one or more sports. |
|
Sports Centre: |
A Sports Establishment specialised in providing, at its premises, the
playgrounds, gear, equipment, and qualified staff required for conducting
various activities, particularly sports activities. |
|
Physical Fitness Centre: |
A Sports Establishment specialised in improving and raising physical
fitness and health through providing the gear, equipment, and qualified staff
required for this purpose. |
|
Sports Event: |
Any sports activity or function organised in the Emirate for
commercial or non-commercial purposes. This includes festivals; shows;
celebrations; competitions; championships; competitive and community sports;
and sports workshops, seminars, conferences and exhibitions held anywhere in
the Emirate. |
|
Dubai Name: |
Any name, logo, symbol, drawing, or similar identifier that refers to
“Dubai” in any language. |
|
Permit: |
A document issued by the DSC authorising the establishment of a Sports
Establishment or organisation of a Sports Event, in accordance with the
provisions of this Resolution. |
|
Licensing Authority: |
The legally competent entity in the
Emirate in charge of issuing Permits to Sports Establishments, whether they are
for-profit or non-profit. |
|
Licence: |
A document issued by the
Licensing Authority to a Sports Establishment authorising it to conduct its
activities. |
|
Register: |
The register maintained by
the DSC for registering the coaches and professional staff members working at
Sports Establishments. |
|
Person: |
A natural or legal person. |
a. The provisions of this
Resolution will apply throughout the Emirate, including in Special Development
Zones and free zones such as the Dubai International Financial Centre.
b. This Resolution will apply
to:
1.
Sports
Establishments existing in the Emirate by the effective date of this
Resolution, and those established thereafter; and
2.
Sports
Events organised in the Emirate.
c. The provisions of this
Resolution will not apply to the sports activities organised by Government
Entities and non-government entities for their employees.
This Resolution aims to:
1. support Sports Establishments
in all endeavours aimed at promoting sports;
2. regulate the Sports Events
held in the Emirate in accordance with the relevant international best
practices; and
3. strengthen the role of Sports
Establishments at the social and cultural levels, and promote physical and
sports activity as a lifestyle.
a. For the purpose of achieving
the objectives of this Resolution, the DSC will have the duties and powers to:
1.
conduct
financial and administrative supervision and audit of Sports Clubs, and
regulate their work;
2.
issue
Permits for Sports Establishments and Sports Events, including those
specialised in artificial intelligence, in accordance with the conditions and
procedures stipulated in this Resolution and the resolutions issued in
pursuance hereof;
3.
issue
approvals for licensing Companies and corporations to conduct any activity
related to manufacturing, importing, or using any sports equipment involving the
application of artificial intelligence;
4.
authorising
the establishment of branches of Sports Establishments, in accordance with the
conditions and procedures stipulated in this Resolution and the resolutions
issued in pursuance hereof;
5.
oversee
the formation of the boards of directors of Sports Clubs;
6.
develop
the standards and rules required for regulating the work of Sports
Establishments and organisers of Sports Events;
7.
register,
in the Register, sports coaches, and professional
staff working at Sports Establishments, in accordance with the conditions and
procedures determined by a resolution of the Chairman;
8.
verify
compliance by Sports Establishments and organisers of Sports Events with this
Resolution and the resolutions issued in pursuance hereof; investigate the
complaints filed against them; record the violations committed by them; and
impose the penalties and punitive measures stipulated herein on violators;
9.
approve
the statutes and the regulatory, administrative, and financial bylaws of Sports
Establishments, in accordance with the conditions and procedures determined
pursuant to the relevant resolution of the Chairman;
10.
approve
the budgets of Sports Clubs, in accordance with the conditions and procedures
determined pursuant to the relevant resolution of the Chairman;
11.
set
the general framework for governance of Sports Establishments;
12.
organise
Sports Events in the Emirate, as well as the workshops, seminars, conferences,
exhibitions, and initiatives related to these Events;
13.
classify
Sports Academies, Sports Centres, Physical Fitness Centres in accordance with
the relevant standards and rules approved by the Chairman;
14.
approve
the Sports Events classification system;
15.
audit
and oversee the performance of coaches and professional staff working at Sports
Establishments, and take the necessary action in respect thereof;
16.
develop
the procedures required for measuring and evaluating the performance of Sports
Establishments; and publish the performance evaluation outcomes in any manner
it deems appropriate;
17.
issue
the necessary approvals to establish Sports Companies and Sports Academies
affiliated to Sports Clubs, in accordance with the relevant requirements and
rules approved by the DSC; and
18.
exercise
any other duties or powers required for the achievement of the objectives of
this Resolution.
b. For the purpose of exercising
its duties and powers under paragraph (a) of this Article, the DSC may seek the assistance
of experienced, competent, and specialised experts; consultants; and local,
regional, and international companies, corporations, and consultancy houses.
a. No Person may organise a
Sports Event in the Emirate without first obtaining a Permit. Permits will be
issued in accordance with the provisions of this Resolution and the resolutions
issued in pursuance hereof.
b. A Person who owns, or has the
right to manage, a venue may not allow any other Person,
including any Sports Establishment, to hold a Sports Event at that
venue unless the
Person wishing to hold the Sports Event obtains a Permit from the DSC.
c. A Licensing Authority may not
issue or renew the Licence of a Sports Establishment or Sports Event without
first obtaining authorisation from the DSC.
d. No entity responsible for
providing public services in the Emirate may
provide any
services related to a Sports Event unless this Event is authorised by the DSC.
a. A Permit will be issued to a
Sports Establishment subject to the following:
1.
The
Permit applicant must submit a study stating the activities, objectives, and
financial plan of the applicant Sports Establishment; and provide any other
relevant information specified by the DSC.
2.
Premises
that are suitable for the nature of the relevant sports activity must be
provided. The premises must satisfy the relevant requirements and
specifications prescribed by the DSC; and the conditions and requirements
stipulated by the planning, construction, public health and safety, and
environmental regulations adopted by concerned Government Entities.
3.
Qualified
administrative and professional staff must be provided in accordance with the
rules and conditions adopted by the DSC in this respect.
4.
All
equipment, gear, and fittings required for practising the sports activity that
the applicant Sports Establishment intends to conduct must be provided at its
premises as prescribed by the DSC in this respect.
5.
All required approvals of concerned Government Entities must be obtained.
6.
An
insurance policy issued by an insurance Company licensed to operate in the
Emirate must be provided to cover any damage that may result from the conduct
of sports activities by the Sports Establishment or its violation of the
provisions of this Resolution or the resolutions issued in pursuance hereof.
7.
Any
other conditions determined pursuant to the relevant resolutions of the
Chairman must be met.
b. The DSC may, where required
and subject to the relevant rules approved by the Chairman, issue a Permit to a
Sports Establishment that does not satisfy all the requirements prescribed by
paragraph (a) of this Article, in which case, the Permit must set a grace
period for satisfying the relevant requirements. Where these requirements are
not satisfied within the grace period, the Permit will be deemed revoked.
a. To be issued with a Permit to
organise a Sports Event, an applicant must:
1.
hold
a Licence issued by the Licensing Authority, stating that the applicant is
authorised to conduct the activity of holding Events in the Emirate;
2.
submit
a study on the proposed Sports Event, together with the information and
documents prescribed by the relevant resolution of the Secretary General;
3.
provide
an approval issued by the entity that owns the venue where the Sports Event is intended to
be held. The venue must be appropriate for the proposed Sports Event and in
conformity with the relevant conditions and rules prescribed by the DSC;
4.
provide
the security and safety means that are applicable to the proposed Sports Event,
in accordance with the relevant requirements adopted by the DSC and concerned
Government Entities;
5.
present
the approvals to hold the Sports Event, obtained from concerned Government
Entities, where such approvals are required;
6.
provide
the qualified administrative and professional staff required for managing the
Sports Event, in accordance with the requirements adopted by the DSC in this
respect;
7.
provide
all the gear, equipment, and fittings required to ensure that the Sports Event
will be held in accordance with the procedures adopted by the DSC in this
respect;
8.
provide
an insurance policy issued by an insurance Company licensed to operate in the
Emirate to cover any damage that may be sustained by third parties on account
of the organised Sports Event;
9.
specify
the entities participating in and sponsoring the Sports Event, if any;
10.
ensure
that the name, logo, and signs to be used for the Sports Event, as well as the
use of the Dubai Name, meet the relevant conditions and rules adopted by the
DSC and concerned Government Entities; and
11.
meet
any other requirements determined pursuant to the relevant resolution of the
Chairman.
b. Except for the condition
stipulated in sub-paragraph (a)(10) of this Article, the Secretary General may
exempt a Permit applicant from any of the conditions stipulated in paragraph
(a) of this Article, in accordance with the conditions and rules determined
pursuant to the relevant resolution issued by the Chairman.
The Secretary General will, pursuant to a resolution he
issues in this respect, prescribe the procedures that must be followed and the
documents that must be submitted to obtain Permits.
a. A Sports Establishment Permit
will be valid for a period of one (1) year, renewable for the same period. The
Permit will be renewed subject to the conditions and procedures prescribed by
the relevant resolution of the Secretary General.
b. A Sports Event Permit will be
valid for the period stated therein. A Permit validity period may be extended
as determined by the Secretary General in this regard.
A Permit may not be assigned to any Person without first
obtaining the approval of the DSC. This approval will be issued in accordance
with the rules and conditions determined by the relevant resolution of the
Chairman. Any assignment concluded without first obtaining the approval of the
DSC will be deemed null and void.
a. A Register will be maintained
by the DSC for registering coaches and professional staff members of Sports
Establishments. The form of the Register, the information to be entered
therein, and the conditions and procedures for registration therein will be
determined pursuant to the relevant resolution of the Chairman.
b. Registration in the Register
is a prerequisite for coaches and professional staff members to work at Sports
Establishments.
a. Subject to the legislation in
force in the Emirate, and in accordance with the exigencies of public interest,
the Chairman may issue the necessary resolutions concerning:
1.
merger
of more than one Sports Clubs into one Sports Club;
2.
acquisition
by a Sports Club of one or more Sports Clubs; and
3.
dissolution
of any Sports Club.
b. The resolutions issued by the
Chairman concerning the merger, acquisition, or dissolution of Sports Clubs
will provide for the transfer of the rights and obligations of the merged,
acquired, or dissolved Sports Clubs.
c. The General Secretariat will,
in coordination with concerned Government Entities in the Emirate, follow up the
implementation and impacts of the merger, acquisition, or dissolution
resolutions.
a. The DSC will draft the rules,
regulations, and procedures required for the governance of Sports Clubs, and
submit the same to the Chairman for approval.
b. In drafting the rules,
regulations, and procedures for the governance of Sports Clubs, the following
must be determined:
1.
the
information that must be provided in a Sports Club’s statute;
2.
the
methodology for
approving a Sports Club’s organisational structure;
3.
the
relationship between a Sports Club and its affiliates;
4.
the
duties and responsibilities of the main entities in charge of Sports Clubs and
the decision-making centres therein;
5.
procedures
and rules for forming the board of directors of Sports Clubs, regulating the
membership of these boards, and determining the term of that membership;
6.
procedures
for convening meetings of boards of directors and general assemblies of Sports
Clubs;
7.
the
obligations and responsibilities of chairmen and members of the boards of
directors of Sports Clubs; and
8.
any
other information or rules determined pursuant to the relevant resolution of
the Chairman.
a. Sports Academies, Sports
Centres, Physical Fitness Centres, and Sports Events will be classified
according to the relevant systems approved by the Chairman.
b. The Secretary General will,
pursuant to a resolution he issues in this respect, determine the process and
procedures for registration on the classification systems referred to in
paragraph (a) of this Article, and the effect of this classification.
In addition to the obligations stipulated by the provisions
of the legislation in force in the Emirate, a Sports Establishment must:
1.
comply
with the terms of its Permit;
2.
not
conduct any sports activity that is not stated in its Permit without first
obtaining the relevant approval of the DSC;
3.
not
amend its statute without first obtaining the relevant approval of the DSC;
4.
obtain
the DSC approval of its regulatory, administrative, and financial bylaws;
5.
submit
periodic reports to the General Secretariat on the activities it conducts; and
a summary report on its financial accounts, as prescribed in this regard by the
DSC;
6.
observe
public order and morality and the UAE values and traditions, and not express
contempt of religion; engage in politics; or instigate sectarian, racial, or
ethnic conflicts;
7.
hold
any Sports Event only in the venue designated for the same;
8.
obtain
the DSC approval of its participation in any sports activities outside of the
UAE;
9.
create,
and regularly update, a record of its coaches and professional staff;
10. follow up the registration of
its coaches and professional staff in the Register;
11. approve terms of reference
that conform to the technical specifications and standards related to Sports
Establishments and to their equipment, gear, and facilities, as prescribed by
the DSC and concerned Government Entities in this respect;
12. not hire any coach or
professional staff member who is not registered in the Register;
13. not use the premises of the
Sports Establishment for other than its intended purpose;
14. not construct or take lease
of new premises, or make changes to its existing premises, without first
obtaining the relevant approval of the DSC;
15. provide the DSC with all the
information it requires and enable the DSC authorised competent employees to
peruse its documents and records and access its facilities;
16. provide the basic supplies,
including technical devices and equipment, required for conducting the
authorised activities;
17. meet the public health and
safety and the environmental requirements, as prescribed in this respect by the
DSC and concerned Government Entities;
18. not establish a commercial
corporation or Company, or hold shares therein, without first obtaining the
relevant approval of the DSC;
19. comply with the resolutions
issued by the DSC concerning governance of Sports Establishments and other
relevant resolutions; and
20. fulfil any other obligations
determined pursuant to the relevant resolution of the Chairman.
In addition to the obligations prescribed by the
legislation in force in the Emirate, a Sports Event organiser must:
1. comply with the terms of the
Permit;
2. ensure the safety of the
Sports Event participants and attendees throughout the duration of the Sports
Event, in accordance with the requirements prescribed by the DSC and concerned
Government Entities, including providing ambulance services;
3. not use any gear or materials
that may pose a hazard to the environment or the health and safety of the
Sports Event participants and attendees;
4. use the name, logo, and sign
of the Sports Event in accordance with the relevant conditions adopted by the
DSC;
5. use the Dubai Name in
accordance with the relevant conditions adopted by the DSC and concerned
Government Entities;
6. not advertise the Sports
Event without first obtaining the relevant approval of the DSC. This approval
will be issued in accordance with the conditions adopted by the DSC in this
respect;
7. conspicuously display the
logo of the DSC in accordance with the rules and specifications adopted by the
DSC in this respect;
8. hold the Sports Event at the
designated time and venue, as stated in the Permit;
9. alert Sports Event
participants and attendees to the importance of observing public order and
morals and the customs and traditions of the UAE;
10. submit a report to the General
Secretariat on the Sports Event upon its conclusion, in accordance with the
relevant requirements adopted by the DSC;
11. comply with the guidelines
issued by the DSC in respect of organising Sports Events; and
12. perform any other obligations
determined pursuant to a resolution of the Chairman.
A name, logo, or sign
will be used for
a Sports Event subject to the following:
1. It must be relevant to the
sport to which the Sports Event is dedicated.
2. Approvals and permissions
from the concerned Government Entities in the Emirate to use the name, logo, or
sign must be obtained, where required.
3. It must not include any
reference that conflicts with public order or morals.
4. It must not have any
political, religious, ethnic, or racist connotation or indication; and not
constitute an offence to any Person.
5. An undertaking must be
submitted to the DSC stating that the name, logo, or sign does not include
anything that constitutes a violation of third party intellectual and moral
rights within or outside of the UAE.
6. Any other conditions
determined pursuant to the relevant resolution of the Chairman must be met.
Without prejudice to any conditions adopted by concerned
Government Entities in the Emirate for using the Dubai Name, the Dubai Name will
be used for a Sports Event subject to the following:
1. The applicant for the Sports
Event Permit and for use of the Dubai Name must have a significant role at the local,
regional, or international levels.
2. The Sports Event must have
substantial impacts and positive effects on the Emirate.
3. The Sports Event must meet
the relevant standards adopted by the DSC.
4. Any other conditions
determined pursuant to the relevant resolution of the Chairman must be met.
a. Without prejudice to any
stricter penalty stipulated in any other resolution, a Person who commits any
of the violations set out in the Schedule attached to this Resolution will be
punished by the fine indicated opposite that violation.
b. Upon repetition of the same
violation within one (1) year from the date of the previous violation, the
amount of the fine will be doubled. A doubled fine must not exceed one hundred
and fifty thousand Dirhams (AED 150,000.00).
c. In addition to the penalty of
a fine, the Secretary General may, in coordination with concerned Government
Entities, take any of the following measures against a violating entity:
1.
suspending
the activities of the violating Sports Establishment for a period not exceeding
six (6) months;
2.
prohibiting
the violating Sports Establishment from accepting registration applications
from new trainees and members for a period not exceeding six (6) months;
3.
revoking
the Permit and, where the violating entity is a Sports Establishment,
coordinating with the Licensing Authority to cancel the Commercial Licence;
4.
banning
the violating Sports Establishment from applying for a Permit for a period not
exceeding two (2) years; or
5.
cessation
of the Sports Event.
The DSC employees nominated pursuant to a resolution of the
Secretary General will have law enforcement capacity to record the acts
committed in breach of the provisions of this Resolution and the resolutions
issued in pursuance hereof. For this purpose, they may access the premises of
Sports Establishments and Sports Events venues; gain access to their records;
issue the necessary violation reports; and, where necessary, seek the
assistance of police personnel.
Any affected party may submit to the Secretary General a
written grievance against any decision, procedure, penalty, or measure taken
against him in accordance with this Resolution or the resolutions issued in
pursuance hereof, within thirty (30) days from the date of being notified of
the contested decision, procedure, penalty, or measure. The grievance will be
determined, within thirty (30) days of its submission, by a committee formed by
the Secretary General for this purpose; and the decision issued by the
committee on the grievance will be final.
No Sports Establishment or Sports Event organiser may raise or accept Donations, aid, or
gifts from any Person within or outside of the UAE; or allow raising, or
the announcement of raising,
the same through print, audio, or visual means of communication and media,
including social media, or any other means without first obtaining the relevant
approval of the DSC and concerned Government Entity.
The fines collected pursuant to this Resolution will be
paid to the Public Treasury of the Government.
The DSC may outsource any of its duties and delegate any of
its powers under this Resolution to any other entity pursuant to an agreement
concluded for this purpose. This agreement will state its term and the rights
and obligations of both parties.
The Chairman may delegate any of his powers under this
Resolution to the vice chairman or the Secretary General, provided that such
delegation is specific and in writing.
The DSC will not be liable for any obligations or damage
that may be sustained by third parties as a result of the Sports Establishments
and Sports Event organisers conducting their authorised activities in the
Emirate.
All concerned Government Entities in the Emirate must, upon
request, fully cooperate and coordinate with, and provide required support to,
the DSC to enable it to perform the functions assigned to it under this
Resolution and the resolutions issued hereunder.
All Sports Establishments and Sports Event organisers
operating in the Emirate by the effective date of this Resolution must comply
with the provisions of this Resolution upon the expiry of their Licences or
Permits or within no later than six (6) months from the effective date of this
Resolution, whichever comes first.
Except for the resolutions whose issuing authority is
delegated to the vice chairman or vested in the Secretary General under this
Resolution, the Chairman will issue the resolutions required for the
implementation of this Resolution. These implementing resolutions will be
published in the Official Gazette of the Government of Dubai.
Any provision in any other resolution will be repealed to
the extent that it contradicts this Resolution.
This Resolution will be published in the Official Gazette
and will come into force on the day on which it is published.
