Decree No. (42) of 2022
Terminating the
Mandate of a Special Tribunal[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of
Dubai,
After perusal of:
Law No. (13) of 2016 Concerning the Judicial Authorities in the Emirate
of Dubai and its amendments;
Decree No. (34) of 2009 Forming a Special Tribunal to Settle the
Financial Liabilities of the Debtor, Abid Ramadan Abdullah Saeed Ra'ae Al Boom,
and its amendments; and
Based on the recommendation of the Chairman of the Judicial Council of
the Emirate of Dubai,
Do hereby issue this Decree.
a.
Pursuant
to this Decree, the mandate of the special Tribunal formed pursuant to the
above-mentioned Decree No. (34) of 2009 is terminated.
b.
All
claims and applications to be filed after the effective date hereof with
respect to the financial liabilities of the Debtor, Abid Ramadan Abdullah Saeed
Ra'ae Al Boom, will be registered with the competent courts.
The claims and applications that have not yet been
determined by a definitive decision or award of the special Tribunal, formed
pursuant to the above-mentioned Decree No. (34) of 2009, will be referred,
without charging any additional fees, to the competent courts in accordance
with the rules of jurisdiction stipulated in the legislation in force in the
Emirate of Dubai.
The above-mentioned Decree No. (34) of 2009 is
hereby repealed. Any provision in any other legislation is also hereby repealed
to the extent that it contradicts the provisions of this Decree.
This Decree comes into force on the day on which
it is issued, and will be published in the Official Gazette.
