After perusal
of:
The Order of
1961 Establishing the Dubai Municipality (the “DM”);
Local Order
No. (89) of 1994 Regulating the Engineering Consultancy Profession in the
Emirate of Dubai and its amendments;
Administrative
Resolution No. (51) of 1998 Issuing the Implementing Bylaw of Local Order No.
(89) of 1994 Regulating the Engineering Consultancy Profession in the Emirate
of Dubai (the “Original Resolution”); and
Administrative
Resolution No. (32) of 2006 Forming the Committee for Registration and
Licensing of Engineering Consultants and Contractors in the Emirate of Dubai
and its amendments,
Do hereby issue this Resolution.
Articles (1), (5), (6), and (20) of the Original Resolution are
hereby superseded by the following:
The following words and expressions, wherever mentioned in this
Resolution, will have the meaning indicated opposite each of them unless the
context implies otherwise:

Committee: |
The
Committee for Registration and Licensing of Engineering Consultants and
Contractors in the Emirate of Dubai formed pursuant to Administrative Resolution
No. (32) of 2006 and its amendments. |
a.
Local Engineering Firms may combine more than one Engineering Specialisations, or add one or more new Engineering
Specialisations to their original specialisations, subject to the following:
1.
The Engineering Specialisations to be combined or added must be relevant, and consistent with each other, as determined at the discretion of the
Committee.
2.
At least one specialist Engineer must be designated to each Engineering Specialisation requested to be added. However, where necessary, the Committee may:
a.
require the assignment of more
than one Engineer to each Engineering Specialisation;
b.
approve the assignment of one or more of the Engineers registered for the original Engineering Specialisation to work in the Engineering Specialisation requested to be added for any period prescribed by the Committee. In this case, the local
Engineering Firm must, within this prescribed period, designate a new Engineer to the additional
specialisation.
b.
In licensing an additional Engineering Specialisation in accordance
with the provisions of paragraph (a) of this Article, the specialisation must
be classified in accordance with the provisions of Article (8) of this
Resolution. When working in the additional specialisation, the local Engineering Firm must abide by the type of projects and works
authorised to be carried out, as per the classification category of that specialisation.
a.
The works and projects authorised to be carried out by a local civil or architectural
Engineering Firm, which is licensed to practise the engineering consultancy
profession in any of the building construction fields, will be determined based
on the classification category of that firm as follows:
-
First Category: Buildings with unlimited number of floors.
-
Second Category: Buildings comprising G + 12 floors.
-
Third Category: Buildings
comprising G + 4 floors.
b.
Notwithstanding the provisions of paragraph (a) of this Article and with a view
to qualifying a local Engineering Firm and upgrading its
classification to a higher category, the Committee may authorise the local Engineering Firm to carry out a project or works in a category higher than its current category, provided that the number of floors of the building in question does not exceed the maximum number prescribed for the category of the firm by more than three (3) floors. The
local Engineering Firm may apply for a permit to carry out another project or works in a category that is higher than its classification category only after completing the previous
project or works.
c.
The works and projects authorised to be carried out by a local Engineering Firm, which is
licensed to practise the engineering consultancy profession in other than
building construction fields, will be classified into the categories prescribed by the entity in charge of regulating
and licensing such projects and works.
Notwithstanding the provisions of Article (8) of this Resolution,
in order for a local Engineering Firm to be licensed to work in the Engineering Specialisation of
“Engineering Management and Technical Feasibility Studies for Building
Construction Projects” as its main specialisation, the firm must designate the required number of Engineers, and ensure that they have the number of years of work
experience, prescribed
for the First Category, as stated in Schedule (2) attached hereto. Where the local
Engineering Firm requests to add that specialisation to other specialisations for the purpose of
obtaining a licence, the firm must designate the required
number of Engineers, and ensure that they have the number of years of work experience, prescribed for the category under which
the firm is classified. In this last case, the local Engineering Firm may be authorised to work in the added Engineering Specialisation only in respect of the projects and works falling within the category under which the firm is
classified.
Schedules (2) attached to the Original Resolution is hereby
superseded by the Schedule attached hereto.
All local Engineering Firms in the Emirate, to which the Local
Order and the resolutions issued in pursuance thereof apply, must comply with
the provisions hereof within no later than one (1) month from the date on which
this Resolution comes into force. The Committee may extend this grace period
once for the same period.
a.
Schedule (3) attached to the Original Resolution is hereby
repealed.
b.
Any provision in any other administrative resolution will be
repealed to the extent that it contradicts the provisions of this Resolution.
This Resolution will be published in the Official Gazette and will
come into force on the day on which it is published.

Notes |
1.
All Engineers must be
members of the UAE Society of Engineers 2.
All Engineers must have
passed the technical tests prescribed in the Emirate of Dubai 3.
The Licensee working on
a full-time basis in the firm will be considered part of the technical staff 4.
The number of engineers
stated in this Schedule is the minimum number required to practise the
profession. The Committee may, where the floor area of projects exceeds the
area mentioned above, require more Engineers based on the Area Requirement
for Each Engineer and on the project implementation phases. |
