Issuing the Implementing Bylaw of

Executive Council Resolution No. (57) of 2017 Regulating the

Issuance of Vehicle Drivers’ Licences and Permits in the Emirate of Dubai[1]

The Director General and Chairman of the Board of Executive Directors of the Roads and Transport Authority,

After perusal of:

Federal Law No. (21) of 1995 Concerning Road Traffic, its Implementing Bylaw, their amendments, and the resolutions issued in pursuance thereof;

Law No. (17) of 2005 Establishing the Roads and Transport Authority and its amendments; and

Executive Council Resolution No. (57) of 2017 Regulating the Issuance of Vehicle Drivers’ Licences and Permits in the Emirate of Dubai,

Does hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

 

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Law:

The above-mentioned Federal Law No. (21) of 1995.

RTA:

The Roads and Transport Authority.

Agency:

The Licensing Agency of the RTA.

Vehicle:

Any motorised machine, pedal cycle, motorcycle, carriage, or other machine designed to run on roads, whether mechanically propelled or otherwise. This includes tractors.

Driver’s Licence:

A document issued by the Agency authorising its holder to drive a particular category of Vehicles.

Special Driver’s Permit:

A document issued by the Agency authorising its holder to drive a particular category of Vehicles in a particular area or to perform special duties.

Occupational Driver’s Permit:

A document issued by the Agency authorising its holder to drive a category of Vehicles designated for any of the occupational purposes determined pursuant to the Law or determined by the Agency.

Learner:

A natural person who is authorised by the Agency to learn to drive a Vehicle in order to obtain a Driver’s Licence, a Special Driver’s Permit, or an Occupational Driver’s Permit.

Examiner:

A natural person who is authorised by the Agency to test Learners.

Test Site:

A site approved by the Agency for testing Learners for the purpose of granting them Special Drivers' Permits.

Assessment Test:

A test conducted by the Agency for a driver whose licence is suspended, cancelled, or revoked in accordance with the Law, or whose licence expires and is not renewed within the time frame stipulated in this Resolution.

 

Occupational Drivers' Permits

Article (2)

a.    A person applying to the Agency for an Occupational Driver’s Permit must:

1.    hold a valid Driver’s Licence issued in the UAE;

2.    prove that he works as a driver;

3.    be medically fit; and

4.    be of good character and repute.

b.    An Occupational Driver’s Permit will be valid for a period of one (1) year, renewable for the same period subject to the same conditions stipulated in paragraph (a) of this Article.

Desert Driving Permits

Article (3)

a.    A person applying to the Agency for a Desert Driving Permit must:

1.    hold a valid Driver’s Licence issued in the UAE at least two (2) years prior to the application date;

2.    be medically fit;

3.    not be less than twenty-one (21) years of age;

4.    be of good character and repute;

5.    for a UAE resident, prove that he works for an establishment licensed to conduct tourist activities in accordance with the legislation in force in the Emirate;

6.    hold a valid tour guide certificate issued by the concerned entity in the Emirate; and

7.    successfully pass the desert driving test prescribed by the Agency.

b.    A Desert Driving Permit will be valid for a period of one (1) year, renewable for the same period subject to the following conditions:

1.    The applicant must hold a valid Driver's Licence.

2.    The applicant must be medically fit.

3.    The applicant must be of good character and repute.

4.    For a UAE resident, the applicant must prove that he works for an establishment licensed to conduct tourist activities in accordance with the legislation in force in the Emirate.

Test Site Permits

Article (4)

a.    An applicant for a Test Site permit must:

1.    have a traffic file;

2.    specify the category of Vehicle to be stated in the Special Drivers' Permits;

3.    specify the area and lanes on which the Vehicles of the category to be stated in the Special Driver’s Permit will run, and the special activities to be performed within the Test Site, if any;

4.    obtain approvals of the entities concerned with the Test Site;

5.    ensure that the Test Site is prepared and suitable for the category of the Vehicles to be stated in the Special Driver’s Permit;

6.    designate a suitable area within the Test Site that is semi-closed by artificial barriers, based on the type of the Special Driver’s Permit; and

7.    provide security and safety gear on the Test Site, such as helmets and protective jackets for drivers and Examiners, and first aid kits.

b.    A Test Site permit will be valid for a period of one (1) year, renewable for the same period subject to the same conditions stipulated in paragraph (a) of this Article.

Types of Special Drivers' Permits

Article (5)

a.    Types of Special Drivers' Permits will be as follows:

1.    Special Driver’s Permit for a motorcycle;

2.    Special Driver’s Permit for a light Vehicle;

3.    Special Driver’s Permit for a heavy Vehicle;

4.    Special Driver’s Permit for a light bus;

5.    Special Driver’s Permit for a heavy bus;

6.    Special Driver’s Permit for light mechanical equipment; and

7.    Special Driver’s Permit for heavy mechanical equipment.

b.    A person applying to the Agency for any of the permits stipulated in paragraph (a) of this Article must:

1.    be medically fit;

2.    hold a valid residence permit (for non-UAE nationals);

3.    be at least:

-       seventeen (17) years old (in case of applying for a motorcycle Special Driver’s Permit);

-       eighteen (18) years old (in case of applying for a light Vehicle Special Driver’s Permit);

-       twenty (20) years old (in case of applying for a heavy Vehicle Special Driver’s Permit);

-       twenty-one (21) years old (in case of applying for a light bus Special Driver’s Permit);

-       twenty-one (21) years old (in case of applying for a heavy bus Special Driver’s Permit);

-       twenty (20) years old (in case of applying for light mechanical equipment Special Driver’s Permit); or

-       twenty (20) years old (in case of applying for heavy mechanical equipment Special Driver’s Permit).

4.    successfully pass the theory and practical driving tests prescribed by the Agency according to the type of the requested permit; and

5.    take the driving test in a Test Site that has a valid permit.

c.     All types of Special Drivers’ Permits will be valid for a period of two (2) years, renewable subject to the same conditions stipulated in paragraph (b) of this Article. The Agency may, upon the request of the concerned government entity, grant the employees of that entity Special Drivers’ Permits valid for more than two (2) years and renewable for the same period.

Examiner Permits

Article (6)

A person applying for an Examiner permit must:

1.    be an RTA employee;

2.    hold a valid Driver's Licence issued in the UAE, for the specific category of Vehicles he will use to conduct tests, at least three (3) years prior to the application date;

3.    successfully pass the Examiner qualification and training course according to the category of Vehicles he will use to conduct tests and in accordance with the relevant rules adopted by the Agency; and

4.    be medically fit.

Permit Issuance Procedures

Article (7)

In issuing the permits stipulated in this Resolution, the following procedures will be followed:

1.    The applicant must submit to the Agency, through the channels prescribed by the RTA, an application accompanied by the required documents and information applicable to the type of the requested permit.

2.    The applicant must take and successfully pass the technical examinations, courses, and tests required by the Agency, if any.

3.    The Agency will, where required, conduct the necessary inspections and assessments based on the type of the requested permit.

4.    The Agency will issue the requested permit upon verifying that the relevant issuance requirements are met and that the prescribed fees are collected           .

Test Vehicle Specifications and Requirements

Article (8)

A test Vehicle must meet the following specifications and requirements:

1.    The Vehicle must be fitted with the necessary safety gear, including seatbelts, a fire extinguisher, and a first aid kit.

2.    A "Driver under Test” sticker must be affixed to the rear side of the Vehicle.

3.    The registration card of the Vehicle must be valid.

4.    The Vehicle must be fitted with extra mirrors as prescribed by the Agency in this respect.

5.    A manual Vehicle must be fitted with an additional accelerator, brake pedal, and clutch, whereas an automatic Vehicle must be fitted with an additional accelerator and brake pedal.

6.    The test Vehicle must be fitted with audio and video recording equipment to record the test and what happens inside the Vehicle cabin.

7.    A test vehicle sticker must be affixed to both sides of the Vehicle as prescribed by the Agency in this respect.

8.    The age of the Vehicle must not exceed:

-       four (4) years (for a light Vehicle);

-       three (3) years (for a motorcycle);

-       eight (8) years (for a light bus);

-       eight (8) years (for a heavy bus);

-       eight (8) years (for a heavy Vehicle);

-       ten (10) years (for light mechanical equipment); and

-       ten (10) years (for heavy mechanical equipment).

Classification of Examiners

Article (9)

Examiners are classified into the following categories:

1.    light Vehicle Examiners;

2.    motorcycle Examiners;

3.    light bus Examiners;

4.    heavy bus Examiners;

5.    heavy Vehicle Examiners;

6.    light mechanical equipment Examiners; and

7.    heavy mechanical equipment Examiners.

Assessment Test Requirements

Article (10)

a.    A person applying for an Assessment Test must:

1.    take the eye vision test at any of the centres approved by the Agency;

2.    pass the practical driving test prescribed by the Agency; and

3.    pay the prescribed fees.

b.    A person whose Driver’s Licence expires and fails to renew it may take the Assessment Test only upon the lapse of ten (10) years from the date of expiry of the licence.

Cancellation and Non-renewal of Permits

Article (11)

Where it is established that a permit holder fails or ceases to meet any of the requirements prescribed for issuing any of the permits stipulated in this Resolution, that permit will be cancelled or will not be renewed.

Issuing Instructions

Article (12)

The Chief Executive Officer of the Agency will issue the instructions required for the implementation of the provisions of this Resolution.

Publication and Commencement

Article (13)

This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
