Resolution No. (35) of 2026
Determining
the Violations Related to Early Childhood Centres
That
Require the Issuance of Written Warnings Prior to Imposing Fines on Violators[1]

The
Director General of the Knowledge and Human Development Authority in Dubai,
After perusal of:
Law No. (2) of 2021 Concerning the Knowledge and Human
Development Authority in Dubai (the “KHDA”);
Law No. (6) of 2026 Concerning Administrative Violations,
Penalties, and Measures in the Emirate of Dubai; and
Executive Council
Resolution No. (35) of 2020 Regulating Early Childhood Centres in the Emirate
of Dubai and its amendments,
Does
hereby issue this Resolution.
The
words and expressions mentioned in this Resolution have the same meanings respectively
assigned to them in the above-mentioned Executive Council Resolution No. (35)
of 2020.
a.
The following Administrative
Violations require written warnings to be served on violators before the fines
prescribed under the above-mentioned Executive Council Resolution No. (35) of
2020 are imposed, to allow them to rectify and remedy the violations:
1.
failure to provide the KHDA with the
data, information, reports, or statistics required by the KHDA or its
authorised representatives; or providing them with incomplete, inaccurate, or
incorrect data, information, reports, or statistics;
2.
conducting any activity other than
the Centre's authorised Activity;
3.
changing the name, address, or any other details
stated in the Permit of the Centre without first obtaining the relevant
approval of the KHDA;
4.
failure to constantly develop the
abilities and skills of the Professional Cadre to ensure the provision of
high-quality Care and Education;
5.
authorising any party other than the
Centre's Operator or Manager to interfere with its affairs;
6.
constructing new buildings; adding new facilities; closing
down any existing facility; or taking a lease of any new building for the
purpose of conducting the Activity, without first obtaining the relevant
approval of the KHDA and the Concerned Government Entities;
7.
failure to conclude contracts, in
Arabic or English as the case may be, with Parents, which set out all rights
and obligations of the parties; or failure to get these contracts approved by
the KHDA;
8.
advertising by a Centre of its
services in any manner whatsoever without first obtaining the relevant approval
of the KHDA;
9.
failure to maintain a website for
the Centre containing information on the Curriculum, Care and Education Fees,
Professional Cadre, development plans, and children’s achievements, as well as
any other information related to the Activity;
10. failure
to comply with the annual calendar approved by the KHDA;
11. failure
to obtain the relevant approval of the KHDA prior to admitting a child to the
Centre; and
12. conducting
any programme or activity other than those approved by the KHDA for
implementation by the Centre.
b.
Where the Centre fails to comply
with the requirement to rectify and remedy an Administrative Violation within
the timeframe prescribed by the KHDA, the KHDA may impose the fine prescribed
for that Administrative Violation, in addition to any other Administrative
Measures prescribed in the above-mentioned Executive Council Resolution No.
(35) of 2020.
Having
regard to the severity of the Administrative Violation and its potential
consequences, the KHDA may, in respect of the Administrative Violations
referred to in Article (2) of this Resolution, directly impose the prescribed
fine without issuing a written warning, provided that it complies with the controls
prescribed for the imposition of Administrative Penalties and Administrative
Measures under the above-mentioned Law No. (6) of 2026.
This
Resolution will be published in the Official Gazette and will come into force
on the day on which it is published.
