 Determining the

Administrative Violations by Private Schools

Requiring the Issuance of Written Warnings

Prior to Imposing Fines on Violators[1]

The Director General of the Knowledge and Human Development Authority in Dubai,

After perusal of:

Law No. (2) of 2021 Concerning the Knowledge and Human Development Authority in Dubai (the “KHDA”);

Law No. (6) of 2026 Concerning Administrative Violations, Penalties, and Measures in the Emirate of Dubai; and

Executive Council Resolution No. (2) of 2017 Regulating Private Schools in the Emirate of Dubai,

Does hereby issue this Resolution.

Definitions

Article (1)

The words and expressions mentioned in this Resolution have the same meaning assigned to them in the above-mentioned Executive Council Resolution No. (2) of 2017.

Violations Requiring Written Warnings

Article (2)

a.    The following Administrative Violations require written warnings to be served on violators before the fines prescribed under the above-mentioned Executive Council Resolution No. (2) of 2017 are imposed, to allow them to rectify and remedy the violations:

1.    failure to comply with the conditions and procedures adopted by the KHDA for the enrolment of Students;

2.    admission of a Student to a Private School without obtaining the approval of the KHDA;

3.    granting discounts on Tuition Fees without obtaining the approval of the KHDA;

4.    enrolling a Student who does not meet the prescribed requirements after the expiry of the grace period, without obtaining the approval of the KHDA;

5.    delay in promoting a Student to the next School Year beyond the prescribed timeframe;

6.    conducting, in a Private School, any activity other than the Educational Activity, or any programmes or activities not authorised by the KHDA;

7.    failure to provide the data, information, reports, and statistics requested by the KHDA or any of its authorised representatives; or failure to provide true and accurate data, information, reports, and statistics;

8.    failure to submit an enrolment application within the period prescribed by the KHDA;

9.    failure to comply with the KHDA requirements for the maximum number of Students per class;

10.  delay by a Private School in entering into the relevant system the details of Students transferred to other schools within the Emirate, without a reason acceptable to the KHDA;

11.  changing the name, address, or any details stated in the Educational Permit of the Private School without obtaining the approval of the KHDA;

12.  constructing new buildings, adding new facilities to the Private School, closing down any existing facility, or taking a lease of any new building, without obtaining the approval of the KHDA;

13.  authorising any Person other than the Principal or the Operator to interfere in the affairs of the Private School;

14.  failure to provide the supplies required for conducting the Educational Activity, including devices, equipment, furniture, and any other supplies the KHDA deems necessary for Private Schools, such as special supplies for Students with disabilities;

15.  failure to conclude with a Parent the Arabic or English contract adopted by the KHDA setting out all the rights and obligations of the parties;

16.  advertising, by a Private School, of its services without obtaining the approval of the KHDA or failure to comply with the promotional material approved by the KHDA;

17.  failure to accept complaints filed by Students or their Parents or to take the appropriate action in respect thereof;

18.  failure to maintain a website for the Private School containing information on the Curriculum, Tuition Fees, development plans, Student achievements, and any other information related to the Educational Activity; and

19.  failure to start the Educational Activity within ninety (90) days from the date on which the Educational Permit is issued, or within any other period prescribed by the KHDA, without a reason acceptable to the KHDA.

b.    Where the Private School fails to comply with the requirement to rectify and remedy an Administrative Violation within the timeframe prescribed by the KHDA, the KHDA may impose the fine prescribed for that Administrative Violation, in addition to any other Administrative Measures prescribed in the above-mentioned Executive Council Resolution No. (2) of 2017.

KHDA Powers

Article (3)

Having regard to the severity of the Administrative Violation and its potential consequences, the KHDA may, in respect of the Administrative Violations referred to in Article (2) of this Resolution, directly impose the prescribed fine without issuing a written warning, provided that the KHDA complies with the controls prescribed for the imposition of Administrative Penalties and Administrative Measures under the above-mentioned Law No. (6) of 2026.

Publication and Commencement

Article (4)

This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
