Forming
the
Emirati
Supplier Support Committee[1]

The
Director General of the Department of Economy and Tourism in the Emirate of
Dubai,
After perusal of:
Law No. (5) of 1995
Establishing the Department of Finance;
Law No. (20) of 2021
Establishing the Department of Economy and Tourism in the Emirate of Dubai; and
Law No. (23) of 2009
Concerning the Mohammed bin Rashid Establishment for Small and Medium-sized
Enterprises Development and its amendments,
Does
hereby issue this Resolution.
The following words and expressions, wherever mentioned in this
Resolution, have the meanings respectively indicated opposite each of them
unless the context implies otherwise:

DET: |
The Department of Economy and Tourism in the Emirate
of Dubai. |
|
Dubai SME: |
The Mohammed bin Rashid Establishment for Small and
Medium-sized Enterprises Development. |
|
Director General: |
The Director General of the DET. |
|
Emirati Supplier: |
A private company or establishment registered with
the Dubai SME. |
|
ESSC: |
The Emirati Supplier Support Committee formed
pursuant to this Resolution. |
|
Chairman: |
The chairman of the ESSC. |
|
Procurement: |
The purchase or other acquisition by Government
Entities of the goods and services required to meet their needs. |
a.
Pursuant
to this Resolution, a permanent advisory committee named the “Emirati Supplier
Support Committee” is formed at the DET under the chairmanship of the Chief
Executive Officer of the Dubai SME and with the membership of representatives
from the following entities:
1.
the DET;
2.
the Dubai Municipality;
3.
the Roads and Transport Authority;
4.
the Dubai Customs;
5.
the Dubai Airports Corporation;
6.
the Dubai Electricity and Water
Authority PJSC;
7.
the Dubai Health Authority; and
8.
the Dubai Police.
b.
The
representatives of the entities referred to in paragraph (a) of this
Article will be nominated by the officials in charge of these entities. A
representative must be experienced and specialised in the field of work of the
ESSC, and must hold a grade not lower than the “Executive Director/ Chief
Executive Officer” grade, or an equivalent grade.
The ESSC will have the following functions:
1.
develop
programmes designed to increase the share of Emirati Suppliers in the total
Procurement of Government Entities, in line with the objectives of the Dubai
Economic Agenda (D33);
2.
propose policies and procedural guidelines to
ensure that Emirati Suppliers are given priority in Procurement by Government
Entities;
3.
propose
clear
and streamlined mechanisms to facilitate Emirati Suppliers' access to tenders
issued, and major projects launched, by Government Entities, including by
simplifying final banking requirements and expediting payments due to Emirati
Suppliers;
4.
propose initiatives and incentives
aimed at increasing the number of Emirati Suppliers registered on the
“Tasharok” platform of the Department of Finance, thereby supporting the local
economy and enhancing the competitiveness of Emirati Suppliers;
5.
propose policies to encourage
contractors, suppliers, and principal service providers to engage Emirati
Suppliers as subcontractors in connection with Procurement activities and
contracts concluded by Government Entities;
6.
examine and analyse the challenges
affecting the award of tenders to Emirati Suppliers, and submit appropriate
solutions and recommendations to address
such challenges to the Director General for
presentation to the competent entities in the Emirate to issue the relevant
directives;
7.
propose performance indicators to
measure the extent of cooperation by Government Entities in granting Emirati
Suppliers preferential access to Procurement activities and contracts concluded
by Government Entities;
8.
provide support and appropriate
suggestions to Emirati Suppliers on pricing and the preparation of competitive
bids, to ensure that products and services of Emirati Suppliers meet the
highest required standards and technical specifications;
9.
propose a system for the
classification of distinguished Emirati Suppliers in accordance with quality
and compliance criteria, to facilitate their selection by Government Entities;
and submit this proposal to the Director General for consideration and
presentation to the competent entities in the Emirate to issue the relevant
directives;
10. propose
integrated coordination mechanisms among Government Entities to ensure the
alignment of their roles in supporting Emirati Suppliers’ participation in the
tenders issued by the concerned entities;
11. identify
and monitor the sectors in which the Emirati Suppliers' participation in
Procurement by Government Entities is low, and propose appropriate incentives
to increase their participation in, and attract national investment to, those
sectors;
12. seek
assistance, in performing its functions, from employees of Government Entities
in the Emirate, as the ESSC deems appropriate; and
13. perform
any other duties assigned to it by the Director General.
a.
The ESSC will be convened at the
invitation of the Chairman, or the vice chairman where the Chairman is absent,
at least once every three (3) months, or where necessary, at the time and place
determined by the Chairman or the vice chairman.
b.
At its first meeting, the ESSC will
elect a vice chairman, who will serve as the Chairman where the Chairman is
absent or becomes incapable of performing his duties.
c.
The ESSC meetings will be valid if
attended by the majority of its Members, provided that the Chairman or vice
chairman is in attendance.
d.
Recommendations of the ESSC will be
passed unanimously or by majority vote of its attending members; and in the
event of a tie, the chair of the meeting will have a casting vote.
e.
Recommendations of the ESSC will be
recorded in minutes of meetings signed by the chair of the meeting and
attending members.
f.
The ESSC may invite experts and
specialists, as it deems appropriate, to attend its meetings to assist it in
exercising its functions under this Resolution. These experts and specialists may
not have a vote in the deliberations of the ESSC.
a. A rapporteur will be appointed to the
ESSC by the Chairman from among the DET employees.
b. The rapporteur of the ESSC
will have the duties to:
1. prepare
the ESSC meeting agendas in accordance with the rules approved by the Chairman
in this respect, and notify the ESSC members of the same within sufficient time
prior to meetings;
2. send
invitations to the ESSC members to attend its meetings;
3. prepare
the minutes of the ESSC meetings;
4. verify
the presence of the quorum required for the validity of ESSC meetings;
5. follow
up on the implementation of the ESSC’s recommendations, and report to the
Chairman on the outcomes of their implementation;
6. provide
all administrative support required to enable the ESSC to perform its duties
under this Resolution; and
7. perform
any other duties assigned to him by the Chairman.
The DET will provide the ESSC with
administrative and technical support to enable it to perform its functions
under this Resolution.
The Chairman must submit to the Director
General, every six months, reports on the outcomes of the ESSC’s work,
including the achievements of the ESSC, the difficulties and obstacles it has
encountered, and the recommended solutions and proposals, to enable the
Director General to issue the relevant directives as he deems appropriate.
This Resolution will be published in the
Official Gazette and will come into force on the day on which it is published.
