Determining
the
Disputes
Falling within the Jurisdiction of the Centre for
Amicable
Settlement of Disputes[1]

The
President of the Dubai Courts,
After perusal of:
Federal Law No. (5) of 1985 Issuing the Civil Code of the
United Arab Emirates and its amendments;
Federal Law No. (29) of 2006 Concerning the Rights of
Persons with Disabilities and its amendments;
Federal Law by Decree No. (14) of 2018 Concerning the UAE
Central Bank and Regulating Financial Institutions and Activities and its
amendments;
Federal Law No. (9) of 2019 Concerning the Rights of Senior
Emiratis and its Implementing Bylaw;
Law No. (7) of 2012 Concerning Financial Social Benefits in
the Emirate of Dubai;
Law No. (18) of 2021 Regulating Conciliation in the Emirate
of Dubai;
Law No. (3) of 2022 Concerning the Rights of Persons with
Disabilities in the Emirate of Dubai, and its Implementing Bylaw and its
amendments;
Decree No. (25) of 2023 Establishing the Probate Court in
the Emirate of Dubai;
Executive Council Resolution No. (10) of 2025 Approving the
Organisational Structure of the Dubai Courts; and
Resolution No. (8) of 2022 Determining the Disputes Falling
within the Jurisdiction of the Centre for Amicable Settlement of Disputes,
Does
hereby issue this Resolution.
In
addition to the functions vested in it under Article (5) of the above-mentioned
Law No. (18) of 2021, the Centre for Amicable Settlement of Disputes (the
"CASD") will have jurisdiction to consider and determine the
following:
1.
applications for the subdivision of
property co-owned in undivided shares, excluding Disputes arising from such
subdivision where it relates to an Estate;
2.
applications for ratification of
Conciliation Agreements, irrespective of the value of the relevant claims;
3.
Disputes involving claims not
exceeding five hundred thousand dirhams (AED 500,000.00), excluding substantive
Disputes in which one of the parties is a financial institution to which the
above-mentioned Federal Law by Decree No. (14) of 2018 applies;
4.
applications for the appointment of
experts prior to the initiation of judicial proceedings, where the subject
matter of the Dispute falls within the jurisdiction of the Dubai Courts,
provided that the Dispute is not already pending before the Dubai Courts or has
not been previously determined by a final judicial decision or judgement;
5.
Disputes involving claims not
exceeding one million dirhams (AED 1,000,000.00) to which UAE Nationals over
the age of sixty (60) years are parties; and
6. Disputes
involving Persons with Disabilities or Beneficiaries of financial social
Benefits under the above-mentioned Law No. (7) of 2012.
The
Chief Justice of the Courts of First Instance will assign one or more of the
Judges of the Courts of First Instance to undertake judicial supervision of the
CASD and to determine the applications and Disputes brought before the CASD in
accordance with the above-mentioned Law No. (18) of 2021.
The
above-mentioned Resolution No. (8) of 2022 is hereby repealed. Any provision in
any other resolution is also hereby repealed to the extent that it contradicts
the provisions of this Resolution.
This Resolution will be published in
the Official Gazette and will come into force on the day on which it is
published.
