Granting
Law
Enforcement Capacity to Certain
Employees
of Parkin Company PJSC[1]

The
Director General and Chairman of the Board of Executive Directors of the Roads
and Transport Authority,
After perusal of:
Law
No. (17) of 2005 Establishing the Roads and Transport Authority (the “RTA”)
and its amendments;
Law
No. (32) of 2015 Concerning the Official Gazette of the Government of Dubai;
Law
No. (30) of 2023 Establishing Parkin Company;
Law
No. (19) of 2024 Regulating Law Enforcement Capacity in the Emirate of Dubai;
Executive
Council Resolution No. (5) of 2016 Regulating Car Parks in the Emirate of Dubai
and its amendments;
Executive
Council Resolution No. (65) of 2024 Approving the Organisational Structure of
the Roads and Transport Authority and its amendments; and
The
Concession Agreement concluded between the Roads and Transport Authority and Parkin
Company PJSC (the “Concession Agreement”),
Does hereby issue this
Resolution.
The
employees of Parkin Company PJSC, whose names and designations are set out in
the Schedule attached hereto, are hereby granted law enforcement capacity to
record the acts committed in breach of the provisions of the above-mentioned
Executive Council Resolution No. (5) of 2016 and the resolutions issued in
pursuance thereof, as specified in the Concession Agreement.
The
employees granted law enforcement capacity pursuant to Article (1) of this
Resolution must:
1.
comply with the provisions of the
above-mentioned Executive Council Resolution No. (5) of 2016 and with the
procedures stipulated therein when performing their duties;
2.
verify that the Persons to whom the
above-mentioned Executive Council Resolution No. (5) of 2016 applies, are in
compliance with the provisions thereof and that they discharge their
obligations thereunder;
3.
record the violations they are
assigned to investigate under the Concession Agreement, and collect the
relevant evidence and information in accordance with applicable rules;
4.
receive reports and complaints
relating to the violations falling within their remit, in accordance with the
procedures adopted in this regard;
5.
take the procedures and measures
required to preserve the evidence relevant to any committed violation;
6.
prepare violation reports documenting
the facts relating to the detected violations and the measures taken by them;
7.
maintain professional integrity,
honesty, impartiality, and objectivity;
8.
produce evidence of having law
enforcement capacity when performing their duties; and
9.
not abuse their law enforcement
capacity to secure personal gains or benefits.
The
employees granted law enforcement capacity pursuant to Article (1) of this
Resolution will have the powers to:
1. seek assistance from police
personnel, where required;
2.
seek
assistance from experts and interpreters, where required;
3.
hear
and record the statements of reporting persons and witnesses; and
4.
conduct
inspections and interviews, request clarifications, and access authorised
places to gather information related to committed violations.
The
Chief Executive Officer of Parkin Company PJSC will take the actions required
for the implementation of the provisions of this Resolution, including to:
1.
issue identification cards to the
Law Enforcement Officers referred to in Article (1) of this Resolution; and
2.
approve violation report templates,
including their required data fields, in accordance with the above-mentioned
Law No. (19) of 2024.
This
Resolution comes into force on the day on which it is issued, and will be
published in the Official Gazette.
