Establishing the

Requirements and Procedures for Issuing Invitations to Prequalified Partners to Obtain Tender Documents of Partnership Projects[1]

The Director General of the Department of Finance,

After perusal of:

Law No. (5) of 1995 Establishing the Department of Finance;

Law No. (22) of 2015 Regulating Partnership between the Public Sector and the Private Sector in the Emirate of Dubai; and

Decree No. (20) of 2009 Appointing the Director General of the Department of Finance,

Does hereby issue this Resolution.

Definitions

Article (1)

The words and expressions mentioned in this Resolution have the same meaning assigned to them in the above-mentioned Law No. (22) of 2015.

Obtaining Tender Documents

Article (2)

a.    In issuing invitations to prequalified Partners to obtain the Project’s Tender documents, the following requirements must be met:

1.    The provisions of Article (15) of the above-mentioned Law No. (22) of 2015 must be complied with prior to issuing the invitation to prequalified Partners.

2.    The invitation must include the following details:

a.    a general overview of the Project, its basic conditions, and the timelines and location(s) for its implementation;

b.    an explanation of the procedure for obtaining the Tender documents;

c.     the deadline specified in the Tender documents for submitting bids for the implementation of the Project; and

d.    any other information the Government Entity deems necessary to include in the invitation.

3.    The invitation must be issued in Arabic, or in both Arabic and a foreign language, and may be issued in a foreign language only if the nature or circumstances of the Project so require.

b.    The Government Entity may charge prequalified Partners a fee, the amount of which it determines, for obtaining the Tender documents.

Procedures for Issuing Invitations

Article (3)

The Government Entity will issue invitations to prequalified Partners to obtain the Tender documents, including the Project implementation conditions and specifications. Such invitations may be issued through the electronic system, the Government Entity’s official email, or any other means it deems appropriate. The invitation process must ensure that prequalified Partners are duly notified of the invitation and its details and are enabled to access all necessary information about the Project in a timely manner.

Commencement and Publication

Article (4)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
