Forming the

Steering Committee for the Environment and Climate Change Project[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

 After perusal of:

Law No. (5) of 1995 Establishing the Department of Finance;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai, its Implementing Bylaw, and their amendments;

Law No. (26) of 2023 Concerning the Executive Council of the Emirate of Dubai;

Law No. (11) of 2024 Establishing the Dubai Environment and Climate Change Authority;

Decree No. (1) of 2023 Concerning Governance of the Councils/ Boards and Committees Affiliated to the Government of Dubai;

Decree No. (15) of 2024 Forming the Strategic Affairs Council of the Executive Council of the Emirate of Dubai;

Resolution No. (39) of 2021 Concerning the Commissioner General for the Infrastructure, Urban Planning, and Well-being Pillar; and

The Order of 1961 Establishing the Dubai Municipality,

Do hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

SAC:

The Strategic Affairs Council of the Executive Council.

General Secretariat:

The General Secretariat of the Executive Council.

Steering Committee:

The steering committee formed pursuant to this Resolution to implement the Project.

DM:

The Dubai Municipality.

DECCA:

The Dubai Environment and Climate Change Authority.

Project:

The project of transferring the duties, functions, powers, and responsibilities related to the Environment, Climate Change, and food security to the DECCA.

Formation of the Steering Committee

Article (2)

a.    Pursuant to this Resolution, a temporary committee named the “Steering Committee for the Environment and Climate Change Project” is formed in the Emirate, under the chairmanship of the Director General of the DECCA, and with the membership of representatives from the following entities:

1.    the General Secretariat of the Executive Council;

2.    the Department of Finance;

3.    the Dubai Government Human Resources Department;

4.    the Supreme Legislation Committee in the Emirate of Dubai;

5.    the Dubai Municipality;

6.    the Dubai Police;

7.    the Dubai Electricity and Water Authority PJSC;

8.    the Supreme Council of Energy;

9.    the Committee Regulating the Fishing of Living Aquatic Organisms in the Emirate of Dubai; and

10.  the Infrastructure, Urban Planning, and Well-being Pillar.

b.    The representatives of the entities referred to in paragraph (a) of this Article will be nominated by the officials in charge of these entities. A representative must be experienced and specialised in areas that are relevant to the implementation of the Project, and must hold a grade not lower than the “Executive Director/ Chief Executive Officer” grade or an equivalent grade.

Functions of the Steering Committee

Article (3)

The Steering Committee will undertake general supervision of the Project. For this purpose, the Steering Committee will have the duties and powers to:

1.    approve the comprehensive plan of the Project based on the set implementation phases, including approval of the deliverables, recommendations, and timeline for each phase;

2.    oversee the transfer of all assets, property, roles, duties, and responsibilities pertaining to the Environment, Climate Change, and food security from the DM to the DECCA and to other entities concerned with the Project;

3.    oversee the transfer of the concerned organisational units and their employees from the DM and the entities concerned with the Project to the DECCA, together with the financial appropriations allocated to these units and employees;

4.    ensure the seamless transfer of functions, powers, responsibilities, budgets, and employees to the DECCA;

5.    approve a joint, time-bound, and structured action plan for the transfer of the assets and other property; monitor the implementation of this plan in line with the relevant strategic priorities and orientations; and ensure performance by the concerned entities of their tasks within a specific time frame;

6.    coordinate with the concerned local and federal entities, where required, for the purpose of performing the duties of the Steering Committee;

7.    issue the required directives and implementing instructions that contribute to achieving the approved objectives and vision of the Project;

8.    submit periodic reports to the General Secretariat on the progress of the Project in order to refer the same to the SAC to issue the relevant directives as it deems appropriate;

9.    ensure the availability of the financial and human resources, the data, and the information required for the implementation of the Project in accordance with the priorities set by the Steering Committee;

10.  monitor and track the progress of the Project implementation phases; issue the necessary directives in respect of any obstacles and difficulties encountered at all Project phases; provide any proposals or solutions as needed to address and overcome these difficulties and obstacles; and submit the relevant reports to the General Secretariat for presentation to the SAC to issue the relevant directives as it deems appropriate;

11.  form sub-committees and work teams pursuant to resolutions issued by the Chairman of the Steering Committee, which determine the duties, powers, Terms of Reference, and all other matters related to these sub-committees and work teams;

12.  seek assistance from experts and specialists as it deems appropriate, provided that they do not have a vote in its deliberations; and

13.  exercise any other duties or powers assigned to it under the above-mentioned Law No. (11) of 2024, or assigned to it by the Chairman of the Executive Council or the Chairman of the SAC.

Governance of the Steering Committee

Article (4)

The provisions of the above-mentioned Decree No. (1) of 2023 and the resolutions issued in pursuance thereof apply to all matters related to the governance of the Steering Committee, including the procedures for convening its meetings and passing its resolutions and recommendations, and the obligations of its Chairman and Members.

Duties of the General Secretariat

Article (5)

For the purposes of this Resolution, the General Secretariat will provide all forms of administrative and technical support as required for facilitating the work of the Steering Committee. In particular, the General Secretariat will:

1.    monitor the progress of the Project in accordance with the relevant approved plans, and submit periodic reports on this matter to the Steering Committee;

2.    approve the media plan for the Project;

3.    manage the agendas of the Steering Committee meetings;

4.    conduct, in coordination with the Chairman of the Steering Committee, a technical review of all the topics listed on the Steering Committee meeting agendas;

5.    follow up on the implementation of the resolutions, recommendations, and directives issued by the Steering Committee;

6.    monitor the work of the sub-committees and work teams; and submit to the Steering Committee the recommendations, observations, and reports prepared by these sub-committees and work teams; and

7.    evaluate and review performance and outcomes; and submit the relevant recommendations, improvement opportunities, and information on the obstacles and proposals for overcoming them to the Steering Committee to take the action it deems appropriate in this respect; and

8.    perform any other duties required to enable the Steering Committee to effectively exercise its duties and powers hereunder.

Cooperation with the Steering Committee

Article (6)

All concerned Government Entities must fully cooperate with the Steering Committee and its sub-committees and work teams; and must provide, in a timely manner and without delay, the data, information, statistics, documents, and studies requested and deemed necessary by the Steering Committee to implement and complete the Project and to enable it to perform its duties under this Resolution, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate.

Submitting the Final Report

Article (7)

a.    The Steering Committee will, through the General Secretariat, submit a final report to the Chairman of the Executive Council within a maximum period of nine (9) months from the date on which this Resolution comes into force. The report will outline the outcomes of the work and achievements of the Steering Committee, as well as any difficulties and obstacles that it has encountered in performing its duties.

b.    Upon the recommendation of the Chairman of the Steering Committee and with the approval of the Chairman of the SAC, the period referred to in paragraph (a) of this Article may be extended once.

Financial Appropriations

Article (8)

 The Department of Finance will provide the financial appropriations required to enable the Steering Committee to perform its functions under this Resolution.

Issuing Implementing Resolutions

Article (9)

The Chairman of the Steering Committee will issue the resolutions required for the implementation of the provisions of this Resolution.

Publication and Commencement

Article (10)

 This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
