Concerning the

Hamdan bin Mohammed Academic Scholarship Programme[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Law No. (5) of 1995 Establishing the Department of Finance;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai, its Implementing Bylaw, and their amendments;

Law No. (2) of 2021 Concerning the Knowledge and Human Development Authority in Dubai;

Law No. (26) of 2023 Concerning the Executive Council of the Emirate of Dubai; and

Decree No. (1) of 2023 Concerning Governance of the Councils/ Boards and Committees Affiliated to the Government of Dubai,

Do hereby issue this Resolution.

Definitions

Article (1)The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

KHDA:

The Knowledge and Human Development Authority in Dubai.

Steering Committee:

The steering committee formed pursuant to this Resolution to oversee the implementation of the Programme.

Programme:

The Hamdan bin Mohammed Academic Scholarship Programme.

Student:

This includes:

1.    a UAE-national student holding a general secondary school certificate or an equivalent qualification from a public or private educational institution recognised in the UAE;

2.    a UAE-national student holding an undergraduate degree, a graduate degree, or an equivalent qualification from a public or private university, college, or institute recognised in the UAE; and

3.    a UAE-national student working at a Government Entity in the Emirate and sent on a scholarship.

 

Approval of the Programme

Article (2)

Pursuant to this Resolution, the Hamdan bin Mohammed Academic Scholarship Programme is approved. The Programme is intended for offering academic grants and scholarships to Students from amongst the citizens of the Emirate to pursue the academic disciplines in demand in the labour market in the Emirate, in accordance with the relevant requirements and criteria prescribed by the Steering Committee.

Formation of the Steering Committee

Article (3)

a.    Pursuant to this Resolution, a permanent Committee named the “Steering Committee for the Hamdan bin Mohammed Academic Scholarship Programme” is formed. The Steering Committee will be comprised of:

1.    the Director General of the Knowledge and Human Development Authority in Dubai, as Chairman;

2.    the Director General of the Dubai Government Human Resources Department, as vice chairman;

3.    Dr. Rasha Essa AlMas Buhumaid, as Member;

4.    a representative from the Knowledge and Human Development Authority in Dubai, as Member; and

5.    a representative from the Department of Economy and Tourism in the Emirate of Dubai, as Member.

b.    ‌The representatives of the entities referred to in paragraph (a)(4) and paragraph (a)(5) of this Article will be nominated by the officials in charge of these entities.

Functions of the Steering Committee

Article (4)

The Steering Committee will have the duties and powers to:

1.    approve the vision, objectives, and strategic plan of the Programme;

2.    approve the Programme’s unified policy for academic grants and scholarships across the Emirate;

3.    issue the required implementing directives and instructions that contribute to achieving the approved vision of the Programme;

4.    approve the budget and financial plan of the Programme, and submit the same to the Department of Finance for approval as part of the annual budget of the KHDA;

5.    form sub-committees and work teams; and determine their duties, powers, and Terms of Reference; and

6.    exercise any other duties or powers assigned to it by the Chairman of the Executive Council.

Duties of the KHDA

Article (5)

a.    For the purposes of this Resolution, the KHDA will, in accordance with its functions under the legislation in force in the Emirate, perform all the duties required for facilitating the work of the Steering Committee. In particular, the KHDA will:

1.    develop the Programme’s unified policy for academic grants and scholarships, including the conditions, criteria, and rules required for accepting Students in the Programme; and determine, in coordination with the concerned entities in the Emirate, the target categories and academic disciplines; and submit the same to the Steering Committee for approval;

2.    manage the financial appropriations allocated for the Programme as per the directives, and under the supervision, of the Steering Committee;

3.    submit periodic reports to the Steering Committee on the progress of the Programme;

4.    seek the assistance of experts and specialists, as it deems appropriate, to give opinion and advice on technical and specialised matters referred to the Steering Committee;

5.    manage the agenda of the Steering Committee; and provide the Steering Committee with technical, administrative, and secretarial support;

6.    review, from a technical perspective, all matters listed on the agenda of the Steering Committee, in coordination with the entities represented therein; and prepare the required relevant reports;

7.    follow up the implementation of the resolutions, recommendations, and directives issued by the Steering Committee;

8.    follow up the work of the sub-committees and work teams formed by the Chairman of the Steering Committee; and submit to the Steering Committee the recommendations, observations, and reports made by these sub-committees and work teams;

9.    conclude contracts and agreements with the Students accepted into the Programme. These contracts and agreements will determine the rights and obligations of the parties thereto;

10.  follow up on the academic records and academic attainment of the Students accepted into the Programme, and liaise with the concerned entities to address any obstacles they may face in their academic and administrative affairs;

11.  conclude contracts, agreements, and memoranda of understanding with local, regional, and international entities, in line with the legislation in force in the Emirate; and

12.  perform any other duties assigned to it by the Chairman of the Steering Committee.

b.    The KHDA may outsource any of its duties and delegate any of its duties and powers under this Resolution to any public or private entity pursuant to an agreement concluded for this purpose. This agreement will stipulate its term, the rights and obligations of both parties, and any other relevant provisions.

Awarding Scholarships to Employees of Government Entities

Article (6)

A Government Entity in the Emirate may coordinate with the KHDA to award a scholarship to any of its Employees through the Programme. The Government Entity requesting the scholarship must coordinate with the Department of Finance to transfer its approved financial appropriations allocated for scholarships to the budget of the Programme. In this case, the Government Entity must conclude a scholarship contract with the Employee who is accepted into the Programme, stipulating the rights and obligations of the parties, as well as any other requirements prescribed by the legislation regulating human resources applicable to Government Entity that the Employee works for.

Governance of the Steering Committee

Article (7)

The provisions of the above-mentioned Decree No. (1) of 2023 and the resolutions issued in pursuance thereof apply to all matters related to the governance of the Steering Committee; the procedures for holding its meetings and passing its resolutions and recommendations; and the duties of its Chairman and Members.

Cooperation with the Steering Committee

Article (8)

All Government Entities in the Emirate, including educational, vocational, and training institutions as well as the relevant private sector establishments, must fully cooperate with the Steering Committee and its sub-committees and work teams; and must provide, in a timely manner and without delay, the data, statistics, documents, information, and studies requested and deemed necessary by the Steering Committee to implement and deliver the Programme and to enable it to perform its duties under this Resolution, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate.

Submitting Periodic Reports

Article (9)

The Steering Committee will submit to the Chairman of the Executive Council a periodic report on the outcomes and deliverables of the Programme; the difficulties and obstacles it has faced in performing its duties; and the solutions, proposals, and recommendations it deems appropriate to overcome these difficulties and obstacles.

Financial Appropriations

Article (10)

The Department of Finance will provide the financial appropriations required to enable the Steering Committee and the KHDA to launch and implement the Programme, as well as to exercise the functions assigned to them under this Resolution, the resolutions issued in pursuance hereof, and other legislation in force in the Emirate.

Issuing Implementing Resolutions

Article (11)

The Chairman of the Steering Committee will issue the resolutions required for the implementation of the provisions of this Resolution.

Repeals

Article (12)

Any provision in any other resolution is hereby repealed to the extent that it contradicts the provisions of this Resolution.

Commencement and Publication

Article (13)

This Resolution comes into force on 1 April 2024, and will be published in the Official Gazette.
