Law No. (17) of 2023

Concerning the Emblem of the Emirate of Dubai[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Federal Law by Decree No. (31) of 2021 Issuing the Crime and Punishment Law and its amendments;

Federal Law by Decree No. (34) of 2021 Concerning Combating Rumours and Cybercrimes;

Federal Law by Decree No. (46) of 2021 Concerning Electronic Transactions and Thiqa Services;

Law No. (8) of 2019 Concerning His Highness the Ruler of Dubai’s Court;

Law No. (20) of 2021 Establishing the Department of Economy and Tourism in the Emirate of Dubai; and

Decree No. (22) of 2021 Concerning the Chairman of His Highness the Ruler of Dubai’s Court,

Do hereby issue this Law.

Title of the Law

Article (1)

This Law will be cited as “Law No. (17) of 2023 Concerning the Emblem of the Emirate of Dubai”.

Definitions

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

Ruler:

His Highness the Ruler of Dubai.

Government:

The Government of Dubai.

HHRC:

His Highness the Ruler of Dubai’s Court.

Chairman:

Chairman of the HHRC.

Government Entity:

Any of the Government departments, public agencies or corporations, Government councils and authorities, or other public entities affiliated to the Government.

Emblem:

The emblem of the Emirate attached to this Law.

Person:

A natural or legal person.

The Emblem

Article (3)

The Emirate will have a distinct Emblem which reflects its culture, values, and principles. The design of the Emblem is depicted in the illustration attached hereto.

Ownership Rights and Legal Protection

Article (4)

The Emblem is hereby deemed property of the Emirate and protected under this Law and the legislation in force in the Emirate.

Use of the Emblem

Article (5)

a.     The Emblem will be used in the buildings, sites, events, activities, functions, documents, official records, instruments, websites, and digital applications of the Government and Government Entities.

b.     Non-government entities may use the Emblem, subject to obtaining a special authorisation from the Ruler or his authorised representative. In that case, the Emblem must be used for the purposes and in accordance with the rules specified in the authorisation.

c.     The Emblem will be used by the entities mentioned in paragraphs (a) and (b) of this Article in the manner and under the conditions prescribed by the relevant manual prepared by the HHRC in coordination with the concerned entities in the Emirate. This manual will be approved by the Chairman under a resolution he issues in this regard, and will be published in the Official Gazette.

Prohibited Acts

Article (6)

No Person may undertake any of the following acts:

1.      the use of the Emblem, by non-government entities or any other entities authorised to use it, in any manner or by any means, before obtaining the authorisation referred to in paragraph (b) of Article (5) of this Law;

2.     any act of infringement or deformation of the Emblem, or undermining its worth or value in any manner whatsoever; or

3.     the use of the Emblem in any activity or event that conflicts with the values and principles of the Emirate, or with public order or morality.

Duty to Report

Article (7)

A Person who becomes aware of the commission, by another Person, of any of the acts stipulated in Article (6) of this Law must report it to the competent administrative authorities in the Emirate, including the Department of Economy and Tourism in the Emirate, and to the competent judicial authorities to take the necessary legal action against the violators.

Penalties

Article (8)

Without prejudice to any stricter penalty stipulated in any other legislation, a Person who commits any of the acts stipulated in Article (6) of this Law will be punished by imprisonment for not less than three (3) months and not more than five (5) years and a fine of not less than one hundred thousand dirhams (AED 100,000.00) and not more than five hundred thousand dirhams (AED 500,000.00), or either of these penalties. In case of conviction, the court will order the confiscation of the tools and equipment used in committing this crime.

Compliance

Article (9)

Any Person using the Emblem by the effective date of this Law, other than the Government Entities or other entities authorised to use the Emblem, must remove it and cease using it within thirty (30) days from the effective date hereof unless that Person has obtained the special authorisation referred to in paragraph (b) of Article (5) of this Law.

Issuing Implementing Resolutions

Article (10)

The Chairman will issue the resolutions required for the implementation of the provisions of this Law.

Repeals

Article (11)

Any provision in any other legislation is hereby repealed to the extent that it contradicts the provisions of this Law.

Publication and Commencement

Article (12)

This Law will be published in the Official Gazette and will come into force on the day on which it is published.
