Approving the
Conditions and Procedures for
Issuing Civil Aviation Permits in the Emirate of
Dubai[1]

After perusal of:
Federal Law No. (20) of 1991 Issuing the Civil
Aviation Law and its amendments;
Federal Law No. (4) of 1996 Establishing the
General Civil Aviation Authority and its amendments;
Law No. (13) of 2011 Regulating the Conduct of
Economic Activities in the Emirate of Dubai and its amendments;
Law No. (7) of 2015 Concerning Airspace Safety and
Security in the Emirate of Dubai;
Law No. (11) of 2020 Concerning the Dubai Civil
Aviation Authority;
Law No. (5) of 2021 Concerning the Dubai
International Financial Centre;
Decree No. (22) of 2009 Concerning Special
Development Zones in the Emirate of Dubai;
Executive Council Resolution No. (4) of 2017
Approving Fees and Fines of the Dubai Civil Aviation Authority; and
The legislation establishing and regulating free
zones in the Emirate of Dubai,
Does hereby issue this Resolution.
The following words and expressions, wherever
mentioned in this Resolution, will have the meaning indicated opposite each of
them unless the context implies otherwise:

authorities supervising Special Development Zones and free zones, such as the
Dubai International Financial Centre. |
Concerned Entity: |
Any of the ministries or
federal public authorities, corporations, or other similar entities; and any
of the Government departments; public agencies, corporations, or authorities;
Government councils; or other public entities affiliated to the Government of
Dubai. |
Operator: |
A natural or legal
person authorised by the DCAA to conduct any of the activities related to operating
Aircraft or Airports in accordance with the legislation in force in the
Emirate. |
Practitioner: |
A natural or legal
person authorised by the DCAA to conduct any of the activities related to
providing and organising air navigation services; providing flight and air
navigation training; conducting air safety studies; providing tourist and
recreational aviation services, sports aviation services, Aerial
Advertisements services, and balloon flying services; providing aerial
photography using various types of Aircraft; and conducting any other Activities
determined pursuant to this Resolution. |
Activity: |
Any of the civil
aviation activities set out in the list attached hereto. |
Permit: |
A document issued by the
DCAA authorising the conduct of the Activity, in accordance with the
provisions of this Resolution. |
a.
A Permit
to conduct the Activity will be issued subject to the following requirements:
1. The Permit applicant must hold a valid commercial
licence issued by the competent Licensing Authority in the Emirate.
2. The technical conditions and requirements
prescribed by the DCAA for conducting the Activity and published on the DCAA official
website must be fulfilled.
3. Copies of the valid approvals of the GCAA and the Concerned
Entities must be submitted, where the legislation in force in the Emirate
requires obtaining these approvals to conduct the Activity.
4. The fees and costs payable under the
above-mentioned Executive Council Resolution No. (4) of 2017 must be paid.
b.
For landing
permits to be issued for non-scheduled flights of private, passenger, or cargo
Aircraft, Operators of such Aircraft must hold an Aircraft Operator Certificate
and Airworthiness Certificate issued by the GCAA or any other internationally
recognised civil aviation authority.
In issuing a Permit, the following procedures will
apply:
1.
A Permit
application will be submitted to the DCAA on the forms, and in accordance with
the procedures, prescribed by the DCAA for this purpose, supported by the
documents it prescribes.
2.
The DCAA
will consider the application, verify that it meets all the technical
conditions and requirements prescribed for conducting the Activity, and issue
its decision whether or not to issue the Permit, within ten (10) working days
from the date of submission of the application.
3.
The DCAA
will record, in its registers, the basic details of Permit
holders, especially those of Practitioners and Operators.
4.
Where
the Permit application is rejected, the DCAA will notify the applicant of the
reasons for rejection. An applicant whose application is rejected
may submit to the DCAA another Permit application.
a.
A Permit
will be valid for a period of one (1) year, renewable for the same period. A
renewal application must be submitted within thirty (30) days from the date of
its expiry.
b.
Notwithstanding
the provisions of paragraph (a) of this Article, a landing permit for non-scheduled
flights of private, passenger, or cargo Aircraft will be valid for the period
specified in the permit. However, the validity of a landing permit may not be
less than one (1) day and not more than six (6) months for Aircraft not
registered in the UAE, and not more than one (1) year for Aircraft registered
in the UAE.
Any provision in any other administrative
resolution is hereby repealed to the extent that it contradicts the provisions
of this Resolution.
This Resolution will be published in the Official
Gazette and will come into force on the day on which it is published.
