Resolution No. (14) of 2022

Concerning the

Notary Public Affairs Committee of the Dubai Courts^{^[1]}

The President of the Dubai Courts,

After perusal of:

Law No. (6) of 2005 Regulating the Dubai Courts and its amendments;

Law No. (4) of 2013 Concerning Notaries Public in the Emirate of Dubai and its amendments;

Law No. (13) of 2016 Concerning the Judicial Authorities in the Emirate of Dubai and its amendments; and

Resolution No. (36) of 2014 Regulating the Practice of Private Notaries Public and Employees of Government Entities Commissioned as Notaries Public in the Emirate of Dubai, and

In accordance with work requirements,

Does hereby issue this Resolution.

Reconstitution of the Committee
Article (1)

a. The Notary Public Affairs Committee (the “Committee”) formed pursuant to the above-mentioned Resolution No. (36) of 2014 is hereby reconstituted as follows:

1. the Chief Justice of the Courts of First Instance, as chairman;

2. the Chief Justice of the Civil Court, as vice chairman;

3. the Director of the Notary Public Directorate, as member;

4. the Head of the Private Notary Public Section, as member; and

5. a Notary Public appointed by the chairman of the Committee, as member.

b. A rapporteur will be appointed to the Committee by its chairman from amongst the Notary Public Directorate employees. The rapporteur will be responsible for arranging the meetings of the Committee; sending meeting invitations to its members; preparing its meeting agendas in coordination with the Committee chairman; recording its minutes of meetings; documenting, and following up the implementation of, its resolutions and recommendations; and performing any other duties assigned to him by the chairman of the Committee.

Committee Meetings

Article (2)

a. Where necessary, the Committee will convene at the invitation of its chairman, or vice chairman in case of absence of the chairman, at the time and place determined by him.

b. Committee meetings will be valid if attended by the majority of its members, provided that the chairman or vice chairman of the Committee is in attendance.

c. The Committee will pass its resolutions and recommendations by majority vote of attending members; and in the event of a tie, the chair of the meeting will have a casting vote.

d. Proceedings of the Committee meetings, and its resolutions and recommendations, will be recorded in minutes of meetings signed by the chair of the meeting and attending members.

Duties and Powers of the Committee
Article (3)

The Committee will exercise the duties and powers vested in it under the above-mentioned Law No. (4) of 2013.

Repeals

Article (4)

Any provision in the above-mentioned Administrative Resolution No. (36) of 2014 contradicting the above-mentioned Law No. (4) of 2013 or its amendments is hereby repealed. Any provision in any other resolution is also hereby repealed to the extent that it contradicts the provisions of this Resolution.

Commencement and Publication
Article (5)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
