Approving the Violations and Fines Pertaining to the
Mohammed bin Rashid Al Maktoum Library[1]

We, Hamdan bin
Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the
Executive Council,
After
perusal of:
Law
No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;
Law
No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate
of Dubai and its amendments;
Law
No. (1) of 2016 Concerning the Financial Regulations of the Government of
Dubai, and its Implementing Bylaw and its amendments;
Law
No. (8) of 2016 Regulating the Grant of Law Enforcement Capacity in the
Government of Dubai and its Implementing Bylaw; and
Law
No. (14) of 2016 Establishing the Mohammed bin Rashid Al Maktoum Library (the “MBRL”),
Do hereby issue this
Resolution.
a. Without prejudice to any stricter penalty stipulated in any other legislation, a person who commits any of the acts stated in the Violations Schedule attached hereto will be punished by the fine indicated opposite that act.
b. The amount of the fine prescribed in the Schedule referred to in paragraph (a) of this Article will be doubled if the same violation is repeated within one (1) year from the date of the previous violation. A fine must not exceed one thousand dirhams (AED 1,000.00).
c. In addition to the penalty of a fine referred to in paragraph (a) of this Article, the MBRL may take one or more of the following measures against a violator:
1. warning;
2. requesting the violator to leave the
MBRL premises;
3. depriving the violator of access to
the MBRL premises for the period prescribed by the Chief Executive Officer of
the MBRL;
4. suspending the violator's membership
in the MBRL for a period not exceeding six (6) months; and/or
5. terminating the violator's membership in the MBRL and preventing him
from entering the MBRL premises.
d. Imposing the fines and measures prescribed by the provisions of this Article will not prejudice the right of the MBRL to claim compensation from the violator, for the damage he causes to the MBRL or Information Resources, in addition to twenty-five percent (25%) of the amount of compensation as administrative fees. The MBRL assessment of the compensation and fees will be final.
e. Imposing the fines and measures prescribed by the provisions of this Article will not prejudice the right of the MBRL to report to the competent entities in the Emirate any violation punishable under the legislation in force.
The
employees of the MBRL nominated pursuant to a resolution of the Chairman of its
Board of Directors will have the capacity of law enforcement officers to record the
violations stipulated in the Schedule attached hereto. For this purpose, they
may issue the necessary violation reports; and, where necessary, seek the
assistance of police personnel.
Any affected party may submit a written grievance to the Chief Executive Officer of the MBRL against any decision, procedure, penalty, or measure taken or imposed against him under this Resolution, within thirty (30) days from the date of being notified of the contested decision, procedure, penalty, or measure. The grievance will be determined, within sixty (60) days from the date of its submission, by a committee formed by the Chief Executive Officer for this purpose; and the decision issued by the committee in respect of the grievance will be final.
The fines collected pursuant to this Resolution will be paid to the Public Treasury of the Government of Dubai.
This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
