Administrative Resolution No. (21) of 2022
Concerning the Requirements and Procedures for Issuing Permits to
Government Entities to Conduct Conciliation and for
Opening Branches for the Authorised Entities[1]

The Director of the Dubai Courts,
After perusal of:
Law No. (18) of 2021 Regulating Conciliation in
the Emirate of Dubai; and
The presentation submitted to the Director of
the Dubai Courts,
Does hereby issue this
Resolution.
The issuance of a Permit authorising a
Government Entity to conduct Conciliation will be subject to the following
requirements:
1.
The Disputes to be
considered by the Government Entity must be related to the functions vested in that
entity under the legislation establishing it or
regulating its work.
2.
The Government Entity
must have at least one Employee who is qualified to conduct Conciliation; has at least (3) years of work
experience in the Government Entity; and holds a degree from a university accredited in the UAE.
3.
The Government Entity
must submit an application to the Dubai Courts for registering its concerned
Employees on the Roll.
a.
A Permit application
will be submitted to the Dubai Courts on the form prescribed by the Conciliators
Affairs Committee for this
purpose, supported by the documents required by Committee.
b.
Upon receipt of the
Permit application, the Conciliators Affairs Committee will consider and determine the application in accordance
with the requirements stipulated in Article (1) of this Resolution.
c.
The
Conciliators Affairs Committee will issue
its decision accepting or rejecting the Permit application within thirty (30)
days from the date of receiving it. Where the application is accepted, the committee will issue the Permit and inform the
Government Entity of the same through the Dubai Courts.
d.
Where the application
is rejected, the Conciliators Affairs Committee will inform the Government Entity, through the Dubai Courts, of the reasons for
rejection.
An Authorised Entity may open branches within the Emirate of Dubai, subject to the following:
1.
The branch must meet
the requirements stipulated in Article (16) of the above-mentioned Law No. (18)
of 2021.
2.
The trade name of
the branch, as stated in
its licence, must be the same trade name of the head office
followed by the word “branch”.
3.
The Permit of the head
office must have been issued for at least one (1) year.
4.
At least three (3)
Private Conciliators, other than the owner and the manager, must be working at the head office of the
Authorised Entity.
5.
Balanced
geographical distribution of the branches to be opened must be
maintained, as determined
at the discretion of the Committee.
This Resolution will be published in the
Official Gazette and will come into force on the day on which it is published.
