Concerning the Conditions for Using the

Dubai Name for Sports Events in the Emirate of Dubai[1]

We, Mansoor bin Mohammed bin Rashid Al Maktoum, Chairman of the Dubai Sports Council,

After perusal of:

Law No. (11) of 2009 Concerning the Dubai Sports Council and its amendments; and

Executive Council Resolution No. (1) of 2020 Regulating Sports Establishments and Sports Events in the Emirate of Dubai,

Do hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise

Emirate:

The Emirate of Dubai.

Executive Council Resolution:

Executive Council Resolution No. (1) of 2020 Regulating Sports Establishments and Sports Events in the Emirate of Dubai.

DSC:

The Dubai Sports Council.

Sports Event:

Any sports activity or function organised in the Emirate for commercial or non-commercial purposes. This includes festivals; shows; celebrations; competitions; championships; competitive and community sports; and sports workshops, seminars, conferences, and exhibitions held anywhere in the Emirate.

Dubai Name:

Any name, logo, symbol, drawing, or similar identifier that refers to “Dubai” in any language.

Approval:

A document issued by the DSC authorising the organiser of a Sports Event to use the Dubai Name for a Sports Event he is permitted to hold.

Evaluation and Classification System:

The system adopted by the DSC to assess a Sports Event’s impact on, and significance to, the Emirate.

Using the Dubai Name

Article (2)

The Dubai Name may not be used for any Sports Event without first obtaining the relevant Approval of the DSC. This Approval will be issued in accordance with the conditions and procedures stipulated in the Executive Council Resolution and in this Resolution.

Conditions for Using the Dubai Name for Sports Events

Article (3)

In addition to the conditions stipulated in the Executive Council Resolution, the Dubai Name will be used for a Sports Event subject to the following:

1.    The applicant for Approval must be a legal person licensed to operate in the Emirate.

2.    The Sports Event must have a significant positive impact on the Emirate. This impact will be assessed using the Evaluation and Classification System.

3.    No Person may claim any intellectual property rights in the name or logo of the Sports Event for which the Dubai Name is used.

4.     The Dubai Name must be used only for the purpose of the Sports Event and for the period prescribed in the Approval.

Procedures for Obtaining Approvals

Article (4)

In issuing an Approval, the following procedures will be followed:

1.    An application for the Approval will be submitted on the form prescribed by the DSC for this purpose, supported by the relevant documents required by the DSC.

2.    The DSC will consider the application and verify that it meets all relevant conditions and that it is accompanied by all required documents. For this purpose, the DSC may require any additional information it deems necessary for determining the application.

3.    Where the application meets all relevant conditions and all required information is complete, the DSC will issue its decision to approve or reject the application.

4.    Where the application is rejected, the DSC will notify the applicant of the reasons for rejection. An applicant whose application is rejected may submit another application for Approval, provided that the reasons for rejection cease to exist.

Revocation of Approvals

Article (5)

The DSC may revoke an Approval in any of the following cases:

1.    where the organiser of a Sports Event fails to meet any of the conditions of the Approval;

2.    where it is established to the satisfaction of the DSC that the approval is issued based on false information;

3.    where the Approval holder becomes insolvent or bankrupt; or

4.     where the activities of the Approval holder are suspended or his licence is cancelled for any reason whatsoever.

Issuing Implementing Instructions

Article (6)

The Secretary General of the DSC will issue the resolutions required for the implementation of this Resolution.

Publication and Commencement

Article (7)

This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
