Transferring the International Institute for Tolerance to the

 Islamic Affairs and Charitable Activities Department[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (5) of 1995 Establishing the Department of Finance;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (2) of 2011 Concerning the Islamic Affairs and Charitable Activities Department (the “IACAD”);

Law No. (33) of 2015 Establishing the Mohammed bin Rashid Al Maktoum Global Initiatives Foundation;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai and its Implementing Bylaw;

Law No. (9) of 2017 Establishing the International Institute for Tolerance (the “IIT”);

Law No. (8) of 2018 Concerning Management of the Government of Dubai Human Resources;

Decree No. (28) of 2017 Appointing the Managing Director of the International Institute for Tolerance;

Decree No. (28) of 2020 Forming the Board of Trustees of the International Institute for Tolerance;

Decree No. (29) of 2020 Forming the Supreme Committee for Development of the Government Sector in the Emirate of Dubai;

Executive Council Resolution No. (40) of 2015 Concerning the Functions of the General Secretariat of the Executive Council of the Emirate of Dubai;

Executive Council Resolution No. (49) of 2018 Approving the Organisational Structure of the International Institute for Tolerance; and

The presentation of the Chairman of the Supreme Committee for Development of the Government Sector in the Emirate of Dubai,

Do hereby issue this Law.

Transfer and Succession

Article (1)

a.    As of the date on which this Law comes into force, the following will be transferred to the IACAD:

1.    all the duties and functions assigned to the IIT under the above-mentioned Law No. (9) of 2017 and the legislation in force in the Emirate. Departments of the IACAD that will exercise such duties and functions must be determined in coordination with the General Secretariat of the Executive Council;

2.    the ownership of the real property, movables, assets, devices, equipment, and other property of the IIT;

3.    the employees of the IIT. These employees will be governed by the above-mentioned Law No. (8) of 2018 and will retain their existing rights; and

4.    the financial appropriations allocated by the Department of Finance to the IIT and the Mohammed bin Rashid Al Maktoum Tolerance Award.

b.    All rights and obligations of the IIT and the Mohammed bin Rashid Al Maktoum Tolerance Award are hereby transferred to the IACAD.

Issuing Implementing Resolutions

Article (2)

The Chairman of the Executive Council will issue the resolutions required for the implementation of the provisions of this Law.

Repeals

Article (3)

a.    Pursuant to this Law, the following legislation is repealed:

1.    Law No. (9) of 2017 Establishing the International Institute for Tolerance;

2.    Decree No. (28) of 2017 Appointing the Managing Director of the International Institute for Tolerance;

3.    Decree No. (28) of 2020 Forming the Board of Trustees of the International Institute for Tolerance; and

4.    Executive Council Resolution No. (49) of 2018 Approving the Organisational Structure of the International Institute for Tolerance.

b.    Any provision in any other legislation will be repealed to the extent that it contradicts the provisions of this Law.

Publication and Commencement

Article (4)

This Law will be published in the Official Gazette and will come into force three (3) months after the date of its publication.
