Establishing the Dubai Council[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (32) of 2009 Establishing the Executive Office and its amendments,

Do hereby issue this Law.

Title of the Law

Article (1)

This Law will be cited as “Law No. (21) of 2021 Establishing the Dubai Council”.

Definitions

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

Ruler:

His Highness the Ruler of Dubai.

Government:

The Government of Dubai.

DC:

The Dubai Council.

Executive Office:

The Executive Office regulated pursuant to the above-mentioned Law No. (32) of 2009 and its amendments.

Chairman:

The chairman of the DC.

General Secretariat:

The general secretariat of the DC.

Secretary General:

The secretary general of the DC.

Government Entity:

Any of the Government departments; public agencies or corporations; Government authorities or councils; or other entities affiliated to the Government.

Development Pillar:

A strategic pillar established by the DC.

Commissioner General:

The commissioner general for the Development Pillar.

Establishment of the DC

Article (3)

Pursuant to this Law, a council named the “Dubai Council” is established. The DC will have legal personality and the legal capacity required to undertake the acts and dispositions that ensure the achievement of its objectives.

Objectives of the DC

Article (4)

The DC will have the objective to shape and develop the future development agenda of the Emirate to ensure its global competitiveness, leadership, and attractiveness through launching and approving major strategic projects and extraordinary transformation initiatives, with a view to making developmental leaps that contribute to providing the best quality of life for the citizens, residents, and visitors of the Emirate.

Functions of the DC

Article (5)

a.    The DC will determine the future outlook, orientations, and vision of the Emirate; approve and launch major transformation projects; and exercise any other duties or powers that are relevant to the achievement of the DC objectives as assigned to it by the Chairman or either of the two deputy chairmen.

b.    The DC will exercise the duties and powers assigned to it under this Law or by the Chairman or either of the two deputy chairmen, in accordance with the relevant terms of reference approved by the Chairman.

Formation of the DC

Article (6)

a.    The DC will be chaired by the Ruler. Two deputy chairmen and a number of members will be appointed to the DC pursuant to a decree issued by the Ruler. Members of the DC must be experienced, competent, and dedicated persons.

b.    Membership of the DC will be for a term of two (2) years, renewable for the same period.

Meetings of the DC

Article (7)

a.    The DC will convene at the invitation of the Chairman, or either of the deputy chairmen if the Chairman is absent. The DC meetings will be valid if attended by the majority of its members, provided that the Chairman or either of the two deputy chairmen is in attendance.

b.    The first deputy chairman will act as the Chairman where the Chairman is absent. In case of absence of both the Chairman and the first deputy chairman, the second deputy chairman will act as the Chairman.

Development Pillars

Article (8)

a.    Each Development Pillar will be supervised by a Commissioner General appointed pursuant to a resolution of the Chairman.

b.    A Development Pillar will involve a number of Government Entities specified pursuant to the resolution appointing its Commissioner General.

c.     A Commissioner General will manage and undertake the general supervision of each Development Pillar and will seek to elevate it to the highest international levels. The Commissioner General will also exercise the duties and powers stipulated in the resolution appointing him and those assigned to him by the Chairman or either of the deputy chairmen.

Supervision of Commissioners General

Article (9)

Commissioners General will serve under the direct supervision of the two deputy chairmen, who will supervise and follow up the overall performance of Development Pillars. The two deputy chairmen will also supervise the transformation projects and action plans of the Development Pillars; and will supervise and evaluate the performance of the managers of these projects.

General Secretariat

Article (10)

a.    The Executive Office will serve as the General Secretariat of the DC and will provide the DC with the support required for performing its duties. This includes the provision of administrative and technical support services; making arrangements for holding meetings; preparing, documenting, and following up the implementation of, resolutions and recommendations; conducting research and studies on the matters referred to it by the DC; and coordinating with the concerned Government Entities and other entities in respect of implementing the policies and projects approved by the DC.

b.   The Chairman of the Executive Office, or his authorised representative, will act as the Secretary General. The Secretary General will undertake general supervision of the performance by the General Secretariat of its duties to support the DC and enable it to achieve its objectives; and will exercise any other duties or powers assigned to him by the Chairman or either of the deputy chairmen.

Issuing Implementing Resolutions

Article (11)

The Chairman, or any of deputy chairmen as authorised by the Chairman, will issue the resolutions required for the implementation of the provisions of this Law.

Repeals

Article (12)

Any provision in any other legislation is hereby repealed to the extent that it contradicts the provisions of this Law.

Commencement and Publication

Article (13)

This Law comes into force on the day on which it is issued, and will be published in the Official Gazette.
