Regulating Work in the
Right of Way in the Emirate of Dubai[1]

We, Hamdan bin Mohammed
bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive
Council,
After perusal of:
Federal Law No. (21) of 1995 Concerning Road Traffic, its Implementing Bylaw, and their amendments;
Law No. (5) of 1995 Establishing the Department of Finance;
Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;
Law No. (17) of 2005 Establishing the Roads and Transport Authority and its amendments;
Law No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai and its amendments;
Law No. (13) of 2011 Regulating the Conduct of Economic Activities in the Emirate of Dubai and its amendments;
Law No. (6) of 2015 Concerning Protection of the Public Electricity and Water Network in the Emirate of Dubai;
Law No. (22) of 2015 Regulating Partnership between the Public Sector and the Private Sector in the Emirate of Dubai;
Law No. (23) of 2015 Concerning Disposition of Impounded Vehicles in the Emirate of Dubai;
Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai and its Implementing Bylaw;

Do hereby issue this Resolution.
The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:
Emirate: |

Government
Entity: |
Any of the ministries or federal government agencies and
corporations, Government departments, public agencies or corporations,
authorities, councils, or similar entities affiliated to the Government. |
Director
General: |
The director general and chairman of the Board of
Executive Directors of the RTA. |
TRA: |
The Traffic and Roads Agency of the RTA. |
Competent
Entity: |
Any Government Entity assigned, as part of the functions
legally vested in it, to perform a regulatory role within the Right of Way. |
Vehicle: |
Any motorised machine, Pedal Cycle, Motorcycle, Carriage,
or other machine designed to run on Roads, whether mechanically propelled or
otherwise. This includes Tractors and Trailers. |
Public
Road: |
Any public way in the Emirate on which traffic movement is
allowed and which is supervised by the RTA, including main Roads, side Roads,
and byroads; streets; public squares; bridges; tunnels; interchanges; Road
median strips; public car parks; Pavements; pedestrian crossings; and other
Operational Facilities of Roads. |
Right of
Way: |
A Public Road and the area extending from the edges of
that Public Road to the boundaries of adjacent land plots, as demarcated on
the plans approved by the DM. |
Right of
Way Airspace: |
The airspace above a Right of Way. |
Protection
Zone: |
The area surrounding certain parts of a Right of Way as
determined pursuant to the relevant resolution issued by the Director
General, in coordination with the Competent Entity, to protect the RTA Assets
and the RTA vital facilities. |
Work in
the Right of Way: |
Constructing Utility Lines within a Right of Way or Right
of Way Airspace; making Traffic Diversions; travelling
on or entering the Right of Way
during prohibited times using a special Vehicle; or carrying out any other
works or occupancy activities that require construction or excavation works,
as determined by the relevant resolution of the Director General. |
Pavement: |
The area extending from the edge of a Road, as demarcated
in the plans approved by the RTA, to the boundaries of the adjacent land
plots, as demarcated in the plans approved by the DM, which is designated for
passage of pedestrians, laying down Utility Lines, landscaping, future Public
Road extensions, and other works. |
Pavement Occupancy: |
Performing any type of occupancy activities that may
affect or limit the use of a Pavement, as determined by the relevant
resolution of the Director General. |
Utility Lines: |
Water pipelines; electricity and telecommunication cables;
sewerage, irrigation, and rainwater drainage networks; street lighting
networks; digital information networks; Alternative Utility Lines; and other
public or private service lines. |
Alternative
Utility Lines: |
Any ducts laid down by the RTA underneath a Right of Way
for future use; and any cables, pipelines, and hoses required for the
implementation of any project adjacent to the Right of Way. This includes
conduits. |
RTA
Assets: |
This includes, without limitation, the RTA facilities,
Utility Lines, and Alternative Utility Lines; and the Operational Facilities
of Roads, namely
lamp posts, traffic lights, information signs, lit signboards, barriers,
fences, speed bumps, and smart systems installed within or designated for a Right of Way. |
Traffic
Diversion: |
A temporary redirection of traffic movement on a Road to
an alternative route whether on the same or alternative Road. |
No-objection
Certificate: |
A document issued by the TRA, through the no-objection
certificate electronic system, temporarily authorising a Person to carry out
excavation works or permanent construction works, or to lay down Utility
Lines within a Right of Way or Protection Zone. |
Permit: |
A document issued by the TRA temporarily authorising a
Person to occupy a Pavement; to travel on or enter a Right of Way during prohibited times using a
special Vehicle; to make a Traffic Diversion within a Right of Way; or to
carry out any works that are not stated in the No-objection Certificate, as
per the relevant instructions of the Director General. |
Authorised
Person: |
A Person to whom a Permit or a No-objection Certificate is
issued. |
Pre-qualification
Certificate: |
A document issued by the TRA authorising a Contractor or
Consultant licensed to operate in the Emirate to design, implement, or
supervise works within the Right of Way, in accordance with the relevant
requirements and standards adopted by the TRA. |
Clearance
Certificate: |
A document issued by the TRA to an Authorised Person
confirming that he has completed all the works he is permitted to carry out
in accordance with the conditions and procedures adopted by the RTA and the
Competent Entities in this regard. |
Shoring
Works: |
A set of actions and measures that must be taken by an
Authorised Person, in accordance with the relevant manuals and requirements
adopted by the RTA, to ensure the stability, and prevent the collapse, of
excavation sides. |
Contractor: |
A Person who is licensed to practise the contracting
profession in accordance with the legislation in force in the Emirate, and
who is authorised by the RTA to carry out Work in the Right of
Way. |
Consultant: |
A Person who is licensed to practise the engineering
consultancy profession in accordance with the legislation in force in the
Emirate, and who is authorised by the RTA to provide engineering or technical
consultations in respect of Work in the Right of Way. |
Blacklist: |
A register maintained by the RTA to record the names of
the Authorised Persons who receive more than thirty (30) black points for
violating the provisions of this Resolution or the resolutions issued in
pursuance hereof. |
Person: |
A natural or legal person. |
a. The provisions of this Resolution apply to the Rights of Way and Protection Zones in the Emirate; and to all Government Entities and non-government entities.
b. Notwithstanding the provisions of paragraph (a) of this Article, the
following will not apply:
1. the No-objection Certificate fees and the security deposits prescribed under this Resolution, in case of the projects and works carried out by the Government Entities using their own resources;
2. the fees and security deposits prescribed under this Resolution, in case of the projects and works carried out within Protection Zones; and
3. the fees prescribed for using the Alternative Utility Lines laid down underneath Public Roads, in case of the projects implemented by the TRA.
For the purposes of this Resolution, the TRA will, without prejudice to the functions vested in the Competent Entities, have the duties and powers to:
1. supervise and monitor the Right of Ways and Protection Zones in the Emirate;
2. determine, in coordination with Competent Entities, the routes and rights of way of Utility Lines;
3. issue, in coordination with the Competent Entities, Permits and No-objection Certificates in accordance with the relevant requirements and procedures adopted by the RTA;
4. issue Prequalification Certificates in accordance with the relevant requirements and procedures adopted by the RTA;
5. approve, in accordance with the relevant requirements and rules adopted by the RTA, the Traffic Diversion plans and their implementation processes;
6. issue Clearance Certificates in accordance with the relevant requirements and procedures adopted by the RTA;
7. determine the specifications and time frames for carrying out Temporary or Permanent Reinstatement of Cuttings within Rights of Way or in the RTA Assets, and for Shoring Works; and approve the manuals regulating Work in the Right of Way;
8. monitor compliance by Authorised Persons with the terms of their Permits or No-objection Certificates;
9. approve manhole levels in accordance with the relevant requirements and standards adopted by the RTA;
10. determine, in coordination with the Competent Entities and in accordance with the relevant requirements and procedures adopted by the RTA, the times and areas within which travel on Rights of Way is prohibited;
11. establish, in coordination with the Competent Entities, the security and public safety requirements within Rights of Way, including those relating to the safety of pedestrians;
12. estimate, in collaboration with the concerned organisational units of the RTA, the value of damage sustained by the RTA Assets located within Rights of Way and Protection Zones;
13. remedy works and occupancy violations within Rights of Way, where the violator fails or refuses to remedy the same;
14. approve the specifications and language of information and warning signs; and monitor compliance with the same, in accordance with the relevant manuals adopted by the RTA;
15. receive, investigate, and take the necessary actions in respect of, the complaints filed against Authorised Persons;
16. notify the Competent Entities of any accident that causes damage to their property; and
17. exercise any other duties or powers required for the implementation
of this Resolution, as determined pursuant to the relevant resolutions issued
by the Director General.
a. No Person may carry out any Work in the Right of Way or Protection Zone without first obtaining a No-objection Certificate or a Permit, as the case may be.
b. Notwithstanding the provisions of paragraph (a) of this Article, a Government Entity may, in emergency situations, carry out works or occupancy activities within a Right of Way without first obtaining a No-objection Certificate or a Permit, provided that the entity notifies the TRA of the same within twenty-four (24) hours from the commencement of works or activities. The Director General will, pursuant to a resolution he issues in this respect, determine the criteria and conditions of emergency situations.
a. All works and occupancy activities within Rights of Way must be implemented in accordance with the relevant technical and planning requirements, standards, and specifications, and the relevant public health and safety requirements and standards, adopted by the Competent Entities; and in accordance with the conditions and requirements stipulated in this Resolution, the resolutions issued in pursuance hereof, and the manuals adopted by the TRA in this respect.
b. Except in cases of the Government Entities permitted to carry out works within Rights of Way using their own resources, or through their contracted service providers, all works within Rights of Way must be implemented by a Contractor and a Consultant.
c. Notwithstanding the provisions of paragraph (b) of this Article, the owners and Contractors of the buildings adjacent to Rights of Way may carry out pavement and tiling works in front of these buildings, provided that they comply with the technical specifications adopted by the RTA; obtain the relevant No-objection Certificates; and obtain the approval of Competent Entities where required.
a. No Person may occupy a Pavement without first obtaining a Permit.
b. Notwithstanding the provisions of paragraph (a) of this Article, a Government Entity may, in emergency situations, occupy a Pavement before obtaining a Permit, provided that it notifies the TRA of the same within twenty-four (24) hours from the commencement of occupancy activities. The Director General will, pursuant to a resolution he issues in this respect, determine the criteria and conditions of emergency situations.
a. The Director General or his authorised representative will determine the areas and spaces of Pavements that may be occupied, the technical conditions for such occupancy, and the requirements for obtaining the relevant Permits. In determining the foregoing, it must be ensured that the Pavement Occupancy does not obstruct the passage of pedestrians, interrupt the public services provided by Government Entities, or contravene the relevant planning conditions or the public health and safety requirements and standards adopted by the Competent Entities.
b. A Permit will be valid for a period of one (1) year, renewable for the same period. Where required, a Permit may be issued with a validity period of less than one (1) year in accordance with the requirements and procedures prescribed by the relevant resolution of the Director General. The fees for a Permit whose validity period is less than one (1) year will be calculated pro rata to the validity period of that Permit. In any case, the fee must not be less than one thousand dirhams (AED 1,000.00).
c. In return for issuing a Permit, the RTA will collect the fee indicated in item (19) of Schedule (1) attached hereto. This fee must not be less than three thousand dirhams (AED 3,000.00) or more than one hundred thousand dirhams (AED 100,000.00).
d. Where a Government Entity is to perform its services in areas and spaces in which the occupancy by an Authorised Person is permitted, that Authorised Person must cease such occupancy within the time frame prescribed by the RTA.
a. No Person may use any Right of Way or Right of Way Airspace for commercial purposes without first obtaining the relevant approval of the RTA.
b. The Director General or his authorised representative will determine the areas and spaces that may be occupied within Rights of Way or Right of Way Airspace, and the technical requirements for the occupancy of the same and for obtaining the approval of the RTA. In determining the foregoing, it must be ensured that the occupancy does not obstruct the passage of pedestrians, interrupt the public services provided by Government Entities, or contravene the relevant planning conditions or the public health and safety requirements and standards adopted by the Competent Entities.
c. The use of Rights of Way or Right of Way Airspace for commercial purposes will be regulated by the legislation in force and by an agreement between the RTA and the user entity. This agreement must state the type and period of use, and the rights and obligations of the parties. The agreement will be concluded in accordance with the requirements and procedures adopted pursuant to the relevant resolution issued by the Director General in coordination with the Department of Finance.
a. Without prejudice to the functions vested in the Dubai Police under the legislation in force, and with the exception of emergency situations determined pursuant to the resolutions issued in implementation of this Resolution, no Vehicle may be parked within a Right of Way in a manner that compromises the safety of Road Users or violates the provisions of the legislation in force in the Emirate.
b. The RTA may take the necessary actions to wheel-clamp, remove, or impound non-compliant Vehicles; and require the violators to pay the relevant fines and the charges for unclamping, removal, and impoundment, in addition to twenty-five percent (25%) of these charges as administrative fees. The RTA’s estimate of these charges will be deemed final.
c. Where a Vehicle is not released from impoundment under paragraph (b) of this Article, that Vehicle will be disposed of in accordance with the rules and procedures stipulated in the above-mentioned Law No. (23) of 2015.
An Authorised Person must:
1. comply with the terms of the Permit or No-objection Certificate, as the case may be;
2. restore, through an RTA-approved Contractor, the site to its original state upon completion of the permitted works, including the Reinstatement of Cuttings within the Right of Way, in accordance with the relevant technical requirements and specifications adopted by the RTA, and the relevant public health and safety requirements and standards adopted by the Competent Entities;
3. comply with the specifications, standards, rules, and procedures stipulated in the manuals adopted by the RTA;
4. ensure that the manhole levels are compliant with the rules adopted by TRA in this respect;
5. carry out excavation, installation, testing, inspection, backfilling, reinstatement, and other works on a sequential and uninterrupted basis, within the time frames prescribed by the TRA and the Competent Entities;
6. not use the RTA Assets without first obtaining the approval of the RTA;
7. take the necessary measures to prevent any damage to the Utility Lines existing within the Right of Way, or to the RTA Assets;
8. comply with the security, public safety, and occupational safety requirements prescribed by the manuals and guidelines adopted by the RTA and the Competent Entities;
9. not impair the general appearance of the Emirate when carrying out the works specified in the Permit or No-objection Certificate;
10. ensure that copies of the permits, plans, and certificates issued by the TRA and the Competent Entities are available at the work site;
11. enable RTA employees and authorised representatives to perform their duties, and ensure that their work is not obstructed;
12. carry out Shoring Works in accordance with the relevant requirements and specifications adopted by the TRA;
13. provide information and warning signs as prescribed by the TRA in both Arabic and English, and in any other language determined by the TRA;
14. provide, where necessary, safe pedestrian walkways within the work site;
15. maintain the work site free from waste;
16. not cause traffic obstruction, accidents, or traffic congestions in any manner whatsoever;
17. prepare reports, supported by photos, on the status of the work site before and during the performance of the permitted works. These reports must contain any damage to the RTA Assets and any obstacles that the Authorised Person faces at the site;
18. notify the RTA and the concerned Government Entities of any occupational accidents that result from carrying out Work in the Right of Way; and
19. comply with any other obligations determined pursuant to the relevant resolutions of the Director General.
A Consultant assigned to supervise the works stated in a Permit or a No-objection Certificate must:
1. notify the TRA of any issue at the work site that may pose a danger to Road Users, RTA Assets, Utility Lines, or any public or private property;
2. supervise the implementation of the works stated in the Permit or the No-objection Certificate; and instruct the Contractor to take the necessary actions to comply with the requirements and conditions stipulated in this Resolution and the resolutions issued in pursuance hereof;
3. cooperate with the competent employees and authorised representatives of the RTA and of the Competent Entities, and enable them to perform their assigned duties;
4. provide the TRA and the Competent Entities with the data and information they require, including the digital plans and the project status report. In this respect, the Consultant must ensure that the provided data and information are accurate; and must produce, where required, all the supporting documents related to the project; and
5. comply with any other obligations determined pursuant to the relevant resolutions of the Director General.
a. In case of occupying Pavements or areas surrounding Buildings and Commercial Establishments, the TRA will collect from the Authorised Person a refundable cash security deposit of ten thousand dirhams (AED 10,000.00).
b. In other than the cases specified in paragraph (a) of this Article, the TRA will collect from the Authorised Person a refundable cash security deposit of ten percent (10%) of the project value. This deposit must not exceed one million dirhams (AED 1,000,000.00).
c. The Director General will, pursuant to a resolution he issues in this respect, prescribe:
1. the cases in which the security deposit referred to in paragraph (b) of this Article will be collected and the percentage of this deposit. In issuing the resolution, the nature of use, occupancy, or works subject of the Permit or the No-objection Certificate must be determined; and
2. the cases in which an amount may be deducted from the security deposit referred to in paragraphs (a) and (b) of this Article.
a. A Person who causes damage to the RTA Assets will be liable for compensation for such damage.
b. The amount of compensation for the damage sustained by the RTA Assets will be determined based on the original value of the damaged parts or the costs of repair or replacement thereof, including all incurred expenses, in addition to twenty-five percent (25%) of such value or costs as administrative and supervisory charges. The RTA’s estimate of the amount of compensation will be deemed final.
An Authorised Person must, upon completing the works stated in the Permit or the No-objection Certificate, apply to the TRA and the Competent Entities for a Clearance Certificate. This certificate will be issued in accordance with the relevant requirements and procedures adopted by the RTA and the Competent Entities.
a. A register of Authorised Persons (the “Blacklist”) will be created by the TRA. The content of this register; the procedure for adding black points to, or removing them from, the register; and the consequences of receiving black points will be determined under a resolution issued by the Director General in this respect.
b. Based on a request of an Authorised Person whose name is not listed in the Blacklist, the TRA may approve removing no more than twenty (20) black points per year in return for thirty thousand dirhams (AED 30,000.00) for each point. This approval will be issued in accordance with the requirements and procedures prescribed by the relevant resolution issued by the Director General.
a. The TRA may, in accordance with the requirements of public interest, planning regulations, and traffic safety; and for the purpose of maintaining the general appearance of the Emirate, revoke or amend a Permit or a No-objection Certificate. In this case, the Authorised Person may not object to such revocation or amendment and the TRA will, in coordination with the Department of Finance, refund part of the fees collected from the Authorised Person pro rata to the remaining validity period of the revoked or amended Permit or No-objection Certificate.
b. The RTA may, based on the reasons referred to in paragraph (a) of this Article, revoke or amend a contract for the commercial use of a Right of Way or Right of Way Airspace, or for Pavement Occupancy. In this case, the contracting party may not object to such revocation or amendment and the RTA will, in coordination with the Department of Finance, refund an amount pro rata to the remaining validity period of the revoked contract or an amount that compensates for the impact of the contract amendment.
In return for issuing the Permits and No-objection Certificates, and providing the services, stated in Schedule (1) attached hereto, the RTA will collect the fees indicated opposite each of these Permits, No-objection Certificates, and services.
a. Without prejudice to any stricter penalty provided for in any other resolution, a Person who commits any of the violations mentioned in Schedule (2) attached to this Resolution will be punished by the fine indicated opposite that violation. Prior to imposing any of the fines listed in items (1) to (16) of that Schedule (2), a written warning must be served on the violator in case he commits the violation for the first time in a year.
b. Upon repetition of the same violation within one (1) year from the date of the previous violation, in the same area or street, as the case may be, the amount of the fine will be doubled. A doubled fine must not exceed two hundred thousand dirhams (AED 200,000.00).
c. In addition to the penalty of a fine prescribed pursuant to paragraph (a) of this Article, the Director General or his authorised representative may take any of the following measures:
1. revocation of the Permit;
2. revocation of the No-objection Certificate;
3. revocation of the Pre-qualification Certificate;
4. wheel-clamping, towing, or impounding the non-compliant Vehicle; or
5. suspend the issuance of Permits or No-objection Certificates to the violating entity for a period not exceeding six (6) months, or permanently cease their issuance.
d. A violator must remedy the violation within the time frame prescribed by the TRA, failing which the RTA may remedy the violation using its own resources or through engaging any other entity, and hold the violator liable for all costs incurred, in addition to administrative charges of twenty-five percent (25%) of these costs. The violator will also be required to pay for his use of the Right of Way as estimated by the TRA. The estimate by the RTA in this respect will be final.
The RTA may, in accordance with the legislation in force, outsource any of its functions under this Resolution to any public or private entity pursuant to an agreement concluded for this purpose. This agreement will state its term and the rights and obligations of both parties.
The RTA employees, and the staff of the companies and corporations contracted by the RTA, nominated pursuant to a resolution of the Director General will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Resolution and the resolutions issued in pursuance hereof. For this purpose, they may issue the necessary violation reports; and, where necessary, seek the assistance of police personnel.
Any affected party may submit to the Director General a written grievance against any decision, procedure, penalty, or measure taken against him in accordance with this Resolution, within thirty (30) days from the date of being notified of the contested decision, procedure, penalty, or measure. The grievance will be determined, within thirty (30) days from the date of its referral to the committee formed by the Director General for this purpose. The decision issued by the committee on the grievance will be final.
The fees, fines, and any other amounts or security deposits collected pursuant to this Resolution will be paid to the Public Treasury of the Government of Dubai.
For the purposes of enabling the RTA to perform its functions under this Resolution and the resolutions issued in pursuance hereof, the Competent Entities must, each within its own jurisdiction, fully cooperate with the RTA and the TRA and provide them with support and assistance when requested to do so.
The RTA will not be liable to third parties for any damage they may sustain as a result of the works performed by Authorised Persons pursuant to this Resolution and the resolutions issued in pursuance hereof.
The Director General will issue the resolutions required for the implementation of this Resolution. These resolutions will be published in the Official Gazette.
a. The above-mentioned Regulation No. (1) of 2006, Regulation No. (4) of 2009, and Executive Council Resolution No. (18) of 2012 are hereby repealed. Any provision in any other resolution is hereby also repealed to the extent that it contradicts the provisions of this Resolution.
b. The bylaws and resolutions issued in implementation of the legislation mentioned in paragraph (a) of this Article will continue in force, to the extent that they do not contradict this Resolution, until new superseding bylaws and resolutions are issued.
This Resolution will be published in the Official Gazette and will come into force ninety (90) days after the date of its publication.
