Concerning the
Use
of Security Cameras in Documenting the
Performance of the
Duties
of Police Staff Members[1]

We, Mohammed bin
Rashid Al Maktoum, Ruler of Dubai,
After perusal of:
Federal Law No. (35) of 1992 Issuing the Criminal
Procedure Code and its amendments;
Federal Law No. (21) of 1995 Concerning
Road Traffic, its Implementing Bylaw, and their amendments;
The Dubai Police Law of 1966 and its
Implementing Bylaw No. (1) of 1984;
Law No. (6) of 2012 Concerning Management
of the Human Resources of Local Paramilitary Personnel in the Emirate of Dubai
and its amendments;
Law No. (13) of 2016 Concerning the
Judicial Authorities in the Emirate of Dubai; and
Ministerial Resolution No. (178) of 2017
Concerning Road Traffic Control Rules and Procedures,
Do hereby issue this Resolution.
The following words and expressions, wherever mentioned in this
Resolution, will have the meaning indicated opposite each of them unless the
context implies otherwise:
Emirate: |
The Emirate of Dubai. |
DP: |
The Dubai Police. |
Commander-in-Chief: |
The Commander-in-Chief of the DP. |
Staff Member: |
A male or female Officer, Non-commissioned Officer, or Recruit working for the DP. |
Security Camera: |
Any equipment used by Staff Members or by the DP for recording and transmitting audio and video. |
Recordings: |
Any material recorded or transmitted by a Security Camera,
including photographs, videos, or sounds. |
This Resolution aims to:
1.
promote the quality of the services
provided by the DP and enhance the performance of Staff Members;
2.
revive the spirit of peace amongst
members of the community and reinforce their sense of security and safety;
3.
protect the rights of members of the
community when dealing with Staff Members;
4.
monitor the behaviour of Staff Members when
dealing with members of the community, with a view to assessing the level of
transparency and impartiality of Staff Members and verifying the acts
attributed to them; and
5.
contribute to collecting evidence for crimes.
For the purpose of documenting the
performance of the duties assigned to the DP under the legislation in force,
including the recording of traffic violations; and verifying the validity of
the actions and measures taken by its Staff Members, the DP will have the
authority to use Security Cameras in the public areas of the Emirate.
A Staff Member authorised to use a Security Camera or to access
Recordings must:
1.
comply with the
legislation in force, in particular those protecting the privacy and personal information of individuals;
2.
not surrender,
transfer, save, dispatch, or disseminate any Recordings without the prior
written consent of the search and investigation authority of the DP or the competent Judicial Authority;
3.
maintain the
confidentiality of the content of Recordings;
4.
not use the Security Camera except for its intended purposes;
5.
hand over the memory
device of the Security Camera to the concerned department at the DP within the time frames prescribed by the DP for this
purpose;
6.
not use his personal
equipment for other than performing the duties and responsibilities assigned to him; and
7.
comply with any
other obligations determined pursuant to any resolution of the
Commander-in-Chief.
Unless otherwise established to the satisfaction of the search and investigation authority of the
DP or the competent Judicial Authority, the content of Recordings will have conclusive evidentiary
value as against all persons.
Recordings are confidential. Staff Members must
not use, disseminate, or disclose Recordings, or allow third parties to access them, except for official work purposes or based on the prior
approval of the search and
investigation authority of the DP or the competent Judicial Authority.
Without prejudice to any applicable civil or criminal liability, a
Staff Member who commits any act constituting a violation of this Resolution, or the resolutions issued in pursuance hereof, will be subject to a
disciplinary penalty in accordance with the legislation in force.
The Commander-in-Chief will issue the resolutions required for the
implementation of the provisions of this Resolution.
This Resolution will be published in the Official Gazette and will
come into force on the day on which it is published.
