Regulating the Activity of Driving Instruction in the Emirate of Dubai[1]

The Director General and Chairman of the Board of Executive Directors of the Roads and Transport Authority,

After perusal of:

Federal Law No. (21) of 1995 Concerning Road Traffic, its Implementing Bylaw, and their amendments;

Law No. (17) of 2005 Establishing the Roads and Transport Authority and its amendments;

Executive Council Resolution No. (57) of 2017 Regulating the Issuance of Vehicle Drivers’ Licences and Permits in the Emirate of Dubai;

Executive Council Resolution No. (38) of 2018 Regulating the Activity of Driving Instruction in the Emirate of Dubai; and

Administrative Resolution No. (428) of 2009 Issuing the Implementing Bylaw of Regulation No. (6) of 2009 Concerning the Licensing of Driving Schools in the Emirate of Dubai,

Does hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

RTA:

The Roads and Transport Authority.

Agency:

The Licensing Agency of the RTA.

e-Traffic System:

The smart electronic system through which drivers’ training and licensing applications, Vehicle licensing applications, and transport business activities licensing applications are processed.

Vehicle:

Any motorised machine, Pedal Cycle, Motorcycle, Carriage, or other machine designed to run on Roads, whether mechanically propelled or otherwise. This includes Tractors.

Motorcycle:

A two- or more-wheeled motor Vehicle designed for transporting persons or objects.

Light Vehicle:

A Vehicle which is designed to transport persons or goods and whose kerb weight does not exceed 2.5 tons. This includes sedan cars and Motorcycles designed or modified to transport goods of whatever weight. Light Vehicles are categorised as private and public.

Heavy Vehicle:

A Vehicle which is designed to transport goods and whose kerb weight exceeds 2.5 tons. Heavy Vehicles are categorised as private and public.

Bus:

A Vehicle designed to transport more than fourteen (14) passengers. Buses are categorised as:

1.       Light Buses

These include Buses whose seating capacity does not exceed twenty-six (26) passengers, excluding the driver.

2.       Heavy Buses

These include Buses whose seating capacity exceeds twenty-six (26) passengers, excluding the driver.

The above-mentioned Buses are further categorised as private and public.

Tractor\ Mechanical Equipment:

A Vehicle designed for purposes other than transporting persons and goods. These Vehicles are categorised as:

1.       equipment of any weight designed to run on other than wheels;

2.       light equipment that runs on wheels and whose kerb weight is less than 7.5 tons; and

3.       heavy equipment that runs on wheels and whose kerb weight exceeds 7.5 tons.

Trailer:

A Vehicle designed to be towed by a Tractor, Mechanical Equipment, or any other Vehicle.

Semi-trailer:

A Trailer without a front axle coupled to a Tractor, Mechanical Equipment, or other Vehicle so that a large proportion of its weight and the weight of its load is borne by that Tractor, Mechanical Equipment, or other Vehicle.

Training Vehicle:

A Vehicle with certain specifications designed for training or testing drivers in order to enable them to obtain Drivers’ Licences or drivers’ permits.

Gantry Crane:

Large dockside Mechanical Equipment used for loading and unloading ships.

Activity:

The provision of theoretical and practical instruction for general Vehicle driving, for Occupational Driving, for Advanced Driving, or for Desert Driving.

Establishment:

A company or corporation authorised by the Agency to conduct the Activity.

Branch:

A centre affiliated to an Establishment where the Activity is conducted.

Registration Office:

An office affiliated to an Establishment where Learners are registered.

Trainer:

A natural person who works for an Establishment and is authorised by the Agency to conduct any of the authorised activities of that Establishment.

Instructor:

A natural person who works for an Establishment and is authorised by the Agency to deliver theory lessons on road traffic legislation to Learners in the languages determined by the RTA.

Temporary Driving Training Site:

A temporary site where the Agency authorises the conduct of the Activity.

Technical Committee:

A committee formed within the Agency to consider Permit applications submitted by Establishments and their Branches and to approve service fees of these Establishments and Branches.

Permit:

A document issued by the Agency, including any of the Permits stipulated in this Resolution, such as permits to conduct the Activity, Temporary Driving Training Site permits, Trainer permits, and Instructor permits.

Desert Driving:

The training of a person who holds a Driver’s Licence to develop the skills required for him to drive off-road and on sand dunes.

Occupational Driving:

The training of a person who holds a Driver’s Licence to develop the skills required for him to drive occupational Vehicles, such as taxicabs, heavy and light passenger Buses, Heavy Vehicles, construction Vehicles used on construction sites, and Vehicles with Trailers.

Advanced Driving:

The training of a person who holds a Driver’s Licence to develop the skills required for him to drive in extreme environments in terms of terrain, climate, or activities.

Central Training System:

An electronic system adopted by the Agency through which the Permits of Trainers and Instructors are issued and renewed, and in which details of the daily training provided by Trainers are entered.

Learner:

A natural person who is authorised by the Agency to learn how to drive a Vehicle in order to obtain a Driver’s Licence, an Occupational Driving Permit, a Desert Driving Permit, or an Advanced Driving Permit in accordance with Executive Council Resolution No. (57) of 2017 Regulating the Issuance of Vehicle Drivers’ Licences and Permits in the Emirate of Dubai.

 

Requirements for Issuing Permits to Conduct the Activity

Article (2)

A Permit to conduct the Activity will be issued to an Establishment subject to the following requirements:

1.       The owner of the Establishment must be a UAE national aged at least twenty-one (21) years.

2.       The owner of the Establishment must be of good character and repute and not have been convicted of any felony or other crime affecting honour and trustworthiness, unless he has been rehabilitated.

3.       The total area of the land on which the Establishment and its various facilities are constructed must not be less than three hundred square feet (300,000 Sq. ft.); and the total area of the land on which any of the Establishment’s branches is constructed must not be less than one hundred fifty square feet (150,000 Sq. ft.).

4.       The location where the Activity is to be conducted by the Establishment or the Branch must be in any of the relevant areas approved by the RTA and the concerned Government entities.

5.       The approvals of the concerned Government entities to conduct the Activity in the Emirate must be obtained.

6.       An insurance policy in favour of the RTA, which covers any damage that may result from conducting the Activity, must be provided;

7.       The RTA approvals of the traffic impact study and of the entrances and exits of the Establishment and its Branches must be obtained within no later than six (6) months from the date on which the initial approval is issued.

8.       Engineering plans must be submitted to the RTA for approval in accordance with the relevant standards and specifications adopted by the RTA. These plans must contain the details of the Establishment's premises, its Branches, and its training and testing tracks, as well as a Driver’s testing section which is provided with the logistic support required for enabling RTA supervisors and Examiners to perform their duties.

9.       The procedures for licensing the Establishment by the Department of Economic Development must be completed upon obtaining the approvals referred to in sub-paragraphs (5) and (7) of this Article and the approvals of the Technical Committee.

10.   Upon completion of construction works, the system of the Establishment and its Branches must be linked to the Road e-Traffic System and the Central Training System, at the expense of the Establishment, to enable it to commence the training activities.

11.   The Establishment must conclude with the Agency an agreement for conducting the activities of training and qualifying Drivers.

Requirements for Issuing Temporary Driving Training Site Permits

Article (3)

a.       A public or private entity will be issued with a Permit to set up a Temporary Driving Training Site to train its employees subject to the following requirements:

1.       The Temporary Driving Training Site must be located on land owned or leased by the entity.

2.       The Temporary Driving Training Site must be equipped as per the technical specifications and requirements approved by the RTA.

3.       The Temporary Driving Training Site must be appropriately equipped and must be approved by the Technical Committee.

b.       Subject to obtaining the relevant prior approval of the Agency, an entity to which the provisions of paragraph (a) of this Article apply may use the Training Vehicles of any Establishment conducting the Activity in the Emirate and engage the Trainers of that Establishment to train its employees at its premises.

Requirements for Issuing Trainer Permits

Article (4)

A Permit will be issued to a Trainer subject to the following requirements:

1.       The applicant must have held a valid Driver's Licence issued in the UAE, for the specific category of Vehicles he will use in providing training, for at least three (3) years prior to the application date.

2.       The applicant must be of good character and repute and not have been convicted of any felony or other crime affecting honour and trustworthiness, unless he has been rehabilitated.

3.       The applicant must not have been convicted of driving a Vehicle under the influence of alcohol, narcotics, psychotropic drugs, or similar substances.

4.       The applicant must not be less than twenty-five (25) years of age.

5.       The applicant must be acquainted with road traffic instructions, rules, and etiquettes; and with Vehicles maintenance basics; and must have the competency to deliver Vehicle driving instruction.

6.       The applicant must successfully pass the relevant tests and examinations conducted by the Agency. This requirement will not apply to Trainers of Gantry Crane operators who submit proof of having the required qualifications to provide training.

7.       The applicant must be medically fit.

Classification of Trainers

Article (5)

a.       Trainers are classified as follows:

1.       Motorcycle Trainer;

2.       Light Vehicle Trainer (manual transmission)

3.       Light Vehicle Trainer (automatic transmission)

4.       Heavy Vehicle Trainer;

5.       Light Bus Trainer;

6.       Heavy Bus Trainer;

7.       Tractor Trainer;

8.       light Mechanical Equipment Trainer;

9.       heavy Mechanical Equipment Trainer;

10.   Desert Driving Trainer;

11.   Recreational Motorcycle Trainer;

12.   Gantry Crane Trainer; and

13.   any other category determined by the Agency.

b.       The Agency may, upon the request of an Establishment, add one or more categories to the Permit issued to a Trainer, provided that the Trainer is issued with a Driver's Licence for the specific category of Vehicles he will use to provide training at least one (1) year prior to the date of addition.

Requirements for Issuing Instructor Permits

Article (6)

A Permit will be issued to an Instructor subject to the following requirements:

1.       The applicant must be at least twenty-five (25) years of age.

2.       The applicant must be medically fit.

3.       The applicant must be of good character and repute and not have been convicted of any felony or other crime affecting honour and trustworthiness, unless he has been rehabilitated.

4.       The applicant must not have been convicted of driving a Vehicle under the influence of alcohol, narcotics, psychotropic drugs, or similar substances.

5.       The applicant must hold at least a general secondary school certificate; have the ability to read and write in Arabic and English, or either languages; be acquainted with the road traffic instructions and rules; and be competent to teach, and effectively communicate with, Learners.

6.       The applicant must hold at least a Light Vehicle Trainer Permit to provide theory lessons on driving Light Vehicles, Heavy Vehicles, Buses, or Motorcycles; and must hold at least a Mechanical Equipment Trainer Permit to provide theory lessons on driving Mechanical Equipment. This requirement will not apply to Instructors who provide theory lessons on Occupational Driving to drivers of taxicabs and other passenger transport Vehicles.

7.       The applicant must successfully pass the relevant tests conducted by the Agency to obtain an Instructor Permit.

Expiry of Permits of Non-UAE National Trainers and Instructors

Article (7)

Upon the end of the employment relationship between a non-UAE national Trainer or Instructor and his Establishment, the Permit issued to that Trainer or Instructor expires. The Agency may require the Trainer or Instructor to take a refresher course, in accordance with the relevant procedures it prescribes, prior to issuing him with a new Permit to work for another Establishment.

Procedures for Issuing Permits

Article (8)

When issuing a Permit, the following procedures will be followed:

1.       An application for a Permit will be submitted to the Agency on the form prescribed by it for this purpose, supported by the documents that are requested by the Agency and that prove fulfilment of the requirements stipulated in this Resolution as per the type of the requested Permit.

2.       The Agency will consider and determine the application after verifying that the requirements stipulated in this Resolution are met.

3.       The Agency will issue the Permit after collecting the prescribed fees.

Renewal of Permits

Article (9)

An application for renewal of a Permit will be submitted at least thirty (30) days prior to its expiry date.

Training Vehicle Categories

Article (10)

a.       Training Vehicles are categorised as:

1.       Motorcycles;

2.       Light Vehicle;

3.       Heavy Vehicles;

4.       Light Bus;

5.       Heavy Bus;

6.       Trailer or Semi-trailer;

7.       light Mechanical Equipment; and

8.       heavy Mechanical Equipment.

b.       The Agency may introduce new categories other than those stipulated in paragraph (a) of this Article.

Technical Specifications and Requirements of Vehicles

Article (11)

a.       A Light Vehicle must meet the following technical specifications and requirements:

1.       The date of manufacture of a Training Vehicle must not be more than six (6) years back. The date of manufacture of a Test Vehicle must not be more than four (4) years back. The date of manufacture of a Training Vehicle used for Occupational Driving, Desert Driving, or Advanced Driving training must not be more than ten (10) years back.

2.       The length of the Vehicle must not be less than 4.4 meters.

3.       The height of the Vehicle must not be less than 1.4 meters.

4.       The width of the Vehicle must not be less than 1.6 meters.

5.       The minimum engine capacity of the Vehicle must not be less than 1.3 litres.

6.       The Vehicle must be fitted with additional brakes and internal mirrors.

7.       A Test Vehicle must be fitted with an additional accelerator and brake pedal at the Examiner side, small blind spot mirrors, audio-enabled cameras inside the cabin to record the test process, and a sticker indicating that the Vehicle is designated for testing Drivers.

8.       A magnetic sign which is made of fibreglass or other similar material, and can be lit at night, must be affixed to the top of the Vehicle

9.       A sticker must be affixed to the rear side of the Test Vehicle to indicate that it is designated for this purpose, and a “Vehicle Monitored by the RTA” sticker must be affixed inside the Vehicle.

10.   The Vehicle must be inspected and registered as a driving instruction Vehicle as prescribed in the e-Traffic System; and must meet the technical inspection criteria adopted by the Agency.

11.   The Vehicle must be equipped with a fire extinguisher and a first aid kit.

b.       A Vehicle, other than a Light Vehicle, must meet the following technical specifications and requirements:

1.       The engine capacity of a Motorcycle must not be less than one hundred cubic centimetres (100cc) and not more than six hundred cubic centimetres (600cc). The date of manufacture of a training Motorcycle must not be more than six (6) years back and the date of manufacture of a test Motorcycle must not be more than four (4) years back.

2.       The date of manufacture of a light Bus, heavy Bus, or Heavy Vehicle used for training must not be more than fifteen (15) years back. The date of manufacture of a Bus or Vehicle used for test purposes must not be more than eight (8) years back.

3.       The date of manufacture of any Mechanical Equipment used for training must not be more than fifteen (15) years back; and the date of manufacture of any Mechanical Equipment used for test purposes must not be more than ten (10) years back.

4.       The length of a Trailer or Semi-trailer must not be less than forty (40) feet. The Trailer or Semi-trailer must carry a load of at least eight (8) tons when used for training.

5.       The Vehicle must be equipped with a fire extinguisher and a first aid kit.

c.       The Agency may require the fulfilment of any additional technical specifications or requirements other than those stipulated in paragraphs (a) and (b) of this Article.

Additional Technical Inspection of Training Vehicles

Article (12)

Training Vehicles that are categorised as Light Vehicles, Heavy Vehicles, and Buses, and are equipped with the additional technical fittings prescribed by the Agency, will be subject to an annual inspection in addition to the ordinary inspection of Vehicles conducted at the time of licensing these Vehicles or renewing their licences.

Activity-related Service Level Indicators

Article (13)

The Agency may conduct a periodic assessment of Establishments to verify that they meet the requirements and standards for conducting the Activity, and the relevant service levels indicators, as adopted by the Agency.

Ceasing the Activity

Article (14)

Where an Establishment wishes to cease the Activity, including in any of its Branches or Registration Offices, the Establishment must notify the Agency in writing of this intention at least six (6) months prior to the cessation date in case of ceasing the Activity of the Establishment or a Branch, or at least one (1) month prior to the cessation date in case of ceasing the Activity of a Registration Office.

Issuing Instructions

Article (15)

The Chief Executive Officer of the Agency will issue the instructions required for the implementation of the provisions of this Resolution.

Repeals

Article (16)

The above-mentioned Administrative Resolution No. (428) of 2009 is hereby repealed. Any provision in any other administrative resolution will also be repealed to the extent that it contradicts the provisions of this Resolution.

Publication and Commencement

Article (17)

This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
