Regulating the

Gemstones and Precious Metals Testing Samples Transport Service[1]

The Director General of the Dubai Municipality,

After perusal of:

Federal Law No. (11) of 2015 Concerning Control of Trading in and Hallmarking Gemstones and Precious Metals and its Implementing Bylaw;

Law No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai and its amendments;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai;

Law No. (12) of 2016 Regulating the Security Industry in the Emirate of Dubai, its amendments, and its Implementing Bylaw;

The Order of 1961 Establishing the Dubai Municipality;

Administrative Resolution No. (440) of 2017 Approving the Organisational Structure and Description of Duties of the Dubai Central Laboratory Department; and

Based on the Department of Finance letter dated 8 October 2018 approving the introduction and pricing of the Service of transporting testing Samples of Gemstones and Precious Metals from and to Commercial Establishments,

Does hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

DM:

The Dubai Municipality.

Department:

The Dubai Central Laboratory Department of the DM.

Service:

Transporting testing Samples of Gemstones and Precious Metals between Commercial Establishments and the Department for testing purposes.

Sample:

A Gemstone or Precious Metal sample selected by a DM inspector for testing purposes.

Gemstones:

Organic and inorganic natural precious stones, artificial precious stones, and semi-precious stones.

Precious Metals:

Gold, silver, and platinum-group metals, whether fabricated or non-fabricated.

Commercial Establishment:

A company or sole proprietorship licensed to conduct the activity of trading in Gemstones and Precious Metals in the Emirate.

 

Sample Transport Service

Article (2)

a.     A new Service is hereby introduced at the Department to transport Gemstones and Precious Metals Samples between Commercial Establishments and the Department for testing purposes.

b.     The Service is priced at one hundred and fifty Dirhams (AED 150.00) per one-way trip.

c.     The Service will be provided upon the request of Commercial Establishments.

d.     The Department may outsource the Service provision to a specialised transport company pursuant to a contract which stipulates the rights and obligations of both parties.

Obligation of Commercial Establishments to Transport Samples

Article (3)

a.     A Commercial Establishment must transport any Sample to the Department within three (3) working days from the date of being requested to do so by the competent DM inspector.

b.     Where the Commercial Establishment fails to transport the Sample within the time frame referred to in paragraph (a) of this Article, the Department will transport the Sample at the expense of the Commercial Establishment.

Issuing Instructions

Article (4)

The Director of the Department will issue the instructions required for the implementation of the provisions of this Resolution.

Publication and Commencement

Article (5)

This Resolution will be published in the Official Gazette and will come into force on the date on which it is published.
