Executive Council Resolution No. (40) of 2018
Concerning the Family

We, Hamdan bin Mohammed bin Rashid Al Maktoum,
Crown Prince of Dubai, Chairman of the Executive Council,
After
perusal of:
Law No. (5)
of 1995 Establishing the Department of Finance;
Law No. (27)
of 2006 Concerning Management of the Government of Dubai Human Resources and
its amendments;
Law No. (9)
of 2007 Establishing the Awqaf and Minors Affairs Foundation (the “AMAF”);
Law No. (8)
of 2015 Concerning the Community Development Authority in Dubai (the “CDA”);
Law No. (1)
of 2016 Concerning the Financial Regulations of the Government of Dubai;
Law No. (14)
of 2017 Regulating Endowments and Gifts in the Emirate of Dubai;
Executive
Council Resolution No. (26) of 2015 Approving the Organisational Structure of
the Community Development Authority in Dubai,
Do hereby issue this Resolution.
Pursuant to
this Resolution,
the affiliation of the Family Village is transferred from the AMAF to the
CDA and the Family Village is incorporated into the CDA Organisational Structure.
Pursuant to
this Resolution, all the assets, rights, and obligations of the Family Village is transferred to the CDA.
a.
The
Department of Finance must reallocate the financial
appropriations earmarked for the Family Village in the annual budget of the
AMAF to the annual budget of the CDA.
b.
As of the effective date of this Resolution, all
the funds allocated to the Family Village, as well as any grants, Gifts, or donations to be provided to the Family Village after the effective date hereof, will be transferred to the CDA.
As of the
effective date of this Resolution, all Employees of the Family Village will be
transferred to the CDA, and will retain their existing rights. Law No. (27) of
2006 Concerning Management of the Government of Dubai Human Resources and its
amendments, and any other superseding law, will apply to these Employees.
Without
prejudice to the above-mentioned Law No. (14) of 2017, the AMAF will continue
to act as Trustee of
the Endowments of the Family Village. However, the AMAF must transfer the
proceeds of these Endowments to the CDA in accordance with the legislation in
force in the Emirate.
a.
A special account named the “Family Village Account” will
be created at the CDA. The proceeds
of the Endowments, Gifts, bequests, and donations made to the Family Village will be deposited
in the Family Village
Account.
b.
The objectives of creating the account referred to
in paragraph (a) of this Article is to:
1.
promote the spirit of social solidarity and
strengthen ties of cooperation between community members with a view to providing aid to
the groups sheltered by
the Family Village;
2.
provide social assistance to the groups sheltered by the Family Village, and help them overcome the
ordeals and hardships that they face;
3.
bridge the gap between community members and ensure decent living conditions for the groups sheltered by the Family Village; and
4.
achieve sustainable financial empowerment of the
groups sheltered at the Family Village, and guarantee them sustainable decent living.
The Family
Village Account referred to in Article (6) of this Resolution will be managed
in accordance with the accounting principles stipulated in the above-mentioned
Law No. (1) of 2016, and with the standards adopted by the Government of Dubai.
The Director
General of the CDA will issue the resolutions required for the implementation
of this Resolution.
Any
provision in any other resolution will be repealed to the extent that it
contradicts this Resolution.
This
Resolution comes into force on the day on which it is issued, and will be
published in the Official Gazette.
