Decree No. (28) of 2018

Concerning

Admissibility of Civil Appeals Brought before the Dubai Courts1

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Federal Law No. (11) of 1992 Issuing the Civil Procedure Code and its amendments;

Law No. (21) of 2015 Concerning Judicial Fees of the Dubai Courts; and

Law No. (13) of 2016 Concerning the Judicial Authorities in the Emirate of Dubai,

Do hereby issue this Decree.

Admissibility of Appeals

Article (1)

Registered civil appeals brought against the judgements and decisions rendered by the Dubai Courts will be admissible in form, in terms of the time limits for payment of fees and deposits, subject to the following:

1.      An appeal must be directly registered with the Case Management Office, or through the electronic system adopted by the Dubai Courts, within the time limits prescribed for appeal under the legislation in force.

2.     The appellant must pay the legally prescribed fees and deposits within three (3) working days from the date of being served a payment notice by the Case Management Office of the competent court, unless any other time limit is prescribed by the President of the Dubai Courts.

Reconsidering Appeals

Article (2)

A civil appeal in respect of which a ruling is rendered that the right to appeal has lapsed, or that the appeal is inadmissible in form due to failure to pay the relevant fees and deposits within the legally prescribed time limits, will be reconsidered. This applies only to appeals registered, from 3 May 2015 until the effective date of this Decree, through the electronic system adopted by the Dubai Courts, and provided that the appellant requests reconsideration of his appeal within thirty (30) days from the day following the effective date of this Decree. No request for reconsideration of an appeal may be registered after the lapse of this period.

Publication and Commencement

Article (3)

This Decree will be published in the Official Gazette and will come into force on the day on which it is published.
