Establishing the

Corporations Affiliated to the

Dubai Health Authority and Determining their Functions[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (11) of 2013 Concerning Health Insurance in the Emirate of Dubai; and

Law No. (6) of 2018 Concerning the Dubai Health Authority,

Do hereby issue this Decree.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Decree, will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

DHA:

The Dubai Health Authority.

Director General:

The director general of the DHA.

Corporation:

This includes the corporations established pursuant to this Decree and any other corporation established and affiliated to the DHA.

CEO:

The chief executive officer of a Corporation.

Establishing Corporations

Article (2)

Pursuant to this Decree, the following two (2) Corporations are established within the DHA:

1.    the Dubai Healthcare Corporation; and

2.    the Dubai Health Insurance Corporation.

Dubai Healthcare Corporation

Article (3)

The Dubai Healthcare Corporation will manage and operate Government healthcare facilities, including hospitals, primary healthcare centres, specialised healthcare centres, medical fitness centres, public health centres, and occupational health centres. In particular, the Dubai Healthcare Corporation will have the duties and powers to:

1.    manage, operate, and develop its organisational units directly or by contracting with third parties;

2.    develop and implement a customized strategy to promote healthcare services in line with the strategic plan of the Emirate and the DHA;

3.    ensure the integration of healthcare services provided at all levels, with a view to achieving operational effectiveness and efficiency;

4.    qualify its healthcare facilities in order for them to obtain international accreditation in all areas and levels of services;

5.    conduct studies on the establishment of new healthcare facilities or on expanding the scope of various healthcare services, such as managing healthcare facilities; providing medical services, pharmaceuticals, healthcare products, medical devices and equipment, and the like, within and outside of the Emirate;

6.    develop public health policies that ensure the health and safety of the inhabitants of the Emirate; obtain the DHA approval of the same, and follow up their implementation;

7.    assess and monitor the health condition of inhabitants; and develop and follow up the implementation of the strategic policies and programmes, and the conduct of the studies and research, required for improving public health and protecting community members from disease and health risks;

8.    build and develop the institutional capacity and competencies required to manage its organisational units, and attract qualified personnel in the technical and administrative fields, through adopting an up-to-date professional development strategy;

9.    organise and participate in local and overseas medical events and conferences in coordination with the concerned entities;

10.  coordinate with the concerned entities in the UAE in areas and matters of common interest, with a view to achieving the highest levels of development and efficiency that ensure achievement of the DHA objectives;

11.  propose, and follow up the collection of, the fees for the health services provided by its healthcare facilities;

12.  provide and purchase supplies, pharmaceuticals, and other requisites needed for its healthcare facilities;

13.  provide therapeutic and preventative health services, and medical fitness and occupational health test services;

14.  manage, operate, and develop any healthcare facilities as assigned to the Dubai Healthcare Corporation by the Government of Dubai; and

15.  exercise any other duties or powers assigned or delegated to it in accordance with the legislation in force in the Emirate.

Dubai Health Insurance Corporation

Article (4)

The Dubai Health Insurance Corporation will manage and oversee Health Insurance in the Emirate in accordance with the legislation in force. In particular, the Dubai Health Insurance Corporation will have the duties and powers to:

1.    ensure that Health Insurance services are provided to UAE Nationals, Residents, and Visitors;

2.    regulate the Health Insurance business and ensure that the rights of individuals who are covered by Health Insurance in the Emirate are preserved;

3.    design and develop Health Insurance schemes for UAE Nationals, Residents, and Visitors;

4.    authorise Insurance Companies, Claim Management Companies, Insurance Brokers, and Health Service Providers to provide Health Insurance services in the Emirate;

5.    oversee the stakeholders of the insurance system, with a view to enhancing the quality of insurance and health services in the Emirate and achieving financial sustainability in accordance with the relevant international best practices;

6.    manage Government Health Insurance schemes;

7.    issue reports, studies, and recommendations related to Health Insurance and health economics; and oversee the implementation of the conclusions of these reports, studies, and recommendations in a manner that ensures the achievement of the DHA objectives; and

8.    exercise any other duties or powers assigned or delegated to it in accordance with the legislation in force in the Emirate.

Executive Bodies of Corporations

Article (5)

a.    Each Corporation will have a CEO appointed pursuant to a resolution issued by the Chairman of the Executive Council upon recommendation of the Director General.

b.    A CEO will manage the Corporation he is in charge of, will ensure that it is performing its functions in an effective and efficient manner, and will be directly responsible to the Director General for performing the duties assigned to him under this Decree and the resolutions issued in pursuance hereof. In particular, a CEO will have the duties and powers to:

1.    develop the general policy and operational and development plans of the Corporation, and follow up their implementation upon approval of the same as part of the overall strategic plan of the DHA;

2.    prepare, review, analyse, and implement the operational and action plans of the Corporation and its strategic initiatives, including projects and programmes; and prepare the relevant annual budgets;

3.    determine the needs of the Corporation in terms of the legislation related to its work, and submit the same to the Director General to take the appropriate action in this respect;

4.    approve the administrative resolutions regulating the technical, financial, and administrative work of the Corporation within the powers delegated to him in this respect;

5.    prepare the draft organisational structure, annual budget, and financial statements of the Corporation; and submit the same to the Director General for approval;

6.    oversee the technical, financial, and administrative performance of the Corporation; and submit the relevant reports to the Director General;

7.    propose fees and charges for the services and products provided by the Corporation, and submit the same to the Director General for approval;

8.    conclude, in accordance with the legislation in force in the Emirate and the powers delegated to him in this respect, contracts, agreements, and memoranda of understanding with various internal and external parties in fields related to the work of the Corporation;

9.    supervise performance by the executive body of the Corporation of its duties under this Decree and the resolutions issued in pursuance hereof, and submit the relevant periodic reports to the Director General;

10.  promote institutional relationships with the concerned Corporations, sectors, and organisational units of the DHA; and with other concerned partners and entities, with a view to achieving the objectives of the DHA; and

11.  exercise any other duties or powers assigned or delegated to him by the Director General.

Commencement and Publication

Article (6)

This Decree comes into force on the day on which it is issued, and will be published in the Official Gazette.
