Amending Law No. (9) of 2013 Establishing

 Al Jalila Cultural Centre for Children[1]

We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,

After perusal of:

Law No. (9) of 2013 Establishing Al Jalila Cultural Centre for Children (the “Original Law”);

Do hereby issue this Law.

Superseded Articles

Article (1)

Articles (2), (3), (8), and (13) of the Original Law will be superseded by the following:

Definitions

Article (2)

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise:

UAE:

The United Arab Emirates.

Emirate:

The Emirate of Dubai.

Ruler:

His Highness the Ruler of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

AJCCC:

Al Jalila Cultural Centre for Children

Board of Trustees:

The board of trustees of the AJCCC.

Chairperson:

The chairperson of the Board of Trustees.

CEO:

The chief executive officer of the AJCCC.

Technical Director:

The technical director of the AJCCC.

Cultural Activities:

This includes, without limitation, programmes; projects; conferences; symposia; exhibitions; festivals; training courses; functions; performing arts shows; exhibitions for the visual, sound, and writing arts; print and digital media publishing and distribution activities; and any other artistic or cultural activities or creative industries organised by the AJCCC, with local or international participation, in line with achieving the objectives of the AJCCC.

 

Establishing the AJCCC

Article (3)

Pursuant to this Law, a public corporation named “Al Jalila Cultural Centre for Children” is established. The AJCCC will have legal personality and the legal capacity required to undertake the acts and dispositions that ensure the achievement of its objectives. The AJCCC will be affiliated to the Executive Council.

Functions of the Board of Trustees

Article (8)

a.    The Board of Trustees will undertake general supervision of the activities of the AJCCC and manage its affairs. For these purposes, the Board of Trustees will have the duties and powers to:

1.    approve, and follow up the implementation of, the general policy and the strategic, development, and operational plans of the AJCCC;

2.    approve the programmes and time frames required for the implementation of the general policy and strategic plans of the AJCCC;

3.    approve the draft annual budget and financial statements of the AJCCC, and submit the same to the competent entities in the Emirate for final approval;

4.    approve the regulations and bylaws required to regulate the administrative, financial, and technical work of the AJCCC, including the human resources regulations applicable to AJCCC’s employees;

5.    approve the organisational structure of the AJCCC;

6.    approve the services, work, projects, initiatives, and activities performed by the AJCCC;

7.    supervise the management of the general policy of the AJCCC and set the priorities for the support provided by the AJCCC in areas related to conducting cultural activities and cultural research and studies on Emirati children;

8.    approve the programmes related to securing the necessary funding for the AJCCC from various sources within and outside of the Emirate;

9.    lay the foundation for cooperation and coordination with the entities concerned with the cultural affairs of children at the local, regional, and international level;

10.  form permanent and temporary sub-committees and work teams; and determine their duties, powers, and tenure;

11.  approve entering into agreements and memoranda of understanding with organisations, institutions, and authorities specialised in areas related to the objectives of the AJCCC;

12.  propose the legislation related to the AJCCC work;

13.  approve the fees and charges for the services provided by the AJCCC, and submit the same to the competent entities for final approval; and

14.  perform any other duties related to the objectives and duties of the AJCCC, as assigned to it by the Ruler or the Chairman of the Executive Council.

b.    The Board of Trustees may delegate any of its powers under paragraph (a) of this Article to any of its members or to the CEO, provided that such delegation is specific and in writing.

Financial Resources of the AJCCC

Article (13)

The financial resources of the AJCCC will consist of:

1.    financial support allocated to the AJCCC in the general budget of the Government;

2.    fees and charges for the services provided by the AJCCC;

3.    returns on the investment, and proceeds of the rent, of the movable and immovable property of the AJCCC;

4.    revenue generated from the cultural projects, publications, services, and activities of the AJCCC; and

5.    grants, donations, gifts, bequests, aid, endowments, and other resources accepted by the Chairperson.

Commencement and Publication

Article (2)

This Law comes into force on the day on which it is issued, and will be published in the Official Gazette.
