Establishing
the
Dubai
Government Human Resources Department[1]

We,
Mohammed bin Rashid Al Maktoum, Ruler of Dubai,
After perusal of:
Law No. (3) of
2003 Establishing the Executive Council of the Emirate of Dubai; and
Law No. (31) of
2009 Establishing the Dubai Government Human Resources Department (the “Original Law”),
Do hereby issue
this Law.
Articles
(2), (3), (8), (10), and (12) of the Original Law are hereby superseded by the
following:
The following words and expressions,
wherever mentioned in this Law, will have the meaning indicated opposite each
of them unless the context implies otherwise:

Emirate: |
The Emirate of Dubai. |
|
Ruler: |
His Highness the Ruler of Dubai. |
|
Government: |
The Government of Dubai. |
|
Executive Council: |
The Executive Council of the Emirate
of Dubai. |
|
Government Entity: |
Any
of the Government
departments, public authorities and
corporations, or other similar entities, including
free zone authorities and Government councils of the Emirate. |
|
DGHR: |
The Dubai Government Human Resources
Department. |
|
Director General: |
The director general of the DGHR. |
Pursuant to this Law, a department named
the “Dubai Government Human Resources Department” is established. The DGHR will
have the duties, functions, and powers vested in it under this Law and the
legislation in force in the Emirate. The DGHR will be affiliated to the
Executive Council.
a. A Director General will be
appointed to the DGHR pursuant to a decree of the Ruler.
b. The Director General will be
directly responsible to the Executive Council for performing the duties
assigned to him under this Law, the resolutions issued in pursuance hereof, and
the legislation in force in the Emirate; and for performing any other duties
assigned to him by the Ruler or the Chairman of the Executive Council.
c. The Director General will
undertake the general supervision of the DGHR, ensure the achievement of the
objectives for which it is established, and verify that the DGHR performs the
duties and powers vested in it under this Law and the legislation in force in
the Emirate. The Director General will, in particular, have the duties and
power to:
1. propose the general policy
and strategic plans of the DGHR, submit the
same to the
Executive Council for approval, and take all actions required for their
implementation upon approval;
2. approve, and follow up the implementation
of, the development and operational plans of the DGHR in line with the approved
strategic plans and general policy;
3. approve the initiatives,
programmes, projects, studies, and recommendations related to the objectives,
work, and activities of the DGHR;
4. prepare the draft annual
budget of the DGHR, and submit the same to the competent entities in the
Emirate for approval;
5. prepare the organisational
structure of the DGHR, and submit the same to the competent entities in the
Emirate for approval;
6. approve the resolutions and
bylaws regulating the administrative and financial work of the DGHR;
7. submit, to the Executive
Council, periodic reports on the implementation of the approved general
policies, strategic plans, and initiatives;
8. prepare annual performance
reports on the work and activities of the DGHR, and submit the same to the
Executive Council;
9. supervise the daily work and
the Employees of
the DGHR, and appoint the technical and administrative staff required to
perform the work of the DGHR in accordance with the legislation applicable to
the DGHR;
10. form permanent and temporary
specialised committees and work teams, and determine their duties and powers,
with a view to achieving the objectives of the DGHR;
11. represent the DGHR before
third parties, and enter into contracts and agreements as
required for the
achievement of the objectives of the DGHR; and
12. exercise any other duties or
powers assigned to him by the Ruler or the Chairman of the Executive Council.
The financial resources of the DGHR will
consist of:
1. the support allocated to the
DGHR in the general budget of the Government; and
2. any other resources approved
by the Executive Council.
The Chairman of the Executive Council
will issue the resolutions required for the implementation of the provisions of
this Law.
This Law comes into force on the day on
which it is issued, and will be published in the Official Gazette.
