Forming the Strategic Affairs Council of the

Executive Council of the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Decree No. (28) of 2015 Concerning Governance of the Boards and Committees Affiliated to the Government of Dubai;

Executive Council Resolution No. (26) of 2009 Establishing the Sectoral Committees of the Executive Council and its amendments;

Executive Council Resolution No. (27) of 2009 Approving the Statute of the Sectoral Committees of the Executive Council and its amendments; and

Executive Council Resolution No. (40) of 2015 Concerning the Functions of the General Secretariat of the Executive Council of the Emirate of Dubai,

Do hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

Ruler:

His Highness the Ruler of Dubai.

Executive Council:

The Executive Council of the Emirate of Dubai.

SAC:

The Strategic Affairs Council formed pursuant to this Resolution.

Government Entity:

Any Government department; public agency or corporation; Government council; public authority; or other entity which is affiliated to the Government of Dubai.

General Secretariat:

The general secretariat of the Executive Council.

Formation of the SAC

Article (2)

A permanent council named the “Strategic Affairs Council” is hereby formed within the Executive Council of the Emirate of Dubai under the chairmanship of His Highness Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, and with the membership of:

1.    His Highness Sheikh Ahmad bin Saeed Al Maktoum, as Member;

2.    the Secretary General of the Executive Council, as Member;

3.    the Director General of H.H. the Ruler’s Court, as Member;

4.    the Commander-in-Chief of the Dubai Police, as Member;

5.    the Director General of the Department of Finance, as Member;

6.    the Director General of the Department of Economic Development, as Member;

7.    the Director General of the Dubai Municipality, as Member;

8.    the Director General of the Dubai Health Authority, as Member;

9.    the Director General and Chairman of the Board of Executive Directors of the Roads and Transport Authority, as Member; and

10.   the Vice Chairman of the Supreme Council of Energy, as Member.

Duties of the SAC

Article (3)

The SAC will be responsible for supporting the Executive Council in performing its functions under the above-mentioned Law No. (3) of 2003. For this purpose, the SAC will have the duties to:

1.    review strategic matters that support the orientations and policies of the leadership of the Emirate in all sectors; and submit the appropriate recommendations on these matters to the Executive Council for approval, in preparation for final approval of the same by the Ruler;

2.    propose and approve the plans, policies, and initiatives aimed at boosting the sectors of highest priority in the Emirate; and submit the same to the Executive Council for final approval;

3.    approve the plans, policies, and initiatives proposed by Government Entities, in preparation for final approval of the same by the Executive Council;

4.    supervise the implementation of the approved strategic sectoral plans and initiatives, and submit periodic reports in respect of the same to the Executive Council;

5.    propose innovative solutions and initiatives for the development of Government services; and submit the same to the Executive Council for approval;

6.    propose the appropriate solutions and measures required for boosting the efficiency and effectiveness of the government general performance and government spending; and submit the same to the Executive Council for approval;

7.    discuss proposals for issuance of legislation related to the strategic affairs of the Emirate; and submit the relevant recommendations to the Executive Council for approval;

8.    enhance cooperation and coordination among Government Entities; between the Government of Dubai and the Federal Government; and with any other entity with which cooperation and coordination is deemed necessary by the SAC; and

9.    perform any other duties assigned to it by the Ruler or the Chairman of the Executive Council.

Powers of the SAC

Article (4)

For the purpose of performing the duties assigned to it pursuant to this Resolution, the SAC will have the powers to:

1.    form permanent or temporary committees and work teams pursuant to the relevant resolutions issued by the Chairman of the SAC. These resolutions will determine the duties, powers, and terms of reference of the committees and work teams and any other relevant matters; and

2.    seek assistance from experts and specialists as it deems appropriate, provided that they do not have a vote in its deliberations.

Charter of the SAC

Article (5)

Subject to the provisions of the above-mentioned Decree No. (28) of 2015 relating to the obligations of the Chairman and Members of the SAC to attend its meetings, to actively engage in discussing the matters referred to it, and to maintain confidentiality, the Chairman of the SAC is hereby vested with the authority to issue the charter of the SAC. The charter must determine the terms of reference of the SAC; the procedures for holding its meetings, the quorum required for its meetings and for passing its resolutions and recommendations, and the process of recording and approving the minutes of its meetings.

Role of the General Secretariat

Article (6)

The General Secretariat will perform all the duties required for facilitating the work of the SAC. In particular, the General Secretariat will:

1.    provide technical, administrative, and secretarial support to the SAC; and provide media coverage for its work, activities, and achievements;

2.    review, from a technical perspective, all matters listed on the agendas of the SAC meetings; and prepare the required relevant reports;

3.    follow up the implementation of the resolutions and recommendations passed by the SAC;

4.    ensure synergy and coordination between the SAC and the Executive Council, between the SAC and Government Entities, and between the SAC and other entities;

5.    follow up the work of the committees and work teams formed by the SAC, and submit the required relevant reports; and

6.    perform any other duties assigned to it by the Chairman of the SAC.

Rapporteur of the SAC

Article (7)

a.    A rapporteur will be appointed to the SAC by the Secretary General of the Executive Council from amongst the General Secretariat employees.

b.    The rapporteur of the SAC will have the duties to:

1.    prepare the SAC meeting agendas in accordance with the rules approved by the Chairman of the SAC in this respect, and notify the SAC Members of the same within sufficient time prior to meetings;

2.    send invitations to the Members of the SAC to attend its meetings at the time and place determined by the Chairman of the SAC;

3.    draft minutes of meetings of the SAC, have the same signed, and submit them to the Chairman of the SAC for approval;

4.    coordinate with the General Secretariat to follow up the implementation of the resolutions, recommendations, directives, and proposals of the SAC; and

5.    perform any other duties assigned to him by the Chairman of the SAC.

Financial Appropriations

Article (8)

The Department of Finance must provide the financial appropriations required to enable the SAC to perform its functions under this Resolution.

Periodic Reports

Article (9)

The General Secretariat will prepare an annual report on the activities and achievements of the SAC; and will present it to the Chairman of the SAC for approval, in preparation for submitting the same to the Chairman of the Executive Council.

Repeals

Article (10)

This Resolution supersedes the above-mentioned Executive Council Resolution No. (26) of 2009 and Executive Council Resolution No. (27) of 2009. Any provision in any other resolution will also be repealed to the extent that it contradicts the provisions of this Resolution.

Commencement and Publication

Article (11)

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
