Approving the

Fees and Fines for Waste Disposal in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai and its amendments;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai;

The Order of 1961 Establishing the Dubai Municipality (the “DM”);

Local Order No. (115) of 1997 Concerning Medical Waste Management in the Emirate of Dubai;

Local Order No. (7) of 2002 Concerning Waste Disposal Sites in the Emirate of Dubai and its amendments;

Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai and its amendments; and

Executive Council Resolution No. (4) of 2012 Regulating the Destruction of Explosives in the Emirate of Dubai,

Do hereby issue this Resolution.

Fees

Article (1)

a.     Pursuant to this Resolution, the fees for the permits issued and services rendered by the DM in the field of Waste disposal, as set out in Schedules (1), (2), (3), (4), (5), and (6) attached hereto, are approved.

b.     For the purpose of calculating the fees set out in the schedules referred to in paragraph (a) of this Article, a part of a tonne will be rounded up to a full tonne, a part of a kilogramme will be rounded up to a full kilogramme, and a part of a year will be rounded up to a full year.

Violations and Administrative Penalties

Article (2)

a.     Without prejudice to any stricter penalty provided for in any other resolution, a person who commits any of the violations set out in Schedule (7) attached to this Resolution will be punished by the fine indicated opposite that violation.

b.     Upon repetition of the same violation within one (1) year from the date of the previous violation, the amount of the corresponding fine set out in Schedule (7) attached hereto will be doubled. A fine must not exceed one hundred thousand Dirhams (AED 100,000.00).

c.     In addition to the penalty of a fine referred to in paragraph (a) of this Article, the DM may, in coordination with the Concerned Entities in the Emirate of Dubai, take any of the following measures against a violator:

1.      warning;

2.     suspension of work for a period not exceeding six (6) months; or

3.     revocation of the permit to conduct Waste-related activities.

Remedy of Violations

Article (3)

In addition to the penalties prescribed by this Resolution, a violator whose act or negligence causes harm to Public Health, public safety, or the environment at Waste Disposal Sites, or causes damage to the property therein, will be liable for remedying the damage or paying damages within the time frame prescribed by the DM. Otherwise, the DM may take the actions required for remedy of damage using its own resources or by engaging third parties, and claim from the violator all costs incurred and damages, in addition to administrative charges of twenty-five percent (25%) of these costs and damages. The DM’s assessment of these costs and damages will be final.

Law Enforcement

Article (4)

The DM employees nominated pursuant to a resolution of the Director General of the DM will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Resolution and the resolutions issued in pursuance hereof. For this purpose, they may issue the necessary violation reports, and, where necessary, seek the assistance of police personnel.

Grievances

Article (5)

Any affected party may submit a written grievance to the Director General of the DM against the decisions, procedures, and measures taken against him under this Resolution within thirty (30) days of being notified of the contested decision, procedure, or measure. The grievance will be determined, within thirty (30) days from the date of its submission, by a committee formed by the Director General of the DM for this purpose, and the decision issued in respect of the grievance will be final.

Payment of Revenues

Article (6)

Fees, fines, costs, and damages collected pursuant to this Resolution will be paid to the Public Treasury of the Government of Dubai.

Issuing Implementing Resolutions

Article (7)

The Director General of the DM will issue the resolutions required for the implementation of this Resolution.

Repeals

Article (8)

Any provision in the above-mentioned Local Order No. (115) of 1997, in Local Order No. (7) of 2002, in Local Order No. (11) of 2003, or in any other resolution will be repealed to the extent that it contradicts the provisions of this Resolution.

Publication and Commencement

Article (9)

This Resolution will be published in the Official Gazette and will come into force six (6) months after the date of its publication.
