Regulating the Issuance of

Drivers’ Licences and Permits in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Federal Law No. (21) of 1995 Concerning Road Traffic, its Implementing Bylaw, and their amendments;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (17) of 2005 Establishing the Roads and Transport Authority and its amendments;

Law No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai and its amendments;

Law No. (22) of 2015 Regulating Partnership between the Public Sector and the Private Sector in the Emirate of Dubai;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai;

Executive Council Resolution No. (8) of 2006 Establishing the Agencies Affiliated to the Roads and Transport Authority and Approving their Corporate and Organisational Structures;

Executive Council Resolution No. (8) of 2008 Establishing the Licensing Agency of the Roads and Transport Authority;

Executive Council Resolution No. (35) of 2011 Approving Fees of the Roads and Transport Authority;

Executive Council Resolution No. (64) of 2016 Approving the Organisational Structure of the Roads and Transport Authority; and

Regulation No. (6) of 2009 Concerning the Licensing of Driving Schools in the Emirate of Dubai and its amendments,

Do hereby issue this Resolution.

Definitions

Article (1)

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise:

Emirate:

The Emirate of Dubai.

RTA:

The Roads and Transport Authority.

Director General:

The director general and chairman of the Board of Executive Directors of the RTA.

Agency:

The Licensing Agency of the RTA.

Law:

The above-mentioned Federal Law No. (21) of 1995, its Implementing Bylaw, and their amendments and the resolutions issued in pursuance thereof.

Vehicle:

Any motorised machine, pedal cycle, Motorcycle, carriage, or other machine designed to run on roads, whether mechanically propelled or otherwise. This includes tractors.

Driver’s Licence:

A document issued by the Agency authorising its holder to drive a particular category of Vehicles.

Special Driver’s Permit:

A document issued by the Agency authorising its holder to drive a particular category of Vehicles in a particular area or to perform special duties.

Occupational Driver’s Permit:

A document issued by the Agency authorising its holder to drive a category of Vehicles designated for any of the occupational purposes determined pursuant to the Law, or determined by the Agency in accordance with this Resolution.

Learner:

A natural person who is authorised by the Agency to learn to drive a Vehicle in order to obtain a Driver’s Licence, Special Driver’s Permit, or Occupational Driver’s Permit.

Examiner:

A natural person who is authorised by the Agency to test Learners.

Test Site:

A site approved by the Agency for testing Learners wishing to obtain Special Driver’s Permits.

Assessment Test:

A test conducted by the Agency for a driver whose licence is suspended, cancelled, or revoked in accordance with the Law, or whose licence expires and is not renewed within the time frame prescribed by the RTA.

People of Determination:

Persons suffering from any permanent or temporary, total or partial, physical; mental; sensory; communicative; learning; or psychological deficiency or impairment that may prevent them from meeting their ordinary needs as their peers, from among persons other than People of Determination, would under the same conditions.

Functions of the Agency

Article (2)

For the purposes of this Resolution, the Agency will have the duties and powers to:

1.    issue and renew Drivers’ Licences in the Emirate in accordance with the conditions and procedures stipulated in the Law and with the rules adopted by the RTA in this respect;

2.    issue and renew driving learning permits in the Emirate in accordance with the conditions and procedures stipulated in the Law and with the rules adopted by the RTA in this respect;

3.    test Learners;

4.    issue and renew Occupational Drivers’ Permits in the Emirate in accordance with the conditions and procedures stipulated in the Law and with the rules adopted by the RTA in this respect;

5.    issue and renew desert driving permits in accordance with the conditions and procedures adopted by the RTA in this respect;

6.    issue and renew Special Drivers’ Permits in accordance with the conditions and procedures adopted by the RTA in this respect;

7.    determine the special areas and duties in respect of which Special Drivers’ Permits are issued;

8.    issue and renew Examiners’ permits in accordance with the Examiner regulations adopted by the RTA in this respect;

9.    establish and adopt a classification of Examiners in accordance with the requirements adopted by the RTA in this respect;

10.  approve the specifications and requirements that must be met by test Vehicles, and any other relevant matters;

11.  issue Test Site permits in accordance with the relevant conditions and procedures adopted by the RTA;

12.  conduct Assessment Tests in accordance with the procedures adopted by the RTA in this respect;

13.  conduct audit and inspection to ensure the proper implementation of this Resolution; and

14.  exercise any other duties or powers required for the implementation of this Resolution.

Types of Licences and Permits

Article (3)

The Agency will issue the following Licences and permits:

1.    Learners’ permits;

2.    Drivers’ Licences; and

3.    Occupational Drivers’ Permits for any of the following occupations:

a.    private drivers;

b.    heavy bus drivers; and

c.     heavy Vehicle drivers.

4.    desert driving permits;

5.    Special Drivers’ Permits;

6.    Examiners’ permits; and

7.    Test Site permits.

Fees

Article (4)

a.    In return for issuing Drivers’ Licences and permits and providing the services stated in Schedule (1) attached to this Resolution, the RTA will charge the fees indicated opposite each of these Licences, Permits, and services.

b.    Notwithstanding the provisions of paragraph (a) of this Article, the RTA will charge People of Determination half the fees prescribed for any Drivers' Licences, permits, or services provided to them in accordance with this Resolution.

c.     In addition to the fees prescribed under this Resolution, the RTA will charge an amount of fifty Dirhams (AED 50.00) where the Driver’s Licence, permit, or service governed by this Resolution is applied for through any means other than the smart methods adopted by the RTA in this respect.

d.    The fees stated in Schedule (1) of this Resolution will not apply to the Examiners of the RTA or to other RTA employees holding similar positions, in relation to performing their employment duties.

Violations and Administrative Penalties

Article (5)

a.    Without prejudice to any stricter penalty provided for in any other resolution, a person who commits any of the violations mentioned in Schedule (2) attached to this Resolution will be punished by the fine indicated opposite that violation.

b.    In addition to the penalty of a fine referred to in paragraph (a) of this Article, the RTA may suspend or revoke an Occupational Driver’s Permit where he breaches any of the provisions of the Law, this Resolution, or the resolutions issued in pursuance hereof.

Liability of Examiners

Article (6)

Except in cases of fraud or gross fault, the Examiners of the RTA and other RTA employees holding similar positions will be exempt from any liability arising from performing their employment duties, including the liability for traffic fines and other consequences arising from the acts committed by Learners during driving tests.

Law Enforcement

Article (7)

The RTA employees nominated pursuant to a resolution of the Director General will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Resolution and the resolutions issued in pursuance hereof. For this purpose, they may issue the necessary violation reports, and, where necessary, seek the assistance of police personnel.

Grievances

Article (8)

Any affected party may submit a written grievance to the Director General against any decision, procedure, or measure taken against him under this Resolution within fifteen (15) days of being notified of the contested decision, procedure, or measure. The grievance will be determined, within thirty (30) days from the date of its submission, by a committee formed by the Director General for this purpose, and the decision issued in respect of the grievance will be final.

Outsourcing

Article (9)

The RTA may outsource any of its duties and delegate any of its powers under this Resolution to any other entity pursuant to a contract concluded for this purpose, in accordance with the provisions of the above-mentioned Law No. (22) of 2015. This contract will state its term and the rights and obligations of both parties.

Cooperation and Coordination

Article (10)

For the purposes of enabling the Agency to perform its duties under this Resolution and the resolutions issued in pursuance hereof, local Government Entities must, each within its own jurisdiction, provide support and assistance to the Agency when requested to do so.

Payment of Fees and Fines

Article (11)

Fees and fines collected pursuant to this Resolution will be paid to the Public Treasury of the Government of Dubai.

Issuing Implementing Resolutions

Article (12)

The Director General will issue the resolutions required for the implementation of this Resolution. These resolutions will be published in the Official Gazette of the Government of Dubai.

Repeals

Article (13)

Any provision in any other resolution or regulation will be repealed to the extent that it contradicts this Resolution.

Publication and Commencement

Article (14)

This Resolution will be published in the Official Gazette and will come into force sixty (60) days after the date of its publication.
