Council Resolution No. (49) of 2017
Concerning
the Rules for
Benefiting
from Al Amal Initiative[1]

We,
Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of
the Executive Council,
After perusal of:
Law No. (5) of
1995 Establishing the Department of Finance;
Law No. (3) of
2003 Establishing the Executive Council of the Emirate of Dubai;
Law No. (13) of
2007 Establishing the Dubai Health Authority and its amendments;
Law No. (1) of
2016 Concerning the Financial Regulations of the Government of Dubai; and
Decree No. (9) of
2016 Approving a Pricing Method for Dubai Health
Authority Services, and
In implementation
of the benevolent initiative of His Highness the Ruler of Dubai, known as
("Al Amal Initiative"), aiming at exempting UAE Nationals and other
persons of similar status from the costs of Medical Services
related to fertility treatment provided by the Dubai Gynaecology and Fertility
Centre of the Dubai Health Authority,
Do hereby issue
this Resolution.
The following words and expressions,
wherever mentioned in this Resolution, will have the meaning indicated opposite
each of them unless the context implies otherwise:
UAE: |
The United Arab Emirates. |
Emirate: |
The Emirate of Dubai. |
DHA: |
The Dubai Health Authority. |
Director General: |
The director general of the DHA. |
DGFC: |
The Dubai Gynaecology and Fertility
Centre of the DHA. |
Medical Services: |
Fertility-related diagnostic and
therapeutic services provided by the DGFC to
any of the categories benefiting
from the Initiative. |
Initiative: |
The benevolent initiative of His
Highness the Ruler of Dubai aiming at exempting UAE Nationals and other
persons of similar status from the costs of
the Medical Services. |
Family: |
The husband and wife applying to
benefit from the Initiative. |
UAE National: |
Any person holding the UAE
nationality. |
Naturalised Citizen: |
A person who is issued an approval,
by His Highness the Ruler of the Emirate, to acquire the UAE
nationality. |
Year: |
A year
measured based on the Gregorian calendar. |
The
beneficiaries of the Initiative are divided into three (3) categories:
First Category: |
This includes: 1. any Family holding a family book (Khulasat Qaid) issued by the Emirate; and 2. any Family in which the wife holds a family book (Khulasat Qaid) issued by the Emirate and the husband is born to a UAE National mother or is a Naturalised Citizen; |
Second Category: |
This includes: 1. any Family holding a family book (Khulasat Qaid) issued by any of the other emirates; and 2. any Family in which the wife holds a family book (Khulasat Qaid) issued by any of the other emirates and the husband is born to a UAE National mother or is a Naturalised Citizen. |
Third Category: |
This includes Families in
which the husband and the wife are born to a UAE National mother or are
Naturalised Citizens. |
To benefit from the Initiative, the
following requirements must be met:
1. the couple in the Family must have been married for more than one (1) Year;
2. the Family must not have any medical insurance that covers the costs of the Medical Services, and must not be receiving any financial support to cover the costs of these services from any public or private entity;
3. the couple in the Family must sign an acknowledgement of the accuracy of the information submitted to benefit from the Initiative;
4. the wife must be registered in the family book (Khulasat Qaid) of her UAE National husband; and
5. the decrees granting citizenship to Naturalised Citizens must be in force at the time of benefiting from the Initiative.
The number of attempts by beneficiaries to
benefit from the Initiative in a Year will be limited to:
1. three (3) attempts per Year for the First Category, where the Family has no children; has a verified medical condition that requires determination of the baby's gender; or has a maximum of three (3) children, and either or both of the parents have a verified medical condition preventing them from reproducing naturally;
2. two (2) attempts per Year for the Second Category, where the Family has no children; has a verified medical condition that requires determination of the baby's gender; or has a maximum of two (2) children, and either or both of the parents have a verified medical condition preventing them from reproducing naturally; or
3. two (2) attempts per Year for the Third Category, where the Family has no children, has a verified medical condition that requires determination of the baby's gender; or has one (1) child, and either or both of the parents have a verified medical condition preventing them from reproducing naturally.
For the purpose of determining the
eligibility for benefiting from the Initiative and the number of conception
attempts
authorised for each of the categories stipulated in Article (2) hereof, the professional
medical principles adopted by the DGFC will be applied.
The procedures that must be followed, and the forms and documents
that must be submitted, to benefit from the Initiative will be
determined pursuant to the relevant resolution issued by the
Director General.
The DHA will provide the Department of
Finance with detailed periodic reports on the categories benefiting from the
Initiative, the number and success rates of the
conception attempts
made by these categories, the costs of Medical Services provided to these
categories, and any other relevant information that the Department of Finance may
request.
The Director General will issue the
resolutions required for the implementation of the provisions of this
Resolution. These resolutions will come into force only upon publication in the
Official Gazette of the Government of Dubai.
Any provision in any other resolution will be repealed to the extent that it contradicts the provisions of this Resolution.
This Resolution comes into force on the
day on which it is issued, and will be published in the Official Gazette.
