Approving
Fees and Fines of the Dubai Civil Aviation

We, Hamdan bin Mohammed bin Rashid Al Maktoum,
Crown Prince of Dubai, Chairman of the Executive Council,
After
perusal of:
Law No. (3)
of 2003 Establishing the Executive Council of the Emirate of Dubai;
Law No. (14)
of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai
and its amendments;
Law No. (19)
of 2010 Concerning the Dubai Civil Aviation Authority (the “DCAA”);
Law No. (13)
of 2011 Regulating the Conduct of Economic Activities in the Emirate of Dubai
and its amendments;
Law No. (7)
of 2015 Concerning Airspace Safety and Security in the Emirate of Dubai;
Law No. (1)
of 2016 Concerning the Financial Regulations of the Government of Dubai;
Decree No.
(22) of 2009 Concerning Special Development Zones in the Emirate of Dubai;
Executive
Council Resolution No. (50) of 2015 Regulating Training Institutes in the
Emirate of Dubai; and
The
legislation establishing and regulating free zones in the Emirate of Dubai,
Do hereby issue this Resolution.
a. No
Person may conduct any aviation-related activity in the Emirate without first
obtaining the relevant permit from the DCAA. Such a permit will be issued in
accordance with the relevant conditions, rules, and requirements approved by
the Director General of the DCAA.
b. The
permit referred to in paragraph (a) of this Article will be valid for a period
of one (1) year, renewable for the same period. A permit renewal application
must be submitted at least thirty (30) days prior to the date of its expiry.
a. Pursuant
to this Resolution, the fees for the permits issued and services rendered by
the DCAA to its clients, as stated in Schedules (1), (2), (3), (4), (5), and
(6) attached hereto, are approved.
b. In
addition to the fees referred to in paragraph (a) of this Article, where the
DCAA seeks assistance from any other entity to assess an application, the
applicant will bear all costs incurred for this assessment, provided that he is
notified in advance of the same. The DCAA’s assessment of these costs will be
final.
a. Without
prejudice to any stricter penalty stipulated in any other resolution, a person
who commits any of the acts stated in Schedule (7) attached hereto will be
punished by the fine indicated opposite that act.
b. The
amount of the fine prescribed in the Schedule referred to in paragraph (a) of
this Article will be doubled if the same violation is repeated within one (1)
year from the date of the previous violation. A fine must not exceed one
million Dirhams (AED 1,000,000.00).
c. In
addition to the penalty of a fine referred to in paragraph (a) of this Article,
the DCAA may take one or more of the following measures against a violator:
1. warning;
2. suspending
the activity for a period not exceeding six (6) months; and/ or
3. revoking
the permit.
The DCAA
employees nominated pursuant to a resolution of the Director General of the
DCAA will have the capacity of law enforcement officers to record the acts
committed in breach of the provisions of this Resolution and the resolutions
issued in pursuance hereof. For this purpose, they may access, inspect, and
audit establishments and access their records, issue the necessary violation
reports, and, where necessary, seek the assistance of police personnel.
The fees and
fines collected pursuant to this Resolution will be paid to the Public Treasury
of the Government of Dubai.
Any
establishment, conducting any aviation-related activity by the effective date
of this Resolution, must comply with the provisions of this Resolution within
one (1) year from the effective date hereof, or before renewing its commercial
licence, whichever is earlier.
The Director
General of the DCAA will issue the resolutions required for the implementation
of this Resolution, including those stipulating the conditions and procedures
for issuing and renewing the permits prescribed herein. These resolutions will
come into force only upon publication in the Official Gazette of the Government
of Dubai.
This
Resolution will be published in the Official Gazette and will come into force
on the date on which it is published.
