Executive Council Resolution No. (17) of 2017

Concerning the

Conduct of Medical Tests in the Emirate of Dubai[1]

We, Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai, Chairman of the Executive Council,

After perusal of:

Federal Law No. (6) of 1973 Concerning Entry and Residence of Foreigners, its Implementing Bylaw, and their amendments;

Federal Law No. (8) of 1980 Regulating Labour Relations and its amendments;

Federal Law No. (21) of 1995 Concerning Road Traffic, its Implementing Bylaw, and their amendments;

Law No. (3) of 2003 Establishing the Executive Council of the Emirate of Dubai;

Law No. (13) of 2007 Establishing the Dubai Health Authority (the “DHA”) and its amendments;

Law No. (1) of 2016 Concerning the Financial Regulations of the Government of Dubai; and

Cabinet Resolution No. (7) of 2008 Concerning the Medical Test System for Expatriates Entering the United Arab Emirates for Work or Residence and its amendments,

Do hereby issue this Resolution.

Entity in Charge of Conducting Medical Tests

Article (1)

The DHA is the competent entity in charge of conducting the following medical tests in the Emirate of Dubai:

1.    pre-employment medical tests;

2.    residence visa medical tests;

3.    driving licence medical tests;

4.    occupational driver’s permit medical tests;

5.    occupational health card medical tests; and

6.    any other medical tests determined pursuant to the relevant resolutions issued by the Director General of the DHA.

Acceptance of Medical Test Results

Article (2)

No Government Entity in the Emirate of Dubai may accept the results of any of the medical tests referred to in Article (1) of this Resolution unless these results are issued by the DHA.

Payment of Fees

Article (3)

The fees collected by the DHA in return for conducting the medical tests referred to in Article (1) of this Resolution will be paid to the Public Treasury of the Government of Dubai.

Issuing Implementing Resolutions

Article (4)

The Director General of the DHA will issue the resolutions required for the implementation of this Resolution. These resolutions will be published in the Official Gazette of the Government of Dubai.

Repeals

Article (5)

Any provision in any other resolution will be repealed to the extent that it contradicts the provisions of this Resolution.

Publication and Commencement

Article (6)

This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
